Meeting called to order by President Liddle. Roll Call. Present: Liddle, Amundsen, Dallman, Hicks, Miller, Moody. Absent: Norton. Upon motion by Amundsen, second by Moody, the minutes of the mee#ing held on July 31919339 were approved. This I JJUg the time and place fixed for adjourned and continued action on the proposal of L.A:Kepp Contracting Company, for the extension of police alarm system, moving traffic control signals, extension of traffic control wiring, etc.., the matter was given consideration. Alderman Dallman introduced the following resolution,which was read: "Be it resolved by the Common Council of the City of Rochester Minnesota: That the bid and proposal of L.A.Kepp Contracting Company for the furnishing of all labor, materials, equipment, tools,etc., necessary for the extension of the existing police alarm system, the moving of traffic control si,gaals, and the extension of. traffic control wirinpi in accordance with plans, profiles, and specifications for the. same which are now'on file in the office of the City Clerk of said City, viz: Lump sum bid for the complete furnishing and installation of all material and labor as specified for the extension of Police Alarm system for the sum of - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - $1400.00 Lump sum bid for the removing of Traffic Control from 1st St. and Broadway S. to 4th St. and Broadway S. furnishing all material and labor as specified for the sum of six hundred and twenty dollars - - - - - - - - $ 620.00 Lump sum bid for the complete furnishing and installation of remote emergency control of traffic system from the Fire Station as specified for the sum of - - - - - - - - - - - - - - - - - - - - - - - - - - - - - $ 610.00 be and the said bid and proposal is hereby accepted. The amount of the surety bond to be given by the said contractor is hereby fixed at the sum of $2630400." Upon motion by Amundsen, second by Dallman, that the said resolution be adopted as read, and all voting in favor thereof, except Alderman Moody, who voted "Nay", President Liddle declared the said resolution duly passed and adopted. ' ' Upon motion by Miller, second by Hicks, the City Clerk was instructed to prepare proceedings for the issuance of $2630.00 certificates of indebtedness .to realize funds for the payment of the above mentioned contract with L.A.Kepp Contracting Company; all voting in favor thereof, except Alderman Moody, who voted "Nay". The matter of hearing on and action on the request of the Chief of Police, tl�at the Podolske and Alkire On Sale and Off Sale licenses to sell non -intoxicating malt liquors at No.109 Center Street East, be revoked, adjourned to this hour and d6tre, was disposed of later in the meeting. Balance sheet of the Rochester nulic Schools., at July 31919339 their statement of bond issues, and a statement of their bonded indebtedness as of the same date, were each read, and President Liddle ordered that the same be placed on file; the said bond: dtatements showing $ 357 9000.00 bonds outstanding on that date. The report of the Health Officer, for the City Farm, for the month of July,1933, showing receipts in the amount of $456.12.1, disbursements $842.531, and balance on hand $86:19, and 294 hogs on hand August lst919339 was read, and President Liddle ordered that the same be . . placed on file. The report of the City Treasurer for the month ending July 31st 91933, showing $373,3130389 as being on hand, was read, and Presi- dent Liddle ordered that the same be placed on file. The City Engineer's trial balance for July 1933 was laid before the Common Council, and President Liddle ordered that the same be placed on file The, application of H4&Lipscomb for the transfer of Off Sale license No.48, and On Sale license No.22, to sell non -intoxicating malt liquors from 1021 Fourth Street Southeast to 110 Ninth Avenue Northeast, ,,v. ,A rear', and President Liddle referred the same to the License Committee.. The application of H.E.Lipscomb, for a soft drink dealer license at No.110 Ninth Avenue Northeast , was read, end upon motion by Dallman, second by Hicks, license was granted: The application of L.F.Milostan, for a plumber's license, was read, and upon motion by Amundsen, second by Dallman, license was granted. The plumber's license bond of L.F.Milosta.n, vdth the Eagle Indemnity Company, as surety thereon in the amount of $11000.00, was read, and upon motion by Hicks, second by Dallman, the said surety was accepted, the said bond was approved, and it was ordered that the same be placed on file. is The application of ET.Connolly, for a plumber's license, was read, and upon emotion by Dallman, second by Amundsen, license 1 was granted. The application of Bourassa Brothers, for an ON Sale License to sell non -intoxicating malt liquors at 513 Second Street 'North- west, was read, and President Liddle referred the same to the License Committee. J23 ) The ap lication of H.H.Sanders, for a license covering six bowling alleys at 11i -13-� Broadway Street North, was read, and upon motion by Amundsen, second by Dallman, license was granted. The application of the Pacific Whaling Company, for a license to exhibit their marine life specimens, such as a whale, octopus, pilot fish, etc-9 the Chicago Great Western Railroad Company tracks in this City, on August loth, llth, 12th, and 13th, 19339 pursuant to Section 2 of Ordinance No.3499 was read, and upon motion by. Hicks, second by Amundsen, license was granted at a fee of $37,50, Upon motion by Miller, second by Hicks, the City Clerk and for the City Attorney, were instructed to prepare proceedings/i. submittil)gthe question of the transfer of the _purpose for present Sinking Fund Investments, for Library Addition, so that the' sai me may be available for the construction of an addition to the present public library buildings the construction of a new public library building, or the construction of a combined public library building and auditorium building,, to the voters of said City at the Special Election fixed for September 12th,1933 The following communication was read, and upon motion by Moody, second by Amundsen, the City Clerk was instructed to work out an adjustment of the matter by, securing a corrected operation statement from the Minnesota Nort Natural Gas Company, as of December 31st,1932, or have them accept %s;: 1933 personal property assessment increase to the true valuation shown do the operation statement filed by them May 19th,1933, for the calendar year ending December 31st91932: " MINNESOTA TAX COMMISSION, ENGINEERING DEPARTMENT August 49 1933: Mr. A.F:Wright, City Clerk, Rochester, Minnesota. Dear Sir: This department of the Tax Commission is concerned with the assessment of the Natural Gas Company property. We have obtained a report from the Company iving the value of the gas lines owned by the Company in your City as 133tO986'399 which is as of May 11,1933 I am under the impression that some official in your city is required to make a record of the pipe line costs when laid by the Gas Company to furnish gas to the large heating customers and the Interstate Power Company distri- bution system. I would greatly appreciate your aid in getting a record of this cost in as much detail as possible. If you have a copy of the contra:et between the Natural Gas Company and the Interstate Power Company or the City of Rochester, I would greatly appreciate receiving a copy thereof. In case you wish to, kindly send the original to met and I will have a copy made and will return the original' t o. you immediate- ly. The folloViXig communication was read, and upon motion by Amundsen, second by Hicks, the City Clerk was, instructed to prepare proceedings for the issuance of a $19000.00 certificate of indebtedness, for financial assistance to the City Farm: "CITY OF ROCHESTER, MINNESOTA Health Department August 3rd9 1933 I To the Members of the Council { Gentlemen: �Y While the price of hogs has lately improved somewhat,- Y, :may it is still too low to successfully finance the collection of garbage.yh There is now outstanding a bill of EZ.- Beck and Company, South St.Paul, $309.59 for pigs purchased July 26th, 1933 and it is not expected that immediate receipts will be sufficient to pay it. I would therefore respectfully request that financial assistance be given to the City Hog Farm fund sufficient to cover this bill and to leave a balance to assist operations for a couple of months until collections of garbage collection accounts come in and I would suggest the appropriation of $1,000.00. Van Clemert , and one of the persons who was one of the principals in the recent fist fight outside the so-called Green Mill, talked of their attempts to run a respectable place of business, after which motion by Miller, second by Moody, that the On Seale license and the Off Sale license,heretofore issued to Podolske and Alkire for 109 Center Street East, be revoked, carried by all voting in favor thereof. H. M. Lumberton, Jr., City Attorney of Winona, Minne- sota, acting as the representative of Miss Anna Ebenhoh, in connection with her On Sale and Off Sale licenses to sell non -intoxicating Malt liquors, which were revoked by this Common Council, -presented the petitions of 16 residents of her neighborhood, asking that her licenses be reinstated �o.r her business location at 1326 Third Avenue Southeast, and the remonstrance elf 56 of her customers against the action taken relative to her licenses, and the certificate of H:J. O'Neill, witnessed by Stanley Mulvihill, and Chas. Ebenhoh, Jr., quoted: "This is to certify that I,. Henry J. O'Neill, did not have any beer or was. not served anything else at the Airport Inn on the night of July 15th919339" and President Liddle ordered that the same be placed on file. Mayor & Common Council Gentlemen: The Street & Alley Committee beg to report that no permission has been granted to anyone for the operation of any Carnival or any Gambling Device in any street or avenue of the City. The City Clerk reported the receipt from the Franklin Heating Station of .86.25 as being � cent per thousand cubic feet on 1792509000 cubic feet of natural gas used during July91933. Connolly with the Fidelity & Casualty Company of New York, as surety thereon in the amount of $1,000.00 , was read, and upon motion Iby Hicks, second by Dallman, the said surety was accepted, the said bond was approved and it was ordered that the same be placed on file. 526 The following request was read, and upon motion by Hicks, second by Amundsen, the authority for the purchase was granted: The Honorable Members of the Council Rochester, Minnesota "August 7th, 1933 i Gentlemen: For the more accurate testing of the strenrrth of chlorine solution in connection with the sterilizing of beer mugs, drinking vessels, swimming pools, drinking water and dairy work a scale chlorimeter is very necessary. I would appreciate very much the authorization to spend approsimaately $3000 in obtaining such an outfit. Yours respectfully, D. C. Lochead, M. D-. " Upon motion by Miller, second by Dallman, the $3.10 account claimed by the H. & H. Electric Company for lamps furnished the sewage disposal plant, and the $3.80 account claimed by the H. ' Upon motion by Hicks, second by Moody, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted: Alderman Moody introduced a resolution appropriating ` $765-059 from the Park Improvement Fund and ordering payment made to the Mayo Trust Fund for Payroll for labor during the period of the week ending August 4th,19339 which was read. Upon motion by Amundsen, second by Pallman, that the said resolution be adopted as read, and all voting in favor thereof, Prey ident Liddle declared the said resolution duly passed and adopted. (. Alderman Miller introduced a resolution appropriating $7155-001 from the Sewer Fund and ordering payment made to C: Fraser, and L estimate N'o.l on contract for the L.M.Feller, for/construction of a trunk line sanitary sewer in parts of i Broadway Street North and Fourth Street Northeast, under Job No:16929 which was read. The written permissions given by Baker & Steinbauer, Blakely & Kennedy, Snack Shop, Leo Cronin Co. 0: & B. Shoe Store, R: Qvale, First National Bank, E. A. Knowlton Company, Huey Cigar Store, F:W.Haase, E.L:Hoffman, Graen Cigar & Novelty Co. M.C.Lawler, J:C:Penny Co:, Union National Bank, and the Olmsted County Bank, were presented by Alderman Miller, and President Liddle ordered that the same be placed on file; the said permission being as follows: "OBSTRUCTION OF STREET I - We the undersigned hereby consent to the use by the Elk's Committee, the street in front of our place of business for the period August 6th to 9th, 1933 for reletting as spaces for concession stands, to be let by the Concession Committee, of the said Minnesota State Elk's Committee." Upon motion by Miller, second by Hicks, the Public Utility Board were requested to install a. street light on Third Street Southeest opposite 1. the Presbyterian Church: Upon motion by Hicks, second by Amundsen, the Ct*jy'1'Engineer was instructed to prepare plans, profiles, specifications and estimate of cost for the construction of a new bridge on Fourth Street Southeast over the Zumbro River, which bridge will be of the same type as that recently constructed over Bear Creek on Fourth Street Southeast, except that it ,ehalh have a 30 foot roadway and a 5 foot 4 inch sidewalk on each side: In the discussion of delinquent sign -permit fees and the failure of taxicab and jitney bus drivers to take out the required licenses, the City Clerk was informally instructed to serve notice upon the License Inspector, that he shall forth with require the payment of delinquent fees or the removal of thi signs, and that he shall require the payment of drivers license fees or that the unlicensed drivers shall quit driving: In the discussion of policy relative to transfer of license or refundment of license fees, it was agreed that in the event the licensee for the sale of non-intoxicaging malt liquors shall well his place of business there shall not be a transfer of licenses to the new owner nor a refundment of unearned license fee to the old owner but that the license shall remain in the name of the old owner until its expiration, during which time the old owner shall carry the responsibility for the conduct of business at that location, in other words he should be arrested for any infraction of law occuring at his former business location until such time a: J "D 0 the license there expires: Upon motion by Hicks, second by Moody, the Common Council adjourned to 7: 30 o'clock P:M. , on August 15th,1933. b v �� �� City Clerk.
