Christenson, as executor of the estate of Frank E. Williams, presented and read his report on the administration of Mr. Williams' estate, and upon motion by Hicks, second by Amundsen, the said report was accepted it was ordered that the same be placed on file. Mr. Christenson presented his check for 09.25 as being the balance of funds on hand after the final accounting for the Frank E. Williams Estate, and upon niution by Ricks, second by Amundsen, the suid p'69.2b was accepted into the Frank E. Williams Estate Fund in the City Treasury of said City, ,which Frank E. TTpon motion by Da.11man, second by Amundsen, the On Sale license No-8 to sell non -intoxicating malt liquors, and Off Sale License No.17, to sell non -intoxicating malt liquors , both at No.2 Droadway Street North, heretofore issued to harry Dr.ossos, were cancelled. The On Sale li quor license bond of Harry Drosos, with the Seaboard Surety Company as surety thereon in the amount o f f°�39000.00 , was read, and upon motion by DallmL, second by Amundsen, the said surety was accepted$ the said bond was approved, and it was ordered that the same be placedon file. The followinrr communication was read, and upon motion by !Ticks, second by Moody, the proceedings mentioned therein were cancelled, and it was o rdere4 that the fee whi ch accompanied his application for Off Sale intoxicating liquor license, 0133.32, be returned to him: "Rochester, Minnesota, February 2lst , 1934. The application of George R. Schultz, for an On Sale intoxicating liquor license at No.313 First Avenue Southwest, was read, at which the Common Council took recess for five minutes for discussion of the application, after which they returned to the Council Chambers and a motion by Alderman Moody, that the license be not granted, received no second. Motion by lT.i ck s , second by Dal loran, carried that the application of George R. Schultz, above mentioned, be returned to him without explanation. Common Council o L' the said City be and is hereby requested to authorize the said Board to enter into a contract with the- Fullerton Lumber Company for the furnishing to the, said City, in accordance with specifications and with their bid dated Feb. 27, 1934 of five 45' 9" top; ten 40, 8" top and thirty 35' 8" top" Western Red Cedar Poles together with 125-12' long Round Peeled Western Red Cedar Pole Stubs. You request an interpretation and opinion on Section 1933, sub -section 18 of Mason's Minnesota Statutes and especially the meaning of the following, "Said authority shall be initiated by a petition siarned by tenvillageo 'as shown by the last regular municipal election." In my opinion this means that the petition mast have the names of at least ten percent of the names of the legal voters wvlo were actually registered in your office as those qualified to vote at the last municipal election. In other words a registered list of ten thousand voters would require one thousand names on the petition. I trust that this gives you the desired Information. Very truly yours, • James T. February 2,691934. City Clerk, Rochester, Minn, Dear Sir: It has been called to our attention that off -sale and on -sale jl licensees operating erclusive liquor stores are selling other merchandise j in addition to liquor as well as holding dances in connection with the opera- tion of such stores. " I wish to call your attention to an o_rdnion of the Attorney General's Office which reads as follows: i j 'Is it legal for an 'exclusive liquor store' to sell any articles of merchandise other than intoxicating liquors?' An exclusive liquor store can only sell intoxicating liquors. i Section 1 of Chapter 46 specifically states that: ' 'Exclusive liquor store' as herein used j shall be an establishment used exclusively ! for the sale of intoxicating liquor at retail, either on -sale of off -sale, or both.' 'This section very definitely states that only intoxicating liquor can be sold ;j in such a store. Cigars, cigarettes, other forms of tabapeo, non-int oxicating malt liquors, candy, food, soft drinks and all other articles of merchandise, i except intoxicating liquors, cannot be sold in an exclusive liquor store. This statute does not, however, prohibit the use of so-called mixtures' to be used �i only in connection with the preparation of the, various forms of concoctions made out ofthese 'mixtures' and intoxicating liquors.' Wells -to- City of Rochester, N.Y: There has been forwarded to us a statement charging Charles L.wells and this company with the sum of $25.9`.; for repairs to pavement. According to the information tl-,at has been furnished to us,, this company executed a bond from March 39 1932 to March 3,1933. It seems that some time during the month of April, 3.932, Mr. Wells obtained a permit to open the pavement; that he put the pavement back in shape a!_,parently under date of June lst,1932. We understand that the size of the opening Mrs Wells made was about N2' x 4'. Will you please lot us know if the entire charge was for work done by Mr.Wells at the time he replaced the opening, and in what way it was defective? Will you also advise if this defect occurred more than a year after it was replaced by Mr. Wells and if some of the other pavement adjacent to this particular opening was not also bad? Our experience in Chica!_,o is that because of- a sand foundation which shifts that holes very often develop in the pavement and we wonder if such is not the case in Rochester. We are advised by Mr. Wells that he replaced the opening j with like material and that the concrete used was properly mixed, with wood creosote -blocks placed on top. If there is an obligation on the part of Vois company under this bond, we want to discharge it. At the same time, we are calling these matters to yourattention because we know you will make due allowance for due wear and tear of the pavement and will not want to assess damages if a further investigation indicates that there is merit in Mr. Well? s contention. Alderman Dallman introduced a resolution appropriating LI13.391 from the General Fund, Code 8, and ordering payment made to the Light Departmemt Depreciation Reserve Investments for interest due March 191934, on City of Rochester, Certificate of Indebtedness No.9, which was read. Upon motion by Dallman, second by Moody, that the said resolution Ibe adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. The Common Council canvassed the result of the Primary Election held. on February, 27th 91934. Alderman Hicks introduced the following resolution,which was read: "Be it'resolved by the Common Council of the City of Rochester, Minnesota: That the .following is a tabulated statement of the number of the: votes cast for each person at the Primary. Election held on the 27th day of February, A.D. 1934, in the City of Rochester, Minnesota, as determined by said Common Council on the canvass of the returns of the said Primary Election made the 28th day of February, 19349 and that the said tabu- lated statement is hereby declared to show the results of the said Primary Election. Upon motion by Dallman, second by Amundsen, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Miller introduced the following resolution,which was read: "Be it resolved by the Common Council of the City of Rochester, Minnesota: That the sum of $3063.75 be and the said sun is hereby appropria- ted from the General Fund (Code 7) of said City, and ordered paid to Electric Lift Bond Sinking Fund Investments for the March lst919349 maturity of City of Rochester 4' ° Certificates of Indebtedness dated March lst,1933, being 3 certificates of $1,000.00 each, numbered 29 3, and 49 $3,000.00 of the said sum being for principal on the said certificates egad $63.75 thereof being for interest due March lst,19349 the said certificates of indebtedness having heretofore been issued to provide funds in the Mayor's Contingent Fund. The Mayor and City Clerk are hereby authorized and directed to draw a warrant for said sum upon the City Treasurer in accordance herewith, and cause said payment to be made." Upon motion by Moody, second by Hicks, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Moody introduced a resolution authorizing the Public Utility Board to enter into contract with the Fullerton Lumber Company in accordance with their above quoted resolution request, and fixing the amount of the bond to be given by the said contractor at the sum of $1245*00 9 which was read. Upon motion by Hicks, second by Moody, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. W_pdn motion by Hicks, second by Dallman, the City Engineer was authorized to expend not to exceed $199.00 for the repair and painting of equipment in his charge. Alderman Miller introduced the followigg;,revolution, which was read: "WHEREAS, Mason's Minnesota Statutes, under Sections 1933-17, 1933C19, 1933-19, 19'33-209 1933-21 and 1933-229 as amended by Chapter 171 of the Session Laws of 1931, provides the p8ocedure for levying of funds for furnishing a band fund, and WHEREAS, The signatures of sufficient legal voters of the City of Rochester, Minnesota, have been presented to this Common Council asking for submittin the question, 'Shall a tax of not exceeding one (1) mill be levied each year for the purpose of furnishing a Band FundV . 18 So TFFRFFORE, Be it reeolved.by the Common Council of the City of Rochester, Minnesota.: That the question, 'Shall a tax of not exceeding one (1) mill be levied each year .for the furnishing of a Bend Fund,' be submitted to the legal voters of the City of Rochester, Minnesota, at the annual Charter Election which is to be held within said City on Tuesday the 13th day of March, A.D. 19349 for their approval or re,j ection, and that the polls shall be kept open from 9:00 o'clock in the forenoon until 7:00 o'clock in the afternoon of said day at the regular polling places within said City, and Be it further resolved by the, said Common Council: That the ballots tc be used for the submitision of the said question shall be printed under the' direction of the City Clerk of said City on lavender paper, and a sufficient number furnished in advance to the judges of each election district for use upon the quest ion,whi ch ballots shall be sub- stantially in the following form: "B ALL OTT FOR VOTING UPON EANTD FUND QITESTION, MARCH 13th,1934.
