My dear Mr. Spillane: we have been invited to participate in the annual cooking school sponsored by the Rochester Post Bulletin, and as a part of the advertising program in connection with this cooking school we should like to sell one of our .modern gas ranges to the. highest bidder: The tentative plans are as follow: An identification card will be handed to each lady as she enters the building and during the course of the demonstration our feature range will be used on the stage* As. she leaves the building she will be permitted to place her bid on this..particular range (the `regular retail sale price will be made knwwn) and the range will be sold to the highest bidder for the amount of the bid at the end of the cooking school* I understand the City of Rochester has an ordinance which prohibits auctions in certain sections of the city without a license. Naturally we do not wish to incur the ill -will or the expense which would be incident to an audtion in the ordinary sense of. thef-term, andI will be pleased to have your advice as to whether or not an .arrangement of this kind would be in violation of° existing ordinances The• procedure_ which has been followed in the past has been that of giving away a range free.- -However, it has been deemed inadvisable in view of the N*R.A4 requirements which do, not permit us to sell any article below cost or to allow free premiums of any kind. 1 Only one transaction will be involved, and it would seem to me that such a plan coulc not be considered an' auction in the ordinary sense of.the term., Your courtesy in rendering an opinion on the subject will be greatly appreciated.. .
