Minutes of an adjourned regular meeting of the
Common Council of the Ctty of Rochester, Minnesota, held in the Council
Chambers in the City Hall, in said City,at 7:30 o' clock P.M. , on May 28th,
1934.
Meeting called to order by President Liddle.
Roll Call. Present: Liddle, Amundsen, Fryer,.
Green, Lemmon, Miller,Moody. Absent: None.
Upon motion by Moody second by Green, the minutes of
the two meetings held on May 7th,919349 were each approved.
This being the time and place fixed for the opening of
proposals for the Purchase of a $19000.00 City of Rochester, Minnesota,
4*1% Certificate of Indebtedness, the following proposals were opened and read:
a premium of $4.45;
accrued interest;
Tie Sinking Fund Commission: Par,accrued interest and
Margaret K. Kennedy: 4% basis with no reference as to
George Went ink:
reference as to accrued interest.

Alderman Moody introduced the following resolution,
"Be it resolved by the Common Council of the City of
That the bid and offer of Sinking Fund- Commission for
$1,000.00 City -of Rochester, Minnesota, 40 Certificate of Indebtedness,
dated May lst919349 and maturing May 1st , 935, being $1,009.00 principal on
the said certificate of indebtedness, $4.45 premiums on the said Certificate
of Indebtedness, and $3.31 as accrued interest on the said certificate of
indebtedness, is deemed to be the ]nest favorable proposal for the said
Certificate of Indebtedness, and
Be it further resolved by the said Common Council;
That the said Certificate of Indebtedness numbered 11, be and the same is
hereby awarded and sold to the Sinking Fund' Commission and that the same
be delivered to them upon their paying into the City Treasury of the amount
of the said bid therefor, and
Be it further resolved by the said Common Council:
That the Mayor and City Clerk of said City are hereby authorized and directed
to execute the' said 'certificate of indebtedness, and the City Treasurer is
hereby authorized and direetedi to deliver the said certificate of indebted-.
ness to the purchaser upon the payment into the City Treasury of the above
mentioned purchase Price; the said payment of Principal and encrued interest
to be placed in Code 10 of the General Fund of said City. "
Upon motion by Amundsen second by Moody that the said
resolution be adopted as read, and all voting in favor thereof, President
Liddle declared the said resolution duly passed and adopted.
Upon motion by Miller second by Amundsen it was
ordered that the certified checks of the unsuccessful bidders for the above
mentioned Certificate of Indebtedness be returned to them.

This being the time and place fixed for the opening of proposals
for the repainting of the outside of the business building on the Frank E. Williams
Estate property, now owned by the City of Rochester, Minnesota, and Simon Stensrud
of Stewartville, Minnesota, the following proposals were opened and read:
Standard Decorating Company $406.00;
Joseph 0• Prince, $3720-90;
KrIs Sundby, $368.00.
President Liddle referred the above mentioned proposals for
repainting to the Public Grounds Committee for their recommendation.
The appointment by the Mayor May 21st 91934, of Corwin L.Stoppel
as a member of the Police Civil Service Commission, with action thereon adjourned
and continued to this hour and date, came up for consideration of the Common
Council, and a motion by Lemmon second by Fryer that the said appointment be not
approved carried by all voting in favor thereof, and President Liddle declared the
said appointment not approved.
The gorpee�ed, report of the Clerk of the Municipal Court for
the week ending November 13th919339 showing criminal fines collected $86.40, civil
fees received $6.60, conciliation court fees received $1.259 court costs charged
to Olmsted County $3.509 and fines collected due to Olmsted County $25.00, was read,
and President Liddle referred the said corrected report to the City Attorney, after
which motion by Lemmon second by Amundsen carried that $25000 be appropriated from
the General Fund and paid to Olmsted County, Minnesota, for fines collected due to
Olmsted County during the period mentioned.
The report of the Clerk of the Municipal Court for the week
ending May 28th91934 , showing criminal fines collected $147.759 civil fees received
$8.35, conciliation court fees received $1.509 court costs charged to Olmsted County

$13,05, and fines collected and due to Olmsted County $35.00, was read, and Presi-
dent Liddle referred the same to the City Xttorney.
Upon motion by .Amundsen, second by Fryer, the sum of $35.00 was
appropriated from the General Fund and it was ordered that the said amount be paid
to Olmsted Count y,Minnesota, for local Municipal Court fines collected due to
ObAsted County, Minnesota.
The report of the City Engineer for the month of May,19349
showing expenditures from the General Fund for labor of $9590,03, Street and. Alley
Fund $1038.17, and Sewer Fund $349.87 9 was read, and President Liddle ordered that
the same be placed on file.
The appli cat ions of Charles 001 Grassle for On Sale and Off Sale
licenses to sell non -intoxicating malt liquors at 6 First Avenue Northwest, were each
read, and upon motion by Moody second by Amundsen licenses were granted.

The applicationsof Earl F. Koelsch and Charles L. Roh-
tong Mrs. Marie Stortzg and Mrs: Robert Merz, for soft drink dealer licenses
were each read, and upon -motion by Fryer second by Green licenses were
granted.
The Sollowing application for change in carnival
license dates was read and upon motion by Moody. second by Amundsen the
changes requested were granted:

inclusive.
The reason is the Castle - Hirsch Shows are unable
to be here on this date and have turned it over to the Royal
American Shows.

by Fryer the request was granted with all voting in favor thereof except

of my license at the Elm Tavern for eight days or until June
8th, at which time my lease expires and this, will enable me to -
move into.my new location'at 410 1st Ave. N.W. so as to be '

The petition of G. L. Witte, that a sidewalk be
constructed on the north side of Eleventh Street Southeast between Fourth
Avenue Southeast and Fifth Avenue Southeast was read and President Liddle
referred the same to the Street and Alley Committee• and the City Engineer.

A Petition asking that a sanitary sewer be constructed
in First Place Southeast from the center of Third Street Southeast to a
point 60 feet north of the north line of Fourth Street Southeast was read
and President Liddle jeferred the same to the Sewer Committee and the City Engineer.
A petition si Eped by Dr. S.W. Harrington, Geo. E.' B1+own, Howard
R. Hartman, and M. W. Comfort, asking for the treating with calcium chloride of
Seventh Street Southwest from Ninth Avenue Southwest to Tenth Avenue Southwest, and
waiving regular Proceedings, was read and upon motion by Miller second by Moody
the City Engineer was authorized and directed to secure the necessary labor and
materials and comply with the petition.
• The following petition was read and upon motion by Lemon second
by Amundsen it was referred to the Sprinkling Committee and the City Engineer
with power to act :

A copy of the City Engineer's application for S.E.R.A, Funds,
heretofore approved by this Common Council, asking for financial assistance in the
repaving of First Street Southwest from Second Avenue Southwest to Fourth Avenue
Southwest. was read and President Liddle ordered that the same be placed on file;
the said application showing a need for $733.20 expenditure for relief employes and
$246920 City of Rochester expenditure for materials, truck time,etc. , a total of
$3202.40,.

by Bl E. Hughes, Chairman of the League of Minnesota Municipalities
Committee on gas franchises, was read and it was decided that it shall
not be andwered until such t ime as a B.T.II. test of the local gas has
been made.

adjustments for garbage service was read and upon motion by Milldr second
by Moody charge off of the amounts set forth was authorized.

after a discussion of tt9in which developed the fact that D. Twentyman is also
preparing to make the proper installations, a motion by Moody second by Amundsen

she intends to or not so that they may take action accordingly;
it being understood that the other three persons mentioned in

Upon motion by Lemmon second by Moody the sum of $10.00
was appropriated from the General Fund and it was ordered that the said sum
be paid to D. L. Wi111ams,Postmaster, for postage stamps for use of the City
Clerk.
The City Clerk reported that Perry M. Cranstan had
failed to qualify under his appointment April 23rd,1934, as Constable of
the Third Ward, at which motion by Green second by Fryer carried thatthe
said appointment be vacated and that Lloyd L. Bennett be lippointed
constable of the Third Ward of the City of Rochester, Minnesota, for the
unexpired tern lading on the first Monday in Apri191935.
Upon motion by Moody second by Fryer the claim of
$64i00 against C. A. Johnson for Community Room rental September 21st and
22nd, 19339 and the $3.00 account against Mrs: W. W. Smith for Community
Room rental November 20th919339 were each referred to the City Attorney
with instructions that he enforce collection.

tions was read and President Liddle ordered that the same be placed on file:

was read and Presidftt Liddle ordered that the same be placed on file.
A motion by Fryer second by Green that W. P. Krasel be granted
On Sale license to sell non-intoxioating malt liquors at 1120 Fifteenth Avenue
Southeast lost by the following vote: Ayes: Fryer_, Breen; Nays: Amundsen, Lemmon,
Miller, Moody.
A motion by Fryer second by Green that W. P. Krasel be granted
an Off ' Sale license to sell non -intoxicating malt liquors at 1120 fifteenth
Avenue Southeast lost by the following vote: Ayes: Fryer,Green. Nays: Amundsen,
Lemmon, Miller, Moody.
A motion by Moody second by Amundsen, that the applications of
Wm. Hb.ins for On Sale and Off Sale licenses to sell non -intoxicating malt liquors
at 15 Second Street Southeast be not granted carried by the following vote: Ayes:
Amundsen, Lemmon, Miller, Moody. Nays: Fryer, Green.
A motion by Lemmon second by Amundsen that John Joachim be not
granted an On Sale license tar sell non -intoxicating malt liquors at 605 Broadway
Street North, carried by -61f voiking in favor thereof.
A motion by Fryer second by Lemmon that Myer Sternberg be not
granted an On Sale and Off Sale licence to sell non -intoxicating malt liquors at
No.119 First Avenue Northwest 'carried by all voting i1n favor th'ereof.

The matter of license renewals for the Chateau Theatre and the
'Lawler Theatre was referred by President Liddle to the Building, Electrical and
Plumbing Inspector and the Chief of the Fire Department for report thereon at the
next meeting which is to be held on June 4th,1934,
Alderman Lemmon introduced the following resolution which was
read:
"Be it resolved by the Common Council of the City of Rochester,
Minnesota:
That the resolution passed and adopted by this Co:rmon Council,
May 7th,19349 awarding contract to the General Motors Truck Company, for an 8100 po
pay load capacity dump truck at a net cost of $2162.77 be and the said resolution
is hereby in all things repealed, reconsidered and cancelled, in that the said
Company is unable to furnish this truck in accordance with specifications. "
Upon motion by Lemmon second by Green that the said resolution

- Alderman Fryer as Chairman of the Public Grounds
Committee orally recominended that the proposal of Kris Sundby for the
repainting of the Williams Property building be accepted.
Alderman Green introduced the following resolution
which was read:
"Be it resolved by the Common Council of the City of
Rochester, Minnesota:
That the bid and proposal of Kris Sundby for the
furnishing of all labor, materials, etc., necessary for the repainting
of the outside of the business building on the Frank E.Williams Estate
Property, now owned by the City of Rochester, Minnesota, and Simon E. Stens-
rude, of Stewartville, Minnesota, in accordance with the specifications
for the said repainting, which are now on file in the office of the City
Clerk of said City, viz:.
For the total sum of 368.00
be and the said bid and proposal is hereby accepted.
The amount of the surety bond to be given by the
said contractor is hereby fixed at the sum of $36840040"
Upon motion by Fryer second by Amundsen that the

Alderman Fryer introduced a resolution appropriating
$806.86 from the Park Improvement Fund and ordering payment made to the
Mayp Trµst Fund for payrolls for labor during the week ending May 25th919349

Upon motion by Amundsen, second by Fryer, that the
said resolution be adopted as read, and all voting in favor thereof,
President Liddle declared the said resolution duly passed and adopted.
Alderman Amundsen introduced the following resolution,
which was read:
"Be it resolved by the Common Council of the City of
Ro the st era Minnesota;,
That the sum of ',1974.00 be and the said sum is hereby
appropriated from the Streetand Alley Fund of said City and ordered paid
to Purington Paving Brick Company for 659800 N0.1 n�" lug V.F.brick at
$32.00 per thousand F.O.B. Rochester, Minnesota, used on the repaving of
First Street Southwest from Second Avenue Southwest to Fourth Avenue
Southwest , under Job 1810.
The Mayor and City Clerk are hereby authorized and
directed to draw 'a warrant for said sum upon -the City Treasurer in
accordance herewith, and cause said payment to be madev

That the sum of $366.55 be and the said sum is hereby appropriate
from the General Fund of sai d Cit y and o rdered paid to Clara Bush and Fraser & Fraser
her attorneys, as and for payment in full of a judgment rendered in favor of the said
Clara Bush and against the City of Rochester. -
The Mayor and City Clerk are hereby authorized and directed to
draw a warrant for .said sum upon the City Treasurer in accordance herewith, and
cause said payment to be made. "

Aldermen Fryer introduced a resolution appropriating $190000,00
from the General Fund, Code 10, and ordering payment made to the City Farm Fund as
the proceeds from the sale of Certificate of Indebtedness No.11, being for financial
assistance in the operation of the City Hog Farm, which was read.
Upon motion by Fryer second -by Amundsen that the said resolution

Alderman Moody introduced the following resolution,which was
read:
"WHEREAS, The City of Ro chest er, Minnesota, has heretofore ent ere(
into contract for the construction and making of the following described local public
improvements, in said City, the cost and expense of which said improvements shall
be paid for partly by special assessments levied in the manner provided by luw, to -wit
The construction of a siphon section of trunk line sanitary sewer
commencing ten (10) feet east and ten (10) feet north of the center lines of Broadway
Street South and Third Street Southeast, and running northeasterly three hundred and
sixty-five (365) feet to a point fifty (50) feet south of the south line of Third
Street Southeast, thence northeasterly one hundred and thirty-five (135) feet to a
point fifteen (15) feet south of the north line of Third Street Southeast , thence
southeasterly fifty-seven and six tenths (57.6) feet to the center lines of Third
Street Southeast and First Place Southeast, thence east to the center of Third
Avenue Southeast and Third Street Southeast, thence south to the center of Third Avenu
Southeast and Fourth Street Southeast, which project is known and designated as a part
of P.W.A. Docket Number 1473.
THEREFORE, Be it and it is hereby resolved by the Common Council
of the City of Rochester, Minnesota:
That the said Common Council will meet rtat 2:00 o'clock P.M., on
July 2nd, 1934, in the Council Chambers, in the City Hall, in said City, and will at
said time and place levy special assessments for part of the cost and expense of the
making and construction of the improvements above described, according to the resoluti
heretofore passed and adopted by the said Common Council determining the mode of said
special assessments. The City Clerk is hereby ordered and directed to cause notice of
the time and place of said meeting and of the purpose for which the said meeting is tc
be held, to be published once in the official newspaper of said City, not less than tE

for having wrecked the Police Chevrolet automobile.

expend an additional ,$50.00 over and above the $200.00 levy made in
the 1933 tax.

.survey and recanmendations relative to the improvement of the Center

that the Public Utility Board be requested to install str^et lights as
follows: one at the intersection of Sixteenth Avenue Southwest and Sixth
Street Southwest and one at the intersection of Eleventh Street South-
east and First Avenue Southeast, and one on Eleventh Street Northwer�t
between Second Avenue Northwest and Fourth Avenue Northwest.
