Therein you state that the city of Rochester is contemplating the

adoption of a zoning ordinance. YouYdirect attention to Chapter 176; Laws of

1929, relating to. zoning ordinances, ax amended by Chapter 235 Laws
Of 1935, .and,:Chapter 376, Laws of 1935�
you inquire:
"The question now arises as - to whether or not, cities bf
the second class' have a right to adopt an..ordinance
for zoning without a vote of the people and whether or
�� II not Chaptpr 235 of the Laws of 1935 is in fill force end
effect as far as second class cities are concerned"
your question resolver itself into whether Chapter 3769 Laws of
1935 operates as a repeal of Chapter 235; Laws of 1935.
In our opinion said Chapter 376 does not repeal the earlier
enactment; ,Chapter 235; Laws of 1935
Chapter 176.E Laws of 1929 authorizes .the regulation of "Location,
size, use and height of buildings, the arrangement of buildings on r
lot s- and the density of population" in' all cities of the
Vilyd and fourth class and in all villages; arid,the adoption of comma
prehensive plans pursuant to such regulations. Said Chapter provides,
however; that the provisions of the same shall not be made effective by
. `g.
the governing body of any •such municipality until.. the proposition of the,

enactment of such regulations shall have been approved by a majority
ti of the lb1 eetors.
Chapter .235, Laws of ,1935 amends Section 1 of z id Chapter 176,
laws of 1929, by inserting after the word ."otherwise" in .the last

After the enactment pof the said Chapter 235 the legislature in k
the same session again amended said Section 1 of said Chapter 1769

Laws of 1929 by the enactment of said Chapter 376' Laws of 1935. It
will, be noted; however, that the legislature at the time of the enact-
ment of said Chapter 376 made no reference. to thei, intermediate act'
Chapter. 235, Laws of 19350: It -will. al so. b.e noted that stld Chapter 376
is limited. in its Application' to. citi.es...of. the•.third. and.fourth class
and villa'ges, This is manifest from an examination of the title as
well as the act itself -0- 'In other words said Chapter 376; the later
enactment* by its express,terms excluder and does not apply to cities

out; Chapter 376 is limited in its application to villages and cities of the thir

able with the later enactment, Chapter 376" in so far as the .former act relates
to cities in the second class. It seems to us that case is one for the applies'

"A later law which is merely a reenactment of a former does not
repeal an intermediate act which has qualified or 'limited the first
one, but such intermediate act will be deemed to remain in force; and
to qualify or modify the new act in the same manner as it did the
first."

As further evidence of the fact that the .legislature at the time
of the enactment of Chapter 3769 Laws of 1935, did not intend to interfere
with or repeal said Chapter 235 attention is directed to the Senate Journal
for Wednesday, April 249 1935, by referring to Page 1607 of said Journal, from
which it appears that Senator Richardson, who introduced and sponsored the bill
which was later enacted into Chapter 235,/Laws of 1935, b triking out the
moved to amend H. F.` 1a72, which is now Chapter `(0,+ � e same. This
word "second" from both the title of said bill and the body of th
motion to amend was adopted by the senat 04 The history of the enactment of
said Chapter 376 discloses, therefore, that the. legislature enacted the same
with deliveration and will full knowledge of the existence of said Chapter 235.
Thus it is manifest that the legislaturedid not intend to interfere with or
to repeal said Chapter 235:

That the said Common Council will meet at 7:30 o'clock P. M:, on
October 28th9 19359 in the Council Chambers$ in the City Hall, in said
City, and will at said time and place levy special assessments for the
cost and expense of the making and construction of the improvements
above described, according to the resolution heretofore passed and
adopted by the said Common Council determining the mode of the said

Upon motion by Fryer second by Lemon that the said resolution be
adopted as read, and all voting in favor thereof; President Liddle declared the said
resolution duly passed and adopted.
Alderman Moody introduced a resolution appropriating $573450 from the
Park Improvement Fund and ordering payment made to the Mayo Trust Fund; for payrolls
for payrolls for labor for the week ending Octoter 11, 1935, which was read:

Upon motion by Lemon second by Amundsen, the City Clerk was instruct
to request the Public Utility Board for an expression as to how much, if any, of. the
1935 tax levy they will absorb by the pa►yment of a tax on their gross incomes, and
the City Clerk accordingly addressed the Board as follows:

Gentlemen:
The Common Council of this City at a meeting held October 149' 1935
discussed the 1935 tax levy, and in that connection instructed me to make
respectful request of your honorable Board that on or before seven -thirty
o'clock P. M., October, 219 1935 you advise as to just how much, if any of this

instructed to request ruling from George W: Granger relative to the
School Boards right to attempt the same wage scale as is in force in the
City of Rochester;

Budget requests by Monday October 21, 1935*
The matter of a new car for the Police Department was informally
