HomeMy WebLinkAbout06-04-1934237 Minutes of a regular meeting of the Common Council of the City of Rochester, Minnesota, held in the Council Chembers, 'in the City Fall, in said City, at 2:00 o'clock P.M., on June 4th,1934. Me:dting?. balltd,, td.:;order by President Liddle. Roll Call. Present: Liddle, Amundsen, Fryer, Green, Lemmon, Miller, Moody. Absent: None. This being the time and place fixed for the opening of proposals for the furnishing and installation of acoustical treatment on the ceiling of the City Clerk's Office in the City Hall, the following proposals were opened and read: Luse -Stevenson & Company $593000; G. Schwartz & Company $715:00. Alderman Amundsen introduced the following resolution, which was read: "Be it resolved by the Common Council of the City of Rochester, Minnesota: That the bid and proposal of Luse -Stevenson Co. of Chicago, Illin ois, for the furnishing of all labor, materials, etc., necessary for the placing of acoustical treatment on the ceiling of the City Clerk's office in the City Hall, in the City of Rochester, Minnesota, in accordance with specifications for this improve went which are on file in the office of the City Clerk of said City, viz: Furnishing and installation of acoustical treatment on the ceiling of the City Clerk's Office in the City Hall, in the City of Rochester, Minnesota, at a total cost of $593.00. The acoustical treatment shall be 1" Absorbex Acoustic Tile, and shall be 9" x 18" tile, light cream No.l, and 9" x 9" tile, ivory No.39 laid diagonally at an angle of 400 across the ceiling, and each of the four spaces formed by ceiling be;Ms will be bordered by 1" Absorbex Acoustical Tile, light cream No.l, out 9" x 36" and 5" x 36"9 laid one below the other to form a moulding as sketched on their proposal; be and the said bid and proposal is hereby accepted. The amount of the surety bond to be given by the said contractor is hereby fixed at the sum of $5934009,." Upon motion by Miller second by Fryer that the said resolution be adopted as read and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted: " The following remonstrance against sidewalk construction was read and President Liddle referred the same to the Street and Alley Committee: "We, the undersigned, DO NOT want a side walk on Fourth Ave. S.E. between Tenth and Eleventh Streets: Lots No. 10 J. Amundson Member City Engineer. " The matter of replacing pavement abutting the Earl A. Vine property at the intersection of Fourth Street Southwest and Broadway Street South was upon motion by Lemmon_ second by Amundsen referred to the the Street and Alley Committee, &hd/City Engineer, for report thereon at the next meeting of this Common Council. President Liddle referred Mr: T. F. Kennedy's explanation of simple explosion insurance for the City T.T-all'building to the Insurance Committee: A petition signed by many residents in the locality' concerned, headed as follows, was read and President Liddle referred the said petition to the Street & Alley Committee, the City Engineer and the City Attorney: "We, the undersigned, do hereby petition your 11onorable Body to clean up the banks and general surroundings of Cascade Creek Bridge in the vicinity .of. Fourteenth Street Northwest, Rochester, Minnesotaw " Tpdn.mation by Amundsen second by Moody it was ordered that the certified check accompanying the bid of GO Schwartz & Company for furnishing and installation of acoustical treatment be returned to them. The report of the City Treasurer for the month ending May 319t919349 showing $2679600:04 on hand, was read and Prenident Liddle ordered that the same be placed on file4 The report of the Building, Electrical aAd Plubbing Inspector for the month of May,19349 showing $35J0 building inspection fees, $24.i50 plumbing inspections and $16.25 electrical inspection, was read, and President Liddle referred the same to the Finance Committee.' 239 The report of the Clerk of the Municipal Court for the week ending June 4th91934, showing *.criminal fines collected $131.40, civil Pees received $1.60, conciliation court fees $1.009 $72075 received from Olmsted County for April t1934 Municipal Court --ftasy Court costs charged to Olmsted County $7.00, and fires collected due to Olmsted County $10.00, was read and President Liddle referred the same to the City Attorney. Upon motion by Lemmon second by Moody the sum of $10.00 was appropriated From the General Fund and it was ordered that the said sum be paid to Olmsted County, Minnesota, for local Municipal Court fines collected due to Olmsted County. The following report made by the Sanitary Inspector was read and President Liddle ordered that the same be placed on file: " CITY OF ROCHESTER& MINNESOTA Health Department June 4th, 1934 To the Common Council City of Rochester, Minnesota Gehtlemen: A general clean-up inspection in the City of Rochester was made during the month of May 19340, There were seven (7) legal notices served to different parties to clean up and remedy Insanitary conditions existing on their premises. A ,second inspection was made ten (10) days later to see if all parties receiving such notices complies with same. There were also eleven (11) legal notices given to property owners to connect up with city sewer and water. This notice was given to make such changes in sixty (60) days. Corrections are to be made as requested by said notices. One permit for filling in on a vacant lot was issued. Yours respectfully, Goo. F. Strifert Sanitary Inspector " The application of Chris Dillon for a license to connect with sewers and drains was read and upon motion by Moody second by Fryer, license was granted. The license bond of Chris. Dillon covering his license to connect with sewers and drains with the Fidelity & Casualty Company as surety thereon in the amount of $19000000 was read, and upon motion by Moody second by Amundsen, the said surety was accepted, the said bond was approved and it was ordered that the same be placed on f ile. The application of R. M. Week for a soft drink dealer license at 1137 Second Street Sout hmest was read and upon motion by Amundsen second by Moody license was granted. .f 9�o The application of Merril Owens for a drivers license was read and upon motion by Lemmon second by Amundsen license was granted. The applications o :`.' the Rochester Amusement Company for motion picture licenses at the Chateau Theatre and the Lawler Theatre were each read and upon motion by Moody second by Fryer licenses were granted. The following communication was read and upon motion by Miller second by 1iuundsen the City Engineer was authorized to comply with the request: '"Rochester, Minn: June 21 1934 Hon. Mayor & Common Council Gentlemen: Would you please sell me three sacks of calcium chloride, and also, have it spread around my A. & W. Root Beer Stand, opposite the Chicago Northwestern R.R.Station. i My main reason for asking this request is for sanitary purposes, and also for allaying the dust.. - might be. " . , , Upon motion by Lemon second by Amundsen the City Clerk was, instructed to draft, a reeolutipn providing authority to the Public Utility Board for the refundment of water main assessments heretofore levied against properties within the City of Rochester, Minnesota. Mrs. Leo F. Mickartz was before the Common Council relative to removal of earth from the street (14th Street Northwest) in front of their property for fill in the brIp"ach to the Fourteenth Street Northwest Bridge over Cascade Creek and President Liddle referred the matter to the Street and Alley Committee and the City Engineer. Upon motion by Green second by Lemmon the Public Utility Board were requested to install a street light a� the intersection of Second Avenue Northwe and Thirteenth Atreet Northwest. A communication from Paul G. Sandell, Business Manager of the League of Minnesota Municipalities, relative to the City of Rochester share in cuts used in the convention issue of the "Minnesota Municipalities" was read and President Liddle ordered that the same be placed on file. The appointment by the Mayor of Chas. Jordan as a Special Policeman for duty on the property of Dr• W. J. Mayo, and of George Schmelzer as a Special Policeman for duty at the National Guard Armory, each to serve without pay a to hold office until the , second Monday in April, 19359 were read and President Liddl ordered that the same be placed on file. 242 The following certificate relative to Inspectors time was read and President Liddl a ordered that the same be placed on file: " June 11 1934 Hon. Mayor & Common Council Gent 1 em en : The time of Mr. Walter Hoganson, for the last one-half of the month of May has been -expended as follows: 14th St. N.W.Bridge 10% 4th St. S.E.Bridge 90%. Hon: Mayor & Common Council Gentlemen: t This Department, acknowledges receipt of 30 ton of calcium chloride from HaSres-Lucas Lumber Company: This shipment arrived in paper sacks, Bearing only e. stencil Number. The , containers bore no manufacturers brand, or analysis of contents This office notified the contractors at once and was assured the necessary information would be provided at once. This ]gas not been done. This office is furnishing no estimate for calcium chloride furnished by contractor for the reasons heretofore stated. 245 This communication is furnished as evidence of good faith on the part of the City, and that payment would be made, less the allowable discount, had the contractors lived up to the. contract and specifications. A Hicks Rochester, Minnesota: Dear Mr: Hicks: Omaha, Nebraska June 1, 1934� The BTU content of the natural gas distributed in Minnesota is maintained at 1000 BTU or better. The average daily calorimeter readings show the BTU content of this gas has been consistently around 1005. For all practical purposes this may be used as the correct figure. Yours very truly, G. B. " The following communication relative to Library matters was read and President Liddle ordered that the same be placed on file: Rochester Public Library • Rochester : Minnesota June 1, 1934. Dear Mr. Wright: What have you in the line of TAXES ????? When looking over our balances, will you please notice code no.l - period- icals; the renewals will be made for next year's magazines in August for the first of October and the bill to be paid either in September or October, when it is presented. Newspapers renewed separately. Code No. 2 - Binding; all the yearly volumes of periodicals are bound in the summer, also books rebound from school collections in childrens' room, several hundred books are now being bound. Code no. 13 - Books; I will have to take some from the Hurlbut Fund this month, please give us as much as possible for summer buying. Other items you will notice yourself ------ EXCEPT Code no. 69 Code no. 7 - just prepare to CASH the $519912.22! For after the voting on June 16, and before the library topples over entirely, we will have to take our little nett -egg and prop it up, get new chairs and otherequipment and --build on towards the lwundry, and settle down for the rest of this century. And then there will another question to worry us - does that $51,912.22 mean just bricks and mortar, or does it mean furnishings also ???? The following report from the Hea Ith Officer was read and upon motion by Amundsen second by Green it was ordered that the same be placed on file and the On Sale and Off Sale licenses to sell non - intoxicating malt liquor heretofore granted and issued to Lillian Scherer was revoked because of her noncompliance with sanitary regulations: " CITY OF ROCIrESI'ER, MINNESOTA Department of Health June 19 1934 Mr. A. F. Wright City Clerk City Dear Sir: Replying to your communication of May 29th in regard to Lillian Sherer, at 221 First Avenue S.W. She has not complied with the sanitary regulations in that she has not provided guit,abl a water closets and has no equipment installed for disinfecting of drinking glasses and washing of hands. Upon motion .by Moody second by Fryer that the said resolution be adopted an read, and all voting in favor thereof, Pr,esidelit Liddle declared the said resolution duly passed and adopted. Alderman Moody introduced the following resolution, which was read: "Be it resolved by th a Common Council of the City of Rochester, Minnesota: That the sum of $202.08 be and the said sum is hereby appropriat $198.48 from the General Fund, and $3.60 from P.W. A. Docket No.1473 Fund of said City and ordered paid to Rochester Post -Bulletin, for official printing and publica- tions, during May,1934. The Mayor and City Clerk are hereby authorized and directed to draw warrants for said sum upon the City Treasurer In accordance herewith, and cause said payment to be made. E: Souther, Inc-9 for partial estimate No.49 on contract for the construction of a bridge on Fourteenth Street Northwest over Cascade Creek, under Job 18060 The Mayor and City Clerk are hereby authorized and directed to draw a warrant for said sum upon the City Treasurer in accordance herewith, and cause said payment to be made." The Mayor and City Clerk are hereby authorized and directed to draw a warrant for said sum upon the City Treasurer, in accordance herewith, and cause said payment to be made. Fraser & L.M.Feller, for Partial Estimate No.3, on construction of a siphon section of trunk line sanitary sewer in parts o.i Third Street Southeast and Third Avenue Southeast under Job 1809. The Mayor and City Clerk are hereby authorized and directed to draw a warrant for said sum upon the City Treasurer in accordance herewith, and cause said payment to' be made." Upon motion by Moody second by Amundsen iV was ordered that a resolution be prepared fixing a hearing on the construction of a sanitary sewer in Hirst Place Southeast from the center of Third Street Southeast to a point 60 feet North of the north line of Fourth Street Southeast: It was reported that Matt Fitzpatrick has a client who wants the City of Rochester to fix a sale price on the so-called Williams Business Propert., and President Liddle referred the subject to the Public Grounds Committee, Mr• H.O. Christensen, Supervisor of the Williams Properties, and Mr. Simon Stenstuck, a 3/8 owner of the Williams Business property. Upon motion by Lemmon second by Moody it was authorized that the Chief of Police and two Patrolmen attend tbre Minnesota Police Association Convention at Hibbing, Minnesota, at the expense of the City of Rochester, Minnesota: Upon motion by Moody second by Green it was authorized that the Chief of the Fire Department and two Firemen attend the Firemen's Convention at Hibbing, Minnesota, at the expense of the City of Rochester, Minnesota.
