Roll Call: Present: Liddle, Amundsen, Fryer, Green, Lemmon, Miller, Moody. Absent: None. The call for the special meeting was read; said meeting being called for the purpose of announcement of President of the Common Council appointment! of 1934 Equalization Board members, payment of the great accumulation of claims, save' discount on Standard Oil Company paving filler billing, and any other business that the said Common Council might deem proper. The following appointment of Equalization Board Members was read and President Liddle ordered that the same be placed on file: 0 Honorable Mayor and Common Council, City of Rochester, Minnesota Gentlemen: "Ro chest er, Minnesota, June 14th, 1934: I hereby appoint the following persons as members of the City Board of Equalization for the durrent term: Tom Moody Ben Amundsen Fred Miller. Respectfully submitted, W. R: Liddle President of the Common Council of said City. " The report of the City Weighmast er, fo r the month of May,1934, showing $8 70 collected in weighing fees was read and President Liddle referred the same to the Finance Committee:. The report of the Health Officer for the City Farm for the month of May,19349 showing receipts $1549:57, disbursements $1506.12 and a balance on hand of $603:90 , was read and President Liddle ordered that the same be placed on file. The City Engineer's Department trial balance for May919349 was laid before the Common Council and. President Liddle ordered that the same be placed on file: The report of the Clerk of the Municipal Court for the week ending June llth919349 showing criminal fines collected $393.20, civil fees received $3.60, conciliation court fees received $2.59, court costs charged to Olmsted County.$7.959 fines collected due to Olmsted County $20;00, and fines collected and remitted direct to State Treasurer $6.009 was read and President Liddle referred the same to the City Attorney. Upon motion by Moody second by Amundsen the sum of $20.00 was appropriated from the General Fund and it was ordered that the said sum be paid to Olmsted CouAtyg Minnesota, for'lo6al. municipal court tines colle6ted due to Olmsted County. General balance sheets trial balances fund statement, statement of unexpended budget appropristioneg statement of Sinking Fund Investments, etc., prepared by the City Clerk as of May 31dt919349 were laid before the Common Council and President Liddle'ordered that the same be placed on file. The application of Nat Tegum for an auctioneers license was read and as it was not accompanied by a surety bond, motion by Amundsen second by Fryer carried that the City Clerk communicate with Mr. Tegum and inform him that a surety bond must accompany his application, from.which order the City Clerk addressed Mr: Tegum as follows' "June 159 1934. Mr. Nat Tegum, c/o Henry Blickle, Rochester Minnesota. Dear Sir: - I am returning herewith the Auctioneer License,Bond which you filed with your application for an Auctioneer's Licenses as the Common Council does not accept personal bonds guaranteeing licenses, contracts, or any other transactions where bonds are required; so therefore you will present a surety bonds written by some surety oompany authorized to do business in the State of Minnesota. This is no reflection on your sureties. Mro Co B'9 Kjerner and Mr. C. F. Dabelsteing as they are financially reliable, etc. Yours - truly, A.-F. Wright City Clerk. The application of Martin Paulsen for license to connect with sewers and drains was read and upon motion by Moody second by Amundsen license was granted. The license bond of Martin Paulsen covering his license to connect with sewers and drains, with the Fidelity & Cp-sualty Company of New York as surety thereon in the amount of $1.000-00, was read and upon motion by Fryer second by Green the said surety was accepted, the said bond was approved and it was ordered that the same- be placed on file. The application of John Joachim for a soft drink i. dealers license at No.805 Broadway' Street North was read and upon motion by Moody second by Amundsen, license was grantbd.i 253 ;1. te- 6 The following License Coanittee recommendation was read and upon motion by Moody second by Fryer, Myer Sternberg was granted the soft drink dealer license mentioned: "-Rochester, Minnesota, June 149 1934. Honorable Mayor and Common Council, City of Ro chest er, Minnesota. Gentlemen: We, the License Committee of the Common Council of said City recommend that Myer Sternberg be granted a soft drink dealer license at No. 119 First Avenue Southwest, under and in accordance with his application presented May 7th,1934. Respectfully submitted, THE LICENSE COMMITTEE ' B.- Amundsen, Chairman Tom Moody, J. T. Lemmon. " The petition of Jahn J. Fitzgerald, 0. C. Erickson, R. H. McDermott, and George W. Torrence, that a sidewalk be constructed on the west side of Fourth Avenue Southeast from First Avenue Southeast to and including Lot 14 in Laura Domke's Sub -Division, was 'read, as was the following quoted Street & Alley Committee recommendation: "Rochester, Minn. June 14, 1934 Honorable Mayor & Common Council City of Rochester, Minnesota. Gentlemen: The Street and Alley Committee recommends that the petition of residents and property owners for a sidewalk on the west side of 4th Ave. S.E. from 10t h St. S.M. to Lot No. 14 and including Lot No.14 of Laura J. Domke's Subdivision be granted. Street & Alley Committee By F. W. Miller, Chairman Tom Moody B. Amundsen. " Upon motion by Green second by Miller the Street & Alley Committ recommendation relative to the Fourth Avenue Southeast sidewalk+;petition was accepted and the City Engineer was instructed to include it in his 1934 recommenda- tion for sidewalk construction. I Public Utility Board members appeared before the Common Council �I and informally asked for authority to furnish electric servico to the proposed lighting 'of the intersection of Trunk Highways Nos. 14 and 52, at the south end of Broadway Street South, at which motion b,r Lemmon second by Moody carried that the City Clerk be instructed to draft a resolution providing authority that the Public Utility Board furnish electric services in accordance with their informal request. 2, 254 I� i The following communication was reed and upon motion by Fryer second by Amundsen, the application mentioned was approved: ` "Office of. CHAS. H. AWSTRONG-, CITY ENGINEER i Rochester, Minnesota June 139 1934 Hon. Mayor & Common Council i Gentlemen: I am this date, submitting to the Local E. R. A. kj Committee, application for ten laborers for a period, covering II 6221 hours labor, to be expended in the Stripping of the over- is i burden from the Gravel Pit at the Henry Grassle Farm. In the event this application is approved by the F.R.A. and the labor is furnished, it is estimated that the Pit ?, may be stripped to a width of fifty ft., along the south side for a distance of 300 ft., east and west. The work will call for the removal of 8555 cubic yards of over -burden, which will be handled by wheelbarrows. . +' There will be no cost to the City, except, it be for wheelbarrows, picks and showeXs, and this cost need not exceed, @1 $100.00. l , Respectfully, C. H. Armstrong City Engineer." A copy of the certificate made by certain members of the Common Council that they witnessed the burning by the Sinking Fund Commission of certain described paid and cancelled bonds,interest coupons, and certificates of indebtedness, was read and President Liddle ordered that the same be placed on file. The following copy of resolution passed and adopted by the Sinking Fund Commission was read and upon motion by Moody second by Amundsen the action set forth therein was approved and it was ordered that the said copy of resolution be placed on file: . "Be it resolved by the Commissioners of the Sinking Fund of the City of Rochester, Minnesota: That the sum of $8 9294.04 be appropriated from the Sinking Fund and paid to the Interest Fund to apply on the July 1st, 19349 maturity of interest on City of Rochester Electric Light bonds 1 f - and Water Works Bonds, $645.34 thereof to be from Code 22 Sinking Fund, j as the accumulation of interest on investments for water works bond maturities transferred to pay interest on Water Works bonds, i.e. to Interest. Fund, Code 59 and $7648.70 thereof to be from Code 7 .Sinking �i Fund, as the interest accumulations on investments for Light Bond �) II maturities transferred to Interest Fund Code 4, for payment of interest on Electric Light bonds. " The following appointment by the Mayor was read and President Liddle ordered that the same be placed on file: --- 255 " June 139 1934. Honorable Common Council City of Rochester, Minnesota Gentlemen: Under and in accordance with State Laws made and provided, I hereby appoint Fred R. Witzke as Weed Inspector for the.City of Rochester, Minnesota during the season of 19349 with provision and understanding; that the cost of his services and the deferred expedditure for weed cutting shall not exceed the funds on hand for .that purpose. Respectfully submitted, Julius J. Reiter Mayor of said City. " The following communication was read and President Liddle referred the same to the Street & Alley Committee and the City Engineer: 0316 Sixth Street South Rochester, Minnesota, June 19 1934. A. P: Wright, City Clerk, Rochester, Minnesota. Dear'Sir: - Will, you call attention to this letter at the next meeting of the council3 I should like to have a drain placed in the street, at the corner of i#y property, fourth avenue and sixth street southwest. The drain has always been on the high side of the street, and tie water has always run over our corner*. When the street was to be repaved, I spoke to the city engineer, Mr. Liddle, and other councilmen. The engineer said that when the new paving was in, the water would be carried away properly. However, the new drain has been no diffevent. Is it possible to have some definite action taken in regard to this matter3 Very truly yours, 0. 0. Baker-" upon motion by Amundsen second by Moody the Chief of Police was authorized to expend not to exceed $100.00 in connection with Safety Council activities. Communications from the manufacturex's representative and from the City Hall contractor relative to City Hall door mats and adjustments for poor service received, were read, and upon motion by Moody second by Fryer the Custodian of the City Hall was instructed to send the rubber door mats from the main and south entrances to the City Hall, by prepaid freight, to the Toledo Rubber Products Company of Middlefield,0hio, for their inspection and offer for adjustment y The City Clerk reported the receipt of $�37.49 from the Franklin Heating Station as one half cent per thousand cubic feet on 1794979000 feet of f 2 256 natural gas used there during May, 1934 i Upon motion by Ibundsen second by Moody the City i, Clerk was authorized to sign a commercial "consumers contract No.T.W.68 in II duplicate with the Standard Oil Company in order that the City of j Rochester, Minnesota filling station may receive an additional one cent per gallon discount if .:mere!:,.thah 3000 gallons per month of gasoline id furnished there. The following communication and estimate by the City Engineer was read and President Liddle ordered that the same be placed on file: " June 14, 1934 Hon: Mayor & Common Council Gentlemen: This is to advise that Hayes -Lucas Lumber Company have complied with contract specifications, and have furnished to this Department, certificate of analysis and name of manu- facturer of the 30 ton of calcium chloride furnished this depart- ment. ' We, therefore, furnish to you, the following estimate in favor of Hayes -Lucas Lumber Company: 30 - ton calcium chloride, Car No. P.M. 85944 ® , $26.00 per ton, less $0.21 per ton discount $773.70 Respectfully, C. H.'Armstrong City Engineer." The following petition was read and President Liddle ordered that the same be placed on file: To the Mayor and City Council Rochester, Minnesota. We, as members of the United Workers Association of Olmsted County, ask your assistance as public officials to accomplish our desire to obtain jobs sufficient to take us from relief rolls. We feel that relief rolls must stop growing, heads of families who earn a hundred dollars per month or more must be satisfied and until there is a real demand for their labor must keep their wives off jobs needed for fam- ilies having no means of support. Your problems as officers of the county, city and community are the same as our and those are to get families on a safe self supporting basis as soon as possible. Until the time comes that every able bodied man or woman is off the relief roll, we - ask that no married woman whose husband is earning a hundred dollars or more per month be permitted to work or take jobs from workers wo must work or gonon relief:► A. Smith of the League of Minnesota Municipalities Executive Offices offert* free information from their ..arming data compilation, was read and President Liddle referred the same to `the Rochester Chamber of Commerce with instructions to the City Clerk that he inform them of the reference,at which the City Clerk addredsed the following communication to them: "June 15th, 1934. Mr. Dyer H. Campbell, Secretary, Chamber of Commerce, City. Dear Sir: At a meeting of the Common Council, held last evening, the offer of the League of Minnesota Municipalities to furnish their zoning service to interested municipalities was referred to the Rochester Chamber of Commerce for their consideration as to accept- ance of the League offer to send their specialist on this subject here with all his assembled data for exposition at a public meeting, say at a "Smoker" arranged by the Chamber of Commerce. This service and all the valuable information we would gain from such a meeting will be without cost to the City or the Chamber of Commerce, so it -looks like a very sweet proposition for us to take on. I will be glad to hear what your. Directors or Committee decide on the matter. Yours truly, A. F. Wright City Clerk." Upon motion by Green second by Fryer the City Clerk was instructed to serve notice upon the Public Utility Board that it is this Common Council's order that the water service now furnished to the Lo E. Kennedy Tourist Camp and to the filling station at the Northwest corner of the intersection of Second Street Southwest and Sixteenth Avenue Southwest be both disconnbnhed and discontinued, at which the City Clerk addressed the Public Utility Board as follows: " June 15th, 1934 . Public Utility Board, City of Rochester, Minnesota. Attention: Mr. A J. Lentfer, Secrhtary. Gentlemen: The Common Council of the City of Rochester, Minnesota, at a meeting held last evening, ordered that your Board cause the disconnec- tion of the water service now furnished to L.E.Kennedy's tourist camp, and to the filling station at the northwest corner of the intersection of Second Street Southwest and Sixteenth Avenue Southwest, so please comply with this order at your earliest convenience. Yours truly, A. F. Wright City Clerk. " The City Clerk reported that Mr• Chas. L. Alexander as Justice of the Peace appointed for the First Ward, and I;loyd L. Bennett as a Constable appointed for the Third Ward, recently made, did not qualify within the prescribed 258 time and consequently the appointments are void and the said offices are again vacant. Upon motion by Green second by Moody Lloyd L. Bennett I was appointed Constable of the Third Ward for the term ending on the first j Monday in Apri1,1935, and the City Clerk notified him as follows: II " Iune 15th, 1934. Mr. Lloyd L. Dear Sir: The Common Council, at a meeting held last evening, again appointed you Constable of the Third Ward of this City, for the term ending on the First Monday in April, 1935. Alexander was appointed Justice of the Peace of the First Ward for the term ending on the first Monday in April, 19359 and the City Clerk notified him as follows: " June 15t h , 1934 Mr. Charles L. Dear Sir: The Common Council, at a meeting held last evening, again appointed you Justice of the Peace of the First Ward, of this City, for the term ending on the first Monday in Apri1,1935. �j You have ten days from the date of this notice in which to qualify by taking the oath of office and filing the required official bond. Upon motion by Lemmon,second by Green that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adoptedf Alderman Moody introduced the following resolution, which was read: "j9EFREfi-S, In the, past petitioners have asked that water mains be installed and assessments levied against their Property for the costs thereof, which occured in locations where the probable revenue at the time of installation would not warrant the investment of Public Utility Funds for the revenue possibilities, and 265 "YTEREAS, Refunds of the water main assessments have been made to the persons who have improved their property and have commenced the use of water service, althaq gh at this time there is a cash reserve on the Public Utility Depart- ment books of tIi)et,139.39wfor thse paymentes o the assessments against the properties no which are y g WHEREAS, The water main assessment mentioned has in many cases been cause of a delinquent -tax against the properties assessed in that the owner was always able to pay the regular real estate tax but when the water main assessment was added to it he could not pay the new total, and so was compelled to allow his taxes to go delinquent, and WHEREAS, The economic conditions have changed since the laying of these water mains until now it is the uniform plan of all the national, state and municipal subdivisions of government to release and put into circulation all availab: money to bolster up the buying power of the public, and WHEREAS, It is the opinion of the Common Council of the City of Rochester, Minnesota, that, regardless of the conditions surrounding the levying of the assessments for these water mains, all such provisions should be disregarded an the assessments that have been paid by property owners, who have not yet been reimbursed, be appropriated to then provided that they show the proper evidence of the assessment payment; "SO THEREFORE, Be it resolved by the Common Council of the City of Rochester, Minnesota% That the Sinking Fund Commission of said City is hereby authorize( to sell sufficient of the Water Works Extension Sinking Fund Investments to pay the above mentioned $189139.39 total of water main assessment accounts, and place the funds realized thereby in the Public Utility Fund in the City Treasury for that purpose, and Be it further resolved by the said Common Council: That the Public Utility Board of said City be and the said Board hereby respectfully requested to appropriate the sums due to the persons involved in the $18,139.39 total as a return of t .e assessments against their property for water mains laid, which reimbursement or refund may be made only upon the presenta- tion and f iling of the original or copy of a Treasurer of Olmsted County tax receip, showing the payment of the assessment along; with real estate taxes or the original or copy of the receipt from the City Treasurer of Rochester, Minnesota, showing that the water main assessment was paid direct to the City Treasurer; the Mayor and City Clerk of said City being hereby authorized and directed to draw warrants upon the City Treasurer and make payment for all of the appropriat inns made by the Publi Utility Board on duly prepared claims for the above mentioned refunds.
