Minutes of an adjourned regular meeting of the Common
Council of the City of Rochester, Minnesota, held in the Council Chambers,
in the City Hall, in said City,' at 7:30 o'clock PDX.', on March 29%h91934.
Meeting called to order by President Liddle:
Roll Call. Present: Liddle, Amundsen, Dallman, Hicks,
Miller, Moody, Norton: Absent: None.
Upon motion by Hicks, second by Moody, the minutes of
the meetings held on March 5th,19349 March 14th,19349 and March 20th,19349
were each approved:
President Liddle announced this as being the time and
place fixed for a hearing on the sprinkling or treating of streets,
avenues and alleys during the season of the year,1934, and asked if there
was arW person present who wished to be heard on the subject
There was no person present who wished to be heard
relative to sprinkling or treating of streets,ayenues or alleys during
the season of 19344
Alderman Dallman introduced a resolution ordering
sprinkling or treating of certain designated streets, avenues and alleys,
from April 191954, to November lot 91934 9 and ordering that the City
Engineer secure the necessary horses, teams, labors water and materials,
and do the said sprinkling or treating by City Force account, which was
read:
Upon motion by Dallman, second by Amundsen, that the
said resolution be adopted as read, and all voting in favor thereof,
President Liddle declared the said resolution duly passed and adopt,pd.
The City Clerk. reported that no bids had been
received for the furnishing of all labor, materials, tools, equipment,
etc., necessary for the repaving with Noel *2 vitrified out lug paving
brick of First Street Southwest from the West line of Second Avenue
Southwest to the west line of Fourth Avenue Southwest, the removal of the
old crossings on the north side of First Street Southwest at Third Avenue
Southwest and Fourth Avenue Southwest, and the laying of a concrete paving
base to the north line of the street at each. of the said intersections.
Upon motion by Am=dsen, second by Miller, the City
Engineer was instructed to secure the necessary labor, materials, tools,
equipment,etc., and make the above described improvements by City Force
Account, all of which will be in accordance with the plans, profiles,
acid specifications for the same which are now on file in the office of
the City Clerk of said City.

In accordance with this being the day and date fixed for the
dissolving of a tie vote for Constable of the Third Ward of said City, between
Elmer Grimm, C. Be Conaty, and M. L. Priebe, lots were drawn and the selection
fell to ' Elmer Grimm, at which notion by Hicks; second by Amundsen, carried that
Elmer Grimm be declared elected to the office of Constable of the Third Ward of
said City.
The following remonstrance against the sprinkling of Seventh
Avenue Southwest, was read, and upon motion by Norton, second by Hicks, it was
referred to the Water and Sprinkling Committee:

We the undersigned property owners wish to have the
sprinkling on Seventh Ave. S.W. from the north line of Lot 4
Block 4 Wm. Healey & corn -forth Add, and the north line of Lot, 18
Block 2 Wm. Healey & Cornforth Adde and south to Eleventh St. S.W.
discontinued as about 90% of these lots are vacated or only two
houses and there is a very small amount of traffic.

The following communications were read, and upon motion by Hicks,
second by Dallman, the City Engineer was authorized to proceed in accordance with
the request of the Mayo Properties Association, subject to the approval of l[he
Wm. N. Carey, State Engineer, p,W.A.:

Gent lemen:.
Mr. A.JQLobb, representing the Msyo 'Properties Association, has
requested of this department, that a change be made in the alignment of the
North Retaining Wall of the West Abutment of the bridge in 4th Street South-
east, across the,Zumbro River.
The plan, as made and approved, and which is a part of the contract
for the bridge construction is as herein described:
Fast face of West Abutment bear North 100 East, a distance of
22' Q" north of center line of roadway, thence north 300 West 15' 114".
It id the desire, as expressed by Mr. Lobb, that the North Retaining
Wall, be constructed in the same alignment as the abutment on a course of
North 10° East, and not North 30' West as plannedi
'i This change in alignment will move the north end of the Retaining
li Wall 10.25 fte east of the peattion as shown on plan.
This request is made to your honorable body for the reason, that
Mr. Lobb, has expressed a desire on the part of the owners of the property

fronting on 4th Street, between the alley and the river, to construct a
Retaining Wall from the north line of Fourth Street to a point 75 fto north,
and wish to secure the additional frontage on 4th -Street that will become
available if ' the change in position of the Retaining Wall is allowed to be made.

This office has prepared a drWng of the suggested
change in position of the Retaining Wall, and have estimated the
additional cost to mount to $115490.
The costs are made up of the following items:

The drawing will be blue printed, and request for
approval made to Mri W. N. Carey, State Engineer P.W.A., obould
the suggested change meet with the approval of your honorable body.
The writer recommends that the change in plan be approved
upon receipt of communication from the Mayo Properties Association,
requesting that the change be made as herein described.

The Mayo Properties Association hereby requests that
a change be made in the alignment of the North Retaining Wall
of the West Abutment of the Bridge in 4th Street Southeast,
across the Zumbro Rivbr, in accord with the plans and specifica-
tions referred to by'the City Engineer in his letter of March
29th, 1934 to your Honorable Mayor and Common Council; and the
Mayo Properties Association hereby agrees to pay the entire
addit tonal cost resulting from such change in construction.

H. J. Postier, representing the Rochester Automobile
Dealers, asked thatthe north twenty feet of Second Street Southwest+
along the south side of E. Ai Knowlton ComparW store, be roped off during
the automobile show there, April 9th, loth, and llth,19349 and upon motion
by Dallman, second by Amundsen, the request was granted;
General Balance sheet, tri&l balances find statement,
statement of unexpended budget approprietions, etc., prepared by the City
Clerk as of February 28th919349were laid before the Common Council, and
President Liddle ordered ,that the some be placed on file.
The February919349 report of the Building, Electrical,
and Plumbing Inspector, showing building inspection fees collected in the
amount of $2400, electrical inspection $2050, and plumbing inspection $3.75,
was Lead, and President Liddle referred the same to the Finance Committee.
The report of the Clerk of the Municipal Court for the
week ending March 19th919349 showing criminal fines collected 0351.40) civil
fees received $.259 conciliation court fees $3400, court costs charged to
Olmsted County $25.059 fines collected due to Olmsted County $200.00, and fine.
collected and remitted direct to State Treasurer $100.00, and for the week ending
March 26th,19349showing criminal fines collected $197.859 Conciliation court fees
$3.00, court costs charged'to'Olmsted County $29.55, fines collected due to Olmsted
,County $100.00, and fine collected and remitted direct to the State Treasurer,$6.00,
were each read, and President Liddle referred the same to the City Attorney.
Upon motion by Hicks, second by Amundsen, the sum of $100-000
was sppropriated from the General Fund and it was ordered that the same be paid to
Olmsted County, Minnesota, for fine collected onJoase No.10429.
Upon motion by Hicks, second by Amundsen, the sum of $100.00
was appropriated from the General Fund and it was ordered that the same be paid to
Olmsted County, Minnesota, for fine collected on case No.10430.
Upoh motion by Hicks, second by Amundsen, the sum of $100,00
was appropriated from the General. Fund and it was ordered that the same be paid to
Olmsted County, Minnesota, for fine collected on case No.10432.
The applications of T. V. Nagle for a public dance permit at the

Words failed to express my gratitude when I received and read the
Resolutions passed and adopted by your honored body, - of my life and work
in Rochester. Sixty two years of my life have been spent in the beautiful
City of Rochester; and for seven years after coming to Minnesota% my thought
was toward Rochester in favor of my future home and never for one moment
have I regretted it.
When I think of the many Denominations, Orders and Civic bodies
whose aims are for good Citizenship, I thank God that ,I have lifed as long
as I have to enjoy the Good Will of her citizens, and to this end, I wish to
thank you most heartily for the honor you have given me on my
one hundredth anniversary.

Minnesota, did on September 27, 19339 appropriate $39293 00 from funds belonging to
the Water Department of the Public Utility Fund to the Street Agnd Alley Fund of
said City and a further appropriation on November 141, 19331of §199744097, both of
which amount were for the repaving of streets, and
1HEREAS9 there remains unexpended in the Street and Alley Fund
for that purpose appropriations $29856.82 as of February 289 1934, and
]FEREA.8, the Common Council of the City of Rochester, Minnesota,
did on March 59 19349 request that the Public Utility Board authorize the said Council
to use such surplus fund above mentioned for the repaving of First Street Southwest

Upon motion by Hicks, second by Miller, the Health
Officer was rewested to give 30 days extension of time for the installation

Copies of letters written by David R. Arundel, Liquor Control
Commissioner, to local Off7Sale liquor, licensees, were read, and President Biddle
ordered that the same be placed on file;' the said letters being as follows:

Your licenses expires according to our records, on April 2, 1934.
This will require that new bonds be executed as per recent ruling from the
Attorney General's office. The bonds covering the license about to expire,
will not carry over unto the new license.
Accordingly, you will make arrangements to execute enclosed bond

Amundsen, the actions set forth therein were approved, and it was ordered that the
said copies of resolutions be placed on file:

That the sum of $12608094 is hereby appropriated from the Sinking
' Fund of said City and it is o dered that the same be paid to the First National Bank
of Rochester, Minnesota, for 11900040 State of Minnesota, 4 registered Rural
.'Credit Bonds, maturing June lst919549 purchased from the Hirst National Bank of
St. Paul, Minnesota, and forwarded through the said First National Bank of Rochester,

the Sinking Fund of said City to the Public Utility Fund of said City for

Gentlemen:
I have this date received a letter, signed by Mr. R.G+Bergstrom,
Construction Engineer on the New Post Office Bldg., in which he calls atten-
tion to. the fact, that the contract for the construction of the Post Office,
requires the construction of a new curb and, the removal of the old curb.
. Should this be done, there will be a 11� ft. space between the
paving in place and the new curb. The area of the space between 3rd Avenue
and 4th Avenue, amounts to 225 sq. yd.
Should the City consider the paving of this area in connection
with the work of repaving of let Street Southwest, from 2nd Avenue to 4th
Avenue Southwest, we estimate that the cost would be fti,60 per sq* yd., and
will amount to $585000 in addition to the e3timated cost of the repaving
work. This does not include the widenin of Center Street, which will. emount
to 225 square yards of asphalt, to cost 20-OC per sq. yd., or $450.00.
In the event this work is dot6be to done, we beg to advise that
the construction engineer be urged to leave the present curb in position.
