Minutes of &,:regular meeting of the Common Council of the City
of Rochester, Minnesota, held in the Council Chambers, in the City Hall, in said City
at 2:00 o'clock P.M., on November 5th,1934..
Meeting called to order by President Liddle.
Roll Call. Present: Liddle, Amundsen, Fryer, Green, Lemmon
Moody. Absent: Miller.
The report of the City Treasurer for the month ending October
31,1934, showing $1899470.25 as being on hand was read and President Liddle ordered
that the same be placed on file.
The report of the City Engineer for the month of October919349
showing expenditures for labor from the Geberal Fund in the amount of $680.25,
from the Street and Alley Fund $1478.369 from the Sewer Fund $?79.92, and from the
Bridge Fund $900239 was read and President Liddle ordered that the same be placed on
file.
The report of the Building, Electrical and Plumbing Inspector
for the month of October919349 showing building inspection fees collected in the
amount of 0260,00, electrical inspection fees $130259 and plumbing inspection
$24.75, was read, and President Liddle referred the same to the Finance Committee.
The application of T. V. Nagle for a public dance permit at the
Woodman Hall November loth, 17th and 24th,1934, was read.
The following request was read and upon motion by Green second
by Moody the issuance of 20 gallon per week to December lst,1934, was authorized
with provision that that shall be final:,

An excerpt from the minutes of your meeting December llth,
1933 in connection with reserved parking space around the City Hall
has reached this Department.
The question of finding a parking place conveniently
has always occasioned the workers of this Department much trouble
and considerable loss of time' as the cars used in this department
are not parked for half a day but are in and out all of the time.
We would appreciate it if reserved parking space could be provided
for the Health Department car, the cars of the Sanitary Inspector, the
Milk" Inspector and the two nurses. I am wondering if it would be

possible to mark off the required space for all cars used in connec-
tion with City servicese It certainly would be a great convenience
and also a saving of valuable time now spent looking for a parking
place and walking to and from where the car has been parked.

Having been informed that under date of August 14919341, the
Public Utility Board did, after duly advertising for bids, award a
contract to L.M.Feller for the furnishing of the necessary labor and
material for (1) the excavation of approximately 800 cubic yards of
earth at the tail raeb of the Hydro -electric Dam at a price of $1.10
per cubic yard, and (2) the construction of a concrete pier and weir
at a price of $29210*00, and
In view of the fact that the Public Utility Board is unable
to complete the construction of the pier and weir owing to the fact that
an easement for access to the location of same has not been obtained, I,
therefore, authorize and empower under the existence of an emergency,
because of the lateness of the season, t'o complete the excavation of
approximately 800 cubic yards at a price of $1e10 per cubic yard under
the provisions of Section 284 of the Charter of the City of Rochester,
Minnesota.

Having been informed that the Fakler Bottling Works
desires City Steam service for the forthcoming season and
advised of the fact that insufficient time remains to advertise
for bids for the changing of piping inside said building, you
are hereby authorized and empowered under the existence of the
above. named emergency to employ the H. Dornack Company, at a
price of $13234009 they being low bidder according to their
quotation to do the said work.
This order is given under the provisions of Section
284 of the Charter of the City of Rochester ,Minnesota:

The following copy of resolution passed and adopted
by the Commissioners of the Sinking Fund, was read, and upon motion by
imundsen second by Fryer the action set forth, therein was approved and it
was ordered that the said copy of resolution be placed on file:
"WHEREAS, the Public Utility Board have made
request of -the Common Council of the City of Rochester, Minnesota, and the
Sinking Fund Commission of the City of Rochester, Minnesota, that certain
sums be appropriated from the Sinking Fund of said City to the Public
Utility Fund of said City for the replacement and betterment of existing
equipment, and
WHEREAS, the Common Council have authorized and
directed the said Sinking Fund Commission to make appropriations in
accordance with the following quoted Common Council resolution and Public
Utility Board Resolution; and
WHEREAS, the uninvested funds for electric light
depreciation reserve does not equal the $349582.98, request as there is
only $119857.57 of uninvested funds on this date for electric light

SO THEREFORE BE IT RESOLVED, by the Sinking Fund
Commission of the City of Rochester, Minnesota: That the sum of $119857,57

That the following quoted resolution hereby forms a part of this
resolution:
'Be it resolved by the Common Council of the City of Rochester,
Minnesota:
That the Sinking Fund Commission of said City be and the said
Commission is hereby authorized and.directed to make appropriations to the Electric
Light Department in the Public Utility Fund, and to the Water Department in the
Public Utility Fund, in accordance with the following quoted resolution request:
'WHEREAS, the Public Utility Board has appropriated to the
Sinking Fund for Light Department Depreciation Reserve certain amounts to be used
for the insta llat ion of new equipment and for the replacement and betterment of
existing equipment, and
WHEREAS, the Public Utility Board has found it necessary to make
certain repairs which' will add to the life of certain structures, being a repair to
the Hydro -Electric Power Dam Structure,in resurfacing the down stream side of the

the Sinking Fund Commission of the said City are hereby requested to appropriate
the amount of $349562.98 from the Sinking Fund for Light Department Depreciation
Reserve, not invested, to the Public Utility'Fund and the amount of $19224.00 from t]
Sinking Fund for Water Department Depreciation Reserve, not invested, to the Public

Gentlemen:
We, the Public Grounds Committee of the Common Council of said
City, report that in the matter of a new furnace for the Williams Estate
business property, our Committee and Mr. H. 0. Christensen, Supervisor Of
the Williams properties, decided in favor of a twenty-four inch combination
coal, oil and gas furnace and, accordingly, purchased one from A. Pekkala at
a cost of $205,009 installed.
Under our order the Minnesota Northern Natural Gas Company are
to install the necessary attachment for natural gas service at a cost of
$101.40, installed.

The, communications of the United Workers Association of Olmsted
County under dates of October 22nd and 29th, 1934 having been referred to
the undersigned committee for investigation and recommendation, the folloftAg
report is submitted:
1. As to the G.Schwartz & Company contract on the city electric
light plant job, you are advised that the Schwartz contract was signed prior
to the time the wage scale mentioned in those communications took effect and
consequently has no bearing on that job. We have asked for some concrete
evidence showing that payments for labor are not being mane in accordance with
the ordinances in effect at the time of the signing of the contract but have
not been favored with any proof to date-i

2. As to the request for a census of the City of
Rochester for the purpose of ascertaining the number of employees
in each family, you are advised that such a matter is not and `{
cannot be a part of the duties of the Common Council or any
official of the City of Rochester and that the City of Rochester,
either acting through its Common Council or otherwise, should
not and could not have arq hand in such a matter.

I believe that at this time the City of Rochester `
should execute the agreement by way of settlement for past
infringement and license for future use of the patents owned
by Activated Sludge, Inc. I attached hereto letter received
from Mr. C.W.Johnson, the president, requesting that some
action be taken along this line and listing some of the cities
with which arrangements have been completed or are being
completedd I also attach the license schedule which is being
used as a basis in arriving at the proper amount to be paid
by any municipality. In this connection I have prepared a
resolution appropriating the sum of $570040 for the above
named purpose:

"WHEREAS, The gross total of the .1934 tax, levy made
by `the Common Council -of 'the City of Rochester jAinnesota , October 29t h, .

WHEREAS, The Public Utility Board of the said City
have expressed themselves as agreeable to a continuation of the payment
gross incomes from the operation of the Electric Light
� of 10� on •
Department and the Water Works Department, anti .
WHEREAS, It is estimated that this 10% gross income
from the operation of the above mentioned departments will, during the
period October lstN1934 to May 319t ,1936, amount to a total sum of h
(� $72,00000 in a pro rate reduction of all funds concerned to arrive at x
the net total levy of $3329275.44, and '
WHEREAS, It is necesse.ry that the Public' Utility
Board• of said City be authorized to make payment of the 10%, on gross
incomes from the operation of the Electric Light Department and the
Water Works Department;
SO THER2PORE, Be it resolved' by the Common Council
of the City of Rochester, Minnesota:
That the Public Utility Board of said City be and the
said Board is hereby authorized to appropriate to the City Treasurer of
said City for distribution to the various funds of said City described
below, 10% of the gross incomes from the operation of the Electric Light
Department and the Water Works Department of said City, October 1st,
1934 to May 31st ,1936, inclusive, which appropriations are to be made
ordinarily upon the 16th day of each month, for the 10�t on incomes from
operations during the Pr'eceeding month. The share each fund of the City
of Rochester, Minnesota, shall have in the estimated $729000.00 total is

Upon motion by Green second by Dryer that the said resolution be
adopted as read, and all voting in favor thereof, President Liddle declared the said
solution duly passed and adopted*
Alderman Amundsen introduced a resolution granting public dance
rmit to T. V. Nagle for the Woodman Hall November loth, 17th, and 24th919349 and
Fixing the fee at $9.00, which was read.
Upon motion by Amundsen second by Moody that the said resolution
be adopted as read, and all voting in favor thereof* President Li ddl a declared the
said resolution duly 'passed and adopted.
Alderman Green introduced the following resolution,which was
read:
"Be it resolved by the Common Council of the City of Rochester,
Minnesota:
That the sum of $789.80 be and the said sum is hereby appropriate
from the Sewer Fund, Code 199 of said City and gvdered paid to C.G.Fraser and L.M.
Feller, as partial payment on their sworn claim for 5% retained on Broadway Street
North trunk line sanitary sewer between Thirteenth Street and Fourth Street.
The Mayor and City Clerk are hereby authorized and directed to
draw a warrant for said sum upon the City Treasurer in accordance herewith, and
cause said payment to be made. "
Upon motion by Fryer second by Green that the said resolution
be adopted as read, and all voting in favor thereof, President Liddle declared the
said resolution duly passed and adopted.
Alderman Fryer introduced a resolution appropriating $378.80
i from the Park Improvement Fund and ordering payment made to the Mayo Trust Fund for
payroll for labor during the week ending November 2,1934, which was read.
Upon motion by Lemmon second by Moody that the said resolution
Ibe adopted as read, and all voting in favor thereof, President Liddle declared the

Alderman Amundsen introduced the following resolution.%hich was
Iread:
i "WHEREAS, an action was commenced in the United States District
Count, wherein Activated Sludge, Inc. was pl aint iff and the City of Rochester wad
defendant, in which itwas alleged that the City of Rochester in the operation of its
I sewage disposal plant had infringed certain patents listed in the complaint in said
action which are the property of the plaintiff; and,
WHEREAS, at the same time there was an action
pending in which the Activated Sludge, Inc was plaintiff and the City of
Milwaukee was defendant brought for the same purpose, which said action
I, terminated in the United States Circuit Court of Appeals in favor of the

ii plaintiff and against the City of Milwaukee by the refusal of the United
States Supreme Court on October 89 1934 to review the decision of that
V II� court; mod+
WHEREAS, the City of Rochester feels that by the
termination of the Milwaukee case it would be useless to appropriate any
funds for the purpose of defending itself in its action; and,
WHEREAS, the Activated Sludge, Inc. has submitted
the proposition for settlement to the City of Rochester as follows: that
for the sum of $5700.00 the Activated Sludge, Inco agrees to release the
City of Rochester from all damages on account of past infringements of
any patents owned by it and also to license the City of Rochester to use
such patents during the life thereof; and,
WHEREAS, the Common Council of the City of Rochester,
Minnesota deem it expedient, necessary and for the best interest of the
public welfare that said offer be accepted and that payment be made by
the City of Rochester of the sum of $5700:00 in accordance with the terms

THEREFORE, be it resolved by the Common Council of
the City of Rochester:
That the sum of $570040 be and the said sum is here-
by appropriated from the Sewer Fund of said City and ordered paid to
Activated Sludge, Inc., as payment in full for all damages, past infringe-
ment of patents mentioned and described in the complaint of Activated
Sludge, Inc. vs. City of Rochester and as payment in full for a license
for future use of said patents, all in accordance with the terms and
conditions of the agreement executed by the City of Rochester and
Activated Sludge, Inc. as settlement for past infringement and license
for future use, reference to which is hereby made for greater certainty]
The Mayor and City Clerk are hereby authorized
and directed to draw a warrant for said sum upon the City Treasurer in
accordance herewith, and cause said payment to be made.
Be it further Resolved, by said Common Council
that the Mayor and City Clerk of the City of Rochester, Minnesota be and
they hereby are authorized, empowered and directed to enter into a con-
tract for settlement Sf past infringement and license for future use of
the said patents and in accordance with the terms of this resolution. "
Upon motion by Moody second by Amundsen that the
said resolution be adopted as read, and all voting in favor thereof,
President Liddle declared the said resolution duly passed and adopted.

The application of Modern Broadway Market, Yellow Cab Company
and Broadway Bar, for permits to place and maintain signs were each read, and upon
motion by Amundsen second by Miller Permit o were granted.
Cancellation notlee by the Mill Mutuals of Policy covering the
Home Laundry sign was read, as was policy written by the Hardware Mutuals Casualty
Company covering the same sign at which mention by Amundsen second by Miller carried
that the said cancellation be accepted, and that the said coverage by the Hardware
Mutuals Casualty Company be accepted.
Alderman Fryer introduced a resolution appropriating 1,205.00
from the Frank E.Williams Estate Fund and ordering payment made to Alfred Pekkala for
oai,=ltohaco Series, C-24 cast iron fmrnace installed in the Williams property business
building,which was read.

said resolution duly passed and adopted.

was read and upon motion by Miller second by Amundsen, the City Attorney was instruc-I
ted to prepare condemnation proceedings for the taking of the lands described:

At a meeting of the Park Board Monday, October 29th, a
resolution passed by the said Board, asking the council to condemn
certain lands, description of which is herewith included.
This land is necessary for the completion of The Silver Lake
Project..

Upon motion by Lemon second by Amundsen the matter of one or
two street lights along the west side of the Catholic Church and one along the
north side of St. Johns School, was referred to the Lighting Committee with power
to act.
Upon motion by Lemmon second by Moody the matter of
ornamental lighting on Pirst Street Southwest between Eleventh Avenue
Southwest and Sixteenth Avenue Southwest was referred to the Lighting
Committee and the Public Utility Board.
Upon motion by Moody second by Fryer the City
Clerk was instructed to transmit a letter of thanks to Miss Belva Snodgrass
for her efforts in handling the Halloween activities October 31919341 and
accordingly she was addressed as follows:

At the last meeting of the Common Council
of the City of Rochester held on November 59 1934 I was in-

be remembered in the City of Rochester and to ask you in turn
to express to the students the thanks of the Common Council for
the manner in which the students conducted themselves on the
night in question*,

Upon motion by Green second by Fryer the Social
of
Welfare -Worker (Police Woman) was authorized ten gallon.e/gasoline per
week for use,in her privately owned automobile while upon public duties
in connection with her office.
Louis J.Claude, Chief of Police, made oral recommende-
tion that the taxi and driver licensee heretofore issued to Richard Holland
be revoked and accordingly upon motion by Fryer second by Amundsen taxicab
license No.17, and Drivers License No.l heretofore issued to Richard
Holland were revoked effective on this date.
Upon motion by Moody second by Miller the Common
Council adjourned to 7:30 o'clock P.M., November 26th,1934.
