To the Common Council of the City of Rochester Rochester, Minn. Gentlemen: As I am doing some building on the property west of the city limits which I lease from Mr. Har±.ley Mnor. e.l wish to be advised rega:r?fgr, tie jurisdiction which th.P city might have on any or a part of this pro- perty. My lease is for a certain'tract of land extending eastward to the city limits which would be the center of 16th Avea S. W. providing this avenue was full width. As a matter of fact several feet of the land a,lcr;7 13tb .Avenue S. Wjj for. which. I pay rent, is now being used by the City in sprinkling and grafting, r I am desirous of this information as a result of ?past experience. You will, no doubt, recall that about on% year ago the nidernon saw fit to order the water service cut off from this property. After this ser- vice had been voted on favorably by the Utility Board, the usual permits were issued by both. t.'he City Engineer and the Superintendent of the Water Department and I had paid all the cost of the connection including the material purchased from the City and for the service to the water depart- ment for joining my pipe to the City Main. -Due to the action on the part of the City Council I was forced to drill a well and purchase egaipment ' for sanitary purpose regardless of the fact that water service has been extended and is now being used by others outside ofthe City limits; Therefore I would appreciate youF advice as to the rights, if any, of the city over this property beyond and outside of the city limits as it will aid me in future planing. Yours truly, L. E. Kennedy" The following ruling by the City Attorney was read, and President Liddle ordered that the same be placed on file: "June ll,. 1935. To the Honorable Mayor and Common Council of the City of Rochester: Gent 1 em en: I have been requested by your honorable body for an opinion relative to the fees collected by the local. registrar, as to whether or not the amount paid by the County of Olmsted is required to be ,rurned over to the City of Rochester. Tke Board of Health of the City of Rochester was established by Ordinance No. 18ti on March 29, 1906, and Section 3 thereof states, "Such Board of Health shall make such investigations and reports and obey such directions concerning diseases as the State Board of Health may require or give, and shall have all the rights and powers and perform all the dtities given and required by the Laws of the State of Minnesota,and by the Charter and ardinances of the City of Rochester relative to local boards of health." Section 2 provides, "each member of .said Board. of Health shall qualify in the manner by law and the charter of said city and shall receive such compensation as shall be, pre-6cribed by the Common Council of I said City." i It is to be noted from the above that the compensation of said official shall be as prescribed by the Uommon Council. In this connection it is a ma+ter I of reasoning that this is limited to the cowensation paid by the City of Rocheste� froin the public funds of said c1ty over which the Common Council has authority, and the Common Council would have no authority over state funds or county funds, and would only have control of city funds. Under the state law, in cities the health officer shall be the local j registrar for the city,, and shall y, perform such duties as required of him by � the provisions of the state law, and as such it is his duty to .furnish certi.ficate� of birth and death for his district to the proper state officials. Pot this service Section 5365 of Mason's Minnesota Statutes for 1927 provides, "Each local registrar except those in cities which have a population of more than 100,000 shall receive, from the county in which his district is located, a sum of twenty- five cents for each birth and each monthly report and for each death certificate." It is to be noticed that this is payable to the local registrar, and there is no provision in the law whereby the City of Rochester can collect this amount for the services of.the registrat: It is also to be noted that the City Council only have control of city funds, have no control over this fuhd, the same being payable from a county fund, and that the state law particularly directs this payment to be made to the local registrar. After a careful analysis of the law in reference to this subject matter, it is my opinion: That the local registrar is under ne obligation to pay to the City of Rochester the amount allowed such local registrar by the County of Olmsted, the same being county funds and not city funds, and having been directed by the state law to be paid to the local registrar and not to the City of Rochester. 78 JON 17 1935 - -- Very respectfullyv Irving L. Dear Sir: Your communication of May 16 regarding the repair and maintenance of the pavement of Fourth Street S. W. between Broadway St. South and 2nd St. S."l in front of Cities Services Oil Co.. station has bden referred to me. I have advised the company that it has no authority to make ji any repairs on the street, that it is purely a municipal function. I believe that it is proper. also to call your attention to the fact that if any damage results to anyone from the dangdrous and unsafe condition of the pavement that it is the municipality' s obliga- tion to take care of any loss resulting therefrom. We note your argument in your letter that the city is not under obligation to make repairs because of the exemption of Winona Oil Co. I i from 32:4 feet in the assessment. The answer to that is that the pavement already installed by the Winona Oil Co was retained by, you and the city undoubt!- edly benefited more thah the $�56-30 which Winona Oil Co, might have had to pay if the paving, had been torn hp and relaid At the time- Tae acceptance and use of Winona Oil Companyt s original pavings would in our opinion not relieve you from responsibility of maintaining that pavement in the future. In view of these facts, we feel very strongly that the request of Cities Service 011 Co, made on April 24th that the street be repaired should be com- plied with. I Alderman Lemmon introduced a resolution adopting the plans, profiles$ specifications and estimate of cost, for Bituminous treatment of the above described parts of streets and avenues, ordering that the some be placed on file, ordering that the cost and expense thereof be paid by special assessments against the property benefited, ordering public hearing at 2;00 o'clock P. M. July 11 1935, on the said improvements, and ordering the City Clerk to advertise for sealed bids for the furnishing of all labor and materials, for doing the said improvements, which sealed bids were to be opened at 2:00,olclock P. M. July 19 1935, which was read, Upon motion by Amundsen second by, Fryer, that the said resolution be ado as read, and all voting in favor thereof, President Liddle declared the said resolutil duly passed and adopted. Alderman Richman introduced a resolution granting !'ublic Dance Permit to Henry Foley for the A. 00 U. W. Hall for June 15, 1935, and fixing the fee at P340 which was read: Upon motion`by Green second by Fryer, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resoluti duly passed and adopted.
