Minutes of an adjourned regular meeting of the Common
Council of the City of Rochester, Minnesota, held in the Council Chambers,
in the Ci A+y Rall, in said City, at 7: 30 o'clock P.M., on April 9th91934.
Meeting called to order by President Liddle.
• Roll Call. Present: Liddle, Amundsen, Fryer, Green,
Lemon, Miller, Moody. Absent: None.
Upon motion by Amundsen second by Moody the minutes
of the meeting held on March 29th,1934, were approved.
The report of the City Weighmaster for the month of
March, 1934, showing weighing fees collectedin the amount of $70.30, was
read, and President Lidele referred the same to the Finance Committee.
The City Engineer's Department trial balance for
March,l934, was laid before the Common Council and President Liddle ordered
that the same be placed on file.
The report of the Public Utility Board for the month of
March91934, as prepared by the Secretary of the Public Utility Board was
laid before the Common Council, and President Liddle ordered that the same
be placed on file; the income statement made as part of the said report
showing a net profit in the Light Department for the month of March91934

of $8982.37 - and a net loss for that month of $2479.29, the/prdfits in the
Light Department foi the fiscal year being W'103,856.21, and net income for
that period of �$3,126.82; the Water Department net profit for March,19349
being $69493.281,

the Steam Heating Department

The annual report of the Public Utility Board as
prepared by the Secretary of the Public Utility Board for the fiscal year end
ing March 3191934, was laid before the Common Council, and President Liddle
ordered that the same be placed on files
The report of the Health Officer for zihe City Farm
for the month of Mareh,19349 showing receipts in the amount of $964,37,
disbursements in the amount of $1230.119 and a balance on hand of $326.36 9
was read, as was the statement of hogs on hand which showed 227 on hand
March 1919349 101 purchased March 22nd919349 and 113 purchased March 299
19349 from which 67 were sold March 22nd919349 and 57 were sold March 299
�19349 with a deduction for one which died March 23,19341, leaving 306 on hand

The report of the Milk Inspector for the fiscal year was read,
end President Liddle ordered that the same be placed on file.
The report of the Clerk of the Municipal Court for the week
ending April 9th,19349 showing criminal fines collected $65.00, civil fees received
$4.60, conciliation' court fees received $4.759 and fines collected due to Olmsted
County $21.859 was read, and President Liddle referred the same to the City Attorney.
The following communi cat ion and the stat em ent s attached thereto
were read, and in connection therewith the City Clerk reported that City Treasurer' s
receipts No.6693 $199465, and No.6694 $304.57, had been written for the cash involved
with endorsement "Wbject to Council acceptance", at which motion by Moody second by
Miller carried that 'the same be referred to the Finance Committee:

For sometime I have been unable to balance my books. I have
used the card system and the cash on hand has been in excess to the
amount of balance shown. I have finally located the trouble in the
,sign permit records, I have tabulated all receipts for sign permits
and find that the following have not been reported to your office. (See
attached copys by years.) All other permits issued by this office
check with the cash received from all sources. I am herewith turning
in the cash for the amounts as shown.

The report of the Building, Electrical and Plumbing
Inspector for the month of March,19349 and to include April 7th,1934 ,
showing building inspection fees collected in the amount of 024.00, electric-
al inspection fees collected $106.25 and 'Plumbing inspection fees $29.75,
was read and President Liddle referred the same to the Finance Committee..
A list of the signs now hanging in the City of
Rochester, Minnesota, prepared and submitted by the retiring Building,
Electrical and Plumbing Inspector, was laid before the Common Council, and
President Liddle ordered that the same be placed on file.
The following applications for permits to place and
maintain signs were each read, and upon motion by Moody, second by
Amundsen permits were granted: Hargesheimer 2nd St. Drug Store, Mid -Continent

The application of C. G. Chamberlain and Lynn C. Chamberlain
for licenses to operate popcorn and peanut wagons: one at the northeast corner of
the intersection of Broadway Street South and Second Street Southeast, and the
other at the Northwest corner of the intersection of Broadway Street South and First
Street Southwest, was reed and upon motion by Lemmon second by Moody licenses were
granted at a fee of $100.00 each for the license year.
The application of J. J. Ritzgerald for a plumber's license
was read and upon motion by Amundsen second,by ;Fryer license was granted covering the
period April llth,1934 to April 10th91935,inclusive.
The application of Mike Peterson for a Plumber's license was read
and upon motion by Moody second by Amundsen license was granted covering the period
April llt h,1934 to April 10t h,1935 ,inclusive.
The following applications for licenses to sell soft drinks were
each read and upon motion by Amundsen second by Fryer licenses were granted: Emanuel

The application of Wm. :Heinz for soft drink dealer license at
15 Second Street Southeast was read and upon motion by Lemmon second by Amundsen
License was granted.
The following applications for Off Sale licenses to sell non -
intoxicating malt liquors were each read and upon motion by Amundsen second by Miller
licenses were granted:

A petition signed by InUM erous local residents praying
that the Common Council grant a 3.2% beer license to the Economy Drug Store
was read and President Liddle ordered that the same be placed on file.
The applications of Mrs. Johanna T. matulys for On Sale
and Off Sale licenses to sell non-- intoxicating malt liquors at No.106
Broadway Street South, were each read and a motion by Moody second by
Amundsen that the said licenses be not granted lost by the following vote:
Ayes: Amundsen Miller, Moody. Nays: Fryer, Green, Lemmon, Liddle.
A motion by Greed second by Fryer that the said
licenses be granted to Mrs. Johanna T. Matulys carried by the folloti,ng
vote: Ayes: Fryer, Green, Lemmon, Liddle. Nays: Amundsen, Miller, Moody.
The application of Wm. Heinz, for On Sale and Off Sale

east were read and upon motion by Liddle second ,by Creen the s8.me were
referred to the License Committee 'and the Chief of Police.
The applieition of Emil Schacht for On Sale license

application of Emil Schacht and John Joachim that the Off Sale license
heretofore issued to John Joachim for 605 Broadway Street North be
transferred to Emil Schacht, were each read and upon motion by Lemmon
second by Fryer the same were referred to the License Committee and the
Chief of Police.
The application of Emanuel Kostakes for license to
operate 6 pool tables in the building known as No.116 Broadway Street
South was read and upon motion by Amundsen second by Moody license was
granted. .
The application of Bemel Brothers for' s license as
Junk buyer and collector covering two automobile trucks was read and
�1upon motion by Lemmon second by Amundsen license was granted.

Gentlemen:
At the first annual meeting of the Board of Park Commissioners
it was unanimously recommended that Mr. Ralph Compton be re- employed_ as
Superintendent of Parks for the year 1935 at a salary of $29160.00 per
annum. .
His work during the past several years has been .entirely satis-
factory.' His able handling of the C.W.A.projeet in which the National
Government has recently expended $77,453.58 on improvement of Rochester
Parks was carried out to the entire satisfaction of the representatives of
the State and National Government and received expressions of highest
commendation on their part
The Board also requests a continuation of the present arrangement
allowing Mr. Compton $20.00 per month plus gas for the use of his car:

Dear Sirs;
It is our understanding that a permit has been granted by
the Building Inspector to H.L.Thurber of the Thurber Confectionary
Store located at 19 - 2nd St S.W. 'Rochester Minn. to erect a sign over
said premises.
This Company as agents for the Parmele estate owners of the
building wishes to object to this sign being erected on the said building.
It not only defaces the front wall of the building, but also, is objec-
tionable to other tenants in the building.
We, therefore, request that permission for erecting this sign
be rejected by the Common Council.

The following letter from the Public Library Board and the letter
from the Mayo Properties Association to the Library Board were each read and upon
motion by Moody second by Amundsen the same were referred to the Public Grounds
Committee,the. Mayor and the City Attorney:

Gentlemen:
I have the honor, of presenting herewith a letter from the Mayo
Properties Association dated March 14th, 1934 resubmitting for the consideration
of the Library Board of the city of Rochester a proposition for the exchange of

the present Public Library site for the old Presbyterian Church
property. This proposal contains some new and very important)
conditions and I suhnit herewith the proposal from the Mayo
Properties Association.

At a special meeting of the Library Board this proposal
was given consideration and referred to the special committee on
buildings and grounds for investigation and report. At the
regular monthly meeting of the Board held April 6th, 1934 this
committee represented their report as follows:
YEEREAS, Under date of March 14th,1934 the Mayo Properties
Association has made a certain offer to t' a Library Board of the
City of Rochester concerning the property knovm as the old
Presbyterian Church property on Second Street and Third Avenue
Southwest, and whereas, the building and grounds committee of
the Library Board has made a study of the offer as it contterns
the board interest and those on behalf of the citizens of
Rochester with relation to the administrative functions of the
board, and whereas, this committee finds after mature considera-
tion and counsel that the future best interests of this board and
the city will be served by acceptance of this offer referred to,
now, therefore be it resolved by the Library Board of the City of
Rochester that this offer be accepted by them and referred further
to the City Council with recanmendations for similar acceptance
and agreement by that body to participate in the contract required
by the offer, and the the President of the Library Board transmit.
to the City Council the offer in writing, apprising that body of
this resolution and requesting notification in writing of their
official action pertaining to the offer so soon as the convenience
of their offices shall permit.

President of the Library Board, I am transmitting to you the City
Council of the City of Rochester, Minnesota, this resolution as
adopted and request a notification in writing of your official action
as per the conditions of this resolution.

To the Honorable Members of the Library Board
City, of Rochester, Minnesota:
The Mayo Properties Association has carefully considered
your letter of January 59 1934, with reference to acquiring title to
the property known as the old Presbyterian Church property.
We have determined to donate such property to the . City of
Rochester, for library purposes, upon the following conditions:
1. That a library building be built thereon and
occupied as the Rochester Public Library on or
before July 19 1936.
2. Such property to remain the property of the
City so long as the principal library of the City
shall be maintained and used thereon, but if and
when the major portion thereof shall cease to be
used for such purposes, the entire property. shall
revert to the Mayo Properties. Association, its
successors or assigas.
31 No structure shall be erected thereon so that
any part thereof shall be nearer than fifteen feet to
the east line of said property:
4. The City of Rochester and the Library Board
shall enter into a contract with the Mayo Properties
Association .that the present library property shall 'be
sold so soon as it can be reasonably done without
undue sacrifice and the proceeds thereof, if suffi-
cient for that purpose, used for the erection in
said City of a public auditorium capable of seating
at least two thousand persons, but, if not sifficient
for that purpose, shall be placed and kept in a
separate fund and invested in authorized securities
and used only for the purpose of erecting such an
auditorium whenever the same, with other funds of
the City which may be available for such purpose,
shall be sufficient therefor.

of Rochester not only has the power to purchase and sell electric appliances, but
that it is, under existing conditions, its plain duty to its customers to provide
whatever appliances as may be necessary in order to successfully and economically
maintain and manage its8City owned public utilities, and another to the effect that
a member of the Public Utility Board may not bid or enter into contract to be let by

A petition signed by the property owners and
residents concerned asking that Ninth Street Northeast from Broadway
Street North to First Avenue Northeast be not treated with calcium chloride
during the season of 19349 was read and upon motion by Green second by
Miller it was ordered that a resolution be prepared that will eliminate this

from the 1934 sprinkling and treating program and that the same provisions be made
for Eleventh Avenue Northeast north of the south line of the A. A. Fratzke Property.
The following copy of a letter to the Health Officer was read and

applications and see that the proper installations are made within the
thirty day limitation so that each of these persons, who are .now licensed,
will be fully qualified at the end of the time that you have given them
to comply with State Law and State Board of Health Rules.
You will please report to the Common Council such. of these
licensees as may fail to or refuse to comply with the order, so that
the licenses may be revoked.

authorized and directed to secure proposals for the printing of 1000 City Clerk's

Upon motion by Miller, second by Amundsen, the use of the
Community Room for the evening of April l0th91934, was granted to a C.W.A.workek
organizer without fee; the City Clerk having informed the Council that Claude
A. Johnson had made the local arrangements for this .meeting.
A copy of a letter received by the City Engineer from the Simplex
1 Elector and Aerator Company of Chicago, Illinois, relative to suit pending over
infringement of patent rights, was read and President Liddle referred the same to
the Sewer Committee, the City Attorney, and the City Engineer, with instructions
that they confer with the State Board of Health relative to chlorination of the
effluent from the local sewage disposal plant instead of aeration until such time as
the patent rights of the Activated Sludge Company on aeration equipment expires.
The City Clerk submitted and read a copy of a questionnaire
filled out for the United States Treasury Department relative to_ the .emergency
financial needs of this City for the year 19349 and upon motion by Amundsen, second

Alderman Amundsen introduced an ordinance providing
for the- formation and government of the Fire Department of the City of
Rochester, Minnesota,.w4ch was given its first reading.
Upon motion by Lemmon second by Amundsen the rules
were suspended and the said ordinance was given its second reading.
Alderman Fryer introduced an ordinance providing for
the formation and government of the Police Department of the City of
Rochester, Minnesota, which was given its first reading.

that such do not interfere with his or her duties in the City Engineer's office.
Said salary and compensation as aforesaid shall be payable semi-
monthly; one-half of said monthly salary and compensation being payable on the 16th
day and the balance thereof on the last day of each calendar month during the ensuing
official year.
All resolutions inconsistent herewith are hereby repealed. "
Upon motion by Miller second by Amundsen thatthe said resolution
be adopted as read, and all voting in favor thereof, President Liddle declared the
said resolution duly passed and adopted.
The -following communication was read and upon motion by Amundsen
Second by Moody it was ordered that proceedings be prepared for the sale of the bridge
tioned t herein:

Gentlemen:
I am furnishing to you, a blue -print -copy of detail
drawing of the steel -girder -bridge in place in 14th Street Northwest,
over Cascade Creek, with the recommendations that this bridge be
offered for sale to the highest bidder, for cash.
The bridge is in good condition, 96 ft* in length, 18 ft.
roadway, with one suspended sidewalk. The plank floor is in fAir
condition, and the entire structure should sell as it stands for, at
least $1000.00.
Sale should be made, subject to release to purchaser on the
15th day of May, 1934

Upon motion by Moody second by Miller the City Engineer
was authottzed to expend not to exceed $199.00 for the overhauling,
cleaning, painting, etc., of the building and machinery at the Sewage
Disposal Plant.
President Liddle referred the matter of the outdoor
toilet construction in the neighborhood of Fifth Avenue Southivest :..,nd
Fifth Street Southwest to the Sewer Committee and the City Engineer
for tbroir investigation:
Upon motion by Lemon second by Miller the Chief of
Police, the City Engineer, one member of the Public Utility Board and
one Council member were designated as a Committee to arrange a conference
with N. W. Elsberg, Commissioner of Highways, relative to the lighting
of the StUte Highway intersections at Second Street Southwest and Seventeenth
Avenue Southwest, Twelfth Street Southeast and Broadway Street South, and
Fifteenth Avenue Southeast and Eleventh Street Southeast.
Upon motion by Miller second by Fryer the Common
cil adjourned to 7:30 o'clock P.M.., on April 23rd91934.
