of the City of Rochester, Minnesota, held in the Council Chambers, in the City Hall,
in said City., at 7:30 o'clock P.M., on July 17th,1933s
Meeting called to order by President Liddle.
Roll Call. Present: Liddle, Amundsen, Dallman, Miller, Moody,
Norton. Absent: Hicks.
Upon motion by Dallman, second by. Amundsen, the minutes of the
meetingsheld on June 28th, 1933, and July 3rd919339 were- approved.
The report of the Weighmaster for the month of June919339
sigowing $980 weighing fees collected, was read, and President Liddle referred
the same to the Finance Committee.
The City Engineer's department trial balance for July,19331,
was laid before the Common Council, and President Liddle ordered that the same be
placed on file.
General Balance sheet, trial balance, fund statement, state-
ment of unexpended budget appropriations,etc., prepared by the City Clerk as of
June 30th,1933,.were laid before the Common Council, and President Liddle ordered
that the same be placed on file:
The report of the Building, Electrical and Plumbing Inspector,
for the month of June,19339 showing b1[ilding inspection fees collected $14.001, elec-
trical inspection fees $60,,259 and plumbing inspection fees $130,259 was read, and
President Liddle referred the same to the Finance Committee.
The report of the Clerk of the Municipal Court for the
week ending July 3,1933, showing criminal fines collected $54.00, civil fees
received $240509 conciliation court fees received $6.251, Olmsted County, May 19339
Municipal Court fees $37.50 paid, court costs charged to Olmsted County $25.35;
for the week ending July 10,19339 showing criminal fines collected $177000, civil
fees received $5:209 conciliation court fees received $7.509 and court costs charged
to Olmsted County $25:75; and for the week ending July 17th,19331, showing criminal
fines collected $3910,35, civil fees received $7.659 conciliation court fees received
$1.750 fines collected due to Olmsted County $114.75, and fine dollected and
remitted direct to the State Treasurer $100,00, were each read, and President Liddle
referred the same to the City Attorney:
Upon Motion by Amundsen, second by Miller, the sum of.$114.75
was appropriated from the General Fund and it was ordered that the said sum be paid
to Olmsted County, Minnesot4• for local Municipal Court fines collected due to
Olmsted County, Minnesota.
The report of the Milk Inspector for the month of June,1933,
was read, and President Liddle ordered that the same be placed on file.

General Balance sheet, income statements, etc., of the
Public Utility Departments, prepared by the Secretary of the Public Utility
Board as at June 30th919339 were laid before - the Common Council, and Presi-
cent Liddle ordered that the same be placed on file; the said income state-
ments showing a net profit in the Light Department for the month of June919339
of $1719.11, and a net loss in the Light Department for the 3 months of this
fiscal year of $9475.249 a net profit in the Water Department for the month Cr
June91933, . of $6380.06 9 and a net pro fit 'in the Water Department for the
three months of this. fiscal year of $7793028.
The application of Martin Paulson for licepse to
connect with sewers and drains was read, apd upon motion by Dallman, second
by Amundsen a license was granted.
The application of E. L. Goldstein of Stewartville,
Minnesota, for a Junk Dealers license to do business in Rochester, Minnesota,
was read, and a motion by Miller, second by Norton, that the said license
be not granted,carried by all voting in favor thereof.
Upon the request of the City Clerk, his stenographer ,
Miss Lillian R. Sveom,was granted a vacation, during the period July 24th,
1933, to July 29th919331, with pay, and provision was made that the balance
of the ten day vacation due her be taken some time hefore_ the end of the
World Fair at -Chicago, Illinois.

Dallman, second by Moody, the requested transfer was granted.

was read and President Liddle ordered that the same be- placedon file:

-July 17,.1933.
To the Honorable Presi dent and members of the Common ..Council -of the
City of Rochester:
On May 31,1933,•the Mayo Properties Association made the gift cC
a site to the City of Rochester, through its Library Board, for the
purpose of constructing and maintaining thereon a suitable edifice for
i housing a combined library and auditorium. This offer, however, was
conditional upon the City of Rochester agreeing to incorporate -in a
Library building, an assembly hall of a seating capacity of not less
than two thousand, and also conditional upon construction being started
not later than January 191934 9 in order to provide early employment of
i local labor.
On June 28919339 your Common Council consented to the
acceptance of this property by the Library Board under the conditions
imposed:

The long, urgent need for a new library building, the fact that
Federal assistance is highly probable, the present low cost of labor and
material, the benefit of relief to unemployed local labor, and the special
advantage of the gift of an ideal site, make it imperative that we act
promptly in this matter, to determine the feasibility of a combined building,
as conditioned in the offer, and. to get plans under way.
It is understood that the Federal Government will entertain no pro=
pose -Is for aid unless plans permanently decided upon ate offered for condi.der-
ation.
Therefore, we feel that unless the Library Board acts promptly in this
matter, as a certain amount of delay will be unavoidable, Federal aid may not
be available. On that account this Board requests an immediate appropriation
not to exceed Seven Hundred Fifty Dollars ($750.00) for the purpose of Prepar-
ing suitable architectural plans for study and final consideration.
This Committee was appointed by the President of the Library Board to
appear before the Council for the purpose of securing definite information as
to the finances that can be depended upon:

The following communication was read, and President Liddle

My dear Mayor Reiter:
I have received your telegram of July 10 in which you advise that
there are a number of worthy projects in Rochester that can be started
without delay. I am very glad to inform you of the plans of operation
of the Federal Emergency Administration of Public Works: The public
works projects will be handled by a Regional Administrator, with an
advisory Committee for each State. I suggest that you provide for your
immediate notification of the appointment of the Administrator for your
district in order that you may present your Proposals to him at the
proper time. I shall be very glad to send your telegram to the Regional
Administrator for your district for consideration when he is named.

A communication from Ambrose Pallor% Staff Attorney for the
League of Minnesota Municipalities, relative to the organization o.f Federal Hnergeney
Administration of Public Works under the National Industrial Recovery Act was read,
President Liddle ordered that the same be placed on file.
Upon motion by Norton, second by Amundsen, it was ordered that
the Common Council, as a committee of the whole, meet with the Directors of the
Library Board and representatives of the Mayo Properties Association, for a confer-
ence relative to proposed construction of a combined public library and auditorium
building.
A communication from R. J: Schultz, of 3420 Park Avenue, Minne-
apolis, Minnesota, setting forth his opinion on the operation of the Hlm Tree Tavern
formed while he was a patient at the Samaritan Convalescent Home, was read, and

The following copy of resolution passed and adopted
II by the Band Committee was read, and President Liddle ordered that the same

"Be it and it is hereby resolved by the Band*
Committee of the City of Rochester, Minnesota; that the following additional
men be appointed as members of the Rochester Park and Municipal Band for a
period of ten weeks -effective as of the beginning of said period -at a salary
per week as herein indicated and an additional amount as further indicated
for extra engagements as'reported by the Band Co:l mittee, and

The certificate by the City Engineer to the effect
that $2096.40 is due the Botsford Lumber Company for the furnishing of 80
tons calcium chloride, was read, and President Liddle ordered that the
same be placed on file.
A requisition from the Tri-State Telephone & Telegraph
Company that they be authorized to make the necessary improvem$nts for
furnishing telephone service to the new post office building in accordance
with their Estimate Noi35989 was read, and upon motion by Hicks, second
by Moody, authority was granted conditioned that the work shall be done
under the supervision of the City Engineer.

The City Clerk reported the payment by the Franklin Heating
Station of $86 63 as � cent per thousand cubic feet on 17,325,000 cubic feet of
natural gas used during June,19330
Public Works Bulletin No.29 issued by the League of Minnesota
Municipalities, sowing the application form to be used in getting aid from the
National Government, under the Federal Emergency Administration of Public Works,
was read, and President Liddle ordered that the same be placed on fildo
The City Clerk asked that he be allowed to correct a statement
made by him at a recent Council meeting, which was that a 1933 law was passed which
provides for the abolishment of Police Civil Service Commissions by a vote of the
citizens of the municipality concerned, which statement was correct in part; the
exception being that while such a law is in effect it only applies to municipalities
that had not adopted police'eivil service laws up to that time; and offered for
quotation the wording of Section 20 Chapter 197 Session Laws of 1933, which is as
follows: "Sec. 20. Application. - The provisions of this Act, with reference to the
abolition of Civil Service Commission, shall not apply and shall have no force or
effect, in any village or city in this state where a Commission has already been
created."
The following copy of resolution passed and adopted by the
Sinking Fund Commission, was reed, and upon motion by Moody, second by Amundsen,
the action set forth therein was approved, and it was ordered that the said copy
of resolution be placed on files
"Be it resolved by the Commissioners of the Sinking Fund of
the City of Rochester, Minnesota:
That the sum of $4200.32 be and the said sum is hereby
appropriated. from the Sinking Fund of said City and it is ordered that the same
be paid to the First National Bank of St.Paul,Minnesota, for $3000.00 State of
linnesota> Rural Credit, registered 4 bonds due February 15th919449 at 104.227
to yield A?.25% less $31190,189 plus accrued interest 160.56 February 15th919339
to duly 18,19339 and for $19000.00 State of Minnesota 4 Rural Credit Bonds due
July 15,1943, at 102.0195 to yield 4.25%9 $1020.20 plus38 accrued interest July
15,1933 to July 18,1933;-$3119.18 of the said appropriation to be from Code 23 of

To the Honorable Mayor,
and Members of the Council
Complaint s - having been received in regard to insanitary
Practises around places licensed to sell beer for consumption
on the premises, I would respectfully recommend that provision
be made by regulation or ordinance that "On Sale" Beer Licenses
be required to provide suitable water closets for the accommodation
of their patrons, both male and fe&Ale.
I would also respectfully draw your attention to the fact
that all such licensed places are "places of refreshment" as
defined by Mason's Minnesota Statutes of 1927- Section 5903, and
as such in Section 5907 are required to be properly plumbed, lighted,
ventilated and fly -screened; and by Regulation 248 Section 1 of the
State Board of Health, they shall be provided with an adequate supply
pf water approved by the State Board of Health for drinking, culinary
and other domestic purposes:
Therefore, I would respectfully recommend that all "On Sale
Beer Licensees be required to comply with such laws and regulations,.
especially, in regard to plumbing and water supply.
I would also respectfully recommend that only block tin beer
pipe lines be allowed, and that it be required that all such pipe
lines be sterilized at least weekly by steam under 15 lbs. pressure,
and cleansed daily with a cleansing solution approved by the Health
Dept:

We have your letter of June 29th relative to the
sash and window areas for the City Hall Building, and altho our
maintenance agreement provides for only one year after comple-
tion of building, we are asking the parties who installed thbse :,
weather strips to take care of these windows without any
additional charge, and if they do not agree to do this we will
advise you.
However regarding the areass the reason these are
deteriorating is because no expansion joint was called for
around them. If new areas are installed expansion joint
should also be provided, otherwise we will have the same.

Dear Sir:
Whereas, at the time of the opening of bids for the
furnishing of calcium chloride to the City of R ochester for the
1933 season, it was felt that the proposals as made were higher
than necessary and all were rejected and, WHEREAS, it now appears
that there is need for the use of calcium chloride on several of
the streets of the City of Rochester, and it is my belief that a
saving can possibly be affected by the purchase of calcium
chloride by you in the open market. Therefore, under the ptovi-
sions of Section 284 of the Charter of said City, I hereby declare
the existence of an emergency and feel that the delay occasioned
by re -advertising of bids will cause damage to the public interests,
I authorize you as the City Engineer of said City to go into the
open market and purchase for the present, not to exceed eighty (80)
tons of calcium chloride from the Botsford Lumber Compaw at a
Price of $26.40 per net ton, less $Oo195 per ton net, if paid -for
in ten (10) days from date of invoice.

Alderman Hicks introduced the following resolution,
which was read: ,
"Be it resolved by the Common Council of the City of
Rochester, Minnesota:
That the resolution passed and adopted by this
Common Council June 28th91933 , relative -to the Rochester Park and

hereby amended to the effect that the following named persons are hereby
added to the said personnell at the salaries set forth, in accordance
with the following quoted resolution passed and adopted by the Band
Committee, July 6 91933:

That the sum of $2105.00 be .appropriated from the Park
r Improvement Fund, $2070.00 of which is payable to Geo . M. Stebbins and
Vilda A:Stebbins, his wife, after deduction of $2340 payment to Holt &
Perry for the cost df abstract preparation and $120,00 payment to D:L.
Williams, Postmaster, for revenue stamps; $2,000.00 of the said gross
amount being for final payment .on contract for degd made with Mabelle C.
Webber, a widow, Geo. M. Stebbins, and Vilda A. Stebbins his wife, and
Dorothy McDougal, formerly Borothy Webber, and Edgar B. McDougal,, her
husband, dated September 27th,19$9, relative to the purchase of the
Northeast quarter (NE4) of Block eighty (80). in Original Plat, less sixty
(60) feet in width off the west side thereof, and also for the Southeast
quarter (SR�) of said Block eighty(SO) less fifty (50) •feet in width off
the west side thereof and $105-00 of the said gross amount is for thterest
on the said unpaid balance of j21000.00 July 1,19329, to July 18919339
inclusive, the above mentionel payment being made to Geo. M.Stebbins, and
Vilda A. Stebbins, his wife, after considering the effect of warranty deeds
given by Mabelle C:Webber, a widow, and Dorothy McDougal, formerly Dorothy

Alderman Miller introduced a resolution appropriating
$1477-046 from the Park Improvement Fund and ordering payment made to the
Mayo Trust Fund for payroll for labor during the period of the weeks ending
July 7th,1933 , and July 14th9-1933, *kl6k was read.
Upon motion by Moody, second by Amundsen, that the
said resolution be adopted as read, and all voting in ib6vor thereof,
President Liddle declared the said resolution duly passed and adopted:
Alderman Moody introduced a resolution appropriating
$2096.40 from the General Fund and ordering payment made to the Botsford
Lumber & Fuel Company for furnishing of 80tons calcium chloride purchased
by the City Engineer under the above quoted Mayor's emergency authorization,
which was read.
Don motion by Amundsen, second by Moody, that the

Alderman Amundsen introduced a resolution appropriating
$209:64 from the Park Improvement Fund and ordering payment made to
'I Botsford Lumber Company for.the furnishing of 8 tons calcium chloride,
which was. read.
Upon motion by Hicks, second by Moody, that the said
resolution be adopted as read, add all voting in favor thereof, President
Liddle declared the said resolution duly passed and adopted:
Aldermen Dallman introduced a resolution appropriating
$309.61 from the General Fund and ordering payment made to the Co -Operative
Oil Company for 3192 gallons gasoline furnished the City Filling Station
�� during June919339 which was read.
Upon motion by Moody, second by Amundsen, that the said
resolution be adopted as read, and all voting in favor thereof, President Liddle
declared the said resolution duly passed and adopted. '
Upon motion by Dallman, second by Moody, the matt'et of
amending the local ordinance relative to licensing for the sale of non -intoxicating
malt liquors, was referred to the Common Council as a Committee of the 'whole, the
City Attorney, and the dhief 'of Police. '
Louis J. Claude, Chief of Police asked that the On Sale and
Off Sale licenses to sell non -intoxicating Malt liquors heretofore granted and
issued to Anna Evenhoh be revoked:
Upon motion by Dallmans second by Amundsen, the On Sale and
Off Sale licenses to sell non -intoxicating malt liquors heretofore granted and
issued to Anna Evenhoh, mere revoked by all voting in favor thereof; the vote on
the said motion being taken after Thomas Fraser appeared and talked,as attorney in
her behalf and she and her principal employee Mr. Mulvihill, were heard in regard
to the conduct of her business:
Louis J: Claude, Chief of Police, asked that the On Sale and
Off Sale licenses to sell non -intoxicating malt liquors heretofore granted and
issued to Morey Kitzman for the so-called Green Lantern Roadhouse, be revoked.
Upon motion by Miller, second by Moody, the On Sale and Off
Sale licenses to sell non -intoxicating malt liquors, heretofore granted and
issued to Morey Kitzman covering the Green Lantern Roadhouse, were revoked by
all voting in favor thereof.
The following recommendation was read and President Liddle
ordered that the same be placed on file:

Council concurs with and approves the above recommendations of the License

Upon motion by Amundsen, second by Hicks, Louis J. ClLaude,
Chief of Police, was authorized .t o attend the 1933 International Convention of
Police Chiefs at Chicago, Illinois, at the expense of the City of ,Rochester,Minne-
sota.

Upon motion by Miller, second by Moody, the sum of $2.88 was
appropriated from the General Fund and it was ordered that the said sum be paid
to C.H.Armstrong, for deposit made on 1000 two cent stamped envelopes for use of
the City Engineer, and $20.00 was appropriated from the General Pond and it was
ordered that the said sum be paid to D.L.Williams, Postmaster, for balance on
1000 two cent stamped envelopes for use of City Engineer.
Upon motion by Hicks, second by Miller, the sum of $75.00 was
appropriated from the General Fund and it was ordered that the said sun be paid
to Henry . Alexander for lands to be' used as a public foot path described as follows:
Commencing at the Northwest corner of Lot No-4 of Block No.34 in Morse & Sargent's
Addition, and running south along the west line of Lots No.4 and No.l in said Block
No.341 ninety -line (99) .ft:, to the southwest corner o ' said Lot No.l; thence east

George J. Anderson appeared with. request that the Common Council
authorize street space for reviewing standa, and concession stands,durin g the Elks'
State Convention here in the first part of August91933, and upon motion by Hicks,
second by Amundsen, his request was granted, conditioned that the assignment of these
locations shall be under the supervision of the Street & Alley Committee and the
City Engineer.
Upon motion by Hicks, second by Amundsen, the Common Council
adjourned to 7:30 o'clock P.M., July 31st,1933.
