Meeting called to order by President Liddle. Roll Call: Present: Liddle, Fryer, Green, Lemon, Miller. Moody. Absent: Amundsen: Upon motion by Moody second by Fryer the minutes of the meetings held on October 10th,19349 and October 15th,1934, were each approved. Mrs. Gordon Kelly made complaint about the treatment received by Gordon Kelly while under arrest for intoxication; his case being Municipal Court case Nov110201 November 2391934, upon which charges he was found guilty and a fine placed at $10.00 or ten days; the A101-900 fine being paid, and President Liddle referred the subject to the Police Committee. his Chair* Alderman Amundsen came in at this time and took The report of the Clerk of the Municipal Court for the week ending November 26th,19349 showing criminal fines $2470-70, civil fees received $16.509 conciliation court fees received $20259 fine collected and remitted direct to State Treasurer $10:009 court costs charged to Olmsted County $59-609 and fines collected due to Olmsted County $2540, was read and President Liddle referred the same to the City Attorney. Upon motion by'Amundsen second by Moody the sum of $25„00 was appropriated from the General Fund and it was ordered that the said sum be paid to Olmsted County ,Minnesota, for local Municipal Court fines collected due to Olmsted Count y,Minn esot a Balance sheet,income statements,etc., of the Public Utility Departments, prepared by the Secretary of the Public Utility Board as of October 31919349 were laid before the Common Council, and President Liddle ordered that the same be placed on file; the said income statements showing a net profit in the Light Department for October, 545 1934, of $8214.71, net income $8694.76, net profit for the 7 months of this fiscal year of $449733.219 net income $31594486! the Water Department net profit for October,1934 $433.461, net income $3196,019 Water Department net p"fit for the seven months $277610-049 and a net income loss for the seven months of %114360.66; Heating Department, operating profit for October,1934, was �1131094, and for the seven months $271.58. The following application for transfer was read and upon motion by Green second by Fryer, transfer was granted: " Ro ch ester, Minne sot a, . November 19th,1934. Notice of cancellation issued by the Aetna Casualty & Surety Com pang on policy Nod 62J-858 covering Richard Holland's taxicab operation, effective Noon November 17th91934, was read and President Liddle ordered that the same be placed on file. The following appIteat ion was read and upon motion by Moody second by Fryer, it was granted: "UNITED WORKERS ASSOCIATION OF OLMSTED COUNTY November 26th, 1934. Nagle for a public dance permit at the Woodman Hall, December 1st, Sth, and 15th,1934, was read. .W. L. Brinson and O:E.Hammer presented the following proposed ordinances and asked for their adoption,at which President Liddle' referred the same to the City Attorney: "ORDINANCE No. ; AN ORDINANCE TO REGULATE THE LOANING 07 MONEY BY COMPANIES, CORPORA- TIONS OR INDIVIDUALS OTHER THAN BANKS IN THE CITY OF ROCHESTER, AND PROVIDING FOR THE LICENSE AND REGISTRY OF SUCH ORGANIZATIONS AND AGENCIES. Be it and the same is hereby ordained that hereafter all agencies or companies in the City of Rochester, other than banks, loaning money to the public shall be required to file in the office of the City Clerk a sworn statement of the names and addresses of all stock holders, partners or other persons having a Financial interest in said agency or company or business and the amount of such interest. E That before said agency, company or business shall be qualified to do business intthe City of Rochester it shall be necessary to post { with the city a bond in the sum of five thousand dollars conditioned that the business conducted by such licensee and money loaning agency shall in all respects be in accordance with the law of the state of Minnesota regulating rates of interest and methods of doing business, and that further said agency shall pay into thetreasury of the City of Rochester for the use of said city the sum of five hundred dollars for which sum a license shall be issued fo-r the conduct of such business for the period of one year: Any corPoration, company or individual who shall conduct a loaning business in the city of Rochester, excepting banks, without first having complied with the terms of this ordinance shall be deemed in the case of each of their officers or managers guilty of a misdemeanor and upon conviction thereof shall be fined not less than the sum of one hundred dollars or be committed to the county jail for a term not to exceed ninety days. " ORDINANCE NO TO REGULATE THE ORGANIZATION, RATES OP INTERES', AND CHARGES FOR SERVICES-L OF ALL LOAN COMPANIES OR PERSONS LOANING MONEY IN THE i CITY OF ROCHESTER, EXCEPTING EITHER Sr ATE, NATIONAL OR PRI7?ATE BANKS LOCATED IN SAID CITY. 547 Hereafter it shall be unlawful for any company, corporation or individual to loan or furnish for use in the City of Rochester, Olmsted County, Min- nesota, any money or thing of value and charge for the use thereof either in the form of advance payments, bonuses or otherwise a sum of money or thing of value exceeding a charge of eight per cent figured annually. Fur- ther that and all charges for the use of money or other thing of value ex- ceeding eight per cent per annum figured on such annual basis !hall be illegal and void and any person negotiating or handling such loans knowingly shall be guilty of a misdemeanor and on conviction thereof shall be punished by a fine of not exceeding one hundred dollars or by confinement in the County jail at hard labor for a term not exceeding ninety days: This ordinance shall be in force from and after the. date of its passage and proper publication." " 549 The following, recommendation and report was made and President Liddle ordered that the same be placed on file: " Rochester, Minnesota November 269 1934 Hono rab-1 a Mayor and Common Council City of Rochester, Minnesota Gentlemen: The matter of taking steps to do away with the, position of Social Welfare Worker and in lieu thereof to create the position of Police Matron within the Police Department and consequently under civil service having been referred to the undersigned committee for attention, the, following recommendation and report is made. The committee feels that because of the fact that there are but a few months before the spring -election with possible changes in the personnel of the Council that it would be best for, all parties concerned to postpone any such action on this matter until after the sitting of the 1935 Council. " The following memo was read and upon motion by Lemmon second by Green the appi-OPriat ion of $22:64 was made from the Park Improvement Fund and made payable to Albert Keel: *memo A.P.Wright City Clerk Rochester, Minn: The Industrial Commission has computed the compensation of Albert Keel on the basis of 5� days per week instead of 2 days per week, the time he worked here, making his compensation rate $16.13 per week instead of $8:00 per week, the minimum allowed by law. The total compensation allowed him according to the Commission's figures is $43498. He has been paid the sum of $21.34 and there is now due him an additional sum of $22.64, which amount the Commission has asked that we pay this man as compensation in full. He has, therefore, signed a receipt for'the additional amount and it is in order to place same in line for payment. James T. Schwarz, City Treasurer, $75.00, refund for personal payment made for the expenses of collecting the 1934 sprinkling assessments, was read, and upon motion by Green second by �I Lemmon the sum of $7516,00 was appropriated from the "-eneral Fund and it I was ordered that the said sun be paid to Carl C. Schwarz, City Treasurer, i for the purpose stated. The claims of C. C. Pagenhart, �,U03031 for concrete 11 work at Foiirtb. Street and Tenth Avenue Southwest, near Saint Mary's Hospital, and $950,26 for curb and gutter work done in different parts of 551 ;he City, were. each read, and upon motion by Lemmon second by Pryer, $103.31 was %ppropriated from the Sewer Fund and $95026 from the Street and -Alley Fund, for payment to C. C Pagenhart , provided that before the warrants are released he shall itemize the days, etc. , for the labor involved in the two claims. Alderman Moody introduced a resolution granting public dance permit to the United Workers Association, for the Woodman Hall November 23th919349 without fee, which was read. Upon motion by Lemmon second by Moody that the said resolution be adopted as read+and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman,Moody introduced a resolution granting public dance permit to 2,iV.Nagle for the Woodman Hall December 1st , Oth, and 15th,19341 and fixing the fee at Z$9 00, which was read. Upon motion by Amundsen second by Green that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Specifications and estimate of cost for the furnishing of a two ton truck for use of the Street and Alley Department, were laid before the Common Council, the said estimate of cost being $1650.00, with the estimated trade-in value of the Dodge 1930 model ad $150:00. Alderman Lemmon introduced the following resolution,which was read: "WHEREAS, It is deemed expedient and necessary that a two ton truck be purchased fV-r use of the Street and Alley Department of the City of Rochester, Minn es of a , . and WHEREAS, The City Engineer has prepared specifications and estimate of cost for the furnishing of a two ton truck, and SO THEREFORE, Be it resolved by the Common Council of the City of Rochester, Minnesota, that a two ton truck be purchased for use of the Street and Alley Department of the City of Rochester, Minnesota; that the said specifications be adopted for the purchase of the said truck and that the same be placed on file in the office of the City Clerk of said City; and that the said estimate of cost be accepted and placed on file in the office of the City Clerk of said City, and Be it further resolved by the said Common Council: That the City Clerk of said City be and he is hereby authorized and directed to advertise for sealed proposals for the furnishing of the said two ton truck F.Q.B. Rochester, Minnesota, which sealed proposals will be received and opened by this CommonCouncil a public meeting thereof which is to be held at 7: 30 "o' clock P.A. , on December 10th,1934. Each bid must be accompanied by a check upon some reputable bank drawn payable to the Mayor, of Rochester, Minnesota, for at least 10 per cent of the amount of the hid, which eheck and , th.e amount of money specified therein shall be forfeited to the City of Rochester, f Minnesota, aii liquidated damages if th.e bidder upon the•letting of the contract to him shall fail to enter into the contract so let; the said Common Council reserves the right to reject any and all bids. i I A surety bond written for the full amount of the contract by a surety company authorized to do business in the State of Minnesota, will be required with the contract. (Personal bonds not to 11 be accepted.) All proposals must be addressed to Mr. A.1'.Wright, City Clerk of Rochester, Minnesota, and shall have endorsed thereon, 'Proposal f'or the furnishing of a two ton truck.' Alderman Amundsen introduced a resolution appro- priating .1440.10 from the Park Improvement Fund and ordering payment made to the City of Rochester, Water Department for water furnished (� to public parks during the season of 1934, which was read. Upon motion by Moo#y second by Amundsen, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Green introduced a resolution appropriating I $2197.50 from the Lighting Fund and ordering payment made to the City of ! Rochester, Light Department,for electricity furnished 11or the lighting of public streets and grounds, as per billings of October 25th,1934, which was read. Upon motion by Fryer second by Moody, that the said recto lut ion be adopt ed • as read, and ' all vot ing in f avo r th ereof, Pres ident Liddle declared the said resolution duly passed and adopted. Alderman Fryer introduced a resolution appropriating $63.01 from the General Fund and ordering payment made to the Permanent 1 11 Improvement Revolving Fund for the said Revolving Fund' s share in the tax penalties collected with the November919349 tax settlement, which was read. Upon motion by L emmon second by Amundsen that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman ^Lemmon introduced the following resolution,which was read: "Be it resolved by the Common Council of the City of Rochester, Minnesota: That the sum of .297.82 be and the said sum is hereby appro- priated from the .Park Improvement Fund of said City and ordered paid to Hanson � Hardware Company for 1022 hours. Stapt. & Erects tools for installation of Tennis court & B.B.park, 2 Tennis Court gates, 500 # dynamite, 4 ft. fencing, 200 caps, and 500 fuse caps, etc., furnished .for improvement of Soldier Field $213.82, and for improve- ment of Cascade Park $84400. The Mayor and City Clerk are hereby authorized and directed to draw a warrant for said sum upon the City Treasurer in accordance herewith, and cause said payment to be made." , Upon motion by Lemmon second by Fryer that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Miller introduced a resolution appropriating $1207.10 from the Park Improvement. Fund and ordering payment made to the Mayo Trust Fund for payrolls for labor during the weeks ending November 9th, 16th, and 23rd919349 which was read. Upon motion by Fryer second by Amundsen that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Fryer introduced an ordinance to amend an ordinance entitled," An Ordinance licensing and regulating circuses, dog and pony shows, carnivals and tent shows within the City of Rochester, Minnesota," the same being Ordinance No.349 of the City of Rochester, Minnesota, which was given its first reading. adjourned.
