Minutes of a regular meeting of the Common Council of the City
of Rochester, Minnesota, held in the Council Chambers, in t re City Hall, in
said City, at 2:00 o'clock P.M., on February 4th,19359
Meeting called to order by President Liddle.
Roll Call. Present: Liddle, Amundsen, Fryer, Green, Lemmon,
Miller, Moody. Absent: None.
Upon motion by Moody second by Amundsen the minutes of the
meeting held on January 21st919359were approved.
This being the time and place fixed for adjourned and continued
hearing and action on the confirmation, revision, or abandonment of the
Commissioners report of damages in the condemnation and taking of lands
fdr the completion of the Silver Lake Park Project, President Liddle asked
if there was any person present who wished to be heard.
There was no person present who wished to be heard, and the
following ruling by the City Attorney was read, after which it was decided
that these proceedings should be abandoned and a resolution of abandonment
was passed and adopted later in this meeting:

In the matter of the condemnation of the City of
Rochester of lands in northeast Rochester recently condemned
for park purposes, you are advised that in my opinion all pro-,
ceedings had and steps taken in said matter have been in
compliance .with the provisions of the charter of the City of
Rochester relative thereto*

The following report from the Rochester Band Committee was read
and upon motion by Green second by Fryer it was accepted, with the provi-
sion that there shall be no additional appropriation for so-called winter
band concerto:

Gentlemen -
"February 4th 1935
In 16nswer to your recent communication addressed to

the Band Committee we wish to say that we cannot finance from
available funds a winter band concert season. This is borne out
by the following;
1. At the time our budget was submitted to you it was our intention
not to carry out our proposed year-round band activity until
sufficient money to adequately compensate the musicians engaged
was available. We felt that any small increase in the budget
should be used to increase salaries of band members.
2. By following the above statement it can be seen that that our
entire budget will be used for the summer park band season.
3. We feel that if it is the desire of your Honorable body to give
winter indoor concerts that you appropriate funds from sources other
than the band fund. The fund necessary to finance two winter
-concrerts would be $440.00. -

showing $1519666.10 as being on hand was read, and President Liddle ordered that

The report of the Building Electrical and Plumbing Inspector for the
month of January,-1935, showing building inspection fees $4.00 ,
electrical inspection11.50, and plumbing inspection %"13.00, was read,
to
and President Liddle referred- the same/the Finance Committee.
The reports of the Clerk- of the Municipal Court,• for the week ending
January 26t}1919359 -showing criminal fines collected $27.90, civil fees received
13.60, conciliation court fees received 11.509 acid U2.50 paid by Olmsted County
for December-91934 Municipal Court fees, and for the week ending February 4th,1935,
showing criminal fines collected 1126.52, civil fees received $6.35, conciliation
court fees 11.%59 court costs charged to Olmsted County $8.40, and fines collected
due to Olmsted County $26.129 were each read and President Liddle referred the same
to the City Attorney.
Upon motion by- Green second by Hoody -526.12 was appropriated from the
General Fund and it was ordered* that the said sum be paid to Olmsted County,
Minnesota, for local municipal court fines collected due to Olmsted Country.

license was read and upon motion by Moody second by Amundsen license was granted.

The petition of E. W. Haley, 948 Eleventh Avenue Northeast, for
sprinkling service during the season of 1935, +ras read and President Liddle referred
the same to the Sprinkling Committee.
The following communication was read and President Liddle ordered that

Upon motion by Moody second by Amundsen, that the said resolution be

adopted as read, and all voting in favor thereof, President Liddle declared the said
resolution duly passed and adopted.
Copies of. applications of George Busher, George Washington, and
4erenta E. Hagen, for'old age'pensions, were each read and President Liddle ordered
that the same be placed on file.
The following assignment' was read and upon motion by Amundsen second
by Moody it was accepted, and the $12.00 mentioned therein was appropriated from the
Street and Alley Fund for payment to the City of Rochester, Light and Water Depart-
ments ,in accordance with the said assignment, all of which transpired after the City
Attorney made oral report on this claim to the effect that lt,t shomld be paid:

that the Administration has ruled that the only projects which are
eligible for additional grants are those in .vti�ich the actual construction

reduced to 892,333.00 after the elimination of the paving which
the City decided to construct by its own forces. Your final
construction costs, including extras and inspection, amount to
approximately90,000.00. Therefore, it appears that you ,are
not eligible for an additional grant:
At the time your application was examined in Washington,
it was the policy to make grant allotments .for 30% of the estimated
net cost of labor and materials only and it is probable that your
allotment was made on that basis* The Administrator letter ruled
that the 30% grants co;zl.d be made to include total contract costs
plus the cost of inspection and supervision but this order of the
Administrator was not made retroactive. Under these ;ircumstances
we a:rn of the opinion that it would be useless for you to make
application for an additional grant:

Lighting Fund and ordering payment made to the City of Rochester$ .Light Depart-
went, -for electricity furnished for lighting.of public buildings, which was read.

Alderman Miller introduced a resolution appropriating,321.43 from the
General Fund and ordering payment made to the City of Rochester, VIJ onesota, Steam
Heating Department for steam heat furnished at the City Hall, which was read.

S, There is on hand in the Sinikin Fund of the City of Rochester
Minnesota, the sum of $9,000.00 for the December st,. 935, maturity of City of
Rochester, Minnesota, 4 % Improvement Bonds (New City Nall) , and
WHEREAS, It is deemed expedient and necessary that the Sinking Fund
Commission of said City be authorized and directed to appropriate this sum for
interest bearing securities and create Sinking Fund Investments for City Mall Bonds,
SO THEREFORE, Be it resolved by the Common Council of the City of
Rochester , Minnesota:
That the Sinking Fund Commission of said City be and the said
Commission is hereby authorized and directed to appropriate $9,0 `0.00 from the
Sinking Fund of said City and invest the sa&e in interest bearing securities and
thereby create a Sinking Fund Investments for City Hall Bonds, and
Be it further resolved by the said Common Council: That the said
Sinking Fund Commission is hereby authorized to invest and re -invest the proceeds
from interest collections and principal maturities on the said Sinking Fund
investments and to sell such of the said Sinking Fund Investments as may be
necessary to meet the December lst,19359 maturity of the said City Hall bonds. "

Alderman Lemmon introduced a resolution granting public dance

Alderman Moody introduced a resolution granting public dance permit
to Thomas V. Nar-le for the Woodman Mall, February 9th and 16th,19359 and fixing
the fee at 4',6.00, which was read.
Upon motion by Moody second by Amundsen, that the said resolution be
adopted as read, and all voting in favor thereof, Presi dent Liddl a declared the

President Liddle transmitted the invitation of F.L.Van Atta, Exalted,
Ruler of B. P. O.E. No. 1091, that all elective and appointive officials of the
City of Rochester, Minnesota, be their guests at a banquet at 6:30 o'clock
