Minutes sf a regular meeting of the Common Council of the City of
Rochester, Minnesota, held in the Council Chambers, in the City Hall, in said City
at 2:00 o'clock P.M-9 on January 3rd9i933:
Meeting called to order by President Liddle.
Roll Call. Present: Liddle, Dallman, .Hicks, Miller, Moody,
Norton. Absent: Alderman Amundsen.
Upon motion by Dallman, second by Moody, the minutes of the
meetings held on December 19th,194p, December ?3rd, 19329 and December 24th,1932,
were each approved.
A 'report from the committee appointed to recommend 'an ordinance
regulating planting, trimming for clearance, and condemnation and removal of trees
interferring with the electric light and telephone wires, submitted :.a-- recommended
ordinance, Waich was considered by the Common Council, but as the... ordinance
proposed does not cover all the points necessary, motion by Moody, -second by Norton,
carried that the same be referred back to the Committee for their further considera-
tion.
Upon motion by Moody, second by Dallman, the sum of $50.00 9 was
appropriated from the General Fund and it was ordered that the said sum be paid to
the Municipal Judge as the. Municipal Judge's Contingent Fund.
The report of the Clerk of the Municipal Court for the week ending
December 19th919329 showing criminal fines collected $60.00, civil fees received
41.35, and court costs charged to Olmsted County $14.00; said for the week ending
December 26th,19329 showing criminal fines collected $10.009 civil fees received
$4.00, Olmsted County check received in the amount of $52.35,for November,1932,
Municipal Court fees, and court costs charged to Olmsted County $8.909 were each
read, and President Liddle referred the same to the City Attorney.
..:Balance sheet, income statements,etc. , prepared by the Secretary
of the Public Utility Board, as at November 30th,1932,* were laid before the Common
Council, and President Liddle ordered that the same be placed on file; the said
income statements showing a net profit in the Light Department for the month of
November,19329 of $4038.03, and for the eight months of this fiscal year of $56955.(
a net profit in the Water Department for November of $3069.70 9 and for the eight
months of this fiscal year of $18575*199 and the operating profit for the Steam
Heating Department for November showing a $677.65 net loss, with a total net
profit for the eight months of this fiscal year of $1550.89.
General Balance sheet, trial balance, Fund statements statement of
unexpended budget appropriations,,etc., prepared by the City Clerk as of November
30th91932, were laid before the Common Council, and President Liddle ordered that
the same be placed on file.
The appligotion of Foster Mrachek Electric Company, for an
electrician's license was read, and upon motion by Norton, second by Moody, license
a
was granted covering the period October 14th91932, to and including October
13th,1933.
The application of Gerry Thompson, for Pub "tic dance permit
at the Woodman Hall January llth, and 18th,1933, was read, as was the
application of A. G: Berndt, for a public dance permit at the Woodman
Hall, January 14th92lst9 and 28th,1933, and February 4th,1933.
The following applications for permits to place and
maintain signs, were read, and upon motion by Dallman, second by Moody,
permits were granted: Anderson Tire Service, Furnstahrl,. & Swanger, Leo
Herrick, Sanitary Barber Shop, Mae Louise Specialty Shop.
The following communication was read, and President Liddle
ordered that the same be placed on file:

I wish to state that our records do not show that
any Calcium Chloride was placed in your alley during the years
of 1930-1931 and 1932.

-Upon motion by Moody, second by Norton, the City Clerk was
instructed to confer with the property owners along the alley mentioned in
Ithe communication quoted above and ask that they make claim for refund of
he charges which they may have paid for sprinkling or treating of the
lley during the years 19309 1931, and 1932, which claim should be supported
evidence than they are entitled to reimbursement, i. e. by City Treasurer
ceipt if they paid to him and the County Treasurer's receipt if it was
aid through taxation.

I received a copy of the resolution passed by your
City Council in favor of the bid of G.Schwartz & Company, contractors,
for the new Rochester post office building.
I saw Major Heath of the Treasury Department the day
after the bids were opened, and urged that the contract;.tbe given to
G. Schwartz & Company, and that Winona stone be used. At that time,
the bid from a contractor in Indiana, who claimed to be the low
bidder, had not been opened by the Treasury Department officials.

Major Heath assured me that if the spread was not too great, he would
recommend that Winona stone be used.
The action of your Council, I -am sure, will be helpful in
securing the contract- for Winona stone and 'for the Rochester contractor.

The following copy of requisition made by the Health Officer on
Saint Mary's Hoppital for -the isolation of the patients named were read and President
Liddle ordered that the same be placed on file: Mary Halley, age 19 years, residing
at Kahler Hall, diagnosed to be suffering fromchicken pox; Winnifred Marsh, age
20 employed at Saint Mary's Hospital, diagnosed to be suffering from diptheria;
Florence Currans, age 18, employed at Saint Mary's Hospital, diagnosed to be
suffering from Chicken Pox, and Ruth Ann Heimetrg,age 9 months, living at 1133 Eightl
Avenue Southeast, diagnosed to be Buffering from erysipelas.
Upon motion by Dallman, second by Norton, the City Clerk was
authorized and directed to release the burglary insurance policy No. BB35697,issued
by the aetna Casualty & Surety Company covering $899000i00 in currency, for cancella-
tion, and with request that the City of Rochester be refunded sucn unearned premium
as may be due.
The following certificate by the County Auditor was read, and
President Liddle ordered that the same be placed on file:

The electrician's license bond of Foster Mrachek
Electric Company, with the Fidelity & Deposit Company of Maryland, as
surety thereon in the amount of $1900040 was read, -and upon motion by
Norton, second by Hicks, the said surety was accepted, the said bond was
approved, and it was ordered that the same be placed on file.

"WT.EREAS, On December 19th,19329 this Sinking Fund
Commission purchased one City of Rochester, 44ti Improvement bond of 31,000 DO
maturing December lst,1941, and optional December 191940, and
WHEREAS, The Drake Jones Company of Minneapolis, Minnesota,.
are unable to deliver a City of Rohester 4*1% Improvement Bond of the
December 1st, 1941,maturity but have already forwarded to the First
National. Bank of this City a City of Rochester, Minnesota, 4A Improvement
bond of the December 1st, 1940 maturity, and
WHEREAS, The furnishing of a 1940 maturity will not eb.ange
the premium paid as the above mentioned 1941 bond was figured as of 1940
maturity on account of the optional privilege,

The City Clerk brought up for discussion the matter of the
-renewal of the resident identification cards, for 1933, asking. which was '
the wishes of the Common Council., the issuance of them to all persons who =_
make demand for them; the issuance of these cards throu_;h- the requisition
Plan heretofore used; or the waiving. of the issuance of them entirely, .as �
was done in the first three months of 1932, and it was finally agreed
among'members of the Common Council that an amendment ;3houl(l be made to the
^r,.1 i nii. c r, )r(- v "in.; -or the issuance of these cards that will continue the `
Attorney
779 cards issued in 1932 and make them effective for 1933, and the City
lwas instructed accordingly.
The claim of George Eyers $13*509 and B0 Winslow $15.501, fqr
services driving city owned trucks hauling wood for the American Legion
1 were Lead, and as the City Attorney ruled that it was not legal to pay them
these claims were passed over to the Mayor to be itaken care of through his
Mayors s Contingent Fund. '

Upon motion by Hicks, second by Norton, the City Engineer was
authorized to offer the use'of City owned trucks to the American°Legion for hauling
wood avid that the use thereof during the week ` just passed be also approved.
The presentation of th6 claim of the Weed Insurance Agency
$19.00 for $19000.00 fire, lightning, and transportation insurance on the #74 Inter-
national truck, brought out the discussion of whether this piece of equipment should
be insured or not during'which, motion by Hicks, second by'Moody, carried that this
insurance policy mentioned as being presented by the Weed Insurance Agency be
cancelled and returned to them, and that no such insurance be carried on this
particular truck.
The following claims for insurance, were read, and upon motion
by Hicks, second by Norton, the same were allowed, and the Mayor and City Clerk, wer
authorized and directed to draw warrants upon theCity Treasurer and make payment
accordingly:

The following notice from John C. Brumm was read, and President
Liddle referred the same to the City, Attorney:
"TO THE HONORABLE MAYOR AND THE HONORABLE COMMON COUNCIL
OF THE CITY OF ROCHESTER, MINNESOTA.
You are hereby notified that.an injury was received by John C.
i' Brumm who was in your employment at the Sewerage Disposal Plant while
engaged as employee in charge of the dry beds of.the digester of said
Sewerage Disposal Plant on December 25th,1932, and who is now located
at the Colonial Hospital, Rochester, Minnesota, that.so far as.now
known the nature of the injury Nas a deep out in the calf of the right
leg from about eight inches above the ankle to about four inches above
the knee and that portion of the leg was badly crushed and that compen-
sation may be claimed therefor.

Alderman Dallman introduced a resolution granting public
dance permit to A. G. Berndt, for the Woodman Hall January 14th, 21st,
and 28th;1933, and Reb. 4th,1933, and fixing the fee at $12.00, which was
read.
Upon motion by Norton, second by Moody, that the said
resolution be adopted as read, and all voting in favor thereof, the said
resolution was duly passed and adopted.
Alderman Moody introduced a resolution granting public
dance permit to Gerry Thompson, for the. Woodman Hall January llth. and
118th,19Z3,) and fixing the fee at $6001, which was read.
UP.on motion by Dallman, second by Norton, that the said
resolution be adopted as read,, and all voting in favor thereof, President

Alderman Hicks introduced the following resolution, which was

"WHEREAS, A resolution passed and adopted by this Common Council,
December 19th,19329 provided for the issuance of two notes to L.M.Feller, one dated
December 20th912329 and maturing July 11,19359 for $214.451, and one dated December
20th,19329 maturing December lst919359 for 0 2811070, and
WHEREAS, L.M.Feller, has made request that the $2811.70 note be
divided into two notes, one for $2011.70 and one for $8004,00 in that he has pur-
chasers for notes drawn in those amounts;
SO THEREFORE, Be it resolved by the Common Council of the City
of Rochester, Minnesota:
That the said note drawn payable to L. M.Feller for $2811.70, dated
December 20th,1932, and maturing December lst,1935, issued for balance on contract fo
construction of a bridge over Bear Creek on Fourth Street Southeast, be and the said
note is hereby cancelled, and the Mayor and City Clerk of said City are hereby
authorized and directed to draw two notes in favor of L_M.Feller, or order, one for
$2011,70, and one for $800.009 both dated December 20th,19329 and to mature December
lst,1935', both of which notes will carry an interest rate of 5% per annum payable
June 1st and December 1st from date thereof until paid."
Upon motion by Miller, second by Moody, that the said resolution
be adopted as read, and all voting in favor thereof, President Liddle declared the said
resolution duly passed' and adopted.
Alderman Norton introduced the following resolution, which was
read:
"Be it resolved by the Common Council of the City of Rochester,
Minnesota:
That the sum of $297.78 be and the said sum is hereby appropriated
and it is ordered that the same be paid to City of Rochester, Light & Water Depart-
ments for the furnishing of electric light and water service in accordance with
billings of December 25th,1932; $229,00 thereof to be from the Lighting Fund, $31.43
from the General Fund, $33.30 from the Fire Protection Fund and $4.05 from the Street
and Alley Fund.
The Mayor and City Clerk are hereby authorized and directed to
draw warrants upon the City Treasurer and make payments accordingly."
Upon motion by Moody, second by Hicks, that the said resolution
be adopted as read, and all voting in favor thereof, President Liddle declared the
said resolution duly passed and adopted.
Alderman De,llman introduced a resolution appropriating v$454.50
from the Park Improvement Fund and brd6ring:payment made to the Mayo Trust Fund for
payrolls for labor during the weeks ending December 23rd91932, and December 30bh,
1932, which was read:
Upon motion by Norton,.second by Moody, that the said resolution
be adopted as read, and all voting in favor thereof, President Liddle declared the
said resolution duly passed and adopted.
Alderman Moody introduced a resolution appropriating $280.08 from 1
General Fund and ordering payment made to the City of Rochester, Steam Heating Depart-
ment,for steam heat furnished at the City Hall, which was read.
Upon motion by Moody, second by Hicks, that the said resolution be
adopted as read, and all voting in favor thereof, President Liddle declared the said
resolution duly passed and adopted.

Alderman Miller introduced a resolution appropriating
$573.30 from the Sewer Fund and ordering payment made to the City of Roches-
ter,Light Department,for electric power furnished at the sewage disposal
plant, which was read.'
Upon motion by Hicks, second by Norton, that the said
resolution be adopted as read, and all ,voting in favor thereof, President
Liddle declared the said resolution duly passed and adopted.
Alderman Miller introduced the following resolution,
which was read:

"Be it resolved by the Common Council of the City of
Rochester, Minnesota:
That the sum of $282.53 be and'the said sum is hereby
appropriated from the Bridge Fund of said City and ordered paid to L.M.'
Feller, as extra labor and materials for the construction of the Bridge
over Bear Creek on Fourth Street Southeast, in accordance with sworn
billing made December 19th919320
The Mayor and City Clerk are hereby authorized and
directed to draw a warrant for said sum npon the City in
:accordance herewith, and cause said payment to be in-ade."
Upon motion by Norton, second by Moody, that the said
resolution be adopted as read, and all voting in favor thereo.f except
Alderman Hicks, who voted "Nay", President Liddle declared the said resolu-
tion duly passed and adopted:
Alderman Hicks introduced an ordinance to amend an
ordinance entitled "An Ordinance defining and punnishing vagrancy", the
same being- Ordinance ffo 236 of the ordinances of the City of Rochester,
Minnesota, which was given its first reading.
Upon.motion by Norton, second by Nicks, the rules were
suspended and the said ordinance was given its second reading accordingly.
Alderman Miller introduced an ordinance to provide for
the licensing and regulation of bowling alleys within the City of Rochester,
Minnesota,"which was given its first reading.
Upon motion by Hicks, second,by Moody, the rules were
suspended and the said ordinance was given its second reading.
Upon motion by Norton, 8a4onc� by Dallman, the rules were
suspended and the said ordinance was given its third and final reading.
Upon motion by Hicks, second by Norton, that the said
ordinance be adopted as read, and all voting in favor thereof, President
Liddle declared the said ordinance duly passed and adopted.
Alderman Dallman introduced an ordinance to repeal an
ordinance entitled, "An Ordinance providing for the granting of permits to
owners of buildings to move the same along, and upon the public streets of
the City of Rochester", the same being Ordinance No.417 of the,ordinances

of the City of Rochest er,Minnesota,which was given its first reading.

Upon motion by Hicks, second by Moody, the rules were suspended
and the said ordinance was given its second reading.
Upon motion by Moody, second by Hicks, the rules were suspended
and the said ordinance was given its.third and final reading.
Alderman Moody introdiced an ordinance to amend an ordinance
entitled, "An ordinance to provide for the licensing of house movers , describing
the manner of moving buildings in the public streets of the City of Rochester,
and regulating the business of house moving, "which was given its first reading.
Upon motion by Hicks, second by Moody, the rules were suspended
and the said ordinance was given its second reading.
Upon motion_ by Miller, second by Norton, the rules were suspended
and the said ordinance was given its third and final reading.
Upon motion by Norton, second by Moody, that the said ordinance
be adopted as read, and all voting in favor thereof, President Liddle declared the
said ordinance duly passed and adopted.

to serve notice upon John J. Kerr, that the City of Rochester,Minnesota, will
dispense with his services at the ending of January 4th,1933, and that Henry K.
Armstrong be notified that the City of Rochest er,Minnesot a,will dispense with his
services at the ending of January 31,19330
Upon motion by Moody, second by Miller, the City Engineer was
authorized to expend not to exceed $350,00 in the purchase of a second hand coal
stove Eor use at the Sewage Disposal plant.
Upon motion by Dallman, second by Moody, the Common Council
adjourned to 7:30 o'clock P.M., January 23rd919330,
