M4, April 22nd, 19354- Meeting called to order by President Liddle: Roll Call: Present: Liddle, Amundsen, Greens Lemmon; Moody and Richman; Absent: Fryer; Alderman Fryer being absent on account of illnes:i of himself Upon motion by Moody, second by Amundsen,the minutes of the meeting held March 299 1935 were approved. The following ruling by the City Attorney was read and President Liddy+ ordered that the same be placed on file: .. a April 129 1935; To the Mayor of the City of Rochester and to the Chief of Police of said City, Honorable Sirs: I have been directed b the proper authority to give you a legal opinion as to whether or no the so-called pin and ball -machines -are gambling devices within the meaning of the ctiminal law4 I have made a personal investigation of the so-called pin and ball machines and find that it consists of a board or table with a slot for the i deposit of coin, a plunger and upon the board itself pint or obstruetionso In the operation of the machine a coin is deposited in the slot and pushed into the machine after which a ball is placed ahead of the plungeri The plunger being pulled back and released starts the ball in a forward motion after which the ball travels forward and then comes back and is obstructed and diverted from a straight line by .reason of the pins and* obstructions upon the board and finally the ball after being so diverted from a straight line falls into a receptacle which receptacle is numberqor named. The ides of the enterprise is to obtain e, scare and the score is smhller or larger according to the receptacle which finally receives the balle Under the Criminal Laws of the State of Minnesota as shown in Mason's Minnesota Statutes 19279 is4ollewing: "Gambling with cards, dice, gaming tables, or any other gambling device whatever is hereby prohibited: Every person who deals Oards at the game called "faro", "pharo", or "forty-eight", whether the same is dealth with fifty-two or any other number of cards, and every pwrson who shall keep any gambling device whatsover designed to be used in gambling, shall be punished by imprisonment in, the county jail for not more than six months, or by a fine of net more than two hundred dollars; or by both; and every personwho shall bet any money or other property at or upon a gaming table, game, or device shall �e punished by a fine of not less than five dole's nor more than twenty dellarsi Every person who shall suffer any gaming table, fare bank, or gambling device to be set up or used for the purpose of gambling in any house, building, steamboat, raft, keelboat, or boom, lot, yard, or garden, ownedt occupied, or controled by him, shall be punished by imprisonment in the c 788 f Jail for not more than six months, or by a fine of not more thax ; two hundred dollar&$ or' by bothi t No person shall be excused from testifying touching an offense committed by another against any provision of this subdivision re- lating to gambling,, by reason of his .having bet 'or played at the prohibited games or gambling devices:" What are 'and what are not gambling devices within the meaning of the above law depends upon legal definition of the word "gambling" and the word "device" The Supreme Court of the State of Minnesota has given us s definition of the word "gambling"" which is as follows: 1 "Gambling is the risking of money or anything of value between two or more persons on a eontest of chance of any kind where one must be I� the loser and the ether the gainer"i The same court has defined a gambling device as follows: "A gambling device may be defined as an invention or contrivance to deterAtne the question of who wins or loses his money on a contest 4 ' of chances" RRRRRRRRRR GAMES OF CHANCE ! The phrase "Game, of Chance" is not one long known in the law i� having therein a; settled signification. I find nothing in -the law -inconsistent with his opinioni� ' _ t r r After a moat careful examination of the law: it is my opinion: ,That the pin and -ball maehines above described, when the use thereof iS free from any and all gambling they are not a gambling devi cd within the terms of the statutes; however, when the proprietor or those in control of the, machine. offers prizes in the form of Bash or merchandise for certain scores obtained by playing the machine then and.in that event these pin and ball machines become gambling devices and are unlawful; Very respectfully yours, fRVING L.
