HomeMy WebLinkAbout05-21-1934Minutes of a special meeting of the Common Council of the City of Rochester, Minnesota, held in the Council Chambers, in the City Hall, in said City, at 7: 30 o'clock P.M. , on May 21st ,1934. Meeting called to order by President Liddle. Roll Call Present: Liddle, Fryer, Green, Miller, Moody. Absent: Amundsen, Lemmon. The call for the special meeting was read; said meeting being called for the purpose of action on Public Utility Board request for authority to enter into contract with L.A.Kepp Contracting Co., City Engineer's application for F.E.R.Ao funds for widening of paving on north and south sides of new Post Office building, and asking Public Utility Board to appropriate the Water Works Extension Sinking Fund Investments toward the cost of the new Library building, and any other business that the said Common Council might doom proper: The following copy of resolution request was read and President Liddle ordered that the same be placed on file: "Be it and it is hereby resolved by the Public Utility Board of the City of Rochester, Minnesota that the Hon: Common Council of the said Citybe and is hereby requested to authorize the said Board to enter into a contract with the L:A.Kepp Contracting Company of this City in the amount of $19461.00 for the furnishing of all the materials, including ornamental standards, equipment and labor necessary for the installation of an Ornamental Street Lighting System and an underground duct system in Fourth Street Southeast from Broadway to Fourth Avenue Southeast and underground to the City Water Works Pumping Station -all in accordance with specifications and with the bid of the said Contractor dated May bleventh 1934-said con- tractor being the only bidder upon said project which was duly advertised." Alderman Moody introduced a resolution authorizing the Public Utility Board to enter into contract with the L.A.Kepp Contract- ing Company in accordance with the above quoted resolution request and fixing the amount of the surety bond to be given by the said contractor at the sum of $199461409 which was read: Upon motion by Moody, second by Fryer, that the said resolution0be adopted as read, and all voting in favor thereof, JPresident biddle declared the said resolution duly passed and adopted. A copy of the City Engineer's applications for S:E.R.A. (F.E.R.A) funds, to be used toward the widening of First Street Southwest along the south side of the new Post Office building, and the widening of Center Street West along the north side of the new Post Office building, was read, and upon motion by Fryer, second by Green, the said application was approved; it showing $492:80 for rel eP labor and r975.80 estimated expenditures by the City of Rochester;9P�materials and labor totaling $146&40i 199 Alderman Lemon came in at this time and took his Chair. In the discussion relative to the creating of funds for the building of a new Library building, the City Clerk presented and read a resolution form for adoption in the event that this Common Council decided to handle the financing as proposed in the Mayor's call for this special meeting, which resolu- tion form was as follows: "WHEREAS, the Public Library Board Directors did on April 27th, 19349 by resolution duly passed and adopted, ask the Common Council of the City of Rochester, Minnesota, for the immediate appropriation of $1009000.00 toward the cost of the construction of a new library building, which would be an addition to the Sinking Fund Investments now held for an addition to the present library building or the construction of a new library building, and WHEREAS, the said Sinking Fund Investments for an addition to the present library building or for the construction of a new library building did on April 30th919349 have a par value of $509950:00, and a book value of $519023:319 and .WHEREAS, it is deemed expedient and necessary by this Common Council that the Sinking Fund Investments for Water Works Extension be appropriated toward the above mentioned $1009000460 appropriation leaving the balance of the $100,000.00 to be realized by a 1934 tax levy, by a bond issue, or by appropriations from Public Utility Funds, the said Sinking Fund Investments for Water Works Extensi( having a par value of $539000,100 at April 30th91934 9 and a book value on that date of $55*418.959 SO THEREFOR, Be it resolved by the Common Council of the City of Rochester, Minnesota: That the' Sinki:hg Fund Commission of said City, are hereby authorized and directed to sell the said Sinking Fund Investments for Water Burks Extension and appropriate the funds realized thereby to the Public Utility Fund of said City, and the Public Utility Board of said City are thereupon authorized to appropriate the receipts from the sale of the said Sinking Fund Investments for Water Works Extension to a special fund for the construction of a new library building in and for the City of Rochester, Minnesota, and Be it further resolved by the said Common Coun9il: , That the Sinking Fund Commission of said City be and the said Commission is hereby authorized and directed to sell the Sinking Fund Investments for an addition to the present library building or the building of a new library building and place the receipts therefrom in a special fund for the construction of new library building: " The Mayor favored the adoption of the above quoted resolution while Rev. A. R: Zick opposed it, and asked that the question be submitted to the voters of the City of Rochester, Minnesota, for their decision at a special election called for voting on a bond issue to provide the funds needed4 Upon motion by Fryer second by Green it was ordered that a referendum ballot be prepardd and submitted to the voters at the Primary Election which is to be held Monday)June 18th,19349 asking for their expression, as follows: For a vote of yes or no on, "Shall a new Library building be built in the City of Rochester, Minnesota, at a cost of approximately 1$1g01000:00 in addition to the Sinking Fund Investments now held for the building of an addition to the present 200 'Ir s Library building or the building of a new Library building" with two other questions following on which the voter would declare if he voted yes on the main question, but he would not vote on them if he voted no on the main question; those last mentioned questions being: "Shall the additional $100,000.00 cost of a new Library building, over and :above the Sinking Fund Investments held, be paid from Public Utility Funds?" and "Shall the addi- tional $100900000 cost over and above the Sinking Fund Investments held be paid from bond proceeds whenever the same might be authorized by the voters of the City of Rochester, Minnesota?" which ballot form shall be prepared in such a manner that the voter be instructed to vote on only one of the last mentioned questions and that only in case that he voted yes on the main question* Matt Fitzpatrick, Ray Emerson, County Relief Director, land others, asked thatthe Common Council provide free water for garden plots planted and maintained by unemployed persons, and that a red'ibtion in water ,.service rates be given to any person who plants and maintains a garden Iduring this season, at which President Liddle referred the requests to the Water and Sprinkling Coimmittee,ai�d the City Engineers Paul Snith asked for an appropriation of $1004-00 for recreational equipment in connection with S: E. R:A. Recreational activities and stated that their headquarters,etc. , could have office space etc., in he Y.M. C. A. Building during the months of June , July and August 919254, if he Common Council would request of the Public Utility Board a cancellation f $50, 00 on the $200:00' electric and water service billing now owing by he Y.M. C.A. Corporation Trusteeship. Upon motion by Lemmon second by Fryer $100000 was propriated from the General Fund and it was ordered that the said sum be aid to the Mayors Contingent Fund. A petition signed by 37 residents in the locality oncerned was read and President Liddle ordered that the same be placed on ile; the heading on the said petition and remonstrance being: "The undersigned residents of the City of Rochester residing in the vicinity of Ninth Avenue and Fourth Street Southeast respectfully represent that the premises occupied by Cy Delaney as a beer garden are public nuisance, and that the noises eminating from the same and the conduct of his patrons both on and off the premises make the neighbor -- hood unfit for residezitial purpose. He has insufficient parking space which results in his patrons parking on the private lawns and driveways of the private resicences." You are ;therefore respectfully petitioned to revoke the _beer license heretofore issued to said Cy Delaney:" 201 Claude H Swearingen, Rev*, Ernest, Moiloy and L. E. DeVogel talked in support of the above quoted petition and remonstrance and C. R. Delaney in addition to offering the maiht.onthoe of police service around his place of business also agreed to close his outdoor beer garden, which last mentioned permission was after his license location was read to him from the license application record. President Liddle referred the above quoted WOn and the C. Ri Delaney matter in general to : the License Committee and the City Attorneys Upon motion'by Lemmon second by Fryer the City Attorney was instructed to draft an ordinance amend-nt requiring dispensaries of non-intoxicat malt liquor to close their places of business at 12:00 o'clock midnight, and not to open them until 5:00 O'clock A.M. , the following morning; all voting in favor thereof except Alderman Miller who voted "Nay'". ' General balance sheet, trial balance, fund statement, statement of unexpended budget ap.,�ropriations, statement of, sinking Fund Investments,ete. , prepared by the City Clerk as of April 30th,1934, were laid before the Common Council, and. President Liddle ordered that the same be placed on Pile: The report of the City Weighmaster for the month of Apri191934, showing weighing fees collected in the amount of $28060, was read, and President piddle referred the same to the Finance Committee. The report of the Public Utility Board for the month of April, 1934, as prepared by the Secretary of the Public Utility Board,wis laid before the Common Council, and President Liddle ordered that the same be placed on file; the net profit in the Light Department for that month being $9816. 59 9 and the Water Department $48e.24, and in the Steam Heating Department $1255:09. The report of the Rochester Fire Department Relief Association for the year ending December 31,19339 was read, and President Liddle ordered that the same be placed on file. The report of the Clerk of the Municipal Court for the week ending May 13th,1934, showing criminal fines collected $9:409 Civil fees received $5460, conciliation court fees received $10'009 court costs charged to Olmsted County $6.159 And fines collected and remitted direct to the State Treasurer $8.001, and for the week ending May 21st 91934, showing criminal fines collected $1460,00, Conciliation Court fees received $3.009 and court costs charged to Olmsted County $3.75, were each read, and President Liddle referred the same to the City Attorneyio The applications of Chas: L. Aber, doing business as the Hd & H: Electric Company,for an161entrician's license was read and upon motion by Fryer second by Green license was granted. The electrician's license bond of John P. Aayber, doing business as the H. &. H. Electric Company, with the Aetna Casualty & Surety Company as surety thereon in the amount of 1,00000 was read, and upon motion by Moody, second by �ryerq the said surety was accepted, the said bond was approved and it was ordered that the same be placed on file. The applications of Samuel F. Moore for a public dance permit at the Y. M. CO A., building, May 26th,1934, and of the Third Weird Betterment Association for a public dance permit at the Woodman Hall May 25th,1934, were each read The following protest signed by the CHtrch Council of the Church of Peace was read, and President Liddle referred the same to the License Committee: "To the Common Council of the Cit ;• of Rochester: We the undersigned residents of the City of Rochester and in close proximity to 601 and 605 North Broadway, respectfully protest against the granting of a license to sell either intoxicating liquors or 362 beer at either of said places. If such licenses be granted, an undesirable crowd will be attracted and noises and disturbances will be created, as experience has shown in the past; it is mainly a residential district without constant police patrol and supervision and the residents ought to be protected against such nuisances. Dated May 19t h, 1934. " A petition signed by 63 citizens asking for improvemente cl.Ptterly Park bathing pool was read President Liddle referred the same to the Board of Park Commissioners; the said petition being headed as follows: "We the undersigned residents of the City of Rochester, hereby petition the Common Council of this city to appropriate for the use of the Park board such sums as are required to make I� the necessary improvements at the swiming pool at Slatterly Park ��. in order that such pool may adequately serve the large number of folks who visit this pool during the summer months The expenditure required is small and will be many times repaid in the greater happiness permitted to our citizens: " The following certification and recommendation was I1 read and upon motion by Moody second by Green the persons mentioned therein were duly apphlnt ed Firemen in .the Fire Department of the City of Ro chest er, Minnesota: 203 46-Y . Norgaarden, and Frank Everett the three required tests. The three first were rated highest and the fourth party in question comes under the soldiers preference Act of 1920 and its Amendment of 1931 and must be put on the chosen list for Appointment. E. Kennedy that he be allowed to connect his tourist camp to the Sixteenth Avenue Southwest water service. It is respectfully requested that you comply with the order as to disconnecting the property above mentioned and that you do not allow Mr. Kennedy to be served from the Sixteenth Avenue Southwest main.
