the City of Ribchester, Minnesota, held in the Council Chambers, in the City Hall, in
said City, at 7:30 o'clock PoM.,. on January 15th91934.
Meeting called to order by President Liddle.
Roll Call. Present: Liddle, Amundsen, Dallman, Hicks, Miller,
Moody, Norton. Absent: None:
Upon motion by Hicks, second by Moody, the minutes of the
meetings held on December llth,19331 December 15th,1933, and December 21st,1933, we
each approved.
President Liddle announced this as the time and place fixed for
a hearing on then proposed construction of a siphon section of trunk line sanitary
sewer in parts of Third Street Southeast and Third Avenue Southeast, and -asked if
there was any person present who wished to be heard relative to this improvement:
There was no person present who wished to be heard concerning
the proposed construction of thesaid siphon section of trunk line sanitary sewer.
This being the time and place fixed for the opening of proposals
for the construction of a trunk line sanitary sewer commencing in the center of
Fourth Street Northeast 30 feet east of the center of Broadway Street North and
running south 150 feet, thence southwesterly to a point 10 feet east of the center
line of 'Third Street Northeast and Broadway Street,North, thence south to a point
10 feet north of the. center line of Third Street Southeast and -10 feet east of the
center line of Broadway Street South, and for the construction of a trunk line sani-
tary sewer commencing 10 feet north of the center line of Third Street Southeast
and 10 feet east of the center line of Broadway Street South and running thence
southeasterly to the center line of Fourth Street Southeast and 27' feet east of
the center line of Broadway Street South, thence south to a point 44 feet south and
27 feet east of the center line of Broadway Street South, and Sixth Street Southwest
platted through Willson's Addition, the following proposals were opened and read:

President Liddle referred the above mentioned pro-
posals for trunk line sanitary sewer construction to the City Engineer -for
his tabulation and recommendations...'
Various persons talked before the Common Council
concerning the proposed intoxicating liquor control- ordinance; A.H:Clemens
speaking for the drug stores in remonstrance against them being eliminated

from the privilege of having Off Sale licenses; Uharles Grassle and Mike
I
Sakell talked for the restaurant owners claiming that the proposed license I
fee is too high and that the removal of booths would cause greAt financial
loss to them; Dick McDermott .talked for the Musicianh" Union against the
prohibition of dancing where intoxicating liquor is sold; C.L.Fischer and
E.L.Van Atta opposed the $500.00 license fee for .clubs, and expressing

themselves as being favorable to a -1100.00 fee instead; Rev.. A.R.Ziek, using j
i
all the adjectives so far coined, placed them in his adverse opinion of the j
ordinance and recommended that an ordinance of such local concern should be
drafted by a committee of fifteen unconcerned in the political or financial
result of its adoption; George J. Anderson concurred with prior opposition
except that he fd31d not concede but that the Common Council i.s, qualified
to draft ordinances and under their election ,are• charged with such legisla-
tive duties; and Julius J. Reiter, Mayor, supported the proposed ordinance
in toto, except that he felt fifteen On Sale licenses were too many, his
prior experience with intoxicating liquor control being that a few licensed
places with a high license fee made better local conditions.
The report of the Building, Electrical and Plumbing
Inspector,for the month of November919339 showing $6.00 collected for Building
Inspection fees, $7.009 for electrical inspection fees, and $9.00, for
Plumbing Inspections was read, and president Liddle referred the same . to the
Finance Committee.

President Liddle ordered that the same be placed on file:

We call attention to the fact that the original estimate of cost
was based upon a labor scale of 55 cents per hour, with the understanding,
the N.R.A. or P.W.A., would assume 30% of the cost of project. From such
information as this office h" been able to obtain, the total allotment
from the Federal Government is fixed at $249000.00.
The estimates
prepared in this office, and evidently, used by the
Federal Government in the making of the allotment, were based upon the
following items:

Therefore, the basis of allotment is 27.9% of the on135000900
inal estimated
cost. We have current contracts which absorb 27.9% of the allotted
to bridge, or $9765.009 and $24000.009 less the $9765.00 leaves $14,235.00
of the allotment to apply to construction of sewer in Broadway and 3rd Avee
and 3rd St. ' '
If we allow the argument, that the estimated cost of construction of
sewer in 3rd St 4 & 3rd Ave. S.E.. (for which bids have been deferred) is
reasonable, and add this estimated cost, to the low bid for construction of
the Broadway Trunk, we arrive -at the amount of 66673.68, as being the total
cost. To meet this cost, we have the following monies available:
27.9% of Federal Grant 14 9235.00
P.U.Bosrd Appropriation 362413.51
Total of all monies now available 509646.51
It therefore, • is evident, that the amount of the difference between
the total cost, and the monies available, be made available, before the
contract may be awarded.
We recommend that the contracts be not awarded- and that no further
action be taken until such time as sufficient ,funds are made available for
the project. The amount of shortage of monies is $16025.17

Upon motion by Hicks, second by Norton, the above mentioned
proposals for construction of trunk line sanitary sewers were referred to the
Mayor and City Engineer, with instructions that they confer with Mr.Wm.N.Carey,
State Engineer, P.W.A., relative to further grant toward'the cost of the
construction of these sections oftrunk line sanitary sewer, and that no
further Common Council action on•the said proposals be taken until report
Is made by
the Mayor and City Engineer on their- conference with Mr. Carey.
A. J. Osman, of the Home Oil Company, R. H. Keating
of the Standard Oil Company, Geo. R. Allen of the Mid -Continent Petroleum
Corporation, and F. J. Kahl of the Conoco * 011 CompazW, each opposed the

existing arrangements for gasoline purchases Prom. the Co -Operative Oil Company;
isch apparently expecting a division of the City of Rochester's gasoline
business to the various local companies on the basis of their local invest-
ment and expenditures.
The report of the Milk Inspector for the month of
December,1933, was read, and President Liddle ordered that the same be placed
-on file.
The report of the City Treasurer for the month ending
December 31st919339 bhowing $325,380.90 as being on hand was read, and
President Liddle ordered that the same be placed on file.
The reports of the Clerk of the Municipal Court for
the week ending January lst919349 showing criminal fines collected $10,00,
conciliation court fees•$3.OQ, Olmsted County Municipal 19ourt fees for
November91933, $50.20, and court costs charged to Olmsted bounty $30-859 for the
week ending January 8th,19349 showing criminal fines collectdd $900009 civil
fees received $11.059 conciliation court fees $20259-and court costs charged
to Olmsted County $15.75, and for,the week ending Manuary 15th,19349 showing
criminal fines collected $54.40, civil fees received $2.259 conciliation
court fees $8.009 court costs charged to Olmsted County $8:85, and fines
collected due to Olmsted County 8" 10 i00, were each read, and President Liddle
referred the same to the City Attorney.
Upon motion by Moody, second by Amundsen, the sum of
$10.00; was appropriated from the General Fund and tt was drdered that the
said sum be paid to Olmsted Count y,Minnesota, for local Municipal Court
fines collected due to Olmsted County, Minnesota.

for the month of December,19339 showing receipts $45820, disbursements
$571.599 and an overdraft of $56.369 together with a statement of the hogs

on hand January lst 91934, were each read, and President Liddle ordered that k

The report of the City Weighmaster for the month of December,
1933, showing $61040 collected as weighing fees, was read, and President Liddle
referred the same to the Finance Committee.

Board as at December 31st919331 were laid before the Common Council, and President
Liddle ordered that the same be placed on filet the said income statements showing
a net profit in the Light Department for the month of December 19339 of $101,601.89,
and a net income for that month of 481321.46; net profit in the Light Department for i

The application of the Minneapolis Brewing Company for an Off
le license to sell non -intoxicating malt liquors at No.109 Center Street East, was
ad, and upon motion by Dallman, second by Amundsen, license was granted.
The applications of the Kahler Corporation(2)9 Minneapolis

ins, were each read, and upon motion by Hicks, second by Norton, permits were

Circular from Dr. A. He Marshall,of Charleston, Missouri, ( I
elative to his plan for re -financing the outstanding government and municipal
ndebtedness, was laid before the Common Council, and President Liddle ordered that

The City Clerk presented a statement showing the result of
an months operation of the City Filling Station, i.e. from,March lst,1933, to
ecember 31st,1933, during which time 30,310 gallons of gasoline were issued to

resident Liddle ordered that the said statement be placed on file.
Upon motion by Norton, second by Hicks, prior orders relative to
he purchase of gasoline for City Departments were cancelled and the City Clerk was
uthorized and directed to purchase gasoline for issuance to various City Departments.

Fidelity individual bond No. F.B. 158193 issued by
the Aetna Casualty & Surety Company in favor of the City of Rochester,
Minnesota, covering Charles Shielas, as Treasurer of the Rochester Hire
Department Relief Absociation, as surety in the amount of .14,326.00, was
read, and upon motion by Amundsen, second by Miller, the said surety was
accepted, the said bond was approved, and it was ordered that the same
be placed on file, and further that the Mayor execute a superseded surety
ship rider,in duplicate, for policy No. F.B. 158193 and a cancellation and
release of individual bond No. F.B. 155096.

Reiter concerning continuance of C.W.A. local employment, was read, and

Mayor's telegram. j
The following copy of tesolution passed and adopted
by the Olmsted County Board of Commissioners, was read, and upon motion
by Norton, .seoond by Amundsen, the City Clerk was instructed to forward a
copy of the same to Governor Floyd B. Olson with the endorsement of this
Common Council on the County Board action taken:
" RESOLUTION
WHEREAS, the Federal Government through the Civil Works
Administration has set up a program of reemployment, and
WF+.ERFAS, Olmsted County has a population of approximately
35,000 people of which approximately 2,500 have registered for
employment under said Civil Works Administration programs, and
WHEREAS, there have been approximately 1,000 families on
the Olmsted County relief list for which Olmsted Bounty has expended
$133,333469 direct relief and approximately $159000.00 work relief
di,iring the year 1933 ,. and
WHEREAS, approximately 900 men have been alloted to 01#sted
County and are now employed on sutsh projects, which still leaves
1600 men registered and unemployed.
NOW, THEREFORE, Be it and it is hereby resolvedby the County
Board of the County of Olmsted, Minnesota, that said County Board
hereby petitions His Excellency, Floyd B. Olson, Governor of the State
of Minnesota, as State Emergency Relief Administrator to allot an
additional 500 men to Olmsted County in order that said condition may
be further relieved.

A copy of the minutes of the meeting of the
Commissioners of the Sinking Fund of the City of Rochester, Minnesota, held
at 1:45 o'clock P.M., on January 2nd, 1934, was read, and upon motion by
Dallman, second by Amundsen, the actions set forth therein were approved,
and it was ordered that the same be placed on file:
A copy of an agreement with the Sinclair Refining
Company as to the purchase of lubricating oil, executed by the Mayor under
date of January 3rd' .1934, was read, and President Liddle ordered that the
same be placed on file.
The resignation - of Wm. Fitzgerald as. a member of
the Police Civil Service Commission, dated.January lOtb.91934,,was read, and
upon motion by Norton, second by Amundsen, it was accepted.
Upon motion by Miller, second by Moody] the City Clerk
was authorized and'directed to make a requisition upon the Civil Works
Service for female help to do the field work necessary for changing the
precinct lines in the Third Ward.
The following request for authority was read, and
upon motion by Amundsen, second by Norton, it was granted, subject to the
supervision of the City Engineer:

Gentlemen:
Due to the replacement of the present bridge on
Fourth Street between Broadway and First Avenue, S.E. , it becomes
necessary for the Tri-State Telephone & Telegraph Company to remove
three 600 pair cables and place them temporarily to the north on
poles during the construction, and upon completion to replace them
into conduit which will be placed during construction of the proposed
method as shown on print #2 of those attached meets with your approval.
On this same proposed Estimate #11, of which print#3 is
also attached, we propose, after receiving your approval, to make
several improvements in our plant in,scattered locations, which
consists namely of placing several poles on private ri.-;ht, of way to
better serve the particular locations and to remove several poles and
anchors from those streets shown.
Two sets of prints will be found attached, one for your
file, and kindly return the other approved if permission is granted
to proceed with the work as specified

Alderman Norton introduced the following resolution,
which vas Lead:
" Resolution determining the transfer and changing
the funds levied, collected, and invested for an
addition to the public library building, to make the
same available for the construction of an addition to

the present library building, or for the construction
of a new library building.
WHEREAS, Tax levies have been made at the request of the Public
Library Board of the City of Rochester, Minnesota, for funds to provide an
addition to the local public library building•, and tax collections have been made
for that purpose, and
WHEREAS, The said tax collections have accumulated and been
transferred to the administration of -the Sinking Fund Commission of said City,
who have invested these funds in interest bearing securities, which account is
now known as "Sinking Fond Investments for Library Addition," which Sinking Fund
Investments have a par value of $50,8000,009 and a book value of $50,841.51, both
at December 31919339 and
WHEREAS, It is proposed that a new public library building
be constructed, and
WHEREAS, It is deemed necessary that to use the above mentioned
Sinking Fund investments, that the purpose thereof be changed to make these funds
available for the construction of an addition to the present library building, or
for the construction of a new public library building, and
SO THEREFORE, Be it resolved by the Common Council of the City
of Rochester, Minnesota:
That the purpose for which the above mentioned Sinking Fund
investments of $509800,00 par value, and $509841.51 book value, were levied,
collected and invested, be changed from Funds for the construction of an addition
to the present library building so that the same may be used either for an addition
to the present public library building,or for the construction of a new public
library building, either of which must be within the City of Rochester, Minnesota,
and%
Be it further resolved by the said Common Council:
That this resolution shall take effect and be in force upon the
same being adopted by the affirmative vote of a majority of the members of the
Common Council of the City of Rochester, Minnesota, and the approval ,of a majority

That there is hereby called a special election to be held in

Alderman Norton introduced a resolution ordering
plans, profiles, specifications and est Jmate of cost for the construction of a
siphon section of trunk line sanitary sewer in parts of Third Street Southeast
and Third Avenue Southeast, and ordering that a part of the said construction
be paid for by special assessments levied as provided by law, which was read.
Upon motion by Norton, second by Amundsen, that the said
resolution be adopted as read, and all voting in favor thereof, President
Liddle declared the said resolution duly passed and adopted.
The City Engineer submitted plans, profiles, specifica-
tions and estimate of cost for the above mentioned siphon section of trunk
line sanitary sewer.
Alderman Amundsen introduced the following resolution,
which was read:
"WF[EREAS, the Common Council of the City of Rochester,
Minnesota, at a meeting thereof held on January 15th,19349 after due notice
given and hearing had as provided by law, did duly pass and adopt a resolution
ordering that a ' siphon section of trunk line sanitary sewer be constructed
commencing ten (10) feet east and ten (10) feet north of the center lines of
Broadway Street South and Third Street Southeast, and running northeasterly
three hundred and sixty-five (365) feet to a point fifty (50') feet south of
the south line of Third Street Southeast, thence northeasterly one hundred and
thirty-five (135) feet to a point fifteen (15) feet south of the north line
of Third Street Southeast, thence southeasterly fifty-seven and six tenths

(57.6) feet to the center lines of Third Street Southeast and First Place Southeast,
thence .east to the center of Third Av:en,(16 Southeast and Third Street Southeast,

said resolution directed the City En,,?ineer of said City to prepare and file in the

Council an estimate of the cost . and expense of said siphon section of trunk line
sanitary sewer, amd said City Engineer pursuant to said directions did on January
15th, 19349 file in the office of the City Clerk of said -City, plans, profiles,
and specifications for the said siphon section of trunk line sanitary sewer, and
did report •to the said Common Council an estimate of tre cost and expense of
constructing the said siphon section of trunk line sanitary sewer;
THEREFORE, Be it and it is hereby resolved by the Common Council,
of the City of Rochester q Minnesota;:
That the plans, profiles and specifications for the said siphon sect
of hunk line sanitary sewer so filed by • said City Engineer in the office of the
City Clerk, be and the same are hereby adopted as the plans, profiles and specifi-
cations for the said siphon section of trunk line sanitary sewer, and that the said
estimate of cost, of the said siphon section of trunk line sanitary sewer, reported
to said Common Council be and the same is hereby accepted, and each are ordered
filed in the office of'the City Clerk: ,
Be it further resolved by the said, Common Council: That a part of
the whole cost and expense of the construction of the said siphon section of trunk
line sanitary sewer shall be assessed, as provided by law, against each lot, piece
and parcel of land benefited by the improvements to -wit: - Against each and every
lot, piece And parcel of land abutting upon the said siphon section of trunk line
sanitary sewer without regard to cash valuation, ratably and in proportion to the
special benefits conferred by the said siphon section of trunk line sanitary sewer,
respectively upon each said lot, piece and parcel of land.
Be it further, resolved by the said Common Council:. That a meeting
of the said Common Council will be held at 2:00 o'clock P.M., on February 5th,1934,
in the Council Chambers, in the City Hall, in said City, at,which meeting all
persons interested in the said siphon section of trunk line sanitary sewer may
appear and be heard before said Common Council in relation to the said siphon sectio
of trunk line sanitary sewer or to the mode of the assessment for the cost and expen
ee • thereof , or any other matter or objection -relating to the said siphon section of
trunk line sanitary sewer upon which they may desire to be heard;
Be it further resolved by the said Common Council: That the City
Clerk of said City is hereby ordered and directed to prepare a list -which will
contain a, description of each and all of the properties abutting upon the said
siphon section of trunk line sanitary sewer above described, and the sames of the
owners of the said properties so far as the same are known, which list, together witl
a notice of the time, place and purpose of the said meeting and hearing above
mentioned, he -shall cause to be published once in the official newspaper of said
City at least ten days prior to the date of said meeting and hearing.
Be it further resolved by the said Common Council: That the City
C1etk of said City be and he is hereby ordered and directed to advertise for bids,
as provided by law, for the furnishing of all the equipment, tools, materials, etc.,
and doing all of the work necessary for the construct ion of the said siphon section
of trunk line sanitary sewer above.described, said bids to be received and opened
by said Common Council at a public meeting thereof to be held at 2:00 o'clock P.M.,
on February 5th; 1934, in the Council , Chambers, in the City Hall, in said City.
Each bid muet be accompanied by a certified check for at least ten per cent of the
amount of the bid, and this Common Council reserves the right to reject ' arty and all

Upon motion by ?.goody, decond by Norton, that the said
resolution be adopted as read, and all voting in favor thereof, President

Alderman Miller introduced the following resolution,
whi ch was read:
"Be it resolved by the Common Council of the City of
Rochester, Minnesota:
That the sum of 33730,00 be and the said sum is hereby
appropriated from the Park Improvement Fund of said City and ordered paid to
Botsford'Lumber Company, for fence constructed at Mayo Field, in accordance
with contract.
The Mayor and City Clerk are hereby authorized and
directed to draw a warrant for said sum upon the City Treasurer in accordance
herewith, and cause said payment to be made."
Upon motion by Amundsen, second by ?Miller, that the
said resolution be adopted as read, and the "Aye" vote of Amundsen, Miller,
Norton, and Liddle, and the "Nay" vote of Dallman, 'Ticks, and Moody, Presi-
dent Liddle declared the said resolution duly passed and adopted.
Alderman Hicks introduced the following resolution,
which was read:
"Be it resolved by the Common Council of the City of
Rochester, Minnesota:
That the sum of $2162.87 be and the said sum is
hereby appropriated from the Firemen's Relief pond of said City and ordered
p^,id to Charles Shields, Treasurer of the Rochester Tire Department Relief
Association, the same being the amount on hand from tax collections and
Public Utility Income tax payments for the relief of Firemen, their widows
and orphans, etc.
The Mayor and City Clerk are hereby authorized and
directed to draw a warrant for said sum upon the City :T'reasurer in accordance
herewith, and cause said payment to be made."
Upon motion by Miller, second by Amundsen, that the

Alderman Dallman introduced a resolution appropriating
$340.49 from the General Fund and ordering payment made to the Co -Operative
Oil Company for 2735 gallons gasoline furnished at the City Pilling Htation
during December,19339whi ch was read. -
Upon motion by Amundsen, second by Millers that the
said resolution be adopted as read, and all voting in favor thereof, Presi-
dent Liddle declared the said resolution duly passed and adopted.

Upon mot ipn by Moody, second by Dallman, the City Engineer was
instructed to serve notice Ripon ,the Reid Murdoch Company that -they shall not empty
any solids into the sewer system of the City of Rochester, Minnesota, nor into the
Zumbror diver.
Upon motion by Norton, second by Amundsen, the City Attorney was
-ranted leave of absence of not'to exceed thies weeks commencing January 18t h,1934.
