Roll Call: Present: Liddle, Amundsen, Hallman, Miller, Moody, Norton; Absent: Hicks: President Liddle announced this as being the time and place fixed for a hearing on the widening of the paving on Second Street Southwest, from the center line of Eleventh Avenue Southwest to the center line''of Twelfth Avenue Southwest, by the construction of one course concrete pavement, with integral curb, on each the north and south sidew of the present paving on the said part of Second Street Southwest, which integral curb shall. be constructed at a distance of 25 feet both north and south from the center line of the street, i:e: to make the paving 50 feet in width inside of the curb line, and the reconstruction of cement concrete sidewalks on each the north and south sides, of the said part of Second Street Southwest, where the present sidewalks may be defective, either in character, alignment, or position, and the grading of the south side of the said part of Second Street Southwest, where the same may :be necessary, and the removal of any trees that may interfere with the widening of the said part of Second Street Southwest, or the reconstruction of any sidewalk, and asked if there was any person present who wished Ito be heard concerning these proposed improvements. The following remonstrance was read, and President Liddle ordere that the same be placed on file: "TO THE HONORABLE COMMON COWIL OF THE CITY OF ROCH BTER. We, the undersigned owners of property abutting on Second Street Southwest in the City of Rochester between Eleventh Avenue and Twelfth Abenue Southwest, hereby remonstrate against the widening of said Second Street Southwest between said Eleventh and Twelfth Avenues beyond the present curb lines for the reasons that such widening is unnecessary and in the present period of depression it will be an expense which they cannot meet, and in some cases, will change the established grade and unnecessarily damage the buildings which have been erect@d in accordance with present grade. This being the time and place fixed for the opening of proposals for the repainting of the outside of the so-called Witherstine House, the following proposals were opened and read% E.J .Put erbaugh & CO. $214.95; Olaf Weiberg $229-0001 Wahl Brothers $238:00; E.A.Danewick & B:Ralstad $2190,00; Chas J: Coghlan, Co-owner and operator of Coast to Coast Store, $216196; Rettinger & Hodge Company $339400; Clarence Huntington & Elmer Roeder, $230000; Louis Banick, Joseph Creeley, and B. K� Darling $216.004 President Liddle referred the above proposals for repainting, to the Pubi.ic Grounds Committee and the City Attorney and recess was taken to allow them to consider the said bids. After their decision was reached,they returned to the Council Chambers and , t he Common Council was again called to order by President Liddle, at which Alderman Hicks made an oral report -and recommendation as Chairman of the Public Grounds Committee, that the contract be awarded to E:J;Puterbaugh & Company. Alderman Amundsen introduced the following resolution which was read: "Be it resolved by the Common Council of the City Of Rochester, Minnesota:. That the bid and proposal of E.JiPuterbaugh & Co. for the furnishing of all labor, materials, equipment, etc., necessary for the repainting of the outside of the house on the so-called Witherstine Property, in accordance with the specifice,t ions _for the said repainting which are now on file in the office of the City Clerk of said City, viz: Painting complete of outside of so-called Witherstine property for 19214.95 be and the said bid and proposal is hereby adcepted. The amount of the surety bond to be given by the said contractor is hereby fixed at the sum of $2154000," 629 4,7 Y+ I - I Upori motion by Amundsen, second°by Hicks, that the said resolu- tion be adopted as read, and all voting in favor thereof, President Liddle declared the said 're'eolutiori duly passed and 'adopted. i Xpon motion by Hicks, second by -Norton; • it was ordered that the certifies checks which accompanied the unsuccessful bids for the above mentioned proposals for repainting, be returned. Aldermen Datllman introduc-ed__an ordinance prohibiting the holding, showing, exhibiting or advertising of 'dance marathons, walkathons, and other similar exhibits of physical endurance, within the Cijry of Rochester, Minnesota, which was. given its first reading. Upon motion by Dallman, second by Moody, the rules were i suspended and the said ordinance was given its second reading accordingly. Upon motion by Hicks, second by Amundsen, the rules were suspended and the , said ordinance was given its third and final reading accordingly: Upon motion by Moody, second by Miller, that the said ordinance be adopted as read, and all voting in favor thereof, President Liddle declared the said ordinance duly passed and adopted: I � Frances Ness made complaint of unsatisfactory service received from O.E.McCoy, City WeiE#master, and President Liddle referred the matter to the Ir City Attorney. The City;Engineer's trial balance for September,19339 was }aid, before the Common Council, and President Liddle ordered that the same be placed on fi eq General balance sheet, trial balance, fund statement, statement of unexpended budget appropriations, . statement of Sinking Fund Investments,etc., i prepared by the City Clerk as of September 30th,19339 were laid before the Common Council, and President Liddle ordered that the same be placed on file. I The report of the Health Officer for the City Farm for the month 1 of September,19339 showing receipts in the amount of $2831.459 disbursements $2370160 and a balance on hand of $212*84, and a statement showing 275 hogs on hand September 1 1 st ,1933, 277 purchased during the month, 113 hogs sold during the month, 16 hogs lost from disease and 423 on hand October lst919331 were each read, and President Liddle ordered that the same be placed on file: the report of the City Wei .jnmaster for the month of August, and September,19339 showing weighing fees colbected in August $16.901, and September $32,70, totaling $49:60, was read, and President Liddle referred the same to the Finance Cbmmittee. The application of W.C.Scharnweber, agent for Local Union No.405 for a public dance permit at the Woodman Hall, October 19th,19339 was read. The foliowing application for transfer of licenses was read, and I • I s upon motion by Norton, second by Dallman, the transfer *as granted: 69 630 "Rochester, Minnesota October_ 9,1933. To the Honorable Mayor and Common Council II Rochester, Minnesota Gentlemen: �i Having purchased all of the interest of the former . owner, Mr. Thurber, in The Old Reidelberg, located at No:313 First Avenue Southwest, Rochester, Minnesota, we hereby petition your honorable body for a transfer of the on sale and off sale licenses to sell non -intoxicating malt beverages, which were heretofore issued to Mr•Thuzber for the operation at the above named address. Respectfully, Severt Lee Richard H: Dahle Having disposed of my interest It the above named place of business to the above named owners, I hereby give my consent to the transfer of the licenses heretofore issued in my name .for the operation of that establishment. H. L: Thurber." A statement -was submitted by the Health Officer certifying uncollected garbage service charges fbr assessment against the Property benefitted, was read, and President Liddle ordered that the same be placed on file, the total of the uncollected garbage service charges mentioned being 091.40. The following communication was read, and President Liddle ordered that the same be placed on file: October 6, 1933 To the Common Council, Rochester, Minnesota. Gentlemen: The following resolution was adopted at the regular monthly meeting of the Library Board, October 5, 1933. RESOLVED: That the Library Board request the Common Council that,the remainder 0400 of the funds originally provided ($750) for the studies of a combined Library and Auditorium be made available to the Library Board for investigation of the comparative dbeirability of two or more prospective sites for ". - a new Library building, and for the development of plans relating thereto, toward the end that the City of Rochester may be provided with Library facilities adequate to its long-standing and growing needs. W. W. Churchill President of Library Boardi" The City Engineer submitted the following statement of trunk line sanitary sewer costs and President Liddle ordered that the same be placed on file; the City Clerk making comment that the 08540-50 mentioned therein for removal and replacement of pavement should be only ♦ , 0623:79, as the $374.01 adjustment he has in this statement carried the charges for the removal of this paving, his $138.00 for driveways removed and replaced should be -1104:68 for the same reason, and his $79.00 for sidewalks removed and replaced should be $61.42 for the same reason: a "Oct. 6, 1933 Hon. " A communication from the President of the League of Minnesota Municipalities, asking for a recommendation of local persons to be included in his Committee appointments, and a questionnaire as to the subjects that this City might want League discussion on, were read, but no action was taken thereon. The appointment by the Mayor of Carlton E.Anderson, and C.B. Hanscom, as Special Patrolmen, October 6th to 12th,1933,inc1usive9 at a compensation of$2.00 per day, was read, and President Liddle ordered that the same be placed on file. The City Clerk reported the payment by the Franklin Heating Station of $79.33, as 2 of one cent per thousand cubic feet on 15,365,000 cubic feet of natural gas used during September919334 The City Clerk called attention to the accumulation of $681,39 in the Sinking Fund from interest on average daily deposits and from savings account and suggested that this amount be transferred to some other budget division of the Sinking Fund for use in reducing the 1933 tax levy, and accordingly motion by Dallman second by Amundsen, carried that this money be transferred to be used for payment of Principal and interest -on City Hall bonds. , I The City Clerk calledattent ion that $2531.04 remains on hand in the Street and Alley 10und from funds for repaving of Sixth Street Southwest, in 1932, in that $131000:00 of bonds 'were issued Aor that purpose dnd the cost was 'only approximately $10500.009 at which motion by Hicks, second by Dallman,carried that this surplus money be transferred within the Street and Alley Fund to make the same available for 1933 repaving costs. 632 The following communi0ation was read, and the Prints mentioned were laid before the Common Council, at which motion by Dallman, second by Miller, carried that authority 7ge given for the making of these improvements provided that the City Engineer shall have supervision overthen: " Rochester , Minn., Oct. 3; 19330 Honorable Mayor & Common Council', City of Ro chest ere' ` Gentlemen: " - Attached please find four Prints of Estimate #35821 Proposed Aerial Cable Extensions and Rearrangements at various locations. Also underground cable in Fourth Street S:E. at the new bridge: These proposed rearrangements and extensions of aerial cable, if approved by'you, will'remove a $ew poles and a considerable number of drop wires from the streets and clean up conditions which are unsatisfe;ctory at this time. Four copies have been included, two are for your file and two approved will be returned. Thanking you ih advance, I am Yours truly, E.J.Gates Wire Chief:" The budget items for a $262, 908.00 levy made by School District No:B, for 19339 and the request of the said Doard of IIEducation for Common Council approval, were read, and President Liddle ordered that the same be placed on file. The proposed budget prepared by the Mayor and Chief of Police for operation of Police Department, to be included in the 1933 tax levy,totaling -$349007600, was read, and President Liddle ordered that the same be placed on file. Upon motion by Dallman, second by Moody, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted* Alderman Amundsen intrdduced a resolution levying special assessments for unpaid garbage collection service charges i-?91.40, interest thereon $7*30, and total $93*709 which was read. Upon motion by Moody, second by Norton, kthat the said resolution be adopted as read, and all voting in favor thereof, Presi- dent Liddle declared the said resolution duly passed and adopted* Alderman Dallman introduced a resolution granting public dance permit to local Union No*405, for the Woodman gall October 19th,1933, and fixing the fee at �1,3.009 which was read' Upon motion by Dallman, second by Moody, that the said resolution be adopted as read, and all voting in fs.vor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Dallman introduced an ordinance to amend an ordinance entitled, "An ordinance to license junk buyers and f collectors in the City of Rochester, Minnesota, and to regulate ikheir doing manner of/business, "the same being an Ordinance No*435 of the City of 635 >7 linnesota, which was given its first reading. Upon motion by Dallman, second by Miller, the rules were suspend and the said ordinance was given its second reading accordingly. Upon motion by Miller, second by Moody, the rules were suspended and the said ordinance was given its third and final reading accordingkly. Upon motion by Dallman, second by Amundsen, that the said ordinance be _adopted as read, and all voting in favor thereof, President Liddle declared the said ordinance duly passed and adopted. Upon motion by Hicks, second by Dallman, any membersof the Common Council that find it possible to go were authorized to go to St:Paul, Minnesot Friday, October 13th,1933, and appear before the State Advisory Board as to why no action has been taken on the City of Rochester's applications for grants for trunk line sewer construction and bridge construction. Upon motion by Dallman, second by Miller, the City Attorney was instructed to give a ruling as to whether or not the actions taken by the Common Council of the City of Rochester, in February and March, 1870, laying out and opening what is now known as Fourteenth Street Northwest, would be a. legal location for the proposed new bridge over Cascade Creek at Fourteenth Street Northwest.
