The City Clark reported that no bids had bee}l received for the purchase of the old bridge across Cascade . Creek on Fourte-enth Street Northwest. The matter of the removal of the old__ curb around the new Post Office building, and the paving of the widened street was disclassod, and upon motion by Lemmon second by Fryer the Mayor was requested to issue an emergency authority to the City Engineer that he purchase the necessary materials and procure the required labor for the paving of the widened First Street Southwest in front of the new Post Office Building, I. e.. 12- feet wide in each case at an approximate cost of $1050.00. The proposals of the Kruger Woodwork Shop .40265.00 and of the Kruse bamella Limber & Mfg. Co. 0325.00, for the furnishing of a trophy case for the City Hsll lobby were upon motion by Lemmon second by Green referred to the Public Grounds Committee with power to act in the matter. L. E. Kennedy's request for water service outside the City limit to the Tourist Camp he Is s constructing on the Moore Property west of Sixteenth Avenue, Southwest between an extension of First Street Southwest aUd an extension of Second Street Southwest, was considered by the Common Council, and upon motion by Lemmon' second by Fryer request was made of the Secretary of the Public Utility Board that he furnish this Common Council with a list of the persons, firms and association that are furnished water service outside of the City limits. The Co -Operative Oil Company, through its Manager Arthur Boie, presented a sketch for a proposed service station at the northeast corner of the inter section of Center Street Wept and Third Avenue Northwest, and President Liddle ordered that the same be placed on file. Mr. Liggett of the Rochester American asked that a Municipal I Milk Depot be provided and President Liddle referred the matter to a committee composed of Aldermen Moody, Fryer and Lemmon and requested that the Mayor serve on this committee. " Upon motion by Moody second by Pryer the,American Legion Auxiliary were authorized to sell poppies upon the streets of the CiV of Rochester, Minnesota, May 26th,1034. The City Engineer's Department trial balance for April,1934 was laid before the Common Council and President Liddle ordered that the same be placed on file. The report of the City Engineer for the month of Apr.il,1934, showinr� expenditures from the General Fund of $373.52 for labor, $1058.96 from the Street and Alley Fund, and 411.26 from the Sewer Fund, was read, and President Liddle ordered that the samebe placed on file. The report of the Cit7; Treasurer .for the month of Apri.1,1934, showing balance on hand of $3199257.94 was read, and President () Liddle ordered that the same be placed on file. I The report of the Building, Electrical and Plumbing Inspector ffor the month of Apri1,1934, snowing building inspection fees collected in the mount of165.00, Plumbing Inspection $31.50, and Electrical Inspection $9.25, was read end President L•id.dle referred the same to the Finance Committee. The report of the Clerk of the Municipal Court,, for the week i ending April 30t h,1934, showing criminal -fines collected $2,1.00, civil fees received $2.35, conciliation court fees, received 11.75, Olmsted County Check received for Municipal Court fees $820'659 being-$8.65 for February 1934, and $74.00 for March 1934, and court costs charged to Olmsted County 4.90, and for the week ending ?Aay 7th,1934, showinn criminal fines collected 168.50, civil fees received 13.30, Conciliation court 'fees received $2.75, court costs charged to Olmsted County $7.00, and fines collected and. remitted direct to State Trea3urer 110.009 were each read, and President Liddle referred the same to the City Attorney. The license fee on this sign were there no insurance on it and no waiver of the fee would be $6.40 , and if you place insurance on it the fee would be $3.109 which last --mentioned amount will be cancelled in your favor if you secure insurance and file Vhe policy in the City Clerk's records. The location. is 1001 First Avenue S.F. The reason vre would like to have our street treated now Is due to the heavy traffic at the present time. The hatchery is kept open until about the 15 of July, only and hencE our reason' for wanting our street treated at the present time. We realize that it is causing an extra expense to you for this small job, but we are willing to pay any added expense that, is necessary. Gent lemon: There being an ordinance now which prevento the sel]_ing of malt beverages, containing 3.2 percent alcohol, upon the second floors of any business place in Rochester, and it now appearing that since such ordinance, the sale of intoxicating liquors has become legalized in this city, I would like to urge that the above mentioned ordinance be amended to permit the sale of malt beverages in business places occupying the second fioor. I have operated a bawling alley in your city for the past two years, and have attempted, and I believe'succeeded, in conducting a very modern, orderly, and efficient place of business. Ml y season, due to the nature of tie business, is short, and I find that during the bowling season. there is a great demand for beer. I realize that the ordinance was adopted to eliminate possible disorders, to which the law enforcement department might have difficulty in keeping in check, because of the fact that proper observation would be difficult. .However, it seems to me that a bowling alley, or other recreational center, might well be eliminated from this ordinance without being detrimental in any way to law and order. Upon motion by Miller, second by Green, the Construction of a new barn at the City Dumping Grounds and of grading Fourteenth Street Northwest from Eleventh Avenue Northwest to Cascade Creek, were each ,approved, as S. E. R• A. projects, grand total of the barn being an estimated cost of $689 20, $2930,80 thereof being for relief employees services, the grading estimated cost being $16650,12, $1307.62 thereof would be for relief employes services. Upon motion by Lemon by Lemon second by Green the City Engineera repaving of First Street Southwest between Second Avenue Southwest and Fourth Avenue Southwest was approved as an S.E.R•A4 project, and the City, Clerk attest thereon was suthorized. (As yet no copy of this project proceedings have been placed in the official files.) A communication from the State Board of Health asking that the enclosed proposed ordinance be adopted thereby placing in effect the State plumbing code, were each read, and Piesi'dent Liddle referred the same to the Building Electrical and Plumbing Inspector, the City Engineer and the City Attorney: The City Clerk called attention to the opinions written by Ambrose Fuller, Attorney for the League of Minnesot& Municipalities, vider heading *Workmen's Compensation under the F.E.R�A. * in the May issue of"Minnesots Municipaji, ties",and read Mr. Fuller's "Summary and Conclusions-* which were as follows: " S02NARY AND CONCLUSIONS The above review considers some of the important matters in connec- tion with employment and the F.E.R.A. The first conclusion is that workmen engaged in public work as a condition for receiving aid, either by voluntary application and acceptance or by necessity as a condition precedent thereto, from state or federal funds set &aide for that purpose under the state and federal Emergency Relief Administration do not have the status of employes under the Minnesota Workmen's compensation act for the following reasons: 1: The local government does not select, hire, discharge or control these workers in any way. ' 20 It does not provide the money for or pay over compensation to the workers, or fix their relief requirements or rates of pay. 3: There is no contract of employment that the worker can enforce in any respect against anyone: ' 4. The whole FE.R.A: program is clearly end entirely one of relief to persons legally entitled to assiirasnae Liability in the last analysis will have to be determined by the supreme court, and until boa -liability is established'the local governing bodies should take some precautions to insure the liability and protect themselves. Aldermen Fryer introduced a resolution authorizing the Public Utility Board to enter into contract with C. C. Pagenhart in accordance with their above quoted resolution request and fixing the amount of the surety bond to be given by. the said contractor at the sum of 012634009 which was read. Alderman Fryer introduced a resolution authorizing the Public Utility Board to enter into contract with Fairbanks Morse & CompaiW in accordance with their above quoted resolution request and fixing the amount of the surety bond to be given by the said contractor at the sum of $2290 00 9 which was read. Alderman Fryer introduced the follo*Ing resolution,which was read "Be it resolved by the Common Council of the City of Rochester, Minnesota: That the Health Off icerof said City be and he is hereby authorized to purchase one Chevrolet truck, serial 21 N.D. 111 311 Model T-2970869 from the Rochester Credit Company for use at the City Farm in garbage collection, at a price of $295*00. The Health Officer of said .City and the City Clerk of said City are hereby authorized to draw a warrant upon the City Farm Fund in the City Treasury and make payment for the said truck upon delivery thereof. Feller, for Payment of partial estimate Ro:2, on contract for the construction of a siphon section of trunk line sanitary sewer in parts of Third Avenue Southeast and Third Street Southeast, under Job 18099 which was read.
