Minutes of a regular meeting'of the Common Council of the
City of Rochester, Minnesota, held in the Council Chambers, in the City Vall, in
said City at 2:00 o'clock P.M., on June 5th,1933.
Meeting called to order by President .Liddle.
Roll Call. Present: Liddle, Amundsen, Wicks, Miller, Moody,
Norton. Absent: Dallman.
Upon, motion by Amundsen, second by Hicks; the minutes of the

This being the time and place fixed for the opening of
proposals for the construction of a. trunk line sanitary sewer in part of Broadway
Street North and Sixth Street Northeast (Propotal No.l) , or in part of Broadway
Street North and Fourth Street Northeast (Proposal No.2),, the following pro-Grosals

t President Liddle referred the above quoted proposals to the
City Engineer for tabulation.
Dyer H: Campbell, Secretary of the Rochester Chamber of
Commerce, asked for financial assistance in the printing of the usual annual
,
illustrated booklet covering the history,etc., of Rochester, Minnesota, and
estimated the cost to be about $170.00 for 3000. copies,at which motion by Hicks,
second by Amundsen ,carried that the City of Rochester pay for the printing of
these booklets at a cost not to exceed $$170.00.
Upan motion by Miller, second by Hicks, request was made of
the Public Utility Board V.3at they appropriate $50.00 toward the printing of the
above mentioned 3000 booklets.
J. C.,Adams, W . L. Eaton, and Richard Holland, the licensed
taxicab operators in this City, at this time, •asked t-at the taxicab rates be
raised to $.25 for the first half mile or fraction thereof, and $.10 for
each succeeding half mile or fraction thereof, and President Liddle referred their
request to the Dicense Committee and the City Attorney.

in commenting upon the provisions of
the solicitors
license ordinance, asked
that the
requirement for written permission
of the property
owner abutting the place where soliciting is to be done, be eliminated from the
ordinance, and Preside nt Liddle referred the matter to the License Corilmittee, The
City Attorney, and the Chief of Police.
The following report from the City Engineer relative to the
above quoted proposals for the construction of the trunk line sanitary sewer, was
read, and Preident Liddle ordered that the seine be placed on file:

Upon motion by Hicks, second by Miller, it was ordered
that,Pursuant to conditions to the specifications for the construction of
the said trunk line sanitary sewer, thee.<.proposals of the two highest bidders
on proposal No. 2, be released and that their certified checks be returned. to
them.-
Upon motion by Miller, second by-'icks, the first
and second and third lowest bids on proposal No.2, were adjourned for action

We, the undersigned committee, appointed to investigate the
matter of suggested amendments to the City Milk Ordinanco, having
considered the same report and recommend as follows:
That the ordinance be left as it now is with the exception
of the provision prohibiting the location of pastuerization plants
outside of the .corporate limits of the city of Rochester and we
recommend that this provision be amended so as to allow the location
of pastuerization plan"jo outside of the limits of the city of Rochester,
but within a reasonable distance from the limits thereof for the
purpose of proper inspection and supervision by the Realth Department
and Milk Inspector of said City.

The report of the City Treasurer for the month ending May 319
1933, showing $341,166.65 as being on hand was read, and President Liddle ordered
that the same be placed on file.
A report from the Sanitary Inspector as toy. his activities in
May,1933, was read, and President Liddle ordered that the same be placed on file.
The report of the Milk Inspector for the last half of April,
1933, and for May,1933, was read, and President Li 'dle ordered that the same be
placed on file.
The report of the Clerk of the Municipal Courts for the week
ending May 29th,19339 showing criminal fines collected ,328.60, civil fees received
$$28.70, $$50.:30 Olmsted County check for April Court fees received, conciliation
court fees received $3000, court costs charged to Olmsted County $7.359 and fines
collected due to Olmsted County 020.00; and for the week ending June 5th,19339
showing criminal fines collected $200040, civil fees received $$7.35, conciliation
court fees received $3.00, court costs charged to Olmsted County $8.409 and fines
collected due to Olmsted County $25 00, were each read, and President Liddle referred
the same to the City Attorney.
Upon motion by Moody, second by Norton, the sum of $45.00 was

Olmsted County, Minnesota, for local Municipal Court fines collected due to Olmsted
County, Minnesota:
The report of the City Engineer for the month of May,19:33,

the Street and Alley Fund $1054.40, from the Sewer Fund .914.9.85, and from the Bridge

The matter of illegal payments for Special Patrolman serAces,
was discussed, in that $125.00 per month is being paid for such services when the
Charter of the City of Rochester, Minnesota, places the limitation at $2.00 per day,
and upon motion by Miller, second by Norton, the- City Clerk was instructed to

notify the Police Civil Service Commission in accordance with the following letter
addressed by him to them:

Dear Sir:
For some time past the Common Council have been compelled
to make illegal payments for the services of Special Patrolmen, in
t_iat the Charter provides that not more than $2.00 per day shall be
paid, while in order to get a person to serve $125.00 per month has
to be paid, and to get away from the liability contracted by these
payments over these restrictions, the Co:armon Council have provided
for the salary of another Patrolman by makin: a $1250.00 transfer to
cover the period June 1,1933, to March 31,19:�4 , inclusive, and have
authorized the Mayor to add another Patrolman to the Police Department
personnel.
We understan i that the Mayor has asked your Commission to
certify him a man for appointment as this additional patrolman, and
that as yet you have not complied with his request, under which situa-
tion the Common Council took action to the effect that I was instructed
to notify your Commission that unless certification is made to the
Mayor before June 15th,1933, future appointments of Special Patrolmen
will be in accordance with the Charter of the City of Rochester, Minne-
sota, regardless of the services that we may get for the $2.00 1imitat ion.
I think it is the hope of the Common Council that you will cer-
tify this man, rather than compel them to abide by the antiqu&ted pro-
visions of the Charter that allows us to pay only $2.001, when the services
are worth at least what a Patrolman with original appointment receives.

Sanitation, of the New well and pump house, was read, and President Liddle ordered

A communication from Morris B. Lambie, Executive Secretary of
the League of Minnesota Municipalities, explaining the proposed Public Works
Bill, which is now before Congress, and furnishing a copy of the said bill., was
read, and President Liddle ordered that t),x a same be placed on file.

that all of the 9 projects proposed for the flood control and
erosion work in southeastern 1vlinnesota have been approved. We
have not as yet, however, received official notice of this fact.
As soon as we do receive notice and can make arrangements, it is
our intention to make an inspection of the sites with a represen-
tative of the Army whose duty it is to decide an final locations.
' Just when this will be I cannot say definitely at this ,time., but
will attempt to advise you, if time permits, as to just when we
will be there.

The following notice from the Industrial Commission,.
was read, and upon motion by Miller, second by Amundsen, the Chairman of
the Public Grounds Committee was instructed to comply with the order:

The following cony of resolution was rea,.j_, and President
Liddl e ordered that the sme be placed on file:
"Be it and it is hereby resolved by the Public Utility
Board of the City of Rochester, Minnesota that the Hon. Common Council of
the said City be and is hereby requested to authorize the said Board to enter
into a contract with the 0' Gara Coal Company for the furnishing, in accordance
with specifications and with their bid dated May 31st,1933, of ONE THOUSAND
TONS (1000) of 3/4 ' inch screenings at a price of $3.90 per ton F:O.P. Cars
Roche#er, Minnesota; said contract to be effective from September lst91933 to
March 31st.1934 and the total amount of same approximating $3900.00."
The license bond of Chris Dillon, covering his license to
connect with sewers and drains, with the Fidelity & Casualty Company of New
York as surety thereon in the amount of $1,000.00 was read, and upon motion by
Norton, second by Moody, the said surety was accepted, the said bond was approved,]
and it wag ordered that the same be placed on file.
The license bond of Lloo►(i Rennett,cove rinn his plumbers license,
with the New Amsterdam Casualty & Surety Company as surety thereon in the amount
Of �11000.00 was read, and upon motion by Moody, second by Hicks, the said surety
was accepted, the said bond was approved and it was ordered that the same be
placed on file.
The following recommendations by the License Committee, were
read, and president Liddle ordered that the same be placed on .file:

Alderman Dallman introduced the following resolution, which
was read:
"Be it resolved by the Common Council of the City of Rochester,
Minnesota:
That the Public Utility Board of said City be and the said
Board is hereby authorized to enter into contract with the O'Gara Coal Company, for
the furni::hing of 1000 tons of j inch coal screenings at a price of 83.90 per ton,
F.O.B. cars Rochester, Minnesota., effective September 1st )1933, to March. 314t,1934,
which amount may be increased or diminished as provided for in the specifications
for the said coal screenings.
The amount of the bond to be given by the said contractor is
hereby .fixed at the sum of $3900.00."
Upon motion by Hicks, second by Dallman, that the said resolu-
tion be adopted as read, and all voting in favor thereof, President Liddle declared

Alderman Tricks introduced the following resolution,
which was read:,
"Be it resolved by the Common Council of the City of
Rochester, Minnesota: '
That the said Common Council does hereby determine
that the streets and avenues and parts of streets and omnnues, �n said
city, hereinafter described shall be sprinkled with water during the
balance of the season of the year 19339 and a part of the cost and
expense of the said sprinkling is to be assessed against the several lot::,
pieces and parcels of land abutting upon Itaid streets as hereinafter
provided, however, that in lieu of the said sprinkling with. water, any
Part or Parts of the said streets or avenues, m-).v be treated with ca_lcl m
chloride, or any other approved r% st preventive..
IISaid streets and avenues and parts of streets and
avenues are as follows:
Twelfth Avenue Northwest and Southwest from the south line of Second
Street Southwest to the north line of Second. Street Northwest;
Fifteenth Avenue Southeast from the north line of Second Street Southeast,
to the south line of Center Street East;
Seventh Street Southiftst fr cm the east line of Fi .r;hth Avenue Southwest to
the east line of Fourth Avenue Southwest;
First Street Northwest from the west line of Thirteenth Avenue Northwest,

Be it further resolved: That a public meeting of said Common
Council will be held on the 15th day of June, 19339 at 7:30 o'clock P.M., in the
Council Chambers, in the City Hall, in paid City, at which time and place said
Co-fanon Council will meet and take action in regard to the doing of the said sprinklin
or treating of the streets and avenues above merit ioned, and any and all persons
interested in the sprinkling or treating of the streets and avenues may then and
there appear and be heard before said Coi mon Council in relation to the said snrinkli g
or treating or to the mode of assessment for the cost and expense thereof, or any
other matter relating to the Said sprinkling or treating upon which they may desire
to be heard;
The City Clerk is hereby directed to publish a notice of the
time and place of said meeting and hearing in the official paper of said City at

amended by Ordinances 3489 364, 3819 430 and 4379 which was given its first reading.

suspended and the said ordinance was given its second reading.
Upon motion by Miller, second by Norton, the rules were suspended
and the said ordinance was given its third and final reading.

Alderman Miller introduced an ordinance to amend an ordinance
entitled, "An ordinance to preserve the public health.by regulating the storing and
handling of food stuffs intended for human consumption for sale within the City, of
Rochester and providing a penalty for the violation thereof." the same being '
Ordinance No.290 of the City of Rochester, Minnesota, wbtch was given its first reading.
Upon motion by dicks, second by .Amundsen, the rules
were suspended and the said ordinance given its second reading.
Upon motion by Miller, second by Amundsen, the rules
were suspended anal the said ordinance was given its third and final
reading
Upon.motion by Amundsen, second by Moody, that the

Upon motion by Ficks, second by 1.1iller, Alderman
Moody was authorized to 'secure and pro -Tide for the installation of
castors on the old City hall chairs that are now in use in the new City
Hall.
Upon motion by Norton, second by Ricks, the City
Clerk was instructed to notify Wm. N. Priedell, that the Hazard from
the open well or cistern on the east 90 feet of Lot 3, and the east 90
feet of the South 41 feet of Lot 49 in Block 16, in OriEfina,l Plat, be
forthwith: eliminated by filling it, or Properly covering it; the City
Clerk writing; him as follows:
"June 7, 1933.

Dear Sir:
Complaint has come to the Common Council that you
_ are maintaining an open well or cistern on the Property that
you recent purchased, viz:- the E.90 feet of Lot 3, and Ev-st 90
feet of the South 41 feet of Lot 49 in Slock 16, Original Plat,
and you are hereby notified that you will forthwith eliminate
this hazard by filling it or properly covering it.

Upon motion by Moody, second by.T.icks, the City
Engineer was authorized and directed to get in touch with the Railroad
and Warehouse Commission as to the early opening of the Ninth Place
Southeast crossing ov:�r the Chicago Great Western Railroad Company tracks.
Upon motion by Hicks, second by Amundsen, four Firemen
from the local department were authorized to attend the State r'i remen' s
convention at St. Paul, (Minnesota $ June 12th,13th, and 14th,19335 for
salvage demonstration.
Upon motion by Norton, second by Amundsen, the Common
Council adjourned to 7:30 o'clock P*M., on June 15th,1933.
