Council i� Chambers, in the City Hall, in said City, at 7:30 o'clock P.M., July 31, 1933. I� Meeting called to order by President Liddle. Roll Call. Present: Liddle, Amundsen, Dallman, Hicks, IIMiller, Moody, Norton,, Absent: None: Upon motion by Amundsen, second by Miller, the minutes of the meeting held on July 17th91933, were approved: The report of .the Clerk. of the Municipal Court for the week ending July. 24th919339 showiXig criminal fines collected $333:00, civil fees received $1 70, conciliation court fees received $7a00, and court costs charged to Olmsted County $945; and for the week ending July 311,1933, showing criminal fines collected $52,00, civil fees received $7.859 conciliation, court fees received $450, Olmsted County check $4170, received for July 19339Municipal Court fees, and $13:05 court costs charged to Olmsted County, were each read, and President middle referred the same to the City Attorney. The applicat ionsof Fred W: Oesterreich for an On Sale license and Off Sale license to sell non -intoxicating malt liquors at No49 Wroadway Street South, were each read, and upon motion by Hicks, second by Norton, these applications were referred to the License Committee. The application of the Sanitary Company for a plumberle license was read, and upon motion by Moody, second by Amundsen, license was granted. The plumber's license bond of the Sanitary ComparW, with the Aetna Casualty & Surety Company as surety thereon in the amount of 1 1 II$19,000000 was read, and upon motion by Miller, second by Norton, the said surety was accepted, the said bond was approved and it was ordered that the same be placed on files The application of AiGiZerndt , for a public dance permit at the Woodman Hall, August 5th, 12th, 19th, and 26th91933, was read. The following resignation was read, and upon motion by Norton, second by Amundsen, it was accepted: "Rochester,Minn. July 31,1933 I To the Hon. Mayor and Common Council Of the City of Rochester, Minn. Gentlemen: I herewith tender my resignation from the Public Utility Board to take effect as of July 31st, 1933 Yours truly, A. A. Hicks." 515 The following appointment was read, and upon motion by Hicks, second by Moody, it was confirmed: "July 311,1933. Honorable Common Council City of Rochester, Minnesota. Gentlemen: Subject to your confirmation, I hereby appoint Fred W. Miller, as a member of the Public Utility Board of said City, to fill the un- expired term of A.A.Hicks, resigned._ Respectfully submitted, Julius J.Beiter Mayor of said City. Upon motion by Miller, second by Amundsen, the accounts against George Garbish, Walter V. Burdick, and the Chicago Great Western Railroad Company, for use of sewer pump and labor, were each referred to the City Attorney, with instructions that he enforce collection. Upon motion by Hicks, second by Dallman, the sum of $5.00 was appropriated from the General Fund and it was ordered that the said sum be paid to the League of Minnesota Municipalities, for the 1933.. year book. A communication signed by various patients at the Samaritan Convalescent Home boosting the management of the Elm Tree Tavern for his stern and unrelenting efforts to run a respectable business there, was read, and President Liddle ordered that the same be placed on file. The appointment by the Acting Mayor of Carlton E.Anderson, and C.B.Hanscom as Special Patrolmen July 21st to 27,th,1933, and the appointment by the Mayor of Carlton E.Anderson, and C.B.Hanscom es Special Patrolmen July 28th,1933, to August 3rd,19339inclusive, each at a compensation of $2.00 per day; and the appoint- ment by the Mayor of Paul F.Schmidt as a Special Policeman upon local school grounds, to serve without pay and to hold office until the second Monday in April,19349 unless sooner removed, were each read, and President Liddle ordered that the same be placed on Pile: A communication from the Garden Project Committee of the Veter- ens of Foreign Wars, thanking the Mayor; Common Council and•the City Engineers for their efforts in the promotion of that project, an# especially commending the City Engineer's Department for their services, was re&4 and president Liddle ordered that tke same be placed on file. Cs E: Ginther, Chief of the Fire Department, presented &.carbon copy of specifications for an assembled motor and chassis to be immediately purchased by I the City of Rochester, Minnesota, for the Fire Department of said City, but did not submit a written estimatd of the cost for this equipment, and President Liddl a referred these condensed sp ecificer tions to the Fire Department Committee, the Chief of the Fire Department, and requested that the Mayor serve with this Committee: Warranty deed given by George M.Stebbins, and Vilda A. Stebbins, his wife conveying the so-called Stebbins. property to the City of Rochester, Minnesota, was presented, and upon motion by Norton, second by Moody, it was accepted, and it was ordered that the same be placed on . record. Alderman Miller introduced a resolution appropriating $272.22 from the Fire Protection Fund, and ordering payment made to the Continental Motor Rebuilders, Inc., for repairs to the Ahrens Fox Fire Engine, in accordance with their sworn billing made under date of July 22nd, 19339 which was reads Upon motion by Dallman, second by "Amundsen, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted: Alderman Hicks introduced the following resolution,which was read: *Be it resolved by the Common Council of the City of Rochester, Minnesota: That the sum of $750,000 be and the said sum is hereby appro- priated from the General (Code 18) Pund of said City and ordered paid to the Library Fund (Code 15) as a temporary transfer to be used for payment of architect services in connection with the proposed construction of a combined auditorium and library building:, The Mayor and City Clerk are hereby authorized and directed to draw a warrant for said sum upon the City Treasurer in accordance herewith, and cause said payment to be made4" Upon motion by Hicks, second by Amundsen, that the said resolu- tion be, adopted as read,. and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Moody introduced a resolution appropriating $1484064 from the Park Improvement Fund and ordering payment made to the Mayo Trust Fund for payrolls for labor during the period of the weeks ending July 21st,1933, ind July 28th,1933, whiall reads 18 Upon notion by Moody, second by Norton, that the said ,resolution be adopted as read, and all voting in favor thereof, President 11 Liddle declared the said resolution duly passed and adopted.. Alderman Amundsen introduced a resolution granting public dance permit to A.G.Berndt, for the Woodman Hall August 5th,.12th, 19th, and 26th91933, and fixing the fee at $32.00, which was read: Upon motion by Amundsen, second by Moody, that the said resolution be adopted as read, and all voting in favor thereof, Presi- 11 dent Liddle declared the said resolution duly passed and adopted. A copy of a communication written by M.JQHoffman, Bridge Engineer of the Minnesota Hepartment -of Highways, to C.ElArmstrong, 11 City Engineer, relative to -the bridge over -the Zumbro River on Fourth Street Southeast, was read, and President 'Liddle ordered that the same be Placed on file. I - The following communication -was read, and President Liddle ordered that the same be placed on file: "STATE OF MINNESOTA, DEPARTMENT OF HIGHWAYS 1246 University Avenue Saint Paul,Minn. July 209 1933. M r: A. F. Wright , City Clerk, Rochester, Minnesota. Dear Sir: Re: Improvement of Trunk Highway # 599 Olmsted County. Your letter of June 29th, transmitting copy of resolution adopted by your Oommon Council on June 28th, has been received: The rules and regulations of the Secretary of Agriculture require that a detailed program of the proposed construction to be financed with federal funds be submitted to that department for approval. Until we have been in- formed as to the action of the Secretary of Agriculture on the projects which have been submitted in this program we will be unable to advise as to whether or not the improve- ment you have requested can be financed with federal funds - We hope to receive word with reference to this matter within the next ten days or two weeksi j Yours very truly; DEPARTMENT OF HIGHWAYS 'ff*W.Slaberg. Commissioner of Highways:" The following communication was read, and President Liddle ordered that the same be placed on file: "Rochester, Minnesota July 319 1933 The Honorable Mayor and Common Council City of Rochester Gentlemen: At a meeting of the Public Improvement and Work Program Committee of the Chamber of Commerce held on Thursday, 5�9 j July 279 1933 the city officials presented a public work Program for Rochester whereby we may expect to receive thirty per cent of the cost of labor and material from the federal government: This program was discussed and considered very carefully. This program as presented contained work by the city engineers department on sewers, repaving, and bridges at a cost of about $32590009 the Park Board program including park roads, greenhouse, silver lake, and swimming pool at a cost of about $1559000 9 and the Utility Board -program at a cost of about $ 3289000 The committee went on record as favoring the entire program as outlined providing it can be properly financed. We urge that your honorable body accept all of this program or at least such parts as can be placed in operation at an early date . "July 31/1933 7500 1000 2500 1600 350 2500 3000 2000 2200 500 4800 45000 $ 72,950 Art Nachreiner• " 520 President Liddl a ordered that the above mentioned estimates by the City Engineer and the Park Bodrds proposed, be each placed on file: Upon motion by Miller, second by,Hicks, it was ordered that copies of the above mentioned City Engineer's estimates and the Park Board's proposal, be submitted to the Minnesota Public Works Advisory Board for their consideration as to approval: Thomas Slatterly, Captain of Police, talking for Louis J.Claude, Chief of Police, asked that the On Sale license and the Off Sale license to sell non -intoxicating malt liquors heretofore issued to Podolske and Alkire for the so-called Green Mill at 109 Center Street East, be revoked, and upon motion by Norton, second by Moody, action was deferred until 2:00 o'clock P.M., on August 7th,1933: President Liddle referred the matter of a sanitary sewer for the E4 J. Jacobs property on Fourth Avenue Southeast, south of Twelfth Street Southeast , to the Sewer Committees, and the City Engineer. Upon motion by Moody, second by Flicks, the sum of Uioo was appropriated from the General Fund and it was ordered that 'the said sum be paid to A.A:Hirman & Co. for insurance premium on the motor driven flusher -sprinkler, and the sum of 046:60 was appropriated from the Park Improvement Fund and it was ordered that the said sum be paid to the C.O.Brown Agency for insurance premiumson amplifier and on Soldier Field buildings% 0 Upon motion by Hicks, second by Amundsen, the City Engineer was authorized to purchase a car load of washed gravel. Upon motion by Hicks, second ,ly Amundsen, the City Clerk was instructed to draw a resolution authorizing the City Engineer to expend not to exceed $499400 for the repair of concrete curbing. Upon motion by Norton, second by Moody, the City Engineer was authorized to purchase new tires for the 1930 Dodge truck.
