Council Chambers, in the City Hi11, .in said City., at 2:00 o' clo do P.M. , on April lst91935. Meeting called to order by President Liddle. Roll Call. Present: Huddle, Amundsen,; Fryer,; Green, Lemmon, Moody, Richman. Absent: None. + W.. A. Moore, Mayor, read his message to the Common Council, and a copy of this message was placed,on file. Mrs. A. +H. Minkle, Patriotic Leader of the Custer Post Women's Relief Corps No.28, Auxiliary to the Custer Post No.44 of the Grand Army of f the Republic, presented an American Flag to the City of Rochester, Minnesota, which Flag was presented .to the City of Rochester in memory of the members of the Grand Army of the Republic and for use in the Council Chambers of the City Hall. W. A. Moore, Mayor, accepted for the citizens of Rochester, the Flag so presented and it was, placed on the platform in the Council Chambers, after which "To- The Colors" was played by Percy Smith, American Legion bugler.. Upon motion by Lemmon second by Fryer,and all voting in favor thereof, except Alderman Amundsen who voted "Nay", Irving L. Eckholdt' was duly appointed City Attorney for the ensuing official year. The applications of C. H. Armstrong, Walter C. Hogenson, E. R. Boyce, and John J. Kerr, for appointment as City Engineer, were each read. A motion by Amundsen second by Moody that C. H. Armstrong be appointed City Engineer for the ensuing official year„ lost by the following vote: Ayes: Amundsen, Moody. Nays: Fryer, Green, Lemmon, Richman. Upon motion by Lemmon second by Fryer E. R. Boyce was duly appointed City Engineer for the ensuing official year, all voting in favor thereof except Aldermen Amundsen and Moody, who voted "Nay". was read. The application of Dr. Chas. H. Mayo -for reappointment as Health Officer Upon motion by Amundsen second by Moody, and all voting in favor thereof, Dr. Chas. H. Mayo was duly -appointed Health Officer for the ensuing official year. The applications of Manfred H. Waldron, William A. Wobbro dc, and George McIntosh for appointment as Milk Inspector for the ensuing year, were each read. Upon motion by Green second by Richman Manfred H. Waldron was duly appoint d Milk Inspector for the ensuing official year; all voting in favor thereof. The applications of Geo. F. Strifert, Glenn W. Trusty, and James McNally, for appointment as Sanitary Inspector, were each read. Upon motion by Amundsen second by Fryer, and all voting in favor thereof, George F. Strifert was duly appointed Sanitary Inspector for the ensuing official year. The following recommendation was read and President Liddle ordered that the same be placed on file: " March 25th, 1935 1 , To the Mayor, the President and Members of the City Council City of Rochester, Minnesota 740 Gentlemen: I would respectfully recommend that Mrs. Edna Oesterrich be appointed Health Office Stenographer for the ensuing year. HiMayo, M.D. " Upon motion by Amundsen second by Fryer, and all voting in favor thereof, Mrs. Edna Oesterreich was duly appointed Health Office Stenographer during the ensuing official year. ' The application of Jose Bosley for repppnintment as Visiting Nurse was read. I I Upon motion by Green second by Fryer Jose Bosley was appointed Visiting Nurse during the ensuing official year, all voting in favor thereof. The following appointment was read and President 'Liddle ordered that the same be plowed on file: " March 29th, 1935. Honorable Common Council ' City of Rochester, Minnesota. Gentlemen: Pursuant to Ordinance No. 311 I hereby appoint Mrs. Mabel Fountain as Public Health Nurse of said City for the term ending on the second Monday in April, 1936. Respectfully submitted, Julius J. Reiter Mayor of said City. " The applications of Alvin E. Benike, Vein Buss, i and E. R. Emerson, for appointmrim as Building, Electrical and Plumbing Inspector, were each read. Upon motion by Green second by Richman,gnd all voting in favor thereof, Alvin E. Benike,was duly appointed Building, Electrical and Plumbing Inspector during the ensuing official year. The application of J. E. Dresbach for appointment as Weighmaster, Custodian of the City Hall, OrAAssistent Superintendent of the Dumping' Grounds was read, and this application was given consideration along with other applications for the respective offices as each office -came -up for appointment in this meeting. 7410 The applications of 0. E. McCoy, Claire Rooney, Fred W. Yochem, Lorenzo Campbell, Arthur G. Leisek, and J.E.Dresback, for appointment as T City Weighmaster were each read. Upon motion by Lemon second by Moody, and all voting in favor thereof, 0. E. McCoy was duly appointed City Weighmaster for the ensuing bfficial year. Michael Powers, The applications of Henry C. Lindberg,/and J. E. Dresbach for appointment as Custodian of the City Hall were each' read. upon motion by Moody second by Green,:and all voting in favor thereof, Henry C. Lindberg was duly appointed Custodian of the City Hall during the ensuing official year` . The application of Joseph J4 Schuster for appointment as Assistant Custodian of the City Hall during the - ensuing year was read. upon motion by Green second by Amundsen, and all voting in favor thereof, Joseph J. Schuster was duly appointed Assistant Custodian of the City Hell during the ensuing official year. • and all voting in favor thereof, Upon• motion by Lemmon second by Fryer,. E. Ginther was duly appointed Fire Warden during the ensuing official year, he to serve without pay. The applications of Wm. R. Jones, and Archie Watson for appointment as City Scavenger and City Dog Catcher, were each read. Upon motion by Fryer second by Moody, and all voting in favor thereof, Archie Watson was duly appointed City Scavenger during the ensuing official year. Upon motion by Fryer second by Moody, and all voting in favor thereof, Archie Watson was duly appointed City Dogvoatcher during the ensuing official year. The application of Thomas Carroll for appointment as Superintendent of the Dumping Grounds was read,but no action was token thereon as the City Charter states that the City Engineer shall be the Superintendent. The following applications for appointment to positions on the City Dumping Grounds were each read: Rude Kruger, Edwin A. Senst, Adolph W. Berndt, Chas. L. Wells, George Kelly,Hr. The applications of W. E. Mitchell, and Alfred Mackey for appointment as Assistant Superintendent of the Dumping Grounds were each read: Upon motion by Green second by Lemon W. E. Mitchell was appointed Assistant Superintendent of the City Dumping Grounds during the ensuing official year;'all voting in favor thereof. I 742 The applications of P. D. Claude, Erwin Standke, and Hiko Snith, for appointment as second Assistant Superintendent of the City Dumping Grounds were each read. Upon motion by Fr7:exi second by Amundsen, and all voting in favor II thereof, P.D. Claude was duly appointed Second Assistant Superintendent of the Dumping Grounds during the ensuing official year. The application of Dr. F. H. Powers for reappointment as a member of the Rochester Board of Health was read. Upon motion by Lemmon second by Moody, and all voting in favor thereof, F. H. Powers was appointed a member of the Board of Health for the term ending the second Monday in April, 1938. The application of Henry 0. Christensen for appointment as Supervisor of the Williams Estate Properties• was read: Upon motion by Fryer second by Amundsen,and all voting in favor thereof, Henry 0. Christensen was appointed Supervisor of the Frank E. Williams Estate properties, during the ensuing official year. The application of Jacob Olsen asCustodian and janitor for the Williams Apartment building was read. Upon motion by Moody second by Richman Jacob Olsen was duly appointed Custodian and janitor for the Williams Apartment building during the ensuing official year# all voting in favor thereof. The application of Harry T. Earle for appointment as Assistant City Engineer was read, and President Liddle ordered that the same be placed on file . r The following appointments by the MayorW*,*rs read and President Liddle ordered that the same be placed on file: "To the Common Council of the City of Rochester Gent amen: Subject to confirmation of your body I hereby make the following appointments: Board of Park Commissioners: One commissioner at large, for two years, Harold Thompson One commissioner from the second ward, two years, Reuben Shearer 4 743 15 Police Civil Service Commission, Arthur J. Moore " Upon motion by Green second by Richman the Mayor's appointment of Harold Thompson as Park Commissioner at Large, and Reuben Scheargr as Park Commissioner of the Seconds Ward, were approved. Upon motion by Lemmon second by Green the Mayor's appointment of Arthur J. Osman as Police Civil Service Commissioner, was approved, all voting in favor thereof. A motion by Green second by that the Mayor's appointment of F. W. Oesterreich as Police Civil Service Commissioner, be approved, carried by all voting in favor thereof except Alderman Fryer, who voted "Nay". Upon motion by Lemmon second by Green the Mayor's appointment of Alderman Moody as a member of the Public Utility Board was approved by all voting in favor thereof. A. R. Zick was before the Common Council with a plea that this Council be as economical as possible in all of their business, and mentioned the trips that members of the Council have taken in the past to League of Minnesota Municipalities conventions and conferences as having been unprofitable to the City of Rochester. J. C. Thompson stated that he felt the City was benefited by the Aldermen going to such meetings and learning what other cities and towns are doing tate and keeping Wormed or�legislation whick would affect Rochester. Benj. F. Dunn suggested that the Council make improvements in the Community Room in -the City Hall to facilitate the holding of meetings i-n this room. His suggestions were that the Council provide,a piano for this room and a screen oA which could be shown slides or moving pictures. President Liddle referred these suggestions .to the Public Grounds Committee. The following appointment was read and President Liddle ordered that the same be placed on file: "Rochester, Minn., April 191935. To the Honorable Mayor and Common Council of the City of x0chester. I have reappointed J. W. Anderson, Clerk of Municipal Court for the fiscal year 1935. gespectfully submitted, Burt Elliott Eat n, Municipal Judge, City of Rochester. " 74�- An Ordinance providing for the licensing, conducting and regulating of acution sales within the City of Rochester, was given its third and final reading. A motion by Lemmon second by Green that the said ordinance be not gt pted, carried by all voting in favor thereof. Upon motion by Moody second by Fryer the matter of a new Auction Sale ordinance was referred to the City Attorney and the License Committee. i The report of the City Treasurer for the month ending March 30th, 1935, showing the sum of $197,941.00 as being, on hand, was read and President Liddle ordered that the said report be placed on file. Upon motion by Moody second by Fryer the matter of anew carnival ordinance , .or an amendment to the present ordinance, was referred to thq City Attorney and the License Committee for consideration. Upon motion by Green second by Lemmon the dispute between Mr. Volz, and the City Farm Department in regard to a.fence and property purchased 17�'* the City of Rochester, was referred to the City Attorney and the Public Grounds Committee. The report of the City Engineer for the month of March,1935, showing expenditures for labor from the General Fund $347.559 Street and Alley Fund $15140819 Sewer Fund $613.50, and from the Bridge Fund $5:40, was read and President Liddle ordered that the same be placed ,on file. The report of the Building, Electrical and Plumbing Inspector, received for the month of March,1935, showing building inspection fees/$18.00, Electrical inspection fees $8.75, and plumbing inspection fees received $11.75, was read and President Liddle referred the same to the Finance Committee. Gentlemen: We, the Finance Committee of the Common Council of "said City, do hereby report that we have. checked the reports of the Building, Electrical and Plumbing Inspector for the months of January, February and March,19359 and have found the same to be correct, and recommend that the said reports be accepted and placed on file. " The application of Bemel Bros. for a junk buyer and collectorls license was reads and upon motion by Green second by Amundsen, license was granted: The junk buyer and collector's license bond of Bemel Bros., with the Maryland Casualty Company of Maltimore; Maryland, as surety thereon in the amount of $19000.00 was read, and upon motion by Moody second by Amundsen, the surety thereon was accepted, the said bond was approved and it was ordered that the same be placed on file. The application of Leonard V. Gilday for a license to pperate a popcorn vending maching at the Southeast., corner of the intersection of Broadway Street South and Third Street Southeast, was read, and upon motion by Amundsen second by Fryer the license was granted sulject to his compliance with the request of the Chief of Police that the wagon be set back at least fifteen feet. The annual report of the Secretary of the Board of Park 19ommissioners for the year ending March 30th919359. /showing receipt$ and disbursements in the amount of $14,166.64 each, Mayo Trust Fund receipts $32,273.089 disbursements for labor to parks, Maintenance $239146.859 746 . Improvements $79931.33, and showing a balance on hand in the Mayo Trust. Fund of $19194.409 was read and President Liddle ordered that the same be placed on file. The hydrometer tests as well as chemical, analyses are self-explanatory and we feel that justice would be better served if the l�censI C . R. Schultz, would be revoked for selling misrepredented liquor as reported herewith, as it is harmful to the liquor business as well as to the public.
