"July 3, 1935:
Mr. Irving L: Eckholdt; City Attorney,
Rochester, Minnesota:
Dear Mr. Eckholdt:
Thank you very much for your 1 ett er of June 29th in regard to drainage
of surface water from my place: With the legal opinions which you have quoted,
it
seems useless for
me to count on the
city
doing
anything in regard to
it
but
I have a feeling
that while this is
laws
it is
certainly not justice
as
the putting through of Fifth Street has been a bit expense to me aside from
the damage which I have to anticipate from the watere j
- I
The whole matter, as far as I am concerned, is that at the time the
street- was put through, I understood that the drainage from my place was taken
care of4 I distinctly understood, but apparently *A6 misinformed, that the
drain was carried to Seventh Avenue and I feel that when the City was providing
drainage they should have done it in a permanent way, not. just spilling it on
to someone else's pnopertyi However, I do not intend to become involved in
any legal matter in .which I know from the start I am def eat ed, but I do not
consider it in any sense of the word fair playi

"July 139 1935
Honorable Mayor and Common Council;
Of the City of Rochester,
Gent 1 em en:
We' are informed that F: G. Desnoyers and A. J. Desnoyers upon
making application to you under City Ordinance number 455 as amended
by number 469 were granted license number 1439 on May 149 1935, to sell
non -intoxicating malt liquors on the following described realestate;
Olmsted County; Minnesota, to wit;
First floor of east past of the Cooperative Buildings lot
Seventeen (17) ; eighteen (18) and nineteen 119) Block eighty
seven (87) in Willson' s Addition to the town .(now City) of Rocheste-r
also known as number ten (10) and twelve (12) Fourth Street S.E.
It appears that there is a large open balcony in said location which
is fitted with booths and tables and Messrs. Desnoyers wish to have
their license amended so as to permit them to se7al non -intoxicating
malt liquors on this balcony also: In making the original application
for license they inadvertently overlooked mentioning this balcony as-
suming that the above description sufficiently covered it:,
This balcony is entirely open not covered in any manner by screens
or curtains. We find nothing in the Statutes of Minnesota or Ordinances
of the City of Rochester which makes it illegal to. grant such amendment
