Minutes of a special meeting of the Common Council of the City I of Rochester, Minnesota, held in the. Council Chambers,in the City HUI, in :said ` City, at 7: 30 o'clock P .M. , on May 19th,1933. Meeting called to order by President Liddle, Roll Call. Present: Liddle, Amundsen, Dallman, Miller, Moody, Norton. Absent: Hicks. The call for the special meeting was read; said special meeting being called for the purpose of action on the approved plans for the Broadway trunk line sanitary sewer, and any other business that the said Common Council might deem proper. The following petition for revocation of license was read and President Liddle ordered that the same be placed on file: "May 9, 1933. To the Mayor and the City Council ! of the City of Rochester, Minnesota. Gentlemen: - We respectfully submit to you the following petition. Whereas a license ,to ,sell beer to be consumed on or off the premises has been granted to Mr. Ernest Schacht, pertaining to a proposed establish - went -at --10 7th St. N. W. , and Whereas this property is located very near to the Church of Peace and the services of the Church of Peach would necessarily be disturbed and interfered with ,by the activities of such an establis �ment, and Whereas Church School is held in connection with Church of Peace on at least two days of the week and an establishment of t+pis nature might easily have -n undesireable effect upon the morals of the'young, and Whereas the Samaritan is equally near to the above premises and the i activities of such a place would be detrimental to the welfare of the sick in that institution, ' i Therefore, we, the Council of the Church of Peace and the Board of the Samaritan do herewith respectfully petition you to reconsider your former action in regard to this license, to declare the proposed establishment at 10 7th St.N.W. a nuisance to the public welfare, and to revoke the license granted to Mr. Ernest Schacht. ,Respectfully yours; The Council of Church of Peace Otto G. Crawford, orally supported the above quoted petition* 'Upon motion by Amundsen, second by Moody, the American Legion Auxiliary were authorized to sell poppies on tree^ streets of the City of Rochester, Minnesota, May 27th,1933. r r f i I g 42 A copy of the Burns & McDonnell Engineering Company report on their consultation relative to the $rosdwsg trunk line sanitary sewer, certified by the City Engineer as being a true and correct copy of the original, was Jaid before the Common Council, and President Liddle ordered that the same he placed on file; the City Engineer having ` furnished the Mayor and Aldermen with copies of this report* thereby 7 eliminating the necessity for the:'teading of it. North 730 30' west of the Northwest corner of Lot No.4 in Block No.37 of the Northern Addition to the City of Rochester, and.running South 770 East one hundred seventy-seven (177) ft,; thence south parallel with and twenty (20) ft. West of the East line of Broadway Street to a point 20 feet west of the intersection of the East line of Broadway Street North and the center line of Sixth Street Northeast, and commencing at a point in the center line of Sixth Street Northeast twenty (201) ft. That the said sanitary sewer or the alternate be constructed, that the said .plans, profiles and specifications be adopted for the construction of the said sanitary sewer, or the alternate, that the same be placed on file in the office of the City Clerk of said City, that the said estimates of cost be accepted and that the same be placed on file in the office of the City Clerk of said City, aTY). , Be it further resolved by the said Conaon Council; That the City Clerk of said City be and he is hereby authorized and directed to advertise for alternate sealed proposals for the furnishing of all labor, materials, equipment, etc.-, necessary for the construction of the said sanitary sewe7,,, which alternate sealed proposals will be received and opened at a, public meeting of this Cormnorr Council, which is to be held at 2:00 o'clock P.M., on June 5th, 19�33. -Each bid must be accompanied by a certified check upon some reputable bank drawn payable to the Mayor of Rochester, tinnesota , for at least 10 per cent of the amount of the bid, whitch check and the amount of money specified therein shall be forfeited to the City of Rochester, Minnesota, as liquidated dairag,es if the bidder upon the letting of the contract to him shall fail to enter into the contract so let; the said Common Council reserving the right to reject any and all bids. A surety bond written for the full amiount- of the contract by s, surety company authorized to do business in the State of ?Minnesota, will be required with the contract. (Personal bonds not to be accepted.) All proposals must be addressed to llr.A.F.Wright, City Clerk of Rochester, Minnesota,, and shall have endorsed thereon "Pro- posalsfor the construction of a sanitary sewer." " I l 4311 �1 Upon motion by Miller, second by Moody, that the said resolutio be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Upon motion' by Hicks, second by Miller, the Cl.ty Clerk was authorized and directed to collect a deposit of $5.00 upon each set of trunk line sanitary sewer plans, that the contractors take out, UrCth condition that ;$3.00 of the said sum will be refunded upon the return of the set of plans, Profiles and specifications, in rpood condition, I' The report of the Health Officer for the City Farm, for the month of April,1933, showing receipts in the amount of 4$1672.11, disbursements $1123.87, and a balance on hand of $586.15, together with 221 hogs on hand May 1st, 1933, was read, and President Liddle ordered that the same be placed on file. The report of the Buildinn;, Electrical and Plumbing, Inspector, for the month of April,1933, showing building inspection fees collected $23.00, electrical inspection fees $9.75, and plumbing inspection fees $120.75, was read, and President Liddle referred the same to the Finance Committee. The report of the Clerk of the Municipal Court for the week ending May 15th,1933, showing criminal fines collected i$101.40, civil. fees received $$2.00, conciliation court fees received $1.009 court costs charged to Olmsted County $7.809 and fines collected due to Olmsted County -S10.00, was read, and President Liddle referred the same to the City Attorney. Upon motion by Dallman, second by Amundsen, the sum of tir10.00 was appropriated from the General Fund and it was ordered that the said amount be paid to Olmsted County, Minnesota, for local municipal court fines collected due to Olmsted County, Minnesota. Balance sheet, income statements, etc. , of the Public Utility Departments prepared by the Secretary of the Public Utility Boeril, as of April '30th, 1933, were laid before the Common Council and President Liddle ordered that the same be placed on fi143 the said income statements showing a net loss in t1 e Light Department .for April,1933 of $$11627.099 a net loss for Apri1,19339 in the Water Department of $59B.21, and a profit in the Steam Heating Department for April,1933, of S2473.2.2 - with a notation that the fuel, overhead, interest, etc., had not been charged against the Steam Heating operation. A report from the Secretary & Treasurer of the Rochester Fire Department Relt^f Association, for the year ending December 31st,1933, showing a balance on hand January lst91932, of %$1097.829 receipts during the year of `,,62J2.01, disbursements during the year of 06,852.65, and a balance on hand at the ending of the year of $527.221 was' read, and President Liddle ordered that the same be placed on file. 9 The application of Bemel Brothers for a junk buyer and junk collector license covering two automobiles, was read, and upon motion by Moody, second by Dallma.n, license was granted. The application of Mrs. Robert Merv, for a soft drink dealer licens-b at 307 Center Street East, was read, and upon motion by pallman, second by Ricks, license was granted. The following communication was read, and upon motion by Miller, second by Moody, H. J. O'Neil was allowed to withdraw his application in accordance therewith: "Rochester, Minnesota May 15, 1933 To the Common Council City of Rochester, Minnesota Gentlemen: On May B, 1933 I made application to your TT.onorable Body for ?)oth an "on sale" and "off sale" beer license, which application was referred to the license committee. Due to circumstances over which I have no control I find it necessary to withdraw my application and request refund of the license fee accompanying my application. Very truly yours, R. J. O'Neil. " The application of Ryan & Ryan, for an On Sale and an Off Sale license to sell non intoxicating malt liquors at 16 Fourth Street Southwest; and of Mrs. Jack Brand for an On Sale and an Off Sale license to sell non -intoxicating Malt liquors at 39 Fourth Street Southeast, were each read, and President Liddle referred the same to the License Committee. The following; License Committee recommendation.. was read, and President Liddle ordered that the same be placed on file: "Rochester, Minnesota. May 19th, 1933.. Honorable Common Council, City of Rochester, Minnesota. Gentlemen: Your License Committee having; considered the applica- tions of Earl J. Gibson, Mrs. Jack Brand and Ryan and Ryan for both "off sale" and "on sale" licenses to sell non -intoxicating malt liquors in the city of Rochester, Minnesota, recommend that said applications be granted. Gibson, for an On Sale license and an Off Sale license to sell non -intoxicating malt liquors at 501-511 Broadway Street South, were again read, and upon motion by Dallman, second by Amundsen, license was granted conditioned that the street address be corrected to 502-510 Broadway Street South; the vote on the said motion being: Ayes: Amundsen, Dallman, Hicks, Liddle. Nays: Miller, Moody, Norton. 1 The application of Ryan & Ryan, for On Sale and Off Sale licenses t'o sell non -intoxicating malt liquors at -16 Fourth Street Southwest, were again read, and upon motion by Moody, second by Amundsen, licenses were granted. The applications of Mrs. Jack Brand, for On Sale and Off Sale licenses to sell non -intoxicating malt liquors at 39 Fourth Street Southeast, were again read, and*upon motion by Dallman, second by Hicks, licenses were granted; the vote on the said motion being: Ayes: Amundsen, Dallman, Hicks, Liddle. Nays: ' 1 Miller, Moody, Norton. The following excerpt from Library Board meeting minutes, was ' read, and'President Liddle ordered that the same be placed on file: " May 51, 1933 Board meeting Minutes It was moved and seconded that $75 be taken from Code no.11 (Miscellaneous expenses) and transferred to Code no. ' 14 (Janitorial supplies.) Carried The license bond of Bembj Brothers, covering their license j as junk buyer and junk collector, with the Saint Paul Mercury Indemnity Company as surety thereon in the amount of $ltOOO.00, was read, and upon motion by Moody.. second by Dallman, the said surety was accepted, the said bond was approved, and it was ordered that the same be placed on file. Copy of requisition by the Health Officer upon Saint Maryts Hospital for the isolation of Avis and Marlys Lee, aged 6 and 9 respectively, residing at 303 Eleventh Street Northwest, diu,�.-nosed to be suffering from diphtheria, was read, and President Liddle ordered that the same be placed on file. A communication from John Townsend Jr. ,Superintendent of the Saint Paul Fire Insurance Patrol, asking that Four members of the local department be authorized for the Saint Paul State Firemen's Convention June 14th,19339 for demonstration of salva`re-evolution 9 was read, and President Liddle ordered that the same be placed on file. Alderman Moody introduced an ordinance to amend an ordinance regulating the placing, erecting and maintaining of signs over streets, walks and put lic grounds in the City of Rochester, the same being Ordinance No.312, of the City of Rochester, Minnesota, as amended by Ordinance No.3309 which vas given its first reading. Upon motion by Hicks, second by Amundsen, the rules were suspended and the said ordinance was given its second reading accordingly. Upon motion by Norton, second by Moody, .the rules were suspended and the said ordinance was given its third and final reading accordingly. Upon motion by Tucks, second by Amundsen, the Chief of Police was instructed to forthwith provide for the preparation of plans, specifications and e:-.,timates of cost for whatever improvements are needed to the Police Alarm system,etc., and the City En,Mineer was instructed to prepare plans, profile:,, specii'ications and estimates of costs for all necessary repairs to the paving on streets, avenues and alleys, for the rebuildin;7 of bric3.ges, and for the construc- tion of storm sewers. Upon motion by Norton, second by Ficks, request was made upon the Board of Park Commissioners that they forthwith provide for the preparation o plans, profiles, specifications and estimates of cost for the improvement of Solier Field, Slatterly Park, Silver Lake, and other park improvements that they may have in mind.
