Minutes of an adjourned regular meeting of the Common Council
of the City of Roe!-iester, Minnesota, held in the Council Chambers, in the City Hall,
in said City, at 7:30 o'c&ock P.M., on June 25th91934.
Meeting called to order by President Liddle.
Roll Call._ Present: Liddle, Amundsen, Fryer, Green, Lemmon,

Miller, Moody. Absent: None.
Upon motion by Moody; second by Fryer, the minutes of the
meetings held on May 21st 91934 , and May 2Bth91934 9 were each approved.
Upon motion by Lemmon second by Amundsen, the recorded minutes
of a meeting of the Common Council of the Cily,,of Rochester, Minnesota, held on
May 17th919349 as shown on Page 291 in Book T. were corrected from:

The report of the Clerk of the Municipal Court ffr the week
ending June 18th919349 showing criminal fines collected $$252.859 civil fees received
$$.95, court costs charged to Olmsted County $270051, fines collected due to Olmsted
County $30 00, and .fines collected and remitted direct to State Treasurer $$205000�
and for the week ending June 25th,19349 showing criminal fines collected $193.859
civil fees received $10.409 conciliation court fees $$2.759 court costs charged to
Olmsted County $19.15, and fines collected due to Olmsted County $10.009 were each
read and President Liddle referred the same to the City Attorney:.
Upon motion by Miller second by Moody the sum of $$40.00 was
appropriated from the General Fund and it was ordered that the same be paid to
Olmsted County,Minnesota, for local Municipal Court fines collected due to Olmsted
County. I
The report of the Public Utility Board, prepared by the SecretaY
of the said Board, as at May 31st,1934, was laid before the Common Council, and
President Liddle ordered that the same be placed on file} the income statement
in connection with the said report showing $3111.14 net income in the Light Depart-
ment for the month of May,19349 $12,927.73 net income for the two months of this
fiscal year; $2688.88 net income for May,19349 in the Water Department operation, and
$3177012 for the two months of this fiscal year; a net loss of $4.58 for May,19349

for licensesto sell non -intoxicating malt liquors at No.119 Broadway
Street North were each read and upon motion by Fryer, second by Amundsen,
licenses were granted.
The applicationsof Johanna T. Matulys, Mrs • Lloyd
Baldwin, E. A. Knowlton Company, Wm. Hein:;, and Ho' E. Randahl, for soft
drink dealer licenses, were each read, and upon motion by Fryer, second by

We have been advised that the Company in which we
carried our insurance is in questionable financial circumstances,
( and although still solvebt, we believed it adviseable to cancel
li coverage in this Company and mibmit a new policy in the Creat
Lakes Casualty of Detroit, Michigan, which company enjoys a very
high rating. '
Please therefore substitute the attached policy for the
one now on file-.
7 . You will note that this policy become-s effective May 26th,
1934.. It was necessary for us to cover this way for a full year to
eliminate a short rate charge; however, on April 1st ,1935 a new
• policy will be written on a prorata basis to conform to License dates.

To the Honorable Common Council

Gentlemen:
We the representatives of, the United Workers Association respect-
Pully request your honorable body to take the necessary steps to construct
the south end of the trunk line sewer, from Third Street Southwest to Sixth
street Southwest and thence -west on sixth street- southwest to relieve the
lift in Soldiers Field Park
Employment conditions in Rochester are very bad at the present. time.
State Ro¢Ld Work on highway 59 south of Rochester is about completed and sewer
work on Broadway will be finished soon. There are very few jobs to be had:
The United Workers Association has a membership of about 400 who
nearly all have families to support. It is nearly impossible for these married
men to leave their families and go out.of town to work. They should be
employed at home.
This sewer must be built in the very near future on account of
river pplution from Dairy, Garages and Canning factory and we feel that your
honorable body should immedialy start this sewer construction work so that
our families may be kept together.
We also petition you to do this work under supervision of the City
Engineer and not by contract.

We also ask that steam shovels and like machinery be kept from the
new library project and do the excavating and such work by hand labor:

-Rherein the Board of Park Commissioners asked for funds for use in Slatterly Park
and Old Mill Park, $13,233:00, for relief employes, $637.90 for non -relief employes,
and total estimated cost of $908.95 to be paid from local and or state funds, making
thetotal project expenditure to be $14,778.85,was read, and upon motion by Fryer sec
Iby Green the application was approved.

by Fryer second by Moody the wood blocks mentioned were donated for
distribution to needy persons, with provision that they shall only be
distributed to citizens of the City of Rochester, Minnesota:

The city has some wood blocks at the disposal plants which will
be destroyed in some manner. This is excellent fuel and we ask
that you request the council that we be given permission to haul
them to our wood lots for relief purposes.
We have been paying the city $1.00 per cubic yard for this full.
It was with a rather indefinite understanding that our orders were
cancelled later. However, to handle it out of our own wood lot
would save us considerable bookkeeping and serve the same purpose.
Anything you could do to allow us to haul this material to our wood
lot would be much appreciated. Thank you.

Thomas Fraser, as attorney for Clara Geraldine Bush,
asked for improvement of the st.teert drainage in front of her property on
Sixth Sheet Southwest , and President Liddle referred the matter to the
Street & Alley Committee and the City Engineers
Arthur R. Nachreiner, President of the Board of Park
Commissioners, asked for Sunday life guard services at .Slatterly Park
bathing pool, and upon motion by Fryer second by Amundsen the City Clerk

was instructed to request of Mr. Hendrickson, that such service be granted; the City
Clerk communicating with Mr. Hendrickson as follows:

last evening, asked that Sunday life guard service be furnished at
the Slatterly Park bathing pool, so this is respectful request that

The City Clerk reported that effective June 22nd919349 local
service station prices for gasoline have been reduced two cents per gallon and that
the local gasoline companies *buld not allow the same reduction on tank wagon prices,
the service station prices having been 389 cents per gallon and now reduced to 16.9
cents,with tank wagon prices remaining at 16.9 cents less one cent federal tax
exempt in favor of city purchases or in other words an individual would pay 16.9 C8.
under the out for gasoline at service stations or 16.9 if he were to buy it in tank
wagon lots of 400 gallons:
The City Clerk gave the net cost of gasoline on this date, i.e.
for the quality known as 60-62 400 65 and up octane, Chicago 4:75 cents, freight
20177 cents, inspection :04 cents, state tax 3 cents, federal tax one cent, total
11.56 cents, which is sold to individuals through service stations or tank wagon
lots for 16.9 cents or a profit of 534 cents on each gallon sold; their net cost on
gasoline furnished to the City being 10:56 cents as the City is exempt for the
federal .tax, making a net price to the City of 159 cents, but with the same profit
of 5434 cents.
After a discussion of the gasoline situation, motion by Miller
second by Amundsen carried that the City Engineer be instructed to prepare plans,
specifications and estimate of cost for the construction of a bulk gasoline storage
station, for the loading and unloading facilities, for gasoline hauling equipment,
also that he secure a location for the bulk station.
The following communication was read and President Liddle orde
that the same be placed on file:

intersection; the Highway Department to furnish and install the
lighting standards and the City Light Plant "to furnish and install
the necessary cable and wiring for the said standards:

The appointment by the Mayor of Wm. Fetzer as a
Special Policeman for duty at the Rochester Egg & Poultry Company property,
he to serve without pay and to hold office until the second Mondpy in
Apri191935, unless sooner removed, was read and President Liddle ordered

The following ruling by the Attorney General was
read and President Liddle ordered that the same be placed on file:

Dear Sir:
Your letter to Attorney General Harry F: Peterson, under
date of May 21st, has been referred to the undersigned for attention.
Therein you state that fran time to tinfe the City of
Rochester finds it necessary to hold bond elections for the purpose
of having voters of the city vote on the question of whether or not
the city shall issue its bonds for certain purposes; and that, the
question has arisen as to the possibility of having voters at these
bond elections allowed to .vote at, such election "only in case they
were, at the time bf such election, actual taxpayers of the City of
Rochester." '
You inquire:
"Does it require a, Constitutional amendment, legislative
act or a charter amendment to place such limitation upon
the voters at such an el ect ion,3"
The qualifications of voters at all elections are Pre-
scribed by Section 1 of Article 7 of the State Constitution,irklbk
requires residence in this state for six months and in an election
district for thirty days next preceding any election. Certain
persons are excluded f r cm voting, shop as felons and persons under
guardianship*
11 addition to the above referred to constitutional pro-
vision, we also directyour attention to Article 19 Section 17, of
the State Constitution, which provides:
"No religious test or amount of property shall ever be
required as a qualification for any office of public
trust under the state. No religious test or amount of
Property shall ever be required as 'a qualification of
any voter at any election in this state; - - - - ."
It must be apparent from the above referred to constitu-
tional provisions that the legislature is without authority to add
to said provisions any additional qualifications, and such additional
qualifications may riot be prescribed in a city charter. The above

referred to constitutional provisions relating to the qualifications
r i of voters govern elections within the state, whether state-wide or
local. It must be oivvioua, therefore, that the requirements therein
prescribed may not be increased or diminished by any statutory or
charter provision.
You are, therefore, advised that in order to limit voting
at bond elections in your city to tax payers, it will be necessary
to amend the State Constitution.

Upon motion by Miller second by Fryer Dr. J. E. Crewe was
appointed a Member of the Board of Health for the term ending; on the second Monday
in April, 19370
It was reported that Warrant No.1371 drawn payable to Lynn
Alker and Morse Brothers, in'the amount of $141.60 has been lost, �at which upon
motion by Fryer .second by Moody the Mayor acid ,City Clerk were authorized and
directed to draw a duplicate thereof and stop payment on the original warrant.

name of the City Clerk; he mentioning that perhaps this was a factory error, but was
corrected on that point by the City Engineer.
Upon motion by Moody second by Amundsen the sum of $ 5.00 was
appropriated from the General Fund and it was ordered that the said sum be paid to
the League o'f Minnesota Municipalities for a copy of the 1934 Minnesota Year Boolc.

The following estimate relative to paving construction was

instructed to prepare a resolution authorizing the Sinking Fund Commission to sell
the Sinking Fund Investments held for an addition to the present library building or
the bomiktituct1dn of a new library building,for use in the construction of a new
library building.
Upon motion by Green second by Lemmon request was made of the
Public Utility Board that a street light be installed on First Avenue Northwest
between Third Street and Fifth Street -near t r-o Ernest Schacht' o new place of
business.
President Liddle asked that the Finance Committee check on
City employes to determine whether or not the wives of any of them are working.
The Fire Chief asked that advertisement be made" for 2000 feet
of 2t inch fire hose and 500 feet of 11 " fire hose.
Upon motion by Amundsen second by Lemmon the Chief of the
Fire Department was authorized to attend the International Association of Fire
Chiefs convention at Milwaukee, Wisconsin, August 21st to 24th,1934,inclusive, at
the expense of the City of Rochester, Minnesota.
Upon motion by Miller second by Mood the -City Engineer was
authorized to purchase 100 feet of *" gum treated fire hose.
Upon motion by Fryer second by Green the City Engineer was
authorized to purchase a new drag line shovel for use at the Grassle Gravel pit.
Upon motion by Fryer secondby Moody the Common Council ddjourned.
