This l,ett er is addressed to the mayors and the clerks of municipalities
in Minnesota- which, it is believed, are planning to vote on the question of zoning
at an early. date. There is still sufficient time left to make Preparations to
Present the matter for consideration at the- coming general election on November ds
if immediate steps are taken. It may be well to call to mind here the fact that
a notice of election is required to be posted fifteen days prior to the 'elect ion
date, or October 22. Knowing that many last minute details will have to be atten&ed
to during the two weeks preceding the elections the League at this time offers it f
special zoning services without charge to all municipalities desiring to use them.
Attention is called to the 'October issue of "Minne#$ta Municipalities."
In `this magazine may be found on page 369 a brief outline of zoning procedure,
Including the council's resolutions notice of election, and special ballot. On
page 366 is an article ddscribing in a general way the Principles and purposes of
zoning., This article is well adapted to use in locasl newspapers and may be re-
printed if desired as a piece of educational matter for the voters.
If any mass meetings or similar gatherings are to be held in the
municipality and a League representative is desired to assist in the discussion
and to answer questions, ;arrangements can be made for Mr. G.J.Snith, League
zoning representative, to be Present, if notified sufficiently in advance. There
will be no cost to your municipality for this service.

could be taken on the last car of gasoline purchased for the Bulk Station,
sho)dwed a 72 gallon sho rt age, and asked for aut ho rity to make certain
changes at the City Bulk Station, anal upon motion by Amundsen, second by
Green, the, City Clerk was authorized to build a sheet metal box over
the dome t0• houserthe vent and -measuring cap, which box would have a
Proper lock, door etc., to take the present vent off and put on anew cap
and it would then be for vent and measuring opening, to place a better
lock and hasp Upon the pum$ house, and to extend the pupp pipe so gasoline
may be pumped out down further than 477 gallons.
The following copies of resolutions passed and adopted
by the Public Utility Board were each read, and President Li dd le ordered t tt

Council of the City of Rochester, Minnesota be and is hereby requested
to authorize the said Board to enter into a contract with the L.A*Kepp
Contracting Company for the furnis#ingg in accordance with specifications
and with the bid of the said Cpntractor, of all the necessary material,
labor, tools and equipment for the installation of an underground duct
system in the East Alley in the City of Rochester, 'Minnesota for a total
lump sum price of THIRTY NINE THOUSAND EIGHT HUNDRED .AND SIXTY E.IGT ,
DULLARB($393,8664-,00)-said company being the lowest responsible bidder."

The Ohicago and Nort Western "railway Company are asking for authority to abandon
and remove 156 feet of track and thirteen 12-foot spans or trestles involved in
trackage originally constructed in 1914 for service to the Interstate Power
C omp any.
The petitioner sets forth that the removal will not interfere with efficient
service to any industry of your city, desiring to -use the material in the.said
trackage and trestles elsewhere on theirXIined

Common Council at a meeting held on that date, which was tied up by the
,! Chairman of the Sewer Committee with the following proviso: "Provided
!'tliat the'warrant shall riot be'released until the' approval of Van. N.
Carey, State Ragineer, P.W.A., is in the City Clerk's files." '
Now that Mr. Carey' a approval has been received here, the firm
above mentioned have been notified that upon them filing the customary
affidavits as to payment for labor materials, etc., this warrant of
$513d00 will be released to them.
This situation makes your estimate of October 12th, 19349
to be in error, copy of which is attached, so that you may know which
estimate we refer to.

We, the Finance Committee of the Common Council of said City,
respectfully report that we have investigated the matter of -the 1507.W66
claim of Fraser and Feller for balance due on North Broadway trunk line
sanitary sewer construction, and find that on October 29 1933, in sworn
claim for extras, they recited that `.''153848 square feet of pavement'i
414 square feet of driveways, and ,293.12 square feet of sidewalks had been
removed and they were p6,fd fifteen centa, eight cents and six cents per
foot respectively.
That on October 6t h, 19331, the City * EAgineer in reporting the
cost of this project recut es the same areas removed and to be replaced,
but does not take any consideration of the nominal payments made on the
Firm's claim for extras except that where he speaks of the sidewalks
removed and to be replaced, he mentions 35545 instead of 2931l29 which
is evidently an error in him picking up the lineal feet of eigateen inch
sewer pipe off from his estimate of September 26, 1933, instead of the
sidewalk area.
. That on September 26th, 1933 $6423.82 was paid to Fraser - and
Feller as a Part payment of est imat a #39 total of�which was $8729:75.
!I'I That on October 16th, 19339 after the Public Utility Board -had
I made .remittance to meet the total cost of this project, $23054093 was
appropriated which left $2224:07 due them bas the %% withheld and for the
replacement of tree paving, driveways and sidewalks over the areas men
tioned at the contract Prices specified which resolution and warrant
m in payment carried the following: which eaves $1433w98-due as
5 held for guarantee of street repair, etc-9 U, 623.79 for 1934 re-
? P acing of paving, $104.88 for 19?4 replacing of driveways, and $61.42

The Charter of the City of Rochester Chapter
No 4 11- Sub -Section No.164 places the limit
of the amount of tax that may be levied for the aboved named
funds, viz:
Street -x Alley Fund, 5 mills of the, asessed;�vailuat ion of the city.
Sewer Pund, 3 mills of the assessed valuation of the city.
Bridge Fund, 5 mills of the assepsed valuation of the city.

Alderman Amundsen introduced the following r'esolutio4
which was read:
"Be it, resolved by the Common Council ofXthe City
of Eo cheater, Minnesota: -
That the slue of 1-6594.37 be, and the said siuh is
hereby appropricted from the Code 189 Ceneral Fund. of said City and order-
ed paid to "ode 20 ,' General Fund, for settlement of the difference be-
tween the 1934 spr inkling,, flushing and treating costs 443,,737.32 and
the sprinklinri assessments levied October loth, 193�4, totaling "' 12,192.95.
The` Margo r and Ctty Clerk are hereby authorized
and directed to draw a warrant for said sum upon the City Treasurer
in accordance l.terewith, and cause said payment to be made. "
Upon motion by Fryer, sec,*)nd by Amundsen, that the
said resolution be adopted as read, and all voting in favor thereof,
President Liddle declared the said resolution duly passed and adopted*
Alderman Green introduced a resolution appropriating
577.16 from the General Fund, and ordering payment made to Co -Operative

Oil Company for 7849 gallons of g soline furnished in Car MWDX #52391
which was read.
Upon motion by Fryer, second by Moody, that the said
resolution be adopted as reed., and all voting in favor thereof, President
Liddle declared the said resolution duly passed ;and adopted.
Alderman Lemon introduced the .following resolution,
which was read:
"Be it resolved by t*iie Common Council of t"e City
of Ro chest, er, Minnesota:
That the sum of 231.55 be and the said. sum is here-
by appropriated :From Code 2'3, General Fund of said City and ordered paid
to State of Minnesota, Oil Inspection Division, for ins ection and Lc:tate
Tax on 7649 gallons of gasoline furnished by the Co -Operative Oil
Company to City ,of Rochester in Car lumber .MVDX 5,23`11; :'�3.14 thereof

being .For inspection fee and;`.228.42 being for the State Tax of 3� per gallon.
The Mayor and City Clerk are hereby authorized and directed
to draw a warrant for said sun upon the City treasurer in accordance herewith,
and cause said payment to be made.
Upon motion by .Amundsen, second by Millers that the said
resolution be adopted as read, and all voting in favor thereof, President Liddle
declared the said resolution duly passed and adopted.

from P.W. A. Docket Number 1470 Fund, and ordering payment made to C. C. P agenhart
and M.E*Souther,/ascPart payment of final estimate for the construction of a
Bridge on Fourth - Street Southeast, over t?re Zumbro Rivers: under Jo b Number
13059 which was read.
r Upon motion by Moody, second by Fryer, that the said
resolution be adopted as read, and all voting in favor thereof, President Liddle
declared the said resolution duly passed and adopted:
Alderman Fryer introduced a resolution ap pTopristing
35138:69 from P.W.A.Docket Number 1473 Fund, and order.'_ng payment made to
Christensen Contractors, Inc., as part payment on final estimate for construction
of trunk line sanitary sewer in parts of Broadway Street No rt h and South, under
Job Number 18079 which was read. _
Upon motion by Miller, second by Amundsen, that the said
resolution be adopted as read, and all voting in favor thereof, President Liddle
declared the said resolution duly passed and adopted*

"Be it resolved by the Common Council of the City of
Rochester, 11innesota:
That the sum of $95.07 is hereby appropriated from the
Fund mentioned for the payment to -the Funds stated, Pin the amounts set forth,
which is for the transfer of the accounts assessed as special services by
this Common Council under date of October 10, 1934, all of which appropriations
are to be from Code 309 General Fund:
We24 to the Pewer Fund; for the George Garbisc account
$4i20; T.M.Sullivan Estate Account 11 05, and Dr. H.H.Bowing Account 4.99;
r $2.26 to the Street and Alley Fund; for the Peter Rasmussen
Account; I -
F 429.73 to the P.I.R•Fund for the Mrs. Barbara, Worth Account;
• 1$52.84 to the General Fund; for.the A.Y.Gates Estate $3.47
account, and for the Laurette Friedell Mickleson $49.37 Account. "
. Upon motion by Fryer, peoond by Green, . thet the said
resolution be adopted as read, and all voting in favor thereof, President Liddle
declared the said resolution duly passed and adopted. r
Alderman Green Introduced a resolution authorizing the
Public Utility Board to enter into contract with L.A.Kepp Contracting Company,
in accordance with their above quoted resolution requests and fixing the amount
of the surety bond to be given by said Contractor at $39986800, which was read.
Upon motion by Amundsen, second by Fryer, that the said
resolution be adopted as read, and all voting in favor thereof, President Liddle
declared the said resolution duly passed and adopted*

the Public Utility Board to enter into contract .with the Botsford Lumber
Company for the furnishing of coal screenings, in accordance with their
above quoted resolution request, and fixing the amount of the surety bond
to be given by said contractor at the sum of 38560*00, which was read4
Upon motion by Lenmon, second by Moody, that the
said resolution be adopted as read, and all voting in favor thereof,
President Diddle declared the said resolution duly passed and adopted:
Alderman Miller introduced a resolution authorizing
the Public utility Board to enter into contract with Clements Chevrolet
Company for the purchase of a One-half ton Chevrolet Truck, in accordance
with their above quoted resolution request, and fixing,the amount of the
surety bond to be given by the said Contractor at the sum of .459,100,

Upon motion by Miller, sec,,,nd by Amundsen, that the
said resolution be adopted as read, and all voting in favor thereof,
President Liddle declared the said resolution duly passed rand adopted*
Alderman Moody introduced a resolution authorizing
!� the Public Utility Board to enter into a contract with L.M.Feller for the
construction of rip -rap at the Hydro-Fleetric Plant, in. accordance with
!II their above quoted resolution request and fixing the amount of the surety
bond to be given by the said coat actor at the sum of N36010-009 which was

Upon motion by Lennon, second. by Moody, that the
said resolution be adopted as read, and all voting in favor thereof,
President Liddle declared the said resolution duly passed and adopted.
The following claims were read, and upon moticn by
Lemmon, second by Fryer, -the same were allowed, and the Mayor and City
Clerk were authorized and directed to draw warrants upon the City
Treasurer and make payments accordinglyt
