Minutes of an adjourned regular meeting of the Common Council
of the City of Rochester, Minnesota, held in the Council Chambers, in the City Hall,
in said City, at 7:30 o'clock P.M., on September 26th,1933.
Meeting called to order by President Liddle.
Roll Call. Present: Liddle, Amundsen, Dallman, Tricks,
Miller, Moody, Norton. Absent: None.
Upon motion by Dallman, second by Amundsen, the minutes of
the meetings held on September llth91933, September 13th919339 and September 15th,
1933, were each approved:
Alderman Dallman introduced a resolution adopting and
approving the grade fixed by the Highway Department .for trunk highway No059, within
the limits of said City, which was read.
Upon motion by Miller, second by Moody, that the said resolu-
tion be adopted as toad, and all voting in favor thereof, President Liddle declared
the said resolution duly passed and adopted.
Alderman Amundsen introduced a resolution approving.&nd
adopting the grade for trunk highways i(os. 7 and 20, as fixed by the Highway
Department for that part of the said highways which are within the City of
Rochester, Minnesota, which was read.

Upon motion by Moody, second by Miller, that the said
resolution be adopted as read, and all voting in favor thereof, President Liddle
declared the said resolution duly passed and adopted.
This being the time and place fixed for the opening of
Proposals for the repaving with No 1 2-g' vertical fibre cut lug paving brick
of certain parts of streets and avenues within the said city, the following
proposals were opened and read:
Center Street West, Broadway to First Avenue;
Fielding & Shepley, Inc.: City scale $1.68 per sq. yd., N.I.R.A.$1.71;

Clement F.Sculley Equipment Co. Inc.: City Scale $1.85 per sq. yd., N.I.R.A. $1490;
Hanla;n & Okes: N.I.R.A. $1.72 per sq. _yd;
Thornton Brothers Co.: $1.60 City scale, 01.80 N.I.R.A.
The proposals of each one of the above named concerns were the
same as above set forth for the repaving of each different street and avenue
concerned at this time, viz:
First Street Southeast from a point 15 feet west of the east line of Broadway
Street North to the main tracks of the C.G.W.R.B.Co;
Second Street Southeast and Southwest from 10 feet west of the east line of First
Avenue Southwest to the west line of the alley next east and from a point 15 feet
west of the 'east line of Broad-rnrayr Street South to the main' track of the C.G.W.R.R.
Co.;
Second Street Southwest from the center line of Eleventh Avenue Southwest to the
east line of Fourteenth Avenue Southwest, less that part which is now paved with

to a point 110 feet north of the north line of Sixth Street Southwest;
Fifth Street Southwest .from the west line of First Avenue Southwest to the
east line of Second Avenue Southwest;

Point 4 feet east of the east line of Second Avenue Southwest;

This being the time and place fixed for the opening
of proposals for the construction of a trunk line sanitarysewer in
Broadway Street South, from Fourth Street to Sixth Street, and the laying
of lateral connections, the following proposals were opened and read:

President Liddle referred the above propos ,,ls for repaving and
for the construction of a trunk line sanitary sewer and the laying of laterals to
the Common Council as a committee of the.whole, the City Engineer and the City
Attorney.
T.Iie following communication was read, and President Liddle
ordered that the same be placed on file:

To the Honorable Mayor and Common Council
of the City of Rochester, Minnesota
Gentlemen:
The Board of Directors of the Rochester Public Library of the City
of Rochester, Minnesota have given full and careful consideration as to the
feasibility and desirability of a combined Library and Auditorium for the City
of Rochester as outlined in the offer of the Mayo Properties Association. We have
had drawings and sketches prepared by competent architects who have advised with
us. We have had correspondence with others who are high in their profession and i
we are fully and unanimously agreed that a combined Li'hrary and Auditorium as
specified in the offer of the Marro Properties Association would not be desirable
or satisfactory either as a Library or an Auditorium, neither would it meet with
the approval of a majority of the citizens of Rochester.

We appreciate the genersus offer of the Mayo Properties
Association. 2h a Real Estate they are offering us is the most
desirable location for a Library in the City of Rochester and we hope
that the conclusions we have reeched will not deter them from further
consideration of the subject and that eventually we may obtain the
desired property for a Public Library that will be satisfactory to
them and a credit to the City of Rochester.
Therefor
At a regular adjourned meeting of the Library Board of the City of
Rochester held September 15th, 1933 the following was adopted:
. Resolved I.
That we hereby notify the Mayor and Common Council of the
City of Rochester that uziess otherwise instructed and
advised by said City Council, we shall allow the offer of
the Mayo Properties Association 'as follows:
'Lots Nos. Aline (9) 'and Ten (10) , and 'the West, half (`) of
Lot A?o. Eight (8). in Block No. Sevent.eeA (17) of the
Original Plat of the Town, now City of Rochester.
The I F)qo Properties Association offers the above mentioned
property to the City of Rochester, through its Library
Board, for the purpose o-" constructing and maintaining
thereon a suitable edifice for housing a library and an
auditorium.
This offer,- however, in canditional upon the City of
Rochester agreeing to incorporate in a library building
an assembly Nall of a seating capacity of not less than '
F 2p00 and also condit iona,l upon construction being started
not later than January lst,1934, in order to provide early
employment of local labor.' Y

The Common Council took recess for consideration of
the above mentioned proposals and upon their decision they returned to
the Council Chambers and were called to order by President Liddle.
Upon motion by Hicks, second by Amundsen, all
proposals for the construction of the above described trunk line sanitary
sewer and the laying of lateral connections were rejected and it was
ordered that the certified checks be returned. to the bidders.
Upon motion by Miller, second by Hicks, each of the
above proposals .for the repaving of parts of streets and avenues, as above
set forth were rejected and it was ordered that the certified checks be
returned to the bidders.
Upon motion by Hicks, second by Amundsen, the
City Engineer was authorized and directed to secure the necessary labor and
materials and in accordance with the adopted specifications, repave the
following parts of streets and avenues with No. 1 22" vertical fibre cut lug
paving brick, and that no further action be taken on the balance of the
projects until such time as there are funds available:

Centet Street West from the west line of Broadway Street North
and South to the west, line of First Avenue Northwest and Southwest, except that
part of the intersection of Center Street West and First Avenue which is now paved
with brick;
First Street Southeast from a point 15 feet west of the east
line of Broadway Street South to the main track of the Chicago Great Western
Railroad Company; -
Second Street Southeast and Southwest from a point 10 feet west
of the east line of First Avenue Southwest to the west line of the alley next east
and from a point 15 feet, west of the east line of Broadway Street South to the main
track of the Chicago Great ,Western Railroad Company;
Second Street Southwest from'the center line of Eleventh
Avenue Southwest to the east line of Fourteenth Avenue Southwest, less that part
which is now paved with brick;
First Street Southwest from the west line of First Avenue
Southwest to a point 4 Teet east of the east line of First Avenue Southwest.
The report of the Clerk of the Municipal Court for the week end-
ing September 18th.119339 showing criminal fines collected 064.4Q,civil fees received
$$.25, conciliation court fees leceived $3.50, court costs charged to Olmsted
County a$15.45, fines collected and remitted direct to State Treasurer $30.00; and
for the week ending September 25th,1933, showing criminal fines collected $$69.00,
civil fees received $4.009 conciliation court fees received $3.75, •and court costs
charged to Olmsted County $9.859 were each read, and President Liddle referred the
same to the City Attorney.
The City Engineer's trial balance for August,i933, was laid,
before the Common Council and President Liddle ordered that the same be placed on
file. _
General balance sheet, trial balance, fund statement, statement
of unexpended bud; et appropriations, etc., prepared by the City Clerk as of August
31st,1933 , were laid before 'the Common Council, and President Liddle ordered that
the same be placed on file. --
The application of Local Union No. 405 for a public dance permit
at the Woodman Hall October 5th,1933, was read. -
The application of Desnoyers & Son by F. G. Desnoyers for the
transfer of their On Sale license No* 11 and their Off Sale license No. 181, heretofore
issued authorizing the vending of non -intoxicating malt liquors at 601 Broadway
Street North, to 112-114 Second Street Northeast, effective at such time as they may
be able to make the move, was read, and upon motion by Norton, second by Amundsen,
the transfer nas granted, after the reading of the following petition:

Upon motion by Hicks, second by Amundsen, the Mayor and City {

Clerk were authorized and directed to execute average demurage agreement
contract forms with the Chicago Great Western Railroad Company.
The following copi as of resolutions passed and adopted by the
Commissioners ,of the Sinking Fund were read,and upon motion by Miller, second by
Moody, the actions set forth therein were approved, and it was ordered that the
said copies of resolutions be placed on file:
"Be it resolved by the Commissioners of the Sinking Fund of the
City of Rochester, Minnesota:
That the sum of $1012499 is hereby appropriated from the Sinking
Fund of said City, and it is ordered that the said sum be paid to Mrs. Vivian
Iverson, for City of Rochester,Minnesota, 4 % Improvement (New City Hall) bond No.
1079 maturing December 1 st,1943, $1,00040 of the said amount being for principal on
the said bond and %112.99 thereof being accrued interest on thq said bond to Septembe
19th,1933, the said appropriation being made .$1,000.00 from Code 23 of the Sinking
Fund of said City, and $12,499 from Code 24 of the Sinking Fund of said City."

The following emergency authorization and the letter accompanying
it were read, and President Liddl a ordered that the same be placed on file:

Whereas, it has come to my attention that the Chevrolet automobile
now in use of the Police Department of said City has been driven more than
709000 miles and that it needs a general overhauling which will cost around
$75.00 and also a new set of tires, and
Whereas, It is deemed best that rather than expend the cost of
repairs and new tires the offer of the Clements Chevrolet Company that they
furnish a 1933 4 door -sedan automobile for 0425.00 after allowance for the
1931 Chevrolet which we now own be accepted;

So therefore, I, as Mayor of the City, of Rochester, Minnesota,
deem it an emergency that we have a new automobile for use of the Police
Department and do hereby authorize you, Louis J. Claude, Chief of Police,
to purchase a 1933 4 door Chevrolet Sedan at the net cost of $425.00; which
emergency authority is given under Section 264 of the Charter of said City,
as I deem that the delay occasioned by strict compliance with the Charter
relative to the furnishing of ca modities will cause great damage to the
public interest and endanger public safety.

The reason that I ask this order is that the car we are using has
gone seventy one thous -and miles, It has had no repair word{ done on
it and it needs a general overhauling which will cost around seventy

Clerk was authorized and directed to call on all department heads making
request that on or before Ovtober 2nd,19339 they file their proposed
budgets for consideration in the 1933 tax levy.
The appointment by the Acting Mayo r . of Carlton E .
Anderson, and C. B.. ,Hanscom, as Special Patrolmen, September 224d, 1933, to
September 28th,1933, inclusive, at a compensation of $2.00 per day, was
read, and President Liddle ordered that the same be placed on .file.
Claims of residents along Third Street Southeast,
between First Place Southeast and. Third Avenue Southeast, for unlawfully
taking and converting without due process of lavr, damaging j excavating,
and removing without permission and to the great detmage of the owners there-
of, earth, sand, gravel, and similar materials, by the Board of Park
Commissioners, and flooding and illegally and unlawfully changing and
moving the Zumbro River out of its natural course and onto, over and upon,
and thereby depriving the owner and person in possession and entitled to
the free and uninterrupted use thereof, totaling $12,995.50, made by

Upon motion by Miller, second•by Moody, the City Clerk was

request as to information concerning the status of Rochester's application for 30%
grant, and the City Clerk accordingly sent the following quoted telegram:

Alderman Moody introduced the following resolution, which was
"Be it resolved by the,. Common, Council of the City of Rochester,
That the sum of al99744097 be and the said sum is hereby
appropriated from the Street and Alley Fund of said City and ordered paid to The
Public Utility Fund of said City to return the appropriation made from the Public
Utility Fund to the Street and Alley Fund. This appropriation is made in accordance
with the terms of a resolution passed and adopted on August 23rd,1933 providing
for the return of said sum as herein mentioned if said sum were not to be used by
said City of Rochester under the provisions of the Federal Emergency Administration
of Public Works.
The Mayor aSd. CityClerk are hereby authorized and directed to
draw a warrant for said sum upon the City Treasurer in accordance herewith, and cause
said payment to be made."

Upon motion by dicks, second by Amundsen, that the
said resolution be adopted as read, and all voting in favor thereof, Presi-
dent Liddle declared the said resolution duly passed and adopted.
Alder&ah Dallmin returned to the Council Chambers and
took his Chair. '
Alderman Hicks introduced the following resolution,
which was read:
"BUFREE.S, the Common Council of the City of Rochester,
Minnesota, has rejected all bids for re -paving streets and avenues in the
City of Rochester as the same were advertised for on bids to be opened
+' on September 26th, 1933 and has instructed the City Engineer of said City
to do the said work by day labor and the purchase of the necessary materi-

authorized and directed to lay a 12 inch vitrified clay sewer pipe across Broadway
:street South near the center liner of Fifth Street Southeast and Southwest, to
allow for the construction of a sub -main along the west side of Broadway Street
South as a sub -main becomes necessary.
Upon motion by Miller, second by Moody, request was made of the
Public Utility Board that a street light be installed on First Street Southwest
about the 1400 block.
Upon motion by ?Ticks, second by Miller the City 11nr7rineer was
authorized to purchase 35 dr' ms of cold patch asphalt,to be included in a car load
shipment of paving filler for the above mentioned repaving of streets and avenues.
Upon motion by Miller, second by Amundsen, the Chief of Police
was authorized to purchase a Friedli Decelerometer (brake tester) at a cost of
'$65.00, and $5:00 per hundred for the brake inspection certificate tickets; the
