Meeting called to' order .by President Liddle. Roll Call. Present: Liddle, .Amundsen, T'ryer, Grben, Lemmon, Miller, Moody. Absent: None. Upon motion by Moody second by Fryer the minutes of the meetings held. on December 3rd,1934, December l0th,19341 and December 17th919349 were each approved. Mr. J-"mes 1j. V",tbeson, Sr., and Mr. Ross •Cordy, made complaint that they could not arrange a meeting with the Rochester Band Committee for consideration;, of winter band concerts,and upon motion by Green second by Fryer their complaint was referred to the Land Committee with respectful re:..iuest that a meeting be arranged and that the Common Council be advised of the reeomitendations made by the Band Committee; the City Clerk addressing the Secretary of the Dand Committee as follows: " January 8, 1935. Matheson, Sr: , . and Mr Ross Cordy, were before the Common Council at 9. meeting held at 2:00 o'clock PM: , January 7th,19359 with complaint that they could not arrange a meeting with your Band Committee for consideration of winter band concerts. The action taken by the Common Council on this complaint was that the matter be referred to the Rochester Band Committee with respectful request that you arrange a meeting with them and that the Common Council be advised of your recommendations; your Committee being cautioned that there are no funds available for winter concerts except that you sell a bond that your Committee ovms or reduce the number o ., summer concerts to create money for the winter concerts. Jan: 10th,19359 except for foot traffic,and that they shall hold an enEine in readiness to open these crossings in case of fire. The reports of the Clerk of Municipal Court during the week ending December 24th,1934, showing criminal fines collected r112.03, civil fees received -15.35, conciliation court fees received '3.00, and court costs charged to Olmsted County T'i)11.10 , and for the week ending December 31st,19349 showing; criminal fines collected ,'s�89.40, civil fees received $10.70, conciliation' court fees 11.501, Iii�26.60 Olmsted County check received for November91934, MunicipiLl.Court fees, and court costs charged to Olmsted County !�19.55, were each re-d, and President Liddle r.e.ferred%the same to the City Attorney. I The .December 1934 report of the Bgilding,Electrical and Plumbin Inspector, showing 1$35.00. collected .for building inspection fees, -0,,35.75 electrical inspection, , 163.00'plumb 'ing inspection, was read and President Liddle referred the same to the Finance Committee. President Liddle referred the matter of a ,typewriter for the Building, Electrical and Plumbing Inspector to the Public Grounds Committee. The report of the City Treasurer for the month ending Decen!�er 31919349 showing the sum of $193,242.14 as being on hand, was read and President Liddle ordered that the same be placed on file. The report of the City Engineer for the month of December, 1934, showing expenditures from the General Fund for labor in. the amount of -$20065, from the Street and Alley Fund $5181.379 and from the Sewer Fund 1105.21, was read, and President Liddle ordered that the seine be placed on file. The City Engineer's trial balance for December919341 was laid before the Common Council and. President Liddle ordered that the same be placed on file. The report of the Milk Inspector for the month of December, 1934, was read and President Liddle ordered that the same be placed on file. The December,19349 report of the City Weighmaster showing December, 1934, receipts in the amount of $14470, and $.50 for November91934, was read, and President Liddle ordered that the same be placed on file. The application of Foster-Mrachek Electric :,,Company for an electrician's license was read and upon motion by Fryer second by Amundsen license was granted. The electrician's license bond of Foster-Mrachek Electric Company wiW.the Fidelity & Depo$it Company of Maryland, as surety thereon in the amount of $1,000000, was read, and upon motion by Lemmon second by Green the said surety .was accepted, the Said bond was approved and it was ordered that the same be placed on file. The application of T. V. Nagle for a public dance permit at the Woodman Hall January 5th, 12th, and 19th,19359 were each read. The following request for cancellation was read and upon motion by Amundsen second by Fryer it was granted and the licenses involved were cancelled: " Rochester, Minnesota, December 24,1934. Honorable Mayor and Common Council, City of Rochester, Minnesota, Gentlemen: I hereby request that On Sale License N0.93 and Off Sale License No.169, both authorizing the sale of non-eintoxicating malt liquors at *1o.39 Fourth Street Southeast, be cancelled and taken up. ' The official' bond'of Charles Shields, as Treasurer of the Rochester Fire Department Relief Association, in the amount of $3819.28, guaranteei; the, safe keeping and proper disbursement of Firemen's Relief funds about to be paid to him with the Aetna Casualty and Surety Company as surety thereon, was read, and upon motion by Green, second by Fryer, the said surety was accepted, the said bond was approved and it was ordered that the same be placed on file. Upon motion by Amundsen second bar Fryer the City Clerk was authorized and directed to issue cancellation and release in favor of the Aetna Casualty & Surety Company of their bond written December 4th,1933, covering Chas. Shields as Treasurer of the Rochester Fire Department Relief Association guaranteei the safe keeping and proper disbursement of Firemen's Relief funds appropriated to him at that time. A report on the present status of the ,Rochester sewage purification_-n, plant with recommendations for increasing the capacity to handle cannery wastes, prepared by Activated Sludge, Inc., was read and President Liddle ordered that the same be placed on file with the understanding that the Sewer Committee would arrange a meeting with the Concern interested for consideration of this report as it effects t+he City of Rochester and the Reid,Murloch Company. The following committee report was read and President Liddle ordered that the same be placed on file: " Rochester, Minnesota. January 7, 1935. Honorable Mayor and Common Council, City of Rochester, Minnesota. Gentlemen: We, the Finance Committee of the Common Council of said City, recommend that in the matter of the 0,,30-00.00 mortgage held by E.H.Vine against the Williams Estate property, that $1200.00 be paid on the mortgage and than a renewal be made for the $2000.00 balance due on or before 3 years from date, carrying 6% interest rate and with a provision that payments on the principal may be made on any interest payment date. Circular letter. No. 11 issued by the Minnesota Price Stabilization Committee to Distributors of.petroleum products in Minnesota; was read and President. Upon motion by Green second by Fryer the sum of $32.40 was appropriated from the Street and Alley Fund and it was ordered that the said sum be paid to Mrs. Linda Randall as compensation for the death of Chas. Randall during t}i a p-eriod December 13th,1934, to January 2nd,1935. An ordinance to amend an ordinance entitled, "An ordinance licensing and regulating; circuses, dog and pony shows, carnivals and tent shows, within the City of Rochester, Minnesota," the same being ordinance No.349 of the City of Rochester, Minnesota, was given its third and final reading. that Upon motion by Moody second by Fryer/the said ordinance be adopted as read, and all voting in favor thereof, President Liddle declared the said ordinance duly passed and adopted. Alderman Fryer introduced an ordinance providing for the licensing and regulating of the carrying' on primarily of the business of loaning money in small amounts to persons by individuals, corporations, co -partnerships, and associations in the City of Rochester, Minnesota, excepting state and national banks, trust companies, so-called credit unions and building and loan associations duly licensed by the State or Fied.er,al..;governments, which was given its first reading. Upon motion by'Lemmon second by Amundsen the rules were suspended and the said ordinance was given its second reading. Vpon motion by Moody second by Green the rules were sus. ---.,ended ankthe said ordinance was given its third and .final reading. Upon motion by Miller second by Fryer that the said ordinance be adopted as read and all voting in favor thereof, President Liddle declared the said ordinance duly passed and adopted. The follow.i.n.cr claims made by Saint, Mary' s T?ospital for isolation services were each read and upon motion by Lemmon second by Amundsen appropriations were made from the General^und: Charlotte Wright, poliomyelitis patient, .7.50; L'hilip Wright, poliomyelitis patient, $25.00; Mrs. Arthur Schultz, scarlet fever patient, $47.50. 617 Alderman Fryer introduced the following resolution, which was read: "WHERrAS, P.W.A. regulations as provided in paragraph two (I) of the P.W.A. construction regulations requires that engineers, arctects anal other professional and sub -professional employees engaged on the work shallreceive not less than ``36.00 per week and that where the working week is longer than forty hours the the weekly compensation shall be increased proportionately, and WHEiEAS, in the or_strruction of the Broadway trunk line sanitary I sewer one George Edward Stewart, white holding the office of .first assistant city en near of the City of Rochester, performed duties of rod man, chain man and pipe nsne for on said work for the Cat of Rochester, Minnesota and in so doing actually woN(Za ten hours per day for six %s per week and. at times in excess of this t whenever his services were required by an emergency, and WHEREAS, the P.VT.A.• auditors bave checked the payrolls on said work and have concluded as a result thereof that the said George Edwand Stewart was actually underpaid by the .City of Rochester the sum of ',102.03 under the aforesaid P.11.A. regulations, and Wh reas, aid ppa ent has not to date been made by the City of Rochester to the said George dwar3 5t ewart , and W[II. EAS, such payment has been ordered to be made by Wm. N'.Carey state engineer, P.W.A., prior to any Vrther payment from the Federal Govern ent tol the City of Rochester of the grant allowed said City on said P.W.11. Project #f1473, ail 11HERFAS,said services as performed by Mr.. Stevrart are not deemed' to come under the charter provisions of the City of Rochester. as to extraordinary services performed, which would entitle Mr. Stewart to file a verified, claim against the City for -the sum of $102.039 and yyT''REAS, the Bommon Council of the City of Rochester, Minnesota deem it expediennecessary and for the best interests of the City of Rochester that the sum of h02.03 be paid forthwith to George Edward Stewart in compliance wit] the order o the P.W.A. authorities and in order that any further delay of payment of the aforesaid grant may be avoided, THEREFORE, BE IT RESOLVED, by the Common Council -of the City of Rochester, Minnesota that the sum of $102.03 be and the said sum is hereby appro- Rd473 iated from the P.W.A. Docket #1473 Fund of said Cityand ordered paid to George ward Stewart as and for payment in full of all services rendered on P.W.A. Project in the City of Rochester, Minnesota. 4 The Mayor and City Clerk are hereby authorized and directed to draw a warrant for said sum upon the City Treasir er in accordance herewith$ and cause said payment to be made." Upon motion by Fryer second try Amundsen that the said resoluti be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Pryer -introduced a resolution authorizing the Putflic Utility Board to pay GL. Schwartz & Company $2959153 as extras on contract for Hydro - Electric power dam repairs, which was read.
