Minutes of a regular meeting of the Common Council
of the City of Rochester, Minnesota, held in the Council Chambers, in the
City Hall, th said City, at 2:00 o'clock I'.?d. , on July 2nd,1934.
Meeting called. to order by President Liddle.
Roll Call. Present: Liddle, A mundsen, Fryer, Green,
Lemmon, Miller, Moody. Absent: None.
President Liddle announced this ;as the time and
Place fixed for hearing on the levying of special assessments for a part of -
the costs for the construction of a siphon section of trunk line sanitary
sewer in parts of Third Street Southeast and Third Avenue Southeast and
asked if there was any person present who wished to be heard relative to
this improvement.
Herrmann Klinsmann, George Garbisch, and "Mike"
Peterson, opposed any assessments for benefits from this sanitary sewer.
The following petition relative to assessments for
benefits on the above described sanitary sewer was read and President Liddle
ordered that the same be placed on, f. ile:

Alderman Moody introduced the following
resolution which was read:
"RESOLUTION LEVYING SPECIAL ASSESSMENTS
FOR PART OF THE COSTS OF THE CONSTRUCTION
OF A SIPHON SECTION OF TRUNK LINE SANITARY
SEWER IN PARTS OF THIRD STREET SOUTHEAST
AND THIRD AVENUE SOUTHEAST.
Be it and it is hereby resolved by the Common
cil of the City of Rochester, Minnesota:
That bUtd Common Council does hereby assess and
evy upon and against the several lots and parcels of land described below

and situated in said City the respective sum of money set opposite to the description
herein of each said lot and parcel:
This assessment is made to defray part of the cost and expense
of the construction of a siphon section of trunk line sanitary sewer commencing ten
(10) feet east and ten (10) feet north of the center lines of Broadway Street South
and Third Street Southeast. and running northeasterly three hundred and sixty-five
(365) feet to a point fifty (50) feet North of the south line of Third Street South-
east, thence northeasterly one hundred and thirty-five (135) feet to a point fifteen
(15) feet south of the north line of Third Street Southeast, thence southeasterly
fifty-seven and six tenths (57.6) feet to the center lines of Third Street Southeast
and First Place Southeast, thence east to thq center of Third Avenue Southeast and
Third Street Southeast, thence south to the 'enter of Third Avenue Southeast and
Fourth Street Southeast, which project is known and designated as a part of P.W.A.
Docket Number 14739 according to the contract for th6 said sewer entered into by
said City of Rochester with C. G. Fraser and L.M.Feller, which contract is on file
in the office of the City Clerk of said City.
Said lots and parcels of land are assessed ratably according to
the special benefits derived from the said siphon section of trunk line sanitary
sewer, without regard to cash valuation; and said Common Council does hereby adjudge
and determine that the amount hereby levied upon and against each lot and parcel of
land described below is the amount of the special benefits derived by each said lot
and parcel of land from said improvement*,

description of the property by them respectively owned, and the amount of such
assessment against each of such properties respectively, are as follows:

Upon motion by Moody second by Amundsen that the
said resolution be adopted as read, and all voting in favor thereof, President
Liddle declared the said resolution duly passed and adopted.
President Liddle announced this as the time and
place,1fixed for hearing on the construction of a sanitary sewer in First
Place Southeast from the center of Third Street Southeast to a point 60 feet
north of the north line of Fourth Street Southeast, and asked if there was
. any person present who wished to. be heard relative to this improvement.
Thefe'was no person present who wished to ,be
heard in regard to this sanitary sewer
Representatives of the Rochester Farmers Mutual
Fire Insurance Company were before the Common Council with the request,
that in the event they purchase rural fire fighting equipment,that the
City of Rochester house it and furnish two men for its operation at fires
outside the limits of the City of Rochester, Minnesota, in consideration
for which the City of Rochester would have use of the equipment at such
time as it might be needed, at which motion by Lemmon second by Fryer
carried that this Common Council favor such an arrangement
• The following communication was read and upon motion
by, Fryer second by Moody the Building, Electrical and, Plumbing Inspector
waa instructed to issue building, electrical and plumbing, permits in favor
of the Highway Patrol barracks being built on Fourth Street Southeast. and'
the matter of && unlicensed plumber doing the plumbing work there web
referred to the Sewer Committee with power to act:

Honorable Mayor, I am submitting herewith copies of our State
Law covering licensing of Master Plumbers:
= Our City Ordinance #433 states -that Plumbing Permits
shall be issued only to Master ;Plumbers licensed by the City: It
has .been brought to my attention, by the Master Plumbers of
Rochester, that this work is being carried on without a permit,.
which is a violation of the present ordinance and the State
' Plumbing Code.

$3.95, conciliation court fees received $1.75, $20.45 received from Olmsted County as

The report of the Milk Inspector for the month of June,1934,
read, and President Liddle ordered that the same be placed on file:
The application of Jesse R. Fenton for a soft drink dealer
license at 1137 Second Street Southwest was read and upon motion by Green second by
Amundsen, license was granted.
The application of Lloyd L. Bennett for a plumbers license was
read and upon motion by Fryer second by Moody license was granted.
The application of A• G. Berndt for a public dance p ezmit at th
Woodman Hall July 7th,14th, 21st and 28th, and August 4th919349 was read.
The On Sale and Off Sale applications of C. R. Hamilton and
H. E. Randahl for licenses .to sell non intoxicating malt liquors at Nos. 14,16 and
18 Second Street Southeast, were read and upon motion by Moody second by Amundsen
licenses were granted.
The following request for release of petitions heretofore filed
was .read and upon motion by Fryer second by Green the petitions mentioned were

Copy, of. Health Officer's requisition on Saint ZMary's
Hospital for the isolation of Mrs. Carl Wood, residing at 716� Broadway Street North,
diagnosed to be sudfering from scarlet fever, was read and President Liddle
ordered that the same be placed on file.
The appointment by the Mayor of Paul Schmidt, as a Special
Policeman for duty at all parks and playgrounds in the City of Pochester, Minnesota,
he to serve without pay and to hold office until the second Monday in Apri1,1934,
unless sooner removed, was read, and President Liddle ordered that the same be
placed on File.
8pon'motion by Fryer second by Green, the sum of 075.00 was
appropriated from the General Fund, Code 18, to the General Fund Code 7, as a
temporary transfer and the sum of $75.00 was appropriated from the General Fund
Code 7, to J. J. Reiter, Mayor,for use in his contingent fund; he to properly
account for the expenditures therefrom:+
The plumbers license bond of Lloyd L. Bennett with the Fidelity
& Casual�y Company as surety thereon in the amount of $1901A.00 was read and upon
motion by Moody second by Fryer, the said surety was accepted, the said bond was
approved, and it, was ordered that the same be placed on file.
Upon motion by Lemmon second by Fryer Lillian R• Sveom, City
Clerk's Stenographer, was granted a vacation July 16th to July 21st119349 inclusive,�nd
Elsie M. Rutz, City Clerk's Second Stenographer, was granted a vacation July 23rd

to you as executor upon the settlement of of the Frank E.Williams
Estate in court. One for $69.25 Feb. 16, 1934 and the other for
$156.09 Mar. 26, 1934. .
I made an error in the division of the fund. The first
check should have been'$89.25 and the last•,$186.09; The total is
exactly the same.
I make this explanation now so there will be misunder-
standing in regard to in the future.

As we do not feel the rugs gave you the proper amount of service, we
are making up a new rug, no charge, to be shipped to you f.o.b.
Middlefield, Ohio.
We feel that the service you will receive out of the new rugs, plus
that which you received out of .the old rugs, will be sufficient to
show that our Product is good. We wish to st.and back of our merchan-
dise at all times and have our customers completely satisfied. We
trust in the future, if there is any type of matting you might need,

I beg to call your attention to the matter of the improvement
of 15th Avenue Southwest, .from 2nd Street to 6th Street Southwest, and
the fact that a levy of $500.00 was made in 1933, to defray a part of the
expense. I hereto advise that this work be started in sufficient time to
insure completion on, or before September 19 if it is to be done this year.
In the matter of the present agitation looking toward bituminous
treatment of graveled streets with Road Oil, Asphalt or Tarvia, I beg to
suggest the following:
That all comers be allowed to submit prices using their own
specifications, and that the price bid and Maintenance Bond be proportionated
on the Ifollowing basis:
3 cents per sqe yd. 1 year Maintenance Bond.
.5 cents per sqe yd. , 2 year Maintenance Bond.
6-1 cents per sq. yd. , 3 year Maintenance Bond.
3 cents per sq. yd., 4 .year Maintenance Bond.
And that the length of Maintenance Bond be increased 1
year i'or each 11 cents per sqlb yde increase, over the last named
price per sq. yd.

Sinking Fund Commission was read and upon motion by Moody second by Green the
action set forth therein was approved and it, wag ordered that the said copy of

"WHEREAS, On June 14th,19349 the Comfnon Council of the City of
Rochester, Minnesota, authorized and requested the, Public Utility Board of said
City to make refundments for assessments levied against properties for the laying
of water mains, and
WHERFAS, The said Public Utility Board, under actions taken by
them June 2Bth,1934, have asked that funds be created for the flefundment of the
assessments mentioned, per the following quoted communication:

value of Sinking Fund Investments for Water Works Extensions, which
Propo sals will be received and openedby this Sinking Fund Commission,
at a meeting thereof which is to be held at '7:15 o'clock , on ,Tuly
16th,1934; the, advertisement for proposals t'o carry the full list of
securities held as Sinking? .Fund Investments for Water Works Extension and
be so drawn that the bidders may bid on any bonds contained therein up to
a total of k 16 9000.00 par value. "
Alderman Amundsen introduced the foillowing resolution
which was read:
"WHEREAS, The Public Library Board Directors did on
April 27th,1934, by resolution duly passed and adopted, ask the Common
Council of the City of Rochester, Minnesota, for the immediate appropria-
tion of $1009000.00 toward t#e cost of the construction of a new Library
building, which would be in addition to the Sinking Fund Investments nc;v
held for an addition to the present Library building or the construction
of a new Library building, and
WHEREAS, The said Sinking Fund Investments for an
addition to the present Library building, or for the construction of a
new Library building did on June 30th919349 have a p cr value of $50 t95O.00 ,
and a book value of $511,023.319 and
WHEREAS, At a referendum election on the gaest ion of
whether a new Library building should be built or not, held Tune 16th,19349
the result was, 'Yes' received 21449 'No' received 14969 blanks received
1133, and the question, 'Shall the additional 11009000400 cost of- a new
Library building, over and above the Sinking T:Vnd Investments held, be paid
from Public Utility Funds.' received 1833 votes and the gixestion,' Shall the
additional A100,000.00 cost of a new Library building, over and above the
Sinking Fund Investm Ents held, be paid .from bond proceeds whenever the same
might be authorized by the voters of the City of Rochester., Minnesota,'
received:311 votes, and
WHEREAS, It is deemed expedient and necessary by the
Common Council of the City of Rochester, Minnesota, that $35,000000 par
value. of Sinking Fund Investments for Water Works Fxtension be I&ppropriated
toward the above mentioned $100 9000.00 appropriation, leaving the balance -
of $659000.00 to be realized by appropriations from the Public Utility

SO THEREFORE, Be it resolved by the Common Council of the City
of Rochester, Minnesota:
That the Sinkng Fund Commission of said City are hereby
authorized and directed to sell 4359000.00 par value of Sinking Fund Investments
for Water Works Extension and appropriate the funds realized thereby to the Public
j Utility Fund of said City, and the Public Utility Board are thereupon authorized to
appropriate the receipts from the sale of the said Sinking Fund Investments for
Water Works Extension to a special fund for the construction of a new Library BuIldinf
in and for the City of Rochester, Minnesota, and
Be it further resolved by the said Common Council: That. the
Sinking Fund Commission of said City be and the said Commission is hereby authorized
and directed to sell the Sinking Fund Investments for an addition to the present
Library building or the building of a new Library building and place the receipts
therefrom in a special fund for the construction of a new Library building, and
Bb it further resolved by the said Common Council: That the
Public Utility Board of the City of Rochester, Minnesota, be and the said Board is
hereby authorized to appropriate $659000.00 from the Public Utility Funds to a
special Fund for the construction of a new Library building in and for the City of
Rochester, Minnesota.

Tanks located on C.G.W. Right of way, beg to submit the following:
We find that it would be necessary to entail an expense of
not less than ' 5000.00 for the placing of mains and hydrants, and the protectiol
afforded would not justify the expense.
Not included in this estimate of cost would be the expense
of extending 7th Place Southeast, from the present end of street to
the Chicago Great Western Right of Way.

Public Utility Board that unless the said Board cuts off the water service to the
so-called Kennedy Tourist Camp and to the filling station at the Northwest .corner
of the intersection of Second Street Southwest and Sixteenth Avenue Southwest on or
before July 15t#i,1934, city forces will open the street to the point and cut off
the water services running to the properties mentioned, and the City Clerk transmitt
the order to the Public Utility Board in a letter as follows:

Camp, lying west of Sixteenth Avenue Southwest and. between an
extension of First Street Southwest and Second Street Southwest,
and to the filling station which is also within those boundaried.
and took further action to the effect that unless the Common
Council' s order heretofore given to your Board for the disconnection
of both of these services is accomplished, on or before July 15th,
1934, City forces will open the Street to the necessary points and
out off the service running to Mr. Kennedy's Tourist Camp and to
the f illing station mentioned.

Upon motion by Fryer second by Green the City
Engineer was authorized to confer with Wn. N4 Carey, State Engineer, P•W•A.,
relative to adjustments in favor of the contractors for the construction of
the siphon section of trunk line sanitary sewer in parts of Third Street
Southeast and Third Avenue Southeast.
The City Clerk reported that Charles LQ Alcexander
had not qualified under his recent appointment as Justice of the Peace -of
First Ward and that Lloyd Li Bennett had not qualified under his recent
appointment as Constable of the Third Ward, and that accordingly both
offices remain vacant+ Y
Upon motion by Milldr, second by I'ryer,the
Common Council adjourned to 7: 30 o'clock P.M., on L;uly 16th,1934 0-
