Meeting called to order by President Liddle,
Roll Call. Present: Liddle, Amundsen, Dallman, Hicks,
Miller, Moody, Norton. Absent:Ntone.
This being the time and place fixed for the opening of
proposals for the purchase of. a $1,000 00 Certificate of Indebtedness, the
following bid was opened and read:

We, the Sinking Fund ,Commission of the City of
Rochester, Minnesota., offer par and accrued interest for the
$1,000.00 City of Rochester, .Minnesota, 4e,, Certificate of
Indebtedness, dated February lst919349 and maturing Feb.lst,
1935, which is offered for sale at this time, being an offer
of ,1000.00 principal, and $,60 for accrued interest.

Alderman Hicks introduced the following resolution,
which was read:
"Be it resolved by the Common Council of the City of
Rochester, Minnesota:
That the bid and offer of the Sinking Fund Commission
for ,$1,000.00 City of Rochester, Minnesota, 4A% Certificate of Indebtedness,
dated February lst919341, and maturing February 1st 91935, being $1900040
principal on saiddcertificateeOff indebtednesss n

favorable proposal for the said certificate of indebtedness, and

the above mentioned purchase price; the said payment of principal and
accrued interest to be placed in Code 10 of the General Fund of said City."
Upon motion by Moody, second by Amundsen, that the said
resolution be adopted as read, and all voting in favor thereof, President Liddle
declared the said resolution duly passed and adopted.
Alderman Hicks introduced the following resolution, which was
read:
"Be it resolved by the Common Council of the City of Rochester,
Minnesota:
That the, sum of $1,000000� be and the said sum is hereby appropriate
from the General Fund (Code 10) of said City and ordered paid to City Farm Fund, as
the proceeds from the sale of a $11,000.00 City of Rochester, Minnesota, 4�% Certifi-
cate of Indebtedness No.109 dated Bebruary lst,1934, and maturing February lst919349
issued for the purpose of financial assistance to the City Farm.
The Mayor and City Clerk_ are hereby authorized and directed to
draw a warrant for said sum upon the City Treasurer in accordance herewith, and cause
said payment tobe made. "
Upon motion by Moody, second by Amundsen, that the said
resoluti as be adopted as read, and all voting in favor thereof, . President Liddle
declared the said resolution duly passed and adopted.
President Liddle announced this as being the time and place
fixed for a hearing on the construction of a siphon section of trunk line sanitary
sewer in parts of Third Street Southeast, and Third Avenue Southeast, and asked if
there was any person present who wished to be heard concerning this improvement.
Herman J. Klinsmann questioned the eficiency of the project, in

that it will not be deep enough to drain basements, and John Powderly made a plea
.for the construction of this ,siphon section of trunk line sanitary sewer in order
that, all the cesspools which dump their affluent .into the Zumbro River can be
e likinat ed.
This being the time and place fixed for the npening of proposals
for the construction of the above mentioned siphon section of trunk line sanitary
sewer, the following proposals were opened and read:
Fraser & Feller: Total bid for construction, lump sum, *119550.00;
Christensen Contractors, Inc.: Total bid for construction,

Upon motion by Hicks, second by Amundsen, the above mentioned
of
proposals were referred to the City Engineer for tabulation and recommendations, with
instruction that the said recommendations shall come to this Common Council at this
meeting.
The following concerning P.W.A. Docket No.1473, were read, and
President Liddle ordered that the same be placed on file:

Herewith are certified copies of resolution passed and
adopted by the Common Council of this City at a meeting, thereof held
January 29th,1934, amending and correcting resolution passed January
22nd, 19 34 , concerning P . W. A. Do ck et No .1473.
In that connection I will say that I took up with the
Common Council at the meeting of the 29th, the matter of whether
or n6t they wanted to award the contract for the one section of
trunk line sanitary sewer without having a definite word from
Washington as to whether it is going to be all right to change the
purpose for the use of funds we have on hand, and their decision
was that they will await Washington's approval or rejection of the
scheme, so respectful request is made that you sPeed up National
Headquarters' declaration on the sijbject, one way or the other, so
that we may have it for action thereon at the meeting of this Common
Council, which is scheduled to be held at 2:00 o'clock P.TA. ,
February 5th91934.
I am also enclosing herewith certified copies of resolu-
tion passed and adopted by the Public Utility Board of this City,
authorizing the change in purpose for the use of funds heretofore
appropriated by them toward the trunk line sanitary sewer construc-
tion costs.

the matter of modification, of the project by the elimination
of part of the trunk line sewer construction to Washington.
Please be advised that there is no objection on the part of the
Administration to abandoning one section of the trunk line sewer
as proposed by your Council.

above project. A letter relative to the approval of abandoning a
section of the trunk line sewer was sent you yesterday.

WHEREAS, the Public Utility Board did,on August 28th 19339 appropriate
to the Sewer Fund of the City of Rochester, the amount of $369413.51
for the installation of a trunk line sanitary sewer in Broadway Street
North and South from Fourth Street Northeast to Sixth Street Southeast
and Southwest tc�;eth::r :grit'' a syphon section of trunk line sanitary
sewer running in Broadway street south in Third Street Southeast to
Third Avenue Southeast and in Third Avenue Southeast from Third Street to
Fourth. Street, and
Whereas, according to a .resolution adopted January 22-id 1934 by the
lion. Common Council, it is deemed expedient and necessary that the
proposed construction of a trunk line sanitary sewer in Broadway Street
South from Third Street Southeast to Sixth Street Southeast be a,bar.doned
due to lack of funds -thus allowing the use of $109567.66) for the balance
of the said project,
TFERRFORE, be it and it is hereby resolved by the Publi c Utility Board
of the City of Rochester, Minnesota that the said amount of $109567.63 be
used for the balanoe of the project subject to the approval of the. Public
Works Administration."
Alderman Dallman introduced the following resolution,whieh was rea
"WHEREAS, In a resolution passed and adopted by the Public Utility
Board of the City of Ro chester i Minnesota, August 28th,19331 :110 ,567.63 was appro-
priated from the Public Utility Fund of said City, for payment to the Sewer Fund of
said City, as 70% of the estimated cost of the construction of a trunk line sanitary
sewer section in Broadway Street, South, from TLI r`i Street Soutr F,tist to Sixth Street
Southeast and Southwest, and
WHEREAS, It has been found necessary to eliminate the construction
of this section of trunk line sanitary server f. rcm the program which was proposed at
the time the above mentioned appropriation was made, due to the lack of funds to
cover the three sections concerned, and
-'WHEREAS, The Public Works Administration, under date of January
31st, 1934, leave agreed that thin particular section may be eliminated and the funds
concerned applied on the construction of a trunk line sanitary sewer in Broadway
Street North and South, from Fourth Street Northeast to Third Street Southeast, and
on a siphon section of trunk line sanitary sewer in parts of Third Street Southeast
and Third Avenue Southeast, all of w':.ich_.ic under IP W:A.Docket No.1473, and
WHEREAS, The Public Utility Board of said City have, under date of
January 30-t li,1934 , passed and adopted a resolution authorizing the change of purpose
for which the 'y"109567.63 above mentioned was appropriated, and have thereby author-
ized the use of the said sum to apply on the construction of the above mentioned
trunk line sanitary sewer section in Broadway Street North and South, and the siphon
section in Third Street Southeast and Third Avenue Southi,-w5t;

Rochester, Minnesota:
That the said $10,567.63 heretofore received into the Sewer Fund
to apply on the construction of a trunk line sanitary sewer in Broadway Street South,
from Third Street Southeast to Sixth Street Southeast and Southwest, be appropriated
to the Sewer Fund of said City, to apply on the construction of a trunk line sanitary
sewer in Broadway Street North and South, from Fourth Street Northeast to
Third Street Southeast, and toward the construction of a siphon section of
trunk line sanitary sewer in Parts of Third Street Southeast and Third
Avenue Southeast.
The Mayor and City Clerk are hereby authorized and
directed to draw a warrant upon the City Treasurer and make payment
accordingly*"
Upon motion by Hicks, second by Amundsen, that the
said resolution be adopted as read, and all voting in favor thereof,
President Liddle declare;1 the said resolution duly passed and adopted.
Alderman Amundsen introduced a resolution accepting
the proposal of Christensen Contractors, Inc., for the construction of a
trunk line sanitary sewer in Broadway Street North and South from Fourth
F Street Northeast to Third Street Southeast, and fixing the amount of the
surety bond to be given by the said contractor at the sum of %139,9290009
which was read.
Upon motion by Moody, second by Hicks, that the said
resolution be adopted as read, and all voting in favor thereof, President
Liddle declared the said resolution duly passed and adopted:

rejected, the project was abandoned, and it was ordered that the certified
checks filed by the bidders be returned to them.
Upon motion by Amundsen, second by Hicks, it was
ordered that the certified checks of the unsuccessful bidders for the
construction of the trunk line sanitary sewer in Broadway Street North
and South, from Fourth Street Northeast to Third Street Southeast, be
returned to them.
This being the time and place fixed for the opening
of proposals for -the furnishing of a motor driven flusher -sprinkler, the

President Liddle referred the above quoted proposals for the
furnishing o f a mot or driven flusher -sprinkler to the City Engineer for his tabula-
tion and recommendations.
An ordinance regulating the sale of intoxicating liquors within
the City of Rochester, providing for such sales by duly licensed persons, establishi
regulations for the operation of places where such intoxicating liquor is sold, pro-
viding regulations for the granting of such licenses, setting license fees, providing
penalties for the violation thereof, and repealing of inconsistent ordinances, was
given its third and final reading.
Upon motion by Norton, second by Moody, that the said ordinance
be adopted as read, and all voting in favor thereof, President Liddle declared the sa
ordinance duly passed and adopted.
An ordinance prohibiting any minor misrepresenting his or her ag
and. stating that he cr she is 21 years of age or over, to any business place in the
City of Rochester, having an "On Sale" or "Off Sale" liquor license for the sale of
intoxicating liquor was given its third and final reading.
Upon motion by Hicks, second by Amundsen, that the said ordinance
be adopted as read, and all voting in favor thereof, President Liddle declared the
said ordinance duly passed and adopted.

was read, and President Liddle ordered that the same be placed on file:

Dear Sir:
We have examined the estimate of quantities show._ in
your letter of January 27th and the accompanied drawings, both of
which describe -the extra work involved in the construction of the
14th St .N.W.bridge and for which you have requested approval.
We are unable to check the quantitt of extra piling shown
in your estimate as required for the West Abutment. The drawing shown nine (91,,
piles under the South wing wall of this abutment in the original plan, which
apparently have not been credited in your estimate. We have checked the
unit prices shown in the contract agreement and find that these are correct,
except that no price had been agreed upon for extra work involving piling,
and it is, -therefore, probable that is is your intention to install the
piling under a force account agreement with the contractor.
In any event, as we understand it, the quantities and costs shown
in your letter are based on' an estimate only and, therefore,, on the assump-
tion that your inf ormat ion is reasonably complete and that the figures are
a substantial and. reasonably estimate of the probable cost, which is estima-
ted to be $1,1059,66, we hereby approve the construction of this extra work.

At a msrt- inn of the Common Council of t' e City of
Rochester, held in the Council C4amber on the 15th clay of
Jaruary 1934, the matter of the use of City Se-Frers and the
discharge of Certain Wastes into the.Sewers and Streams in
the city was infoirnally discussed by the T''onorable douncil.
At the suggestion of the City Clerk, the :following
motion was made, seconded, and carried: "The City Engineer
serve notice upon the Reid -Murdoch Company, that they shall
not empty any solids into the sewer system of the City of
Rochester, Minnesota, nor into the 1umbro River."

In regard to my accident I had on, Jan.30th. 1934 between
' 1-30 and two'o6lock, lwas standing'on a four foot ladder and the
ladder skidded, I fell on the edge of Miss Sveon deck.
The next day I felt it in my back, foot, and the cords in
my right leg so much pain that I am still layed up in bed with pain
from this Accident.
