Minutes of a regular meeting of the Common Council
of the City of Rochester, Minnesota, held in the Council Chambers, in
the City Hall, in said City, at 2:00 o'clock P.M., on December 7,,1934.
Meeting called to order by President Liddle.
Roll Cagl. Present: Liddle, Amundsen, Fryer, green,
Lemmon, Miller, Moody. Absent: None:
upon motion by Moody second by Amundsen, the minutes
of the meetings held on October 22nd91934, October 29th,19349 November
5th,19349 and November,l9th91934, were each approved.
The report of the City Engineer For the month of
November,19349 showing expenditures from the General Fund for labor of
$121.53, Street
and Alley

President Liddle ordered that the same
be
placed on file.
The report of the Building, Ele ctrical and
Plumbing Inspector for the month of November,1934, showing Building
Inspection fees collected in the amount of $32000, electrical inspection
fees $1540, and Plumbing Inspection fees $21.259 was read, and Presi-
dent Liddle referred the same to the Finance Committee. '
The following report made by the Building,
Electrical and Plumbing gnspectp�r on his tests of natural gas, was
read and upon motion by Lemmon second' by Miller, the City Clerk
was instructed to serve a copy thereof on the Minnesota Northern Natural
Gas Company, and ask,. that they have some qualified representative
before a meeting of this Common Council, scheduled to be held at 7:30
o'clock P.M., on December 10th919349 and explain why there is such a
wide range from the high to the low tests;

The following copy of resolution passed and adopted by the

commissioners of the Sinking Fund was read and upon motion by Moody second by Fryer

the action set forth therein was approved and it was ordered that
the said copy of resolution be placed -on file:
"WHEREAS, The Public Utility Board have made
request that 13495821698 be paid from Electric Light Department Depre-
ciation Reserve investment funds, uninvested, to the Electric `Light
Department in the Public Utility Fund, and
WHEREAS, The Common Council of said City have duly
authorized such an appropriation, and the Sinking Fund Commigsion of
said City have already appropriated 111,657.57 under this authority and
request, as being; the amount of uninvested funds at the slate of that
appropriation, and
WHEREASi $179169447 of uninvested -Light Department
Depreciation Reserve funds are on hand and uninvested at this -date
SO THEREFORE, Be it resolved by the Commissioners
of the Sinking Fund of the City of Rochester, Minnesota, that .the sum
of $179169.47 be appropriated from the Sinking Fund of said City and
paid to the Electric Light Deportment of the Public Utility Fund of said
City, as a further partial payment on the Public Utility Board's request
for Electric Light Department Depreciation Reserve funds ; $1498c0.59
thereof to be from Code 239 of the Sinking Fund, and $2363.60 thereof
to be from Code 24•, of the Sinking Fund. "

To the Honorable City Council
Rochester, Minnesota
Gentlemen:
In 1923 when I was elected Mayor-, our city was full
of slot machines and the City Attorney, at that time Thomas
Fraser, ruled that it was against the law to operate' slot machines.
During the two years while I was Mayor these machines did not
op erat el
When again elected in 1931 I found a new machine operating
in our city which had started during the time that Alderman Lemmon
was Mayor. ' I supposed that they were alright but inquired of the
City Attorney who ruled that they were legal and classified them as
'games of skill*. We allowed these last machines to run but while
I was out of the city for two weeks last February they all disappearedi
I._haere never been able to find out why they disappeared and on
asking the Chief of Police found that he had not ordered them out.

They were'not operating until about a month ago when they appeared again
all over the city. Nobody seems to know just who is responsible for
their retuIrn and they have come back so strong that there had to be some
explanation and so word is being passed around that they are the 'Mayor's
racket'.
- I wish to say in my defense that the Mayor had nothing
to do with it. These machines were operating under the Ex -Mayor Lemmon's
administration and they were put out of commission and appeared in the
city again without anybody knowing anything about it but now are causing
-a whispering campaign that they are the 'Mayor's racket'.
At different times in. the city every kind of a slot machine
has been operated, and I auppose legally, but I am now asking for a
written opinion as to the legality of all these different types df slot
machines:
If it is a racket, it is somebody�s racket, but I object
to anybody using my name in connection with it.

Upon motion by Lemmon second by Green the above quoted communi-
cation was referred to the City Attorney with request for a written ruling on the
legality of all the different types of slot machines mentioned and that the Chief
of Police he furnished with a copy thereof.
A circulat letter from Ambrose Fuller, Director of the League of
Minnesota Municipalities, asking for attendance at the Regional Conference, which is
to be held at Austin, Minnesota, on Wednesday December 12th,19349 at 10:00 o'clock
A.M., was read and upon motion by Miller second by Fryer such officials as may find
it possible to go are authorized to do so at the expense of the City of Rochester,
Minnesota.
The following copies of resolutions passed and adopted by the

"WHEREAS, the Public Utility Board did by motion on July 27th
1934 employ Harold H. Crawford to furnish such architectural services as necessary

for the new Light Plar Addition, such services to supplement the work of other
1 architects previously employed and said Harold H. Crawford to receive the, amount
of $1250.00 for said services,
THEREFORE, be it and it is hereby resolved by the said Public
Utility Board that the Hone Common Council be and is hereby requested to authorize
said Board to make the: payment as herein.. stipulp6ted-ss said services are furnished."

President Liddl a announced the appointment of the
following persons as aii Auditorium Committee for a study of the type of
building, location,ete., for a local Auditorium: H. J. Harwick, Dr.H.S.
Plummer, Glenn Witherstine, Walter Hae3ley, Dan Macken, J. T. Lemmon,
Tom Moody, C.E41(nowlton, and Mayor Julius J. Reiter.

Clerk were authorized and directed to draw warrants upon the City Treas-

Alderman Amundsen introduced the following resolut ion, which was
read:
"Be it resolved by the Common Council of the City of Rochester,
Minnesota:
That the Public Utility Board of the said City be add the said
Board is hereby authorized to make payment of $.2600.00 to the Minnesota Northern
Natural 'Gas 'Company in accordance with the following quoted resolution request:
'Be it and it is hereby resolved by the Public Utility Board
of the City of Rochester, Minnesota that the Hon. Common Council of the said City
be and is hereby requested to authorize the said Board to make payment in the amount
of TWENTY SIX HUNDRED DOLLARS($06004100) to the Minnesota Northern Natural Gas
Company for one Hagen Automatic Control System which was installed with the regular
Gas -burning equipment for which payment was made March 31st91933 and which item
was included in invoice for said equipment, payment for same having been withheld
to this date pending proper adjustment thereof and approval of the Fire Under-
writers Association covering installation of said equipment and the said equipmant
meets the approval of the Board at this time and the said Board having received
approval of the Fire Underwriters Association.'

Be it further resolved by the said Common Council: That the
said approval and authority is hereby made retroactive to qualify the appropriation
made by the said Public Utility Board November 30.19349 of $2600 00 under warrant
Noo 6403:"
Upon motion by Lemmon second by Fryer that the said resolution
be adopted as read, and all voting in favor thereof, President Liddle declared the
said resolution duly passed and adopted.
Alderman Fryer introduced the following resolution,which was
read:

"Be it resolved by the Common Council of the City of

hThat the Public Utility Board of said Citf be, and the
said Board is here by authorized to employ Harold $. Crawford's architec
tural services in connection with the new light plant addition, in
accordance with the following quoted resolution request:
'WHEREAS, the Public Utility' Board did by motion

That the said authority and approval Is hereby made retroactive to
qualify the appropriation made by the Public Utility Board November 30th,
19349 of $950.00 to apply on account, under warrant No36405."

Upon motion by Fryer second by Amundsen that the
said resolution be adopted as read, and all voting in favor thereof,
President Liddle declared the said resolution duly passed and adopted.
Alderman Green introduced a resolution appropriating
$215064 from the General Fund and ordering payment made to the City of
Rochester, Steam Heating Department,for steam heat furnished at the City
Hall, in accordance with the November 28th,1934,billings ,which was read.
Upon motion by Green second by Moody that the
said resolution be adopted as read, and all voting in favor thereof,
President Liddle declared the said resolution duly passed and adopted.
Alderman Lemmon introduced a resolution appropriating
$22910-75 from the Lighting Fund and ordering payment made to the City of
Rochester,Light Department,for lighting public buildings, in accordance
with the November 25th919349 billings.) which was read.
Upon mot ionby Amundsen second by Fryer that the
said resolution be adopted as read, and all voting in favor thereof,
President Liddle declared the said resolution duly passed and adopted.

Alderman Miller introduced a resolution appropriating $2686.50
from the Lighting Fund and ordering payment made to the City of Rochester, Light
Department ,for lighting of public streets and grounds, in accordance with the
November 25th,1934,billinga,which was read.
Upon motion by Moody second by Green that the said resolution
be adopted as read, and all voting in favor thereof, President Liddle declared the
said resolution duly passed and adopted.
Quit claim deeds given by Otto W. Riess and Augusta Riess, his
wife, and William 0. Riess, and Mabel K. Riess, his wife, conveying certain lands

to the City of Rochester, Minnesota, as a public street and road running west from
Eleventh Avenue Northeast, were each read, eAd Upon motion by Lemmon second by
Miller,the said quit claim deeds were accepted and it was ordered that the same
be placed on re ord.
Agreement in settlement for past infringement and license for
future use between Activated Sludge, Inc., and the City of Rochester, Minnesota,
relative to the Aerators in use. at the local sewage disposal plant was read and upon
motion by Lemmon second by Fryer the same was accepted and it was ordered that the
said agree"nt be:.plaeed on file.
Alderman Lemon introduced the following resolution,which was
read:
"Whereas, the Board of Park Commissioners of the City of
Rochester, Minnesota has requested the Common Council of said city to acquire by
condeanat ion certain lands for the purpose of completing what is known as The
Silver Lake Park Project; and
Whereas, the said Common Council, deeming it expedient and necessary
and for the best interest of the citizens of Rochester that said land be condemned
and that the lands hereinafter described are suitable, desirable and proper for the
purpose of completing said project;
Therefore, be it and it is hereby resolved by the Common Council
of the City of Rochester:
That the f ollowing described pieces and parcels of land situated
in the City of Rochester, in the County of Olmsted and State of Minnesota be and the
same are hereby condemned for the use of said City of Rochester, Minnesota in the

Common Council:
That all the right, title and interest of each and
every person claiming an interest in or to the said premises above
described, to any and all streets and alleys passing through or abutting
upon the said above described premises on the east, north and the west
sides thereof, where said right, title, and interest, or either of the
same, in apd to said streetsand alleys, or. either or any of them, is
claimed as belonging or appurtenant to any of the property or premises
above described, be and the same are hereby condemned for the use of said
City of Rochester in the completion of the Silver Lake Park Project in
said City of Rochester, Minnesota.
Be it and it is hereby further resolved by said
Common Council: '
That John P. Huyber of the first ward of said City,
John M. Norton of the second ward of said city, and Paul II: Priebe of
the third ward of said city, three disinterested freeholders and qualified
voters of said city, be and they are hereby appointed Commissioners to
view the above descried premises and to assess the damag-es , if any there
be, which t kyy be occasioned by the condemnation and taking of said
property, or any of it, o'r the damaging or destroying of the same or any
part thereof, for use of said City of Rochester in the completion of the
Silver Lake Park Project in said City of Rochester, Minnesota
The City Clerk is hereby authorized and directed to
notify the said Commissioners appointed as aforesaid to be and appear at
his office in the City Hall of said City of Rochester on such day as the
said City Clerk may designate, for the purpose of qualifying and entering
upon the duties of their office as such Commissioners. "
Upon motion by Moody second by Amundsen that the
said resolution be adopted as read, and all voting in favor thereof,
President Liddle declared the said resolution duly passed and adopted.

ney was instructed to, after he has had an opportunity to go before the
Attorney General December llth or 12th919349 draft an ordinance that will
comply in a general way with the ordinance controlling loan companies and
individuals making loans as requested by Mr: 0� E. Hammer and Mr: W.L.
BrdLnson, provided that the Attorney General passes on the legality of
such an ordinance, which said ordinance shall be ready for action at a
meeting of the Common Council of the City of Rochest er,M nnesotatwhich is
scheduled to be held at 7:30 o'clock P.M-9 on December 17th,19349 prior to
which time he will furnish the local loan companies and individuals making
small loans with a copy of his proposed ordinance:

Alderman Lemmon introduced a resolution appropriating $323.01
from the General Fund and ordering payment made to the City of Rochester, Water
Department,for water furnished for sprinkling and flushing as per billings of
November 25th919349 which was read.
IIpon motYon`by,Moody second` by Amundsen that the said resolution
be adopted as read, and all voting in favor thereof, President Liddle declared the
said resolution duly passed and adopted.
President Liddle referred the matter of potatoes owned by
S.E.R.A. and stored in the basement of the Williams Estate business property build-
ing, being detrimental to the restaurant business of George Barbes, to the Public
Grounds Hommittee with power to act in the matter.
The following c a=ittee report was read and upon motion by
Lemon second by Fryer it was adopted and the sum of $50*25 was appropriated from
the Street and Alley Fund Aor payment to Edward C. Stettler in settlement of the

account for damages mentioned:

City of Rochester, Minnesotae,
Gentlemen:
Having investigated the 'claim of Mri Stettler for damages
caused to his automobile on account of running into a pile of broken
concrete at the intersection of North Broadway and Seventh St.N.W.
on October 8th,19349 we recommend that the same be allowed and paid in
full.
