Present: Moody, Richmane, Absent: None. Lliddle, Amundsen, Fryer; Green, Lemon, Upon motion by Green second by Amundsen the minutes of the meetings held May 13, 19359 May 219 1936, June 31 1935 and June 179' 1935 were approved, President Liddle announced this as the time and place for hearing on the vacation of Fifth Street Southeast (formerly Line Street), ii ;i lying westerly of a line drawn from a point in the South line thereof 67 feet East of the East line of Broadway Street South to a point in the North line i ,' thereof.80 feet East of the East line of Broadway Street. Lamprecht, the petitioners for the vacationing of Fifth Street Southeast, was before the Common Council with a request that the Council vacate Fifth Street Southeast, in accordance with this petition. Alderman Fryer introdueed the following resolution which was read: "Be it resolved by the Common Council of the City of Rochester; Whereas, Alvina M: Lamprecht and F: W: Schuster being the owners Qf all the property along the line of the street hereinafter described, have presented to the C' inon Council of said City a petition asking that the same be vaoated, which petition the Common Council ordered filed of record with the City Clerk of said City, who has given due notice of the time and place of hearing thereon: and Whereas it appears to the Common Council that said street has never been opened or used for public travel; that the expense of opening and improving the same would not be justified by its use: that it extends only to the river bank and that the public interests will be well served by the remaining streets and it is not needed for access to any property abutting thereon: Now, thelftefore, Be it resolved that all that part of Fifth Street Southeast in the City of Ro chest er, Olmsted County, Minne sot a, (f or'merly Line Street) lying westerly of a line drawn from a point in the South 117 01 r eof sixty seven feet east of the east line of Broadway Street South line the y to a point in the north line thereof eighty feet east of the east line of Broadway Street South be- and the some is hereby vacated, subject however$ to �i the condition that the City of Rochester does hereby reserve the righJr to use maintain and repair and replace the Surface Drainage Sewer now upon said premiseis �! and full right of ingress and egress for such Purpose: " I upon motion by Moody second by Amundsen; that the said resolution be II (I adopted as' read; and all voting in favor thereof; President Liddle declared the said repoliition duly passed and adopted. The following cannunioation was read; and President Liddle ordered that the same be placed on file: "Board of Park Commissioners City of Rochester$ Minnesota t July 15th$ 1935 Honorable Mayor and Common Council; City of Rochester; MinnesotaG Gentlemen: Ori July llth; 19359 the Board of Park Commissioners received a re- port from Hugh Vincent 'Reehan and Sven Nordling, the engineers who have been preparing plans and specifications for the dam in Silver Lake: They estimated the total cost of the project to be approximately $509-000. Mr. Nordling assured the Board that $35.000 . of this amount could be secured from Federal and State funds which would leave the stmt of $1590004 to be provided by the City of Rochestera It is necessary that definite action be taken to assure that the City will make this contribution before the application for the project can be submitted to theproper authorities: Therefore- the Board of Park Com- missioners respectfully rattiest your Honorable'Body to approve the contribution; of $159000a by the City of Rochester toward this project and to make fe funds available as soon as possible so that the work may continue without furthet delay Respectfully submitted; Harold Thompson President. M: August 5, 19354 The reports of the Northern Naturdl Gas Company on gas tests taken at Sioux City, Iowa, showing an average BTU for the week ending July 39 1935 of 997 and for the week ending July 109 1935 of 094, were read: The requisition by the Health Officer upon St. Mary s Hospital, _ for isolation of Beverly Ferris; aged sixteen months, living at 303 Third Avenue Northwest$ 1- diagnosed to be suffering from Whooping Cough and Pneumonia, was read, and President Liddle ordered that the s4e be placed on file: The request of the Seaboard Surety Company for notices of expiration of liquor licenses issued in 1934 to Christ Margellos' Leo Huey; Joe Wallace; James Ra Ryan and Harold Golod, was read, and upon motion by. Amundsen second by Fryer the City Clerk was authorized to execute the said notices4 The following letter addressed to Irving L: Eckholdt, City Attorney, was read, and President Liddle ordered that the same be placed on file: "July 3, 1935: Mr. Irving L: Eckholdt; City Attorney, Rochester, Minnesota: Dear Mr. Eckholdt: Thank you very much for your 1 ett er of June 29th in regard to drainage of surface water from my place: With the legal opinions which you have quoted, it seems useless for me to count on the city doing anything in regard to it but I have a feeling that while this is laws it is certainly not justice as the putting through of Fifth Street has been a bit expense to me aside from the damage which I have to anticipate from the watere j - I The whole matter, as far as I am concerned, is that at the time the street- was put through, I understood that the drainage from my place was taken care of4 I distinctly understood, but apparently *A6 misinformed, that the drain was carried to Seventh Avenue and I feel that when the City was providing drainage they should have done it in a permanent way, not. just spilling it on to someone else's pnopertyi However, I do not intend to become involved in any legal matter in .which I know from the start I am def eat ed, but I do not consider it in any sense of the word fair playi 120 JUL 15 19V !! T 127 2 Alderman, Moody introduced the following resolution which was reads "Be it resolved by the Common Council of the city of Rochester; Minnesota: That the salary and compensation of the Mechanic in the City Engineer' s Department of the, City of Rochester; Minnesota, be and the same is hereby fixed at the sum of $140400 per month beginning June let$ 1935, and continuing for. and during the ensuing official year; the said M echAni c in the City Ehgin- ; eer's Department to hold office at the pleasure of the City Engineer of said City. The duties of the said Mechanic are hereby declared to be such mechanical work as may be necessary on theautomobiles, trucks and motorized equipment in the City Engineer's Departments Said salary and compensation as aforesaid shall be payable weekly by ,City Engineer's Tine ..Checks, drawn . by the City Engineer and the Street and Alley Comittee; said salary to be payable from'the funds appropriated for use of said _Street and Alley committee." Alderman Richman introduced a resolution adopting the said Engineers i Specifi•catiohs for the furnishing and placing of 200 metal street signs; ordering advertisement for sealed bids to be opened at two o'clock P. M. on August 5; 19351 ,which was read: Upon motion by Amundsen second by Fryer that the said resolution be adopted as reads and all voting in favor thereof$ President Liddle declared the said resolution duly passed and adopted4 Alderman Amundsen introduced a resolution granting Public Dance Permit to T. V.
