Minutes of an adjourned regular meeting of the Common Council
of the City of Rochester, Minnesota, held in the Council Chambers, in the
Citf Hall, in said City, at 7:30 o'clock p.M., on February 27th91935.
Meeting called to order by President Liddle:

Upon motion by Amundsen second by Miller the minutes of the
meeting held' on February 18th,19359 were approved:
The report of the Clerk of the Municipal Court, for the week
ending February 25th,1935, showing criminal.fines collected `11M40,
civil fees received $2059 conciliation court fees received $1.509'and
court costs charged to Olmsted County $59tNg was read, and President Liddle

The annual report of the City Engineer, for the period beginning
January 27th,1934, and ending January 25th,1935, was laid before the Common
Council, and President Liddle ordered that the same be placed on file:

read, and upon motion by Lemmon. second by Moody, license was granted
The application of the United Workers Association for a public
dance permit at the Woodman Hall February 27th,1935, was read:

you say in regard to meeting with you when I am in Rochester. I -a
intend to be in Rochester next Saturday night, March 2, but it will r
probably be 9 o'clock at night before I get there. I will stay over
Sunday in Rochester, and if it would be convenient for any of the
Council to meet with me Sunday morning, I would be very glad to do so,
or if they would prefer to, I can meet with them Saturday evening, but
I know it would be about 10 o'clock before I could get there.

Upon motion by Green second by Lemmon the City Clerk was
authorized and directed to place an advertisement in the official paper to
the effect that March 13th91935, is the dead line for the consideration

City Attorney was read and upon motion by Miller second by Fryer it was

as outlined in the request of the Board of Park Commissioners under
date of February 4, 1935 to your Honorable Body having been referred
to the Board of Park Commissioners and the City Attorney for investi-
gation and report, the following is submitted for your consideration.
We have arranged with the following owners to acquire the
desired property from them at the price set opposite the owners' names,

Warranty deeds have been signed by all of the owners, some being in the

named therein. It being understood of course between your committee and

Common Council and that the City in no way has bound itself unless the
Council approves the above prices, in which event payment is to be made

After negotiating with Mr:•Moe Goldberg for the purchase of ,his
property we have received from him a final offer of $240000 to be paid in
cash by the City of Rochester at the time deeds are delivered from Mr.
Goldberg and Otto W. Rlesp: After considerable negotiating with Mrs.
Karau and MSC. Schatz we have obtained from them a final total purchase
price of all of their interest of $2182,i80.
These purchase prices are submitted to the Common Council for its
consideration.

Alderman Moody introduced a resolution appropriating $2370'25 from the
Lighting Fund and ordering Payment made to the Rity of Rochester,Light Department,
for electricity furnished for lighting of public buildings, which was read:
Upon motion by Lemon second by Green that the said resolution be adept
as read, and all voting in favor thereof, President Liddle declared the said resolu-
tion duly passed and adopted:►
Alderman Green introduced a resolution appropriating $245:25 from the
General Fund and ordering payment made to City of Rochester, Steam Heating Depart -
meat, for steam heat furnished at the City Hall, which was read.
Upon motion by Fryer second by Moody that the said resolution be
adopted as read, and all voting in favor thereof, President Liddle declared the said
resolution duly passed and adopted.
Alderman Lemmon introduced the following resolution which was read:

Upon motion by Green second by Amundsen that the said resolution be
adopted as read, and all voting in favor thereof, President Liddle declared the said
resolution duly passed and adopted:
Alderman Lemmon introduced a resolution appropriating $539:85 from
the Park Improvement Fund and ordering payment made to the Mayo Trust Fund for
payrolls for labor during the week ending February 22nd,19359 which was read.
Upon motion by Moody second by Fryer that the said resolution be
adopted as read, sAd all voting in favor thereof, President Liddle declared the said
resolution duly passed and adopted.
Alderman Fryer introduced a resolution appropriating $19000.00 from
the Sewer Fund Sor use of the Street and Alley Committees which was read:
Upon motion by Green second by Lemmon that the said resolution be
adopted as read, and all voting in favor thereof, Presidenjg Liddle declared the said
resolution duly passed and adopted:
Alderman Green introduced a resolution authorizing the Public Utility
Board to enter into contract with the American Cast Iron Pipe Company in accordance
with their above quoted resolution request, and fixing the amount of the surety bond
to be given by the said Contractor at the sum of $4650.009 which was reed.
Upon motion by Amundsen second by Moody that the said .resolution be
adopted as read, and all voting in favor thereof, President Liddle declared the saic
resolution duly passed and adopted:
! Alderman Amundsen introduced a resolution providing for the
issuance and sale of 365001600 4% Certificates of indebtedness dated March 1,

Upon motion by Fryer second by Lennon that the said resolution

` be adopted as read, and all voting in favor thereof, President Liddle
declared the said resolution duly passed and adopted.
II Alderman Amundsen introduced the following resolution, which
was read:
"WHEREAS, there has been introduced in the Minnesota Legislature
a Bill for an Act to impose a tax of 5/ per 1000 cubic feet upon all natural
gas entering the State of Minnesota, and
WHEREAS, such a tax would have to be paid only by the users of
natural gas in this state, and
WHEREAS, the tax, if' leviedg would increase not only the cost of
gas for ordinary domestic cooking use but would also increase it for house
heating, commercial use and industrial uses, and
WHEREAS, the City of Rochester in the operation of its municipally
owned electric light plant uses natural gas under the, boilers and a tax as
proposed would mean an increased cost for fuel necessary for generating
electricity, which in turn would have the effect of increasing rates to be
charged to the users of electricity in the City of Rochester, and

WHEREAS, natural gas has always been sold on competitive' basis in
regards to other fuels and the tax as proposed would be followed in all
probability by an increase in the cost to the consumer of other fuels in
addition to natural gas, and
WHEREAS, the tax, if levied, would be added to the cost of the
gas at the city gate in the event the City of Rochester should desire to take
over the distribution system for gas in this city, and
WHEREAS, other residents of the State of Minnesdta living outside
of the area served by natural gas do not pay at present and would not in the
future be required to pay such a tax as proposed, resulting in an unfair tax
upon a very small percentage of the residents of the Stateof Minnesota and
would in the opinion of -,the Common Council of the City of Rochester be
discriminatory in its operation;
THEREFORE, BE IT. RESOLVED by the Common Council of the City of
Rochester, Minnesota:
That such proposed legislation is hereby condemned as unjust,
unfair, unnecessary and highly discriminatory and out of harmony with present
economic conditions and that such proposed measure in the interests of
economy and fairness should be deleateda
BE IT FURTHER RESOLVED by said Common Council:
That said Common Council does hereby protest the enactment of
such a law and does urge its Senator and Representative in the Minnesota
State Legislature to use their power and influence to defeat the Bill:

The claim of. T. F. Kennedy, ..15450 .for insurance premium on
Fire Department equipment, was read, and upon motion by Green second
by Lemmon, appropriation was made from the Fire Protection Fund and it was
ordered that the said sum be paid to T.F.Kennedy for the purpose mentioned.
The Common Council canvassed the returns from the Primary Elec-
tion held February 26th,1935,
Alderman Amundsen introduced the following resolution,which was
