President Liddle announced this as being the time and place fixed
for -hearing on the special assessments of sprinkling and -flushing of streets and
avenues, during the season ,of the year 1935 and asked if there were any person
present who wished to be heard concerning any of these assessments:

The `receipt of the Midland National Bank and Trust Company of
Minneapolis, covering collateral in the amount of $409000 00, deposited by the
Olmsted County Bank and Trust Company in lieu of their depository bond, was read,
and President Liddle ordered that the same be placed on files
The City Clerk reported the receipt of $95 46 from the Frankling Heat-
ing Station as one-half cent per M on 19,90919000 cui ft: of Natural Gas used during
September 1935
The following copy of letter to the Attorney General was read; and
President Liddle -ordered thatthe ,same be placed on file:

The school district which has been designated Independent School Dis-
trict No. 8 of Olmsted County is the district the boundaries of which are
coterminous with the boundaries of the city of Rochester:
It h6s never been organized as an independent district under the laws
of this state$ nor did the general laws apply to it except as it was granted
OCT 21 1915
certain powers by the various special acts relating to it. Stats:
1878, Cgapt: 369 Sec. 949 p. 486. See also section 2 of said chapter
on page 466
It was first created by special laws 1864, Chap. 179 which was
amended by Chapi 21, special laws 1867y These acts. were superseded
by Chap. 21, special laws 1867;
This act was in turn superseded by sub -chapter 10 of chapter 48,
P. 4959 of the special laws 1891; and when our home rule charter was
adopted, this special act was expressly continuedin force and excepted.

Chapter 2769 laws 19319 p; 318 authorizes independent school dis-
tricts within any city of the second class to adopt arjy ordinance en- I
acted by such city relating to wage scales etc. of labor on public worke.
Tire . city of Rochester has . enacted such an ordinance and the question
has arisen as to whether the school district, being a special and not an

W: A. Moore, Mayor, requested that the. Common Council reconsider
their action taken in granting the On -Sale liquor license to Anna Oesterreich
at which Alderman Anundsen withdrew his motion to grant the license and
Alderman Fryer withdrew his second thereto, which actions were taken with
the unanimous approval of the other Aldermen.
Upon motion by Moody second by Fryer the said application of
Anna Oesterreich for a liquor license at 322 Broadway Street South, was
referred to the Common Council as Committee

Minutes of a special meeting of the Common Council of the City of
Rochester, Minnesota held in the Council Chambers in the, City Hall in said City at one
o''clock P. M., October 229 19354
Meeting called to ordertV President Liddle;
Roll Call; Present: Liddle, Amundsen; Pryer, Green, Richman:
Absents Lemmon and Moody:
. The call for the special meeting was read; and President Liddle
ordered. that the same be placed on file; said meeting having been called for the
purpose of reconsideration of the On -Sale Liquor License application of Anna M.
Oesterreich, and any other business the said Common Council may deem proper:
Upon motion by Amundsen second by Richman; and all voting in favor
excepting Aldermen Lemmon and Moody who were absent,
thereof, an "On -Sale" license to sell intoxicating liquors at 322 Broadway Street
South,-- was granted to Anna M: Oesterreich-
The On -Sale Liquor License Bond of Anna M: Oesterreich with the
Seaboard Surety Company as -surety thereon; in the amount of $39000300 was read,
and upon motion by Amundsen second by Richman, the Surety thereon was accepted, the
said bond was approved and it was ordered thatthe samebe placed on file
Alderman Moody came in at this time and took his chair:
The application of Fred W4 Oesterreich for transfer of his Pool Table
License #189, covering five pocket billiard tables at 322 Broadway Street South,
to 9 Broadway Street South, was read, and upon motion by Amundsen second by Fryer,
transfer was granted;
The following resignation was read, and upon motion by Green second
by Richman, the same was accepted, and President Liddle ordered that the same be
placed on file:

We the members of the committee appointed by the
council to recommend the purchase of a car. for the Police Depart-
ment of the City of Rochester do recommend that the mayor of said
City issue an emergency order to the Chief of Police to purchase
from the Clements Chevrolet Co: One 1935 Master DeLuxe Sedan fully
equipped for $436 50
Said Clements Chevrolet Co. to accept the Graham
Sedan now in service in the Police Department a�the price of $350-00.

the amount of Seven Hundred Eighty- Dollars and Fifty Cents (76:50) with an
allowance on the 1934 Graham Sedan of Three Hundred Fifty Dollars and no Cents
($350400) leaving a net balance, of Pour Hundred Thirty Six Dollars and Fifty
Cents ($436 50)
This authority is given to you for the reason that the Police Department
at the present time is without adequate motor facilities and the delay occasions
by compliance with the charter provisions as to advertisement of bids would$
no doubt; cause great damage to the public interest and safety:.

made from the General Fund for payment -to J. W: Feller, Postmaster, for stamps for
the City Clerk; .
The claim of Lillian R: Sveom, City Clerk, for refund of cash paid
for stamps for use in the City Clerkt s Office, in the amount of $5 00 was read, and
motion „by 'Fryer second by Moody, the said claim was allowed, and the sum of $5:00
was appropriated for said purpose from the General Fund:
