Minutes of an adjourned regular meeting of the Common Council of the
City of Rochester- Minnesota; held in the Council Chambers in the City Hall in said
j City at 7: 30 o'clock P: M. on October 30, 1935;

The 6ommon Council considered the costs and levying of assessments for
the Bituminous Treatment of streets in this City during the season of 1935; and upon
motion by Green second by Richman; the City Clerk was instructed to make a statement
and report on the sprinkling of streets where Bituminous Treatment had been placed;
one-half. of which will be deducted from the costs of Bituminous Treatment before the
said costs are spread for assessment.
The City Attorney was informally instructed to prepare a resolution
making the temporary troApfer of $159000 00 a permanent transfer, to the Park
�.
Department;
Harold Thompson requested that the Common Council reconsider the action'
taken on October 280 1935, in regard to the purchase of lands; especially one piece
of land that s likely to be sold to some other purchaser;
A copy of communication from the Attorney General was read, and
President Liddle ordered that the same be placed on file:'

I have your letter of October 259 addressed to the Commissioner of
Education in which you -bring up the question as to whether or not Chapter 276,
Laws of 19319 would apply to your district;
I have discussed this *att er with the Attorney General's office and
they have held unofficially that Chapter 276 would not apply to your district;

which is classified as special4
As you know$ the law refers specifically to independent districts
in stating"that the school board of any independent school district which
is within the limits of any city of the second class may adopt any
ordinance......:a"
Therefore; since your district is a,special district and since some
of the lands of your school district lie outside of the limits of the
City of Ro chest er; Chapter 2761 Laws of 1931; would `not apply.
