M. by President Liddle, and i` on roll call, the following members were present: Liddle, Amundsen, Fryer, Green, Lemon, Moody, and Richman: Absent: Nones On motion by Ricbman second by Amundsen, the minutes of the meeting of i August 319 1936 were approved: j I Members of the Library Board were present and eked for a change in the labor ordinance permitting stone setters to work forty-four hours per week. On motion; by Lemon second by Amundsen that the President appoint a Committee to investigate said matter and report at the next meeting of the Council. President Liddle appointed'. i Green, Amundsen, and Moog on said Committee: .. i ! Mr: W. R: Knutson called attention to the fact that some gasoline filling stations have gasoline pumps located at the curb, and are using CU# property thereby being able to produce overhead expenses and cut gasoline prices accordingly, and asked that the Council take action to prohibit the use of the City streets for such i I concerns: ! i On motion by _Green second by Ricbman, the matter was referred to the Public j Grounds Committee, the Chief of Police, and City Attorney with request to report at their earliest conveniences Mr. J. M. Brewer, representing the National Youth Administration, asked for the use of the second story of the building located on the Williams property for I, youth center. On motion by Lemon second by' Ricbman, the matter was referred to the Public Grounds Committee, Mr. H. 0. Christensen, and the City Attorney, i Mr. H. C. Theopold, representing the Works Progress Administration; asked that the City assume one-half of the cost of the light, heat and water for the W. P. A: office: On motion by Green' second by Amundsen,, the matter was referred to the Finance! ` I Committee and, the City Attorneys President Liddle announced this as being the time fixed for the hearing on the recommendations of the Zoning Board The matter of the appeal of George B. H Clemens representing the I; citizens in the near- vicinity of the proposed store building were before the Common Council. ij Alderman Lemmon introduced the following resolution, which was read �I ",NHEREAS, an appeal has beep taken by Geo. B. Tauer from a decisim of the Building Inspector directing him to discontinue the construction of a store building at 604 Fifth Avenue Southeast, and WHEREAS, the Board of Zoning recommends that the appeal be denied; NOW THEREFORE, Be it resolved by the Common Council of the City of ii Ro chest er, Minnesota; That the appeal of Geo. B. The report of the City Weighmaster for the month of August 1936 showing weighing fees collected $8 10, was read, and Bresident Liddle referred Ithe same to the Finance Committee. The report of the Milk Inspector for the month of August 1936 was dread, and President Liddle ordered that the same be placed on file. The Plumber's Licence Bond of, Edward T. Connolly with the Fidelity and ,Casualty Company of New York, as surety thereon, in the sum of $$19000:00, was read, and on motion by Moo cry second by Amundsen, the surety thereon was accepted, the said ;,bond approved, and it was ordered that the same be placed on file. A petition signed by H. S. Plummer et. al. asking that curb and gutter be constructed on Tenth Strut Southwest from the west property line of Seventh Street Southwest to and including the east end of. Plummer_' a drive, was read, and on Motion by, ,Lemmon second by Amundsen that permission be given to the owners of said property to enter into a private contract with John P. Cassidy for the construction of said curb to be done under the superivision of the City Engineer: The resignation of Merton . Cowan as second Assistant City Engineer, effective i September 8, 1936, was read, and on motion by Lennon second by Greehs said resignation i ,;was acc ept ed4 An application signed by C. McHugh for a license to operate a one chair barber shop at 1118 Second Street Southwest, was read, and on motion by Moody second by ::Amundsen t i c en s e was granted: Applications signed by H. H. Sanders, Joe Daly and Ralph Kelly asking that "On -Sale" Intoxicating Liquor License #36 be transferred from H. H. Sanders to Joe Daly and Ralph Kelly at 313 First Avenue Southwest, in the City of Rochester, were •read, and on motion by Moody second by Richman transfer was granted The surety bond for "On -Sale" Liquor License of Joe Daly and Ralph Kelly i with the Seaboard Surety Company of New York, as surety thereon, in the sum of $3,000.00 'Was read, and on motion by Moody second by Richman, the surety thereon was accepted, the _ .said bond approved, and it was ordered thatthe same be placed on file. Applications signed by Joe Daly and Helen Daly asking that "On -Sale Non - Intoxicating Malt Liquor License #189 and "Off -Sale Non -Intoxicating Malt Liquor License #365 be transferred from Joe Daly to Helen Daly at 106 Broadway Street South was read, and on motion by Richman second by Moody, transfer was granted: 32 A communication signed by "on -Sale" Liquor Dealers in Rochester was read. asking that permission be granted them to sell 3.2 bder/ On motion by Green second by Richman, the City Attorney -was, instructed to prepare an amendment to the liquor ordinancetA conform with said request The following communication from the Finance Committee was read, and on motion by Green second by Amundsen, the same was approved: "Rochester, Minnesota: September 8, 19361 Honorable Mayor and Common Council, City of Rochester, Minneebt:e,. Gentlemen: We, the Finance Committee of the Common Council of the City of Rochester, Minnesota, recommend that .the Common Council approve the following loan to be made by the Fire YDepartment Relief Association: John D. Ryan, $2800.00 on his resident at 715 Fourth St. S. E. Carl W. Ranfranz, $325400 on his residence at 520 Third Avenue Northwest Herman Carey, $4000*00 on his residence at 212 Eighth Avenue Northwest. Aldermen Moody introduced the following resolution, which was read: ' "WHEREAS, An appeal has been taken by A: C. Moehnke, to the Common Council, appealing from a decision of the Building Inspector in r.efusin# to issue a permit to alter a builcthg located at 807 Second Street Southwest to accommodate more than four i j' ,families, and WHEREAS, said appeal has been considered by the Board of Zoning of the City of Rochester, and said Board has made no recommendation as they have no juris- i Y J ,'diction in the matter, for reason that it is a violation of the building code ordinance; i NOW TH7.REFORE, Be it and it is hereby resolved by the Common Council of the City of Rochester, Minnesota: That said appeal be and the same is hereby dismissed and the action o^ the Building Inspector upheld: On motion by Moody second by Amundsen, that the said resolution be adopted .. as read, and all voting in favor thereof, President Liddle declared the said resolution; d i t duly passed and adopt ed4 Alderman Moody introduced the following resolution, which was read: "WHEREAS, An appeal has been taken by Vernon Engh6 from a decision of the 7 Building Inspector, directing him to discontinue the use of a certain building located at 411 Ninth Avenue Southeast, for a public garage, and WHEREAS, The Board of Zoning recommends that the application be denied; NOW THERI WREL Be it resolved by the Common Council of the City of Rochester'. Alderman Richman introduced a resolution appropriating 0399:009 234625 thereof from the Street and Alley Fund &nd 0164075 thereof from the Sewer Fund, and ordering payment made to the Botsford Lumber Company for sewer pipes furnished for storm sewers and to stock, which was read. On motion by Green second by Richman, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared he said resolution duly passed and adopted: Alderman Richman introduced a resolution appropriating 0459.44 om the Park Improvement Fund, end ordering payment made to the City of Roch- fester Light and Water Departments, for power and water furnished the swimming 9 ,j pool, as per the August 25, 1936 billings, which was read. i On motion by Green second by Amundsen, that the said resolution be adopt ed as read, and all voting in favor thereof, President Liddle declared the said resolution ;duly passed and adopted: Aldermen Moody introduced the folio ling resolution, which was read: "Be it resolved by the Common Council of the City of Rochester, Minnesota: That the sum of $2287653 be and the said sum is hereby appropriated , $1675:00 thereof from the General Fund and $612, 33 thereof from the Street and All ety Fund of said City and ordered paid to the following funds: $1675;a00 to the General Pond for use of equipment during August 1936i #812,33 to the Street and Alley Fund for ,use of equip t during August r938. �� Mayor and City Clerk 'are herby authorized and directed to draw warrants ;for said sums upon the City Treasurer in accordancd herewith, and cause said payment �n ':to be made: k i On motion by Green second by Amundsen, that the said resolution.be adopted as read, and all voting in favor thereof; President Liddle declared the said resolution, duly passed and adopted4 i Alderman Lemmon introduced a resolution appropriating 11233.17 from Code 28 of the General Fund, and ordering payment made to the State of Minnesota Oil Inspection; Division, for 3 cents per gallon State Tax $230:01 and inspe5tion fee 03016, on 7,904 gallonsof gasoline furnished in car NATX 59429 which was read. On motion by Richman second by Green, that, the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted Alderman Lamon introduced a resolution appropriating $49919.75 from the Sewer Fund, and ordering payment made to Wn C. Fraser and Son as fifth and final i estimate for construction of sanitary sewer in Broadway Street South, from Third Street Southeast to Sixth Street Southwest'$ which was read. On motion by Moody second by Richman, that the said resolution be adopted 2i 36 as ready and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Lemon introduced a resolution appropriating d,�9120-96 from the Permanent Improvement Revolving Pund, and ordering payment made to John P. Cassidy as first and final estimate for construction of curb and ;_gutter in Sixth Avenue Southwest from Ninth Street Southwest to Eleventh Street South- west, which was read. on motion by Lemmon second by Green, that the said resolution be adopted as read, and all voting in favor therOvf 9 President Liddle declared the said resolution duly passed and adopted. Alderman Lemmon introduced a resolution appropriating,* $29000.00 t $1,000.00 thereof from the Sewer Pond and $1,000.00 thereof from the General Fund, for use of the Street and Alley Committee, which was read. Mi 1 o st an .1154 70 0 ` The matter of the bids for the furnishing of radio equipment for the Police Department was taken up at i this time, and on motion by Green second by Richman,' all bids were rejected and the City Clerk was authorized to return the certified checks which accompanied the bids: An Ordinance entitled "An Ordinance regulating the operation of bicycles and other similar conveyances on the public streets of the City of Rochester", was given it sthird and final reading: On motion by Lemmon second by Green, that the said Ordinance be adopted as read, and upon roll call all voting in favor thereof, President Liddle declared said Ordinance duly passed and adopted:. ' An Ordinance entitled "An Ordinance repealing an Ordinance entitled 'P.An Ordinance to prohibit the riding' of'bicftles, etc. , ' on'the sidewalks on certain streers or avenues in the City, and to regulate and restrict the use of such vehicles on all other sidewalks, streets and avenues in said City, and pro - habit the riding of motor-gehicles on sidewalks", was given its third and final reading. i On motion by Lemmon second by Green, Chet the said Ordinance be I adopted as read, and e2-11 voting in favor thereof, President Liddle declared i the said Ordinance duly passed and adopted. On motion by Lemon second by Richman, the Police Commitsion and the Chief of Police were authorized to purchase the necessary forms and supplies to carry out the provisions of the Bicycle Ordinance. A communication from the Rochester Chapter of the Isaac Walton League regarding the condition of the Sewage Disposal Plant was read, and President Liddle ordered that the same be placed on file. 39:) .SDI On motion by Leranon second by Amundsen, the Mayor and City Clerk were in- structed to ask the Charter Commission to make a complete study of the Present charter of the City of Rochester for the purpbse of revising and amending the same in order to more; fully fit the needs of the City; On motion by Richman second by Amundsen, the Common Council adjourned to seven thirty of clock P.
