Minutes of an adjourned regular meeting of the Coiamon Council of the
City of Rochester, Minnesota.,. held in the Council Chambers, in the City Hall, in
said City, at 7: 30 o'clock P.14. , on Janrdary 14th,1935.
Meeting called to order by president Liddle.
Roll Call. Present: Liddle, Amundsen, Fryer, Green, Lennon, Miller,
Moody. Absent: None.
Upon motion by Moody second by Fryer the minutes of the meeting
'.elci on January 7th,19359• were approved.
President Liddle announced this as being the time and place fixed for
hearin;; on the report of the Commissioners appointed in the condemnation of lands fol
use in the completion of the Silver Lake Park Project, and asked if there was any
person present who wished to be heard .in any matter concerning the award of damages
in the taking of the lands concerned.
The report ,of John P. Hgyber, John 124- Norton, and Paul H. Priebe, Com-
missioners appointed in the matter. of condemning certain lands for use of the said Ci
of Rochester, Minnesota, in the completion of the Silver Lake Park Project, was read.
Written objection by Martha K. Schultz to the awards made in her favor,
made by Granger & Blethen, her attorneys, was read, and George W. . Granger, one of the
said firm orally enlarged upon these objections.
As to the award made to Lottie and Esther Walker. there was no written
objection to the award, nor was there . any person appeared relative to it.
Otto W. Riess made written and oral objections to the Commissioners
awards in his favor, which written objections were read.

Upon motion by Lemmon second by Moody.further action on the said
Commissioners' report and award of damages and on the said written objec-
tions was adjourned and continued ,to 2:00 •o' clolck P.M. , February 4th,1935.

Board with the Common Counell, Monday evening, January 14th. , at
7: 30 o'clock P.M.
Arrangements had been made by the board to attend this
meeting. Circumstances however, have arisen vhereby .a number of
the members of the board cannot be present. We are sorry to cause
i a delay, but if it could. be made agreeable to the Council, we would
ask that action upon.the.matter in question may be postponed until
some future datod

grant for this improvement and, therefore, have been unable to take any
action with reference to this proposed application.
Will you kindly advise us whether or notit is the intention to
submit the application for this project,, together with the data necessary
to make the application eomplete2
We received the application, drawings, and specifications for the
power plant addition from the Board of Public Utilities and are now preparing
a report on that application. We are today writing Mr: Lentfer requesting
some' information with reference to this power plant addition.
It now seems advisable to complete these applications and send
them on to Washington as soon as possible, but we are, of course, unable to
transmit the project for the sewer. improvement until the formal application
is received.

Dear Sir:
Answering your letter of January 9th,1935, I will say that it
is proposed to hold a joint meeting of the Library Board, the Public
Utility Board and the Common Council at 7: 30 0' clock P:td. , on January
14th, 1935, at which time the matters concerning, the P.W.A. applications
for trunk line sewer construction and Public Library construction will be
clarified in that funds for the trunk line sewer construction must come
from Public Utility Board turning over their 30% grant on light plant-
build-ing alterations and additions, or by direct appropriation from Public Utility
Funds, and that the Library Board is concerned to the effect that if they go
P.W..A. on Library building construction they have sufficient funds otherwise
if they should not go P.W.A. the Public Utility Fund will have to supply the
difference for construction costs and in each case the equipment of the
building will have to come from Public Utility Funds or by 1935 tax levy.
An attempt to coordinate the activities of these various local
subdivisions has not borne fruit up to this but from the. joint meeting
scheduled the 14th we expect to be able to give you something definite as
to 'local policies relative to P.W.A.

The Public Utility Board, in $esponse to the Common Council request
at there be a joint meeting of the Common Council, the Public Utility Board and the
ibrary Board, were represented by John A. Marsh *President. H. J. Postier, Member,
nd Fred W. Miller, Member sitting as a member of the Common Council, and in the
iscussion that followed nothing definite was arrived at relative to P.W.A. policies,
xcept that John A. Marsh, President stated that he would not sanction further appro-

priations for other than Public Utility needs, except for the agreed upon
ten percent income tax on gross light and water revenues:
-A report by Burlingame & Hitchcock, Consulting Engineers of
Minneapolis, Minnesota, on proposed steam and electric generating units for
the Rochester municipal plant, was read and President Liddl a ordered that
the same be placed on file.
Generkl balance sheet, trial balance, fund statement, statement
of unexpended budget appropriations, statement of Sinking Fund investments,
etc., prepared by the City Clerk as of December 31919349 were told before
the Common. Council and President Liddle ordered that the same be placed on
file.
The reports of the Clerk of the Municipal Court for. the week
j ending January 7th,1934, showing criminal fines collected $237040, civil
fees received $90059 conciliation court fees received $50-00 % and court
costs charged to Olmsted County � 37.65, and for the week ending January
14th,19359 showing criminal fines collected $64:30, civil fees received
$13435, conciliation court fees $3:75, and court costs charged to Olmsted
County $9.601, were each read ,and President Liddle referred the same to the
City Attorney.
The report of the Health Officer for the City ^arm for the month
of December,19349 showing receipts $1130 389 disbursements $539�86 and a
balance on hand $1880.24, was read, as was the statement of pigs on hand,
which statement showed 427 on hand December 1,19349 83 sold December 6th,
19349 9 died and 335 on hand January 191935, and President Liddle ordered
that the same be placed on file.
The balance sheet, income statements -,etc:, of the Public utility
11 Departments prepared by the Secretary of the Public Utility Board as of
December 31, 1934, were laid before the Common Council and President Liddle
ordered that the one be placed on file; the said income statements showing
a net profit in the Light Department - for the month of December .1934, of
$102210,59, net income $7655�39, net profit for the nine months of this
fiscal year of $63051.17'. net income $44,582:29, net profit in the Water
Department for December 1934, $7751i17, net income $6848.359 net profit
in the Water Department for the nine months of this fiscal year of $39143.39,
net income, a loss of $4260:02, the Steam Heating net income for December
1934 $1,891.57, for the nine months $2633:39.

will continue to be operated under its present name which is the Rochester
Liquor Supply.
The purpose of this letter is to request you to please transfer
to me license number thirteen of the "off sale" exclusive liquor store
licenses, which license now appears in the name of James R.Ryano
I attach herewith the verified applications for retailers off
sale license, surety bond, and the verifitd statement setting forth the
information desired by the liquor commissioner of this state.

The Off Sale liquor license bond of John T. McLaughlinwith the
Staboard Surety Company as surety thereon in the amount of $3,000.00 was read, and
upon motion by Moody second by Fryer the said surety was accepted, the said bond waf
approved and it was ordered that the same be placed on file.
The application of Neil D. Adams for a plumber's license was read and
upon motion by Amundsen second by Miller license was granted.
The plumber's license bond of Neil D. Adams with the Fidelity &
Casualty Company of New York as surety thereon in the amount of. 01,000.00�
was read, and upon motion by Green second by Amundsen,.the said surety was
accepted, the said bond was approved and it was ordered that the some be
placed on file:
The following applications for drivers licenses were each read
and upon motion by Moody second by Amundsen licenses were granted to the

I II Dear Sir:
We acknowledge receipt of your letter of Jan49th with
which you enclosed a certified copy of the resolution passed by
the City Council on Jan,; 7th,with reference to the payment of
additional wages to your First Assistant City Engineer, in order
to comply with P.W.A. regulations.
When our letter to you of November 21st was written we
were under the impression that the Assistant City Engineer was a
professional employe, Subsequent to this the Construction Regula-
tions quoted in that letter were clarified tto pebmit a distinction
between professional and sub -professional employes and that the
rates of pay could be modified accordingly. On December 5th you
wrote us explaining that the employe in question was engaged in
non-professional duties and that the matter would be referred to
the Council at its meeting on December loth. Under the circumstances,
it appears that it was not necessary to reimburse the employe for
additional wages, except for the additional amount made necessary
by excessive hours of employment over forty (40) hours per week.
This matter, however, has now been satisfactorily adjusted
by the action of the City Council in accordance with the resolution

of Jane 7th, and, therefore, this violstion is clear so far as this
office is concerned. ,

of the agitation in certain places to secure un added one cent per
g-;.11on to the present gasoline tax, and the added tax to be distri-

buted to townships and counties of which the City of Rochester will
receive no appreciable benefit, I am placing before you such fo.cts
as I have been able to gather:
The City of Rochester nays into, t be, County Read and Bridge
Fund at least 50% of the �-53,000.00 of the 1934 County .Levy for
County Road & Bridges, or V26,500.00'.
There was marketed in the County of Olmsted during the year
19349 6,312;606 „allons of gasoline, which collected 3 cents per gal.
tax, or �'192,410.64. .
Two cents of this tax or �"124,279.06 was paid to the Trunk
Iiighwa- Dept., and one cent of �62,139.53, r,-Tas apportioned to Counties.
Should. another one cent be added, the total amount collected in Olmsted
County would amount to $272,507.52.
From such information as we are able to obtain, at least
66't of the gasoline sold in the County is -used exclusively within the
limits of the City of Rochester, therefore, the clti zen' of t ochester
are paying at the present time, "''12'6,991.03 tax, for w;lich they
receive no return, except in the use of Trunk "ighwa.ys. "'his amounts
to a per capita tax of 1'6.15 per capita. Should the one cent more be
added, the per capita ta; would amount to -'1,6.20 per capita.
On 40,651.gallons, the City paid a state tax of q 1291.53
dur in Y the year 1934.
We. are riot offering recommendations at this time, the
fore- going is such information as is obtainable:

the said sum be paid to Holt & Perry as balance due for insurance premium

.due Simon Stensrud in that thus far he has not attended to the payment of
this his share of the premium on the said tornado policy.

The Mayor acid City Clerk are hereby authorized and directed to

Lion services rendered to Leon Koenig as a diphtheria patient from October 2nd,1934,

Alderman Fryer introduced the following resolution,which was reed:
"W IMEAS, The budget division in the Street and Alley Fund in the City
Treasury for snow removal was,' on December 31,1934, <^511.16 overdrawn, and
WiIE,-REQS, On this date $646.50 is being appropriated from the snow
removal 'Dudget for the use of equipment during December,1934, and .
WHEREAS, the above mentioned budget overdraft together with equipment
use wppropriation will make an overdraft total of '`"1457.68 with no consideration
taken of snow removal expenditures thus far in January,1935, and
WHERE�.S, It is deemed expedient and necessary that a transfer be made
from the Street and Alley Fund budget division for the geberal maintenance of stree-
and ;alleys, such as cleaning streets and alleys, grading streets and alleys, cuttin
weeds, sanding walks and crossings, cleaning water ways, dragging streets and alley
new equipment, not provided for in Code 3, equipment repairs and materials for same
etc., to the budget division for snow removal to take this overdraft and creete
estimated funds for snow removal during the balance of the 1933-1934 season;
SO THEREFORE, Be it, resolved by the Common Council of the City of
Rochester, Minnesota:
That the sum of 13457.68 is hereby appropriated from Code 11, Street
and Alley Fund, for general maintenance, etc. , and paid to Code 10 Street and
Alley Fund, for snow removal.
