Roll Calle Present: Liddle, Amundsen, Dallman, Hicks, Miller, Moody, Norton. Absentt None. Upon motion by Dallman, second by Moody, the minutes of the . meeting held on AugiApt 7th,19339 were approved: The report of -the City Weighmast er, for the month of July, 1933,. showing weighing fees received in the amount of $6:809 was read, and President Liddle referred the same to the.Finance Committee. General Balance sheet, trial balance, ,fund statement, state- ment, of unexpended budget appropriations, statement of sink�ng.fund investments, ebc, of the City of Rochester, Minnesota, prepared. by the City Clerk, as of July 31, 1933, were laid before ,the Common Council, and President Liddle ordered that the same be placed on file. The report of the Clerk of the Municipal Caurt, for the week ending August 7th,1933, showing criminal fines collected $234.309civil fees received $9.50, conciliation court fees received $2:009 court costs charged to Olmsted County $31450 9 and fines collected due to Olmsted County $350,001 and for the week ending August 14th,1933, showing criminal `fines collected 085.409 civil fees received $1.35, conciliation court fees received $2.009 court costs charged to Olmsted County $27,40, j and fines collected due to Olmsted County $10.00, were'each read, and President Liddle referred 'the same to the City Attorney. Upon motion by Dallman, second by Amundsen, the sum of $45.009 was appropriated from the General Fund and it was ordered that the said sum be paid to Olmsted County,Minnesota 9 for the above mentioned municipal court fines dollected due to Olmsted County,Minnesota. Balance sheet, income statements, etc. , of the Public Utility Departments, prepared by the Secretary of the Public Utility,Board as of July 31st, 1933, were laid before the Common Council, and President Liddle or that the same be placed on file; the said income statements showing a net income in the Light Department for the month of July,19339 of $3951.85, and a net loss df income in the amount of $5523.399 for the four months of this fiscal year; and a net loss of income in the Water Department for Jul.y,1933, of $985:44, leaving a net profit in the Water Department for the four months of this fiscal year of 1,6807.84. The report of the Building, Electrical and Plumbing Inspector, showing building inspection fees: collected for Ju]-y,1.933, in tbt) electrical inspection fees 8505, and plumbing inspection fees $9.00, was read, and President Liddle referred the same to the Finance Committee. The Lieutenant in.chsrge of the local Civilian Conservation Corps contingent asked that sewage disposal facilities be provided for their camp at the Olmsted Coi}nV Fair Grounds and offered to do the labor concerned if they were furnished with the material, at which motion by .Norton, second by Dallman, carried that the request be referred to a::committee, and President Liddle designated the Sewer Committee and the City Engineer as a committee for the consideration of the Lieutenant's petition. A petition, headed as follows, signed by 32 resident-s of the locality concerned, was read, and President Liddle. ordered that the same be placed on file: "State of Minnesota, County of Olmsted, ss. To the Honorable Common Council of the City of Rochester, Minnesota: Gentlemen: The undersigned residents of the City of Rochest er,Minnesota, respectfully petition your honorable body not to grant any license to sell beer on the premises known as No.110 Ninth Avenue Northeast in the City of Rochester $Minnesota:" ' The following copy of resolution passed and adopted by the Public Utility Board, was read, and after a discussion of the �I figures set forth therein, motion by Hicks, second by Dallman, . carried that the same be referred back to the Public Utility Board. for correction as to what they expect to pay the Olmsted County Power Company for their distribution system and for the additional customer connections: 533 "WHEREAS, under Chapter No1419Session Laws of the State of Minnesota for 1933,(an act to permit municipalities to extend electric service) provides, according to the. opinion of the Attorney General of the State of Minneso- taithat a special election is required for the purpose of determining the question of extending light and power facilities beyond.the corporate limits of a munici- pality, and "Whereas, the Public Utility Board of the City of Rochester, Minnesota, has deteinnined that it is to the best interest of the said City to make the following extensions under the provisions of the said act: gonstiliction Labor 410 Stewartville 149100400 33-1/3% labor ..................... The plumbers license bond of the Rochester Plumbing & Heating Company, with the Eagle Indemnity Company as surety thereon in the amount of $1,000 o was read, and upon motion by Dallman, second by Moody, the said surety was accepted, the said bond was approved, and it was ordered that the same be placed on file: The appointment by the Acting Mayor, of C: B. Hanscom, and Carlton E.Anderson, as Special Patrolmen, August llth, to 17th919331, inclusive, at a compensation of $2000 per day, was read, and President Liddle ordered that the same be placed on file: A ruling received by Miss Grace Stevens, Librarian, from Clara F. Baldwin, Director of the Library Division of the Department of Education of Minnesota, that library employes do not come under the provisions of the National Industrial Recovery Act, was read, and President Liddle ordered that the same be placed on file. The application of Jose Bosley for a ten day vacation commencing August 14th919331 was read, and upon motion by Hicks, second by Moody, her request was granted. The following ruling made by the City Attorney, was read, and upon motion by Hicks, second by Amundsen, it was, ordered that the same be placed on file, and that the suggest/relative to deposits be placed in effect at this time: "August 79 1933 Honorable Common Council City of Rochester,Minnesota r Gentlemen: The matterofthe refusal of several individuals to pay to the City of Rochester the, charges for pumping out basements caused by 3 . pO �2 o34 surface water having been referred to me for attention, the following opinion is given: The City of Rochester cannot waive any charges for services performed for and at the request of individuals in which city employees, machinery or equipment is used. In this connection I would suggest that the department requested to perform such service protect itself and the City of Rochester by re uiring a substantial deposit prior to the commencement of any operations at the place requested4 jt s- eo ee - C. Upon motion by Hicks, second by Amundsen, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. 0 537 r Alderman Hicks introduced a resolution providing for the issuance of $2630.00 certificates of indebtedness to be issued for financing the extension of the existing police alarm system, the moving of traffic control sigmals, and the extension of traffic control wiring and ordering advertisement. for proposals of purchase to be opened at 2:00 o'clock P.M., September 5th,19339 which was read. Upon motion by Miller, second by Amundsen, that the said • resolution be adopted as read, and all voting in favor thereof, except Alderman Moody who voted "Nay% President Liddle declared the said resolution duly passed and adopted. Alderman Moody introduced a resolution appropriating $142078 from the General Fund,Code 18, for payment to the General Fund Code 79 as a temporary transfer, which was read. Upon motion by Hicks, second by Norton, that the said resolu- tion be adopted as read, and all voting in favor thereof, President Liddle declared'the said resolution duly passed and adopted. Alderman Norton introduced the following resolution, which was read: "Be it resolved by the Common Council of the City of Rochester, Minnesota: That the sum of $142:76 be and the said sum is hereby appropriated from the General (Code 7) Fund of said City and ordered paid to Julius J:Reiter,Mpyor, for use in his Contingent Fund, the said appropriation to be' used by him for the payment of the following accounts contracted by the Mayor's Welfare .Committee: H. Alderman Norton introduced a resolution appropriat- ing $290:73 from the Bridge Fund and ordering payment made to C. C Pagenhart for labor and materials relaying paving on approaches to the bridge on Fourth Street Southeast over Bear Creek and for the construction of sidewalk approaches to the said bridge,chsrgeable to Job 1687,which was read: Upon. motion by Moody, second by Dallman, that the said resolution be adopted as read, and all voting in favor thereon, President Liddle declared the said resolution duly. passed; and adopted. Alderman Millen introduced the following resolution, . whi ch was read: "Whereas, the Common Council' of the City of Rochester, ,Minneesota, deem it expedient and necessary that a new sidewalk bo construc- ted in said city along the East side of Ninth Avenue Southwest from Fifth Street to Sixth Street Southwest at such places as there is at present no sidewalk along said Avenue and a petition therefor has been presented to and .filed by said Common Council requesting that said sidewalk be construc- ted; ' Therefore, Be it resolved by the Common Council of the City of Rochester, Minnesota: That -the City Engineer of said City be and he is hereby ordered end required to publish a notice in the official newspaper of said City requiring the owners or occupants of any lot.or parcel of land adjoining the said parts of said Ninth Avenue Southwest as above mentioned to construct, at their own cost and expense, such sidewalks as are not.,now in place on said avenue, within thirty (30) days from the first publication of the said notice, which shall be published in the official newspaper of said City not less than two (2) weeks, and which said notice shall comply in all other respects with the requlremerts of. Section 251 of the Charter of said City of Rochester** Be it further resolved by said Common Council: That, in the event of the neglect$ failure or refusal of the said owners of the said lots or parcels of land adjoining said avenue to construct the said sidewalks within the time specified in said notice I 539 then and in that event the City Engineer is hereby authorized, ordered and required to construct said sidewalks at the expense of the property adjoining the said avenue as above described." Upon motion by Amundsen, second by Hicks, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. was read: Minnesota: Alderman Amundsen introduced the following resolution, which "Be it resolved by the Common Council of the City of Rochester, i 3 That the Common Council of the City of Rochester deem it expedient and necessary that local public improvements, the cost and expense of which shall be paid for by special assessments levied as provided by law be made in the City as follows: ,.,The construction of a sanitary sewer in Broadway Street South, commencing at a point ten (10) feet east of the center of the intersection of Fourth Street Southeast, and Broadway Street South, and running south parallel with the center line of Broadway Street South to a point sixty (60) feet east and thirty-seven and one-*alf (37�) feet north of the northeast corner of Lot No.7 in Block 103 of Willson's Addition, in accordance with the plans and specifications as approved by the Minnesota State Board of Health, as designated on sheets No.8 and 99 from Station No:82 plus 2349 to Station No:91 plus 21:8. The elevation at Station No:82 plus 23:9, being elevation 7447 feet and Station No.91 plus 21.39 being elevation 7545 feats City Datum. The pipe to be used in the construction of the sanitary sewer shall be either vitrified -salt -glazed -clay sewer Pipe or steel -reinforced - cement -concrete sewer pipe, as specified in A.S.T.M. Designation C 13-32 T. for Clay sewer pipe, and designation C05-30 T: for Concrete sewer pipe; And commencing 4t ,a point thirty-seven and one-half (37j) feet north and sixty (60) feet east of the northeast corner of Lot No�79 in Block No.103 of Willson's Addition, and running west parallel with the north line of said Lot No.7 Fifty-five (55) feet, and there ending; And commencing again at a point thirty-seven and one-half (372) feet north and sixty (60) feet east of the northeast corner of said Lot No,7 and running south 270 45' east forty-three (43) feet and there ending; Also, the construction of lateral connections to consist of 6" vitrified clay sewer pipe, and 1" copper water pipe, and 11 " gas pipe, from the mains now in place or to be constructed, to a Voint..thirty-six (36) feet east and west of the Center line of Broadway Street South, together with the necessary corpora tion cock, curb stops, curb boxes, L's. T's, branches, crosses and junctions as shown on standard plan of the City Engineer for lateral connections for Broadway Street South, from Fourth Street Southeast and Southwest, to Sixth Street Southeast arri Southwest, to be constructed in accordance with standard specifications and the o dinances and the charter of the City of Rochester, Olmsted County, Minnesota. SO THEREFORE, Be it further resolved by the said Common Council: That a public hearing of all persons interested in said improvements will be held at 7:30 o'clock P.M., on August 29th, 1933, at the Council Chambers, in the City Hall, in said City, at which time and place all persons interested in said improvements may be heard before said Common Council in relation to said improvements Be it further resolved: That the City Clerk be and he is hereby directed to cause to be published in the official paper of the City a notice to all persons of the time, place and object of said meeting and hearing. The City Engineer in reporting the collision August llth,1933, between a_ Ford touring automobile owned and driven by Andrew AAby, living about four miles south of Kasson, Minnesota, and I) the City owned 54 International truck driven. by Fert Winslow at the • I intersection of Trunk Highway No.7 and Trunk Highway No.20, stated that + all information concerning this accident is in Policq department records • under their vehicle accident report No. 0109.
