Minutes of an adjourned regular meeting of the Common
Council of the City of Rochester, Minnesota, held in the Council Chambers, In
the City Hall, in said City, at 7: 30 o'clock P.M. , on April 23rd, 1.934.
il Meeting called to order by President Liddle.
Roll call. Present: Liddle, Amundsen, Fryer,,Green,
Lemmon, Miller, Moody. Absent: None.
Upon motion by ihAsen, second by Moody, the minutes
of the two meetings held on April 2nd, 1934, the minutes of the meeting
held on April 9th919349 and the minutes. of the meeting hela on April llth,
19349 were each approved.
This being the time and place fixed for the opening of
proposals for being designated as a city depository, the following proposals
were opened and read:
"April 199 1934.
To the Honorable Mayor & Common Council
City of Rochester,
Rochester, Minnesota.
Gentlemen:
The Rochester Loan and Trust Company of Rochester,
Minnesota hereby makes application for appointment and designation
as depository for Fifty Thousand dollars of funds belonging to
the City of Rochester, Minnesota, and in case we are so appointed,
we will furnish as security for such funds a. good and sufficient
bond or collateral security* at the option of this Company, to be
approved and accepted by the Common Council of the City of Rochester,
Minnesota.
Tf collateral securities are used, they shall be d.oposited
for safekeeping with the Northwestern Netional Bank in Minneapolis,
which is a .member of the Minneapolis Clearing House Association.
We will pay interest on such funds as are deposited on
savings accounts, at the rate of one per cent per annum, interest to
be computed on the minimum balance for each quarter and compounded
semi-annually.
All funds ant accrued interest thereon placed on deposit
with this company shall be subject to withdrawal by the duly author-
ized officials of the City of Rochester in accordance with the rules
and regulations governing such deposit.

belonging to the City of Rochester, Minnesota, and in case we are so
appointed we will furnish as security for such funds a good and

sufficient bond. or collateral securities at the option of the Bank, to be
approved and accepted by the Common Council of the City of ',Rochester,
Minnesota.
If collateral 'securities are used they shell be deposited for
safekeeping at a bank in Minneapolis which is a member of the Minneapolis
Clearing House Association.
On open checking account we will pay no interest. We will pay
on Certificates of Deposit for not less than, six months time at the rate
of one per cent (1%) per annum but if withdrawn before six months, no
interest:
We will pay on Savings AccoiLnts for not less than six months time
at the rate of one per cent per anAum but on accounts withdrawn before
the six months period, no interest will be paid.
All funds and accrued interests so placed on deposit shall be
subject to check of the duly authorized officials of the City of
Rochester and payable on demand. `

Agreeable to your published notice, the union National Bank
of Rochester, Minnesota, hereby makes application to be designated as
a depository for the sum of $501,000.00 of funds of said city of Rochester,
Minnesota.
If we are selected as such depository, we will deposit with
the Federal Reserve Bank of Minneapolis, Minnesota, acceptable collateral
to be approved by the Common Council of the City of Rochester, Minnesota.
Upon funds deposited on Certificates of Deposit for not less
than six months time, interest will be paid at the rate of one per cent

following remonstrance, at which motion by Fryer second by Green carried that the
same be referred to the License Committee:
"To the Common Council of the Uity of Rochester:
The undersigned residents in the vicinity of 601 North Broadway
in said city respectfully protest against the granting of a license to
sell non -intoxicating malt beverages .and,/or intoxicating liquors in the
j building located at that number.
The members of the council well know the results of such a license
at that place last year and we feel certain that conditions would be the
same were another license granted and that another nuisance would be
maintained.

statement of unexpended budget appropriations, etc-, Prepared by the City

President Liddle ordered that the sane be placed on file.
�j The report of the Clerk of the Municipal Court for
the week ending April 16th,19349 showing criminal fines collected 947.00,

l+ conciliation court fees received $.509 count costs charged to Olmsted
County $24AO and fines collected and remitted direct to the State
i i Treasurer $103.00) and. for the week ending April 23rd,19349 showing criminal
fines collected $75020, civil fees received $6.009 conciliation court
fees received $1.009 court costs charged to Olmsted County $17.95, fines
collected due to Olmsted County $10.00, and fines collected and remitted
I direct to State Treasurer $13.009 were each read, and President Liddle
referred the same to the City Attorney.
Upon motion by Mill ef, Isecond by Moody, the sum of
$10.00 was appropriated from the General Fund and it was ordered that the
said sum be paid to Olmsted County, Minnesota, for municipal court fines
collected and due to Olmsted County.
The annual report of the Board of Park Commissioners
for the Park Revenue Fund and the Mayo Trust Fund during the year ending
March 319193.1, was read, and President Liddle ordered that the same be
placed on file.
The applications of Donald P. Stedman, Obert P. Petersor_
and Fred W. Oesterreich (2) , for licenses to sell. soft drinks, were each
read., and upon motion by Amundsen, second by Fryer, licenses were granted.
The application of the Fordham Electric Company for
an electrician'-- license was read and upon motion by Moody second by Green
license was granted.
The application of Samuel F. Moore for a public dance
ermit at the Y. M. C. A. Buildi.na, April 21st and tat-.1934, and of the
hird Ward Betterment Association, for. the Woodman Hall April 27th,1934,
were each read.
The electrician's license bond of 'the Fordham Flectric
any, with the Fidelity And Casualty Company as surety thereon in

Gentlemen:
It again becomes necessary to request that $19000.00 be appro-
priated as financial assistance to the Hog Farm Fund for its activities
in connection with the collection and disposal of the city' s garbe;te.
For your. information I might say that from present indications
it appears that less assistance in t}jis respect will be needed this
year than in previous years.
It is our intention at the present time to purchase a second
hand light truck to take the place of the a4tiquated team and wagon
for collection of residence garbage at less expense.

to realize the funds you request, which consideration brought with it the
discussion as to what was going to be done with the teem and wagon that the
new truck will replace, so accordingly request is made that you appear at
the Council meeting which is scheduled for 2 o'clock P.M., May 7th, 1934, and
explain your plans An that regard.

Copy of requisition by the Health Officer upon Saint Mary's
Hospital for the isolation of Mary McNiff, age 2 years, residing at 213 Ninth
Street Northwest, diagnosed to be suffering from Whooping cough, was read and
President Liddle ordered that the same be placed on file:
A communication from Korey Grue of 660 Jenks Street
Saint Paul, Minnesota, relative to his length of residence being against his
getting free hospitalization, wqs read and President Liddle referred the same to
the County Auditor.

The following request vas read and upon motion by
Miller second by Moody the City Engineer was authorized to furnish the
necessary men, teems and equipment to comply with the petition:

The Veterans of Foreign Wars of Rochester see the
necessity 'of sponsoring the Community Gardens agaiwf this year
and are doing so jointly. with the Civic League Welfare Director.
We would sincerely request the use of the seine tract
of ground, the,plot around the Disposal Plant. We also request
the plowing and harrowing of this plot and our other tracts namely,
the tract west of the Hatchery, the tract on 12th Ave. S.B. , the
5th St.N.E.tract, the plot inside the Race Track.
The Committee wishes you to know that they appreciate
this cooperation and wish to extend thanks for all favors extended.

by the Public Utility Board was read and President Liddle ordered that the

"WHEREAS, in the resolution adopted.by the Public Utility
Board under date of April 91 1934 and subsequently approved by'the Common Council,
the salary of Joe Smith, Fireman, appeared therein at a salary of $1620.00 per year,
and
WHEREAS, the Public Utility Board desires that his salary shall
be $1701.00 per year.
THEREFORE, be it and it is hereby resolved by the Public Utility
Board that the salary of Joe Smith shall be $1701.00 per year retroactive to April 19
1934, and that a copy of this resolution be referred to the Common Council with a
request for their approval."
Upon motion by Miller second by Green the City Attorney and the
Public Grounds

make expenditures
in the taking of
pictures to be
used in the convention issue
of the "Minnesota
Municipalities", and
that they secure prices on the furnishing to the City of Rochester of an extra set
of cuts from the pictures.

authorized and directed to make an affidavit as to the correctness of the answer in
the matter of the enforcement of taxes against the properties belonging to Frank E.
Williams decedent on May 17th,1932 , and now the property of the City of Rochester;
paragraph 5 of the said answer being quoted as follows:

former building, electrical and plumbing inspector for the
City of Rochester, having been referred to the Finance Comm-
ittee for investigation report, the following is submitted
for your consideration:

committee to properly check its report and, in view of the
l fact that the books of the City of Rochester are to be audited

qualify under his election as Justice of the Peace of the First Ward, and
upon motion by Lmmon second by Miller the office of Justice of the Peace of
First Ward was declared vacant.

in favor thereof Ernest R. Molloy was appointed Justice of the Peace of the
First Ward of said City for the term ending on the first Monday in April,
1935.
The City Clerk reported that Elmer Crimm did not
qualify under his election to the office of Constable of the Third Ward and
upon motion by Miller second by Amundsen the office of Constable of the
Third Ward was declared vacant.
Upon motion by Green second by Fryer and all voting
in favor thereof, Perry Me Cranston was appointed Constable of the Third
Ward of said City for the term ending on the First Monday in April,1935.
The City Clerk reported the receipt of $113*35 from
the Franklin Heating Station as one half cent per thousand cubic feet on
23,770,000 cubic feet of natural gas used there during March91934•4

without comment, in view of the fact that a recommendation to adopt
said constitution and by laws would automatically eliminate the
present band committee.

Upon motion by Lemmon second by Fryer the existing members of
the Band Committee were approved and the City Clerk was instructed to request of the
Elks Drum Corps and the Rochester Municipal Band that they each propose a member
for service on the Band Committee.
Upon motion by Amundsen second by Green the City Clerk was instru
ed to execute a proof of loss on the barn at the City Dumping Grounds which burned
recently.

President Biddle referred the matter of the construction of a new
barn at the City Dumping Grounds to the Public Grounds Committee and the City
Engineer.
Upon motion by Lemon second by Moody the sum of $42.50 was
appropriated -:rom the General Fund and it was ordered that the same be paid to
Saint Mary's Hospital for the isolation of Grace Lee as a scarlet fever patient
December 7th,1934 to December 24th,1934 (17 days) .
The claims of the Morrison Electric Company, $2.00 for
services at t,'he Sewage Disposal Plant, $8.70 for services at the Police
Department, and 13.50 for services to the Park Department, were each read
and upon motion by Lemmon second by Fryer the sum of $2000 was appropriated
from the Sewer Fund,$8.70 from the General Fund, and 13.50 from the Park
Improvement Fund, each payable to the Frank F. Williams Estate Fund
for credit to the $175.00 delinquent rental account now owed -:by the
Morrison Electric Comp at�y .
In connection with the checkup by the U. S. Coast
and Geodetic Service Department on the bench mark installation here last
fall, the City Clerk presented the following for establishment of a public
record of the sea level elevation at that point:
"ROCHESTER•--Alt Rochester, Olmsted County, at the northeast corner
of First Avenue and Third Street, at the city hall, 8.4 feet west of the
west face. about 16 feet south of the center line of the main sntrance,
end in the top of the south stone newel, 4 feet above the sidewalk. A

feet.)"
The auotations made by the Rochester American, the
Quality Print Shop, the Whiting Press, the Rochester Post -Bulletin,
Williams & Carr and Schmidt Printing Company, for the printing of 1000
Copies .of the City Clerk's annual report at a price of $357.25 up to
84 pages and $4.00 per page for those in excess of 64 pages, were each

accordance with the following quoted resolution request;

underdste of April 9, 1934 and subsequently approved by the Common Council, the
salary of Joe Smith, Fireman, appeared therein at a salary of $1620.00 per year, and

Upon motion by Amundsen, second by Fryer, the Chief of Police
was authorized to purchase 20 stop signs at a price of $6.50 each.
The Chief of Police requested that a Committee be designated to
consider the traffic danger situation at the intersection of Broadway Street South
and Sixth Street Southwest, and President Liddle accordingly referred the matter to
the Fire Department Committee,the Police Committee, the Chief of Police and the
Chief of the Fire Department for their recommendations.
The proposals of Elmer Kruger, Rochester Auto Markets Motor
Sales and Service COO, Rochester Nash Motor Company, Ellis Motor Company, R.L.Grundme er.
Co., West Motor Company, Mkeary Motors, Inc., Clements Chevrolet Company, and the
Day and Night Garage, for the furnishing of an automobile for use of the Police Dep
went to replace the Chevrolet recently wrecked in a collision, were each read, and up
motion by Fryer second by Green the Mayor was requested to issue an emergency
authority for the purchase of the Graham automobile offered in the Day and Night
