Minutes of a special meeting of the Common Council of the City of
Rochester, minnesota, held in the Council Chambers, in the City Hall in said City at
5:00 O'clock, P: Ma on November 12, 19354
Meeting called to order by President Liddle:
Roll Call: Present: Liddle; Amundsen; Fryer; Green; Doody; and
Richman: Absent: LemmonA
The call for a special meeting was read, the special meeting having
been called for the purpose of considering certain phases on the Silver Lake Project;
and any otherbusiness the Common Council might deem proper:
James Starkey, Secretary and Harold Thompson, President of the Board o
Park Commissioners; explained the information that the government wanted in regard -
to the construction of the dam at Silver Lake; stating that the government wished to
be assured that the City of Rochester has the necessary land for the construction of
the dam and lake, that the United States or State of Minnesota would not be liable
for any damages caused by either the construction of the dam-., or flooding .of lands;
and that the City of Rochester would maintain the dam after it is built 4
In the discussion of the matter, the Council were assured by the Park
Commissioners that no trouble was anticipated in making arrangements with Oakwood
Cemetery for a part of their land; which will be flooded and the City Attorney ad-
vised the Council that the transaction of the Riess property would be completed as
soon as the case of Alexander and Riess was settled in court:
Alderman Green introduced the following resolution which was read:
"WHEZEAS; the City of Rochester; Minnesota has heretofore made plans
for. the carrying out of what is known as the Silver .Lake Project and has
requested contributions to be made from the United States Government and from
the State of Minnesota; and
WF{FREAS, the City of Rochester is the owner in fee of the lends upon
w-�ich the dam is to be erected and the owner of all of the property that will
be overflowed or injured by the result of the erection thereof except one
piece of about two acres in area owned by the Rochester Cemetery Association
with whom negotiations have been made so that the City of Rochester will

become the ovmer of that piece; and
WHEREAS$ the United States Government and also the State
of Minnesota expect to make contributions for the carrying out of
said project and the construction of the dam shown on the plans;
NOW THFVEI70RE; Be and it is hereby resolved by the
Common Council of the City of Rochester; Minnesota;
.That the City of .Rochester; in consideration of the
contribution above mentioned; hereby assume and agree to pay
any and all damage cau:,ed by the erection of the dam aforesaid
to persons or property and also caused by the overflow of any and
all lands which may be overflowed by the erection of the said dam.
Be it further resolved by the Common Council of the City
of Ro chest er; Minnesota;
That the City of Rochester does hereby agree to save
harmless from any and all claims of every kind$ character and
description the United States Government and the State of Minnesota
that may arise or be caused by the erection and maintenance of the
dram aforesaid
Be it further resolved by the Common Council of the City
of Rochester; Minnesota;
That the City of Rochester will maintain the said dam
to the best of its ability permanently: n
Upon motion by Richman second by Green,that the said resolution
be adopted as read; and all voting in favor thereof; President Liddle de-
clared the said resolution duly passed and adopteds
A petition that street lights be installed at the intersection of
Thirteen and One-ITalf Place and Second Street Southeast; was read; and
President Liddle referred the same to Alderman Moody with a request
that inst all et, ion b e made:
The following claims were .read, and upon motion by Moody
second by Anundsen; the same were allowed; and the Mayor end City Clerk
were m.thorized end directed to draw warrants upon the City Treasurer and
make payments accordingly:

Alderman Richman introduced a resolution appropriating 1$310913 from the
F. E. Williams Estate Fund, and ordering payment made to Simon Stensrud for 3/A share
of the 'net income from the P. E. Zilliams Estate Business Building; during the
months of August, September and October 19359 which was read:
Upon motion by Amundsen second by.Richmen,that the said resolution be
adopted as read, and all voting in favor thereof; President Liddle declared the said
resolution duly passed and adopted:

Alderman Amundsen introduced a resolution appropriating $264:65
from the Park knprovanent Fund and ordering payment made to the C-eneral
Fund for sprinkling along various park properties; during the season of

The Mayor reported that he had a telephone call from 13i st er Joseph
at St.-Mary's Hospital; thanking the City of Rochester and the Common Council for in! -
stalling the street lights on Second Street Southwest

to allow the use of chains
in plowing
snow at a
