HomeMy WebLinkAbout09-24-1934405 Minutes of .an adjourned regular meeting of the Common Council of the City of Rochester, Minnesota, held in the Council Chambers, in the City Hall , in said City at 7: 30 o' clock P.M. , on September 24t h,1934: Meeting called. to order by President Liddle. Roll Call. Present: Liddle, Amundsen, Fryer, Green, Lemmon, Miller, Moody: Absent: None. Upon motion by Moody second by Amundson, the minutes of the meeting held on September 4t h,1934, were approved. President Liddle announced this as the time and place fixed for hearing op the levying of special assessments for the construction of a sanitary sewer in First Place Southeast fran the certer of Third Street Southeast to a point 60 feet north of the north line of Fourth Street Southeast, and asked if there was amy person present who wished to be heard on any matter concerning this sanitary sewer or the assessments for the cost thereof. to this improvement. There was no person present who wished to be heard relative It became known that the City Engineer has not yet rendered estimate in favor of the 'contractor for this sanitary sewer and consequently upon motion by Moody second by Amundsen further action in the matter of levying of special assessments for the said sanitary sewer in part of First Place Southeast and the hearing thereon was adjourned and continued until 2:00 o'clock P.M., on October lst919344, Warren S. Holmes of Warren S. Holmes & Company laid before the Common Council three volumes of the "Appraisal of City Properties at Rochester" and after a discussion of them President Liddle referred the same to the Insurance Committee. A committee composed of A. A. Hirman ,as Chairman ,and T. F Kennedy, Dr. Rynearson and Earl A. Vine, as the Fire Prevention Committee of the Chamber of Commerce, orally presented recommendations, first by Mr• Kennedy. as to the great .hazard which the City of Rochester, Minnesota, has in the vast amount of bulk gasoline storage along the Chicago Great Western Railroad Company tracks in Southeast Rochester, second by Dr. Rynearson who solicited the passage and adoption of the ordinance extending the fire limits which was recently defeated at its third reading, and third by Earl A. Vine as to the Fire Department, Water Department and Alarm System, wherein he suggested a program for increased fire prevention facilities extending over a term of years taken up by yearly installments so that no one years share would be a great hardship to the taxpayers. The following copy of resolution and certificate as to its correctness was read and President Liddle ordered thatthe same be placed on files J 466 "Whereas the Mayo Properties Association has offered to give to tthhe City of Rochester, for library purposes, the property formerly known as the Presbyterian Church property and such offer has been accepted by the Common Council and the Library Board of the City of Rochester; and Whereas it is a condition of such gift that a library building be built thereon and occupied as the Rochester Public Library on or before July 1919361 Now, therefore, be it resolved by the Library Board of the City of Rochester that plans be prepared and a library building constructed on said property; Be it further resolved that the Common. Council of the City of Rochester be requested to approve the determination to proceed with the construction of such building I do hereby certify that the foregoing is a true and correct copy of a resolution duly adopted by the Library Board of the City of Rochester on September Sept 7 1934 Catherine Harney Lawler. Secretary of the Library Board of the City of Rochester:" Alderman Amundsen introduced the following resolution, which was read: "WHEREAS, The MayorProperties Association has offered to give to the City of Rochester, for library .purposes, the property formerly known as the Presbyterian Church property and such offer has-been accepted by the Common Council and the Library Board of the City of Rochester; and WHEREAS, It is a condition of such lift that a library building be built thereon and occupied as the Rochester Public Library on or before July 191936; and WHEREAS, The Library Board of the City of Rochester has decided to prepare plans and proceed with the construction of a library building on said property and has requested the approval of the Common Council, and WHEREAS, It is deemed eapediafit and necessary for the best interests of the City of Rochester, Minnesota that the Library Board be authorized to prepare plans and proceed with the construction of the library building on the property mentioned; SO THEREFORE, Be it .resolved by the Common Council of the City of Rochester, Minnesota: That the decision of the Library Board of the .City of Rochester to prepare plans and proceed with the construction of a library building on said property be, and the same is hereby approved, and the said Library Board is hereby authorized accordingly:" Upon motion by Green second by Fryer that the said resolution be adopted as read, and all voting in favor thereof, Presideft Liddle declared the said resolution duly passed and adopted. 407 Udei'm&A:>Fiyer introduced the following resolution which was read: "Be it resolved by the Common Council of the City of Rochester, Winne sot a: That the Mayor and City Clerk of said City are hereby authorized and directed to sign the agreement by and between the Mayo Properties Association, grantors, and the City of Rochester, Minnesota, and the Library Board of the City of Rochester, Minnesota, grantees, copy of which is quoted as follows: r ".Whereas the present public library building has become inade- quate for use as such, and it would not . be practicable to remodel or enlarge it and a new building has become necessary; and Whereas, one of the public needs of the City of Rochester long has been a public auditorium; and Whereas, in May 19339 the Mayo Properties Association, recognizing these needs, offered to give the property hereinafter described to the City of Rochester upori condition that a library building be builtiereon containing an auditorium capable of seating at least two thousan Persons, wh h proposition, after due consideration, the Library Board declined to accept on the ground that such a building would not be feasible and suggested that the proceeds of the present library property could be used for the purpose of building an auditorium and that the City of Rochester and the Library Board would be glad to ggree to use such proceeds therefor when the present library property should be sold and that they would enter into a contract to that effect if the offer were made to give such property solely for public library purposes; and . Whereas the members of the Mayo Properties Association are desirous that such facilities be provided and said property by reason of its location, is highly desirable for use as a library site, and has offered to convey the same to the City of Rochester for use for public Library purposes, upon the conditions hereinafter set forth, and the City of Rochester and the Library Board of the City of Rochester have accepted such offer: Now, therefore, this agreement made this day of September, 19349 by and between Mayo Properties Association, Grantor, and C1W of Rochester and Library Board -of the City of Rochester, Grantees,r Witnesseth: That, for the foregoing considerations, and upon the conditions hereinafter set forth, the grantor hereby agrees to convey to the grantee, City of Rochester, for public library purposes, lots Nos: nine (9) and ten (10) and the west half (�) of lot No. eight (8) in block No. seventeen (17) of the Original Plat of the towns now city of Rochester, in Olmsted County, Minnesota, by warranty deed oontaining the following conditions] 14 That a library building be built thereon and occupied as the Rochester Public Library on or before July 1st ,1936. 2. That such property shall remain the property of the City of Rochester so long as the principal library of such city shall be maintained and operated thereon, but if and when the major portion thereof shall cease to be used for such purposes, the entire property shall revert to the grantor, its successors or assigns. 3. That no structure shall be erected thereon so that any part thereof shall be nearer than fifteen feet to the east line of said property. In consideration thereof, the grantees covenant and agreeto sell the present library property so soon after the new building is occupied as it can be reasonably done, without "due sacrifice, and use the proceeds thereof, if sufficient for that purpose, for the erection in said city of a public auditorium capable of seating at least two thousand persons and, if such proceeds shall not be sufficient for that purpose to place Lid keep said proceeds in a separate fund invested in authorized securities and when said fund, with other funds of the city which may be available for that purpose, shall be sufficient therefor, the grantee City of Rochester agrees to use the same for the purpose of erecting such public audit oriumv' " r Upon,motion by Fryer second by Amundsen that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. �. Town Secretary " The following petition was read and President Liddle ordered that the same be placed on file: " Sept. 24, 1934 To the Honorable Mayor of the Common Council of the City of Rochester, Resolved that we the members of the United Workers Association of Olmsted County, Rochester Chapter, hereby petition you to take the necessary steps to construct the South end of the trunk line sewer from Third Street S.W. thence south on Broadway to Sixth Sti SW, and thence west on Sixth Street S.W. to relieve the - lift in Soldiers Field. We find upon investigation that river polut ion thru the City at f present time fa terrible, due to the dumping of refuse in the river from garages, dairies and the Reid Murdodk Cannery: Therefore we feel that as a step absolutely necessary to public health in our city this work should be done at once: This also will, we feel, make employment for many men now out of work. Town, Secretary " 3 The following request was read and President Liddle referred the same to the Sewer Committee, the City Attorney. the City Engineer, the Health .Officer and the President of the Park Board: "DEPARTMENT OF PARKS City of Ro chest er, Minn. September 24th91934 Hon. Members of the Common Council, Ro chest er, Minnesota 499 Gent lemenr- Since the establipbment of the Reid Murdock & Comp an canning factory adjacent to the Southeast portion of Rochester, it has been the practice of that Company to dispose of the waste matters from the plant ' through drains which empty into the Zumbro River and Bear Creek at points above Mayo Park. This has resulted in pollution of these streams to such an extent that a very undesirable condition is created in Mayo Park, Zumbro River and the" Tourist Park, during the canning season. The disagreeable odors arising from the refuse have made the parks almost unt enant able during hot weather, while the discoloration of the water has completely destroyed the: beauty of the river. The conditions a Yist during the canning of the pea crop which commences about the middle of June, through to the completion of the corn packing in September. It is only when the plant is not in operation that the river is clear and free from unpleasant odors. The disagreeableness of these conditions has increased from year to year until now it has reached to such an extent as to seriously interfere with the enjoyment of the city parks by the hundreds of visitors who come to Rochester each Sunday. In order that this condition shall not exist during the summer of 1935 the Board of Park Commissioners at a meeting held • September 24th,19341, unanimously voted to request the Common Council of the City of Rochester, Minne- sota, to at once take the necessary steps to prevent Reid Murdock & Company from continuing to dispose of the objectionable waste matter from their Plant in any of the streams in Rochester4 We therefore respectfully ask that your Honorable Body take immediate favorable action on our request so that the continued pollution of our streams may be stopped and the beauty of our Parks restored. L: Briese, as Secretary of the Rochester Chamber of Commerce, asked for financial assistance in the publication of the Rochester Bo o$let published by that organisation and President Liddle referred his request to the Finance Committee: E. L. Briese, as Secretary of the Rochester Chamber of Commerce, asked that the City of Rochester purchase the "greens" for Christmas street decorations, and President Liddle referred his request to the Street and Alley Committee. The City Engineer's Department trial balance for August91934, was laid before the Common Council and President Liddle ordered that the same be placed on file. The August 1934 report by the Health Officer, for the City Farm, showing; receipts in the amount of $877a719 didbursements $1045�469 balance on hand $173.09, and a statement of Hogs on hand,at September lst919349 shoking a balance Aug lst01934,of 329, hogs purchased 115, hogs sold 65, and hogs died 49 leaving 375 on ha September lst,19341, were read and President Liddle ordered that the same be placed on file. r 0 410 General Balance sheet, Fund statement, -statement of unexpended budget appropriations, etc-9 prepared by the City Clerk as of August 3l.st„1934, were laid before the Common Council and President Liddle ordered that the same be placed on file. The report of the City Weighmaster for the month of' August,1934, showing weighing fees collected in the amount of $7.60 , was read and President Liddle referred the same to the Finance Committee. ' The report of the Clerk of the Municipal Court for the week ending $eptember 3rd91934, showing criminal fines $3140-909 civil fees $6.859 Conciliation Court fees $2.009 County check for July I' 1934 $63.85, and court costs charged to Olmsted County $30.851 for the week ending September 10th,19349 showing criminal fines $103080, civil fees $6.20, conciliation court fees $.509 court costs charged to Olmsted County $5.159 fines collected due to Olmsted County •;fi1010'00) for the week ending September 17th,1934, showing criminal fines collected .$112.309 civil fees $8:709 conciliation court fees $2.009 court costs charged to Olmsted County $27060 9 and for the week ending September 24th, 1934, showing criminal fines $122:40, civil fees $2:109 conciliation court fees $4.009 and court costs charged to Olmsted County $7009 were each read, and President Liddle referred the same to the City Attorney: Upon motion by Moody second by Amundsen, the sum of $10000 was appropriated from the General Fund and it was ordered that the same be paid to Olmsted County, Minnesota, for loc4l Municipal Court fines collected due to Olmsted County,Minnesota. The report of the Public Utility Board prepared by the Secretary of the Public Utility Board as of August 31st,19349 was laid before the Common Council and President Liddli ordered that the same be placed on file; the said income statement showing a net profit in the Light Department for the month of August919349 of $3654.74, and a net income for that month in that Department of $1522.15, the 5 months net profit in the Light Department showing $289259.52 and net income of $19,8750-089 the Water Department net profit for August91934 was $41540-40 and the net result-. was a net loss of $349834�449 the net profit for the Water Department for the 5 months of this fiscal year was $179021.36 while the net fesultN was a net loss of $229471.25. The application of Biltgen Brothers for an Off Sale license to sell non -intoxicating malt liquors at 22 Fifth Street Southeast, was read and upon motion by Amundsen second by Green license, was granted. 411 The application of E. T. (sconnolly for a Plumbers License was read and upon motion by Lemmon second by Fryer license was granted. The Plumbers license bond of E. T. Connollg ° , with the Fidelity & Casualty Compar r of New York as surety thereon in the amount of $19000.00 was read and upon motion by Lemon second by Moody, the said surety was accepted, the said bond was approved and it was ordered that the same be placed on file: The application of Stanley Peterson for a soft drink dealers license at 1232 Ninth Avenue Southeast was read, and upon motion by Miller second by Green this application was referred to the License Committee. The application of T: V. Nagle for a public dance permit at the Woodman Hall September 22nd and 29th, -1934, and of Joe Endrizzi for a public dance permit at the Y.M: C. A. building, September 29th91934 , and Qkctober 6th and 13th,1934, were. each read. The application of William King for a drivers license was read and upon motion by Amundsen second by Fryer license was granted. The appli cation; of James Elmer McGrath for a Drivers license was read and upon motion by Moody second by Amundsen, license was granted. The following applications were each read and upon motion by Fryer second by Green, the On Sale License heretofore issued to Mike Caffes, was transferred to Don arson. " Rochester, Minnesota. W: Cross or Walter Mundt successfully passed the examination held for plumbers, was read and upon motion by Fryer second by Green the plumbers license Vo4 41 heretofore issued. to S.W:Cross effective July 14th,1934, to July 13th919359 was revoked and the Mayor and CZttwy Clerk were authorized and , directed to draw warrants upon the General Fund for $2040 and make refund of the unearned' license f ee Upon motion by Miller second by Fryer, the City Attorney was requested to ask for the Attorney General's ruling as to just how far the City of Roahebtrer can go and expect to enforce an etrder removing the bulk gasoline storage tanks on the Chicago Great Western Railroad Company tracks in Southeast Rochester: The following cammaini cation pleading that the Building, Electrical and Plumbing Inspector be authorized to go to the New Orleans Convention of Electrical Inspectors, was read and upon motion by Lemon second by Amundsen, he was authorized to do so: " Chamber of Commerce Building ROCHESTER ELECTRIC COMPANY • Electrical Dealers Phone 2919 Roohester, Minn. Gentl emens - We believe it to be of the best interests of the City Building Plumbing and Electrical Inspector that he attend the meeting of the International Association of Electrical Inspectors to be held at New Orleans Oct 1st, 2nd & 3rd, at which meeting there will be representatives of all the large electrical manufacturers and items of vital concern to the industry will be discussed. By attending such meetings the Inspector can keep himself .properly informed on the various matters pertaining to his duties and we would recommend that he be authorized to attend this meeting. " The City Clerk reported the payment by the Franklin Heating Station of $92:62 as one half cent per thousand cubic feet on 1895241000 cubic feet of natural gas used there during August ,1934: The following copy of emergency authority given by the Mayor was read and President Liddle ordered that the same be placed on files " Rochester, Minnesota September 10, 1934 Mr: CiH:Armstrong City Engineer Rochester, Minnesota Dear Sir: Supplementing my emergency order to you under date of August 22nd and it appearing that the sum of $50000 is not sufficient for the purpbae of constructing a new barn atthe dumping grounds and that an additional sum of $125a00 is needed for the construction and completion of said barn, you are hereby ordered and authorized under the provisions of the city charter to go into the open market and obtain the necessary labor and materials for the construction of said barn at an additional cost of $125,009 making a total of $62540 to be expended by you for this said purpose Very truly yours, Julius J: Reiter Mayor of the City of Rochester* " 415 Upon motion by Moody second by Fryer, the City Clerk was instructed to bill sewage -disposal plant operation costs October lst,1933, to September 30th,19349 as follows: 82 per cent to the City of Rochester, 11.89 per- cent to the Rochester State Hospital and 6.11 percent to Saint Mary's Hospital. The following communication was read and President Liddle ordered that the same be placed on file: , "Rochester, Minnesota September 239 1934 Mr. W. The following communication from the 6itiy. Gentlemen of the Common Council , I have at hands. a letter from Mrs E. M: Paul son, county Highway Engineer of Houston, County, in which the County Commissioners make offer of $800.00 for the 14th St.N:W.Bridge, taken down and piled, and match -marked flir re- erect ion: The Street and Alley Committee and the City Engineer have an agreement with Mra- Walter Martin to sell to him the bridge as is ibr the sum of $500.00, net, to the City. I have attempted to obtain prices for the dismantling, and marking, of the bridge. And it is likely,, that Mr. Chase and Mr. Martin, will appear before the Council Sept. 24th, in an attempt to arrive at some further agreement4 Yours very truly, C. H. Armstrong, City Engineer. Engineer Rochester, Minn: Dear Sir: Sept. 18th, 1934 At our County Board Meeting yesterday, I took E up the purchase of your high truss bridge on fourteenth , Street N.W. They finally decided they would pay $60040 providing it was taken down and marked for retrection and placed in a good place for loading. If this agreement is satisfactory to your council, please let me know as soon as possible as I would like to start the abutments for it at once. ' Yours very truly, E. M. Paulson County Highway Engineer." A report from the Park Board as t o their attendance at the American Institute of Park Executives held in Louisville, Kentucky, September 16th to 20th91934 , was read, and President Liddle' ordered that the same be placed on file. During the .month of Aui-ust $35 9000 was spent by the Covern- ment, and $5,000 by the County on E.R.A. projects, but this simply takes care of the immediate needs of the unemployed and leaves nothing as a reserve for the winter. 3. We, in Rochester, believe direct relief will get us nowhere• The unemployed seek an opportunity to earn an honest living and not be dependent upon a dole4 4. Without asking for any government loan, Rochester therefore, I ;i is willing to put on a work program under P.W.A. of sufficient size to absorb the greater part of the existing unemployment i� and thus take care of the situation. 50 Last year we filed with you estimates for a Program calling for a considerable sum, out of which only :�187,500 was made available of which the government's share was only about 024,500. i 6. We, in Rochester, are fully aware of the seriousness of the problem and are willing to do our utmost to meet it.
