Minutes of a regular meett:hg of the Common Council of the City
Of Rochester, I Minnesota, held in the Council Chambers in the City Aall,. in
Dodd City on December, 7th,19P6.: y
the meeting was called to ' order by President. Liddle at 2:00
o'clock P.M., and upon Roll Call, the following members were present:
Amundsen, Green, Lemmon, Moody, Richman. Absent: Fryer.
Upon motion by Moody second by Richman, the minutes of the
meeting of November 27th,1936, were approved.
President Liddle stated this as being the tine and place fixed for
a hearing on the construction of s sanitary sewer in Tenth Street Southeast,
between. Seventh Avenue. Southeast_ and Eighth Avenue Southeast, and asked if tV
II one present wished to be heard concerning the said improvement.
No one was present who wished to be heard concerning the improve-
ment above described.
This being the time set for the. receiving and opening of. proposals
fAr, the furnishing of one 1937: model, two -door touring sedan, with built-in.
trunk, less trade in allowance for the 1929 Dodge sedan, for the .City
lkgineer,'s Department, according to specifications on file in the office
IIof the City Clerk, the following bids were received and opened at this time:
Qaality Motors, Oldsmobile, $770.00; Ellis Motor Company, Dodge, $796.00;
Rochester Auto Market, Studebaker, $812.00 f StollAt Motors, Chrysler Royal,
$815:00; Joy Brothers Motor Car Co. , Packard, $930.00.
President Liddle referred the above bids to the Street and
Alley Committee and the City Engineer for tabulation and recommendation.
The Council recessed for a short time to allow the Street and
Alley Committee and the City Engineer to go over the bids for furhishing of
an automobile for the City Engineer's Department.
The Council was again called to order and the following
Committee report was read, and President Liddle ordered that; the same be
placed on file:

%lderman Amundsen introduced the following resolution,which was read:

Engineer's Department, viz:

Upon motion by Amundsen second by Richman, that the foregoing resolu-
tion be adopted as read, and all voting in favor thereof, President Liddle declared

Upon motion by Green second by Richman, all other bids were rejected
the City Clerk was authorized to return the checks which accompanied the re.ected

A communication from the Hon. A.H: Maze, Mayor of the City of Winona,
inviting Rochester City Officials to the Regional Conference of the League of
Minnesota Municipalities, to be held in the City of Winona, December loth, 19369
was read, and President Liddle ordered that the same be placed on file:
A .communication from Irene D.R.English, Director of Nursing of the Kahler

:. School of Nursing, expressing the appreciation of the Kahler School of Nursing for
the new street light that has been placed ,pn Second Avenue Southwest between Fourth
and Fifth Streets Southwest, was read, and President Liddle ordered that the same be
placed on file.

A communication from the Plumbers & Steam Fitters Local Union
No.5569 inviting the members of the Council to. meet with the Plumber's
Code Committee on December 9th,at the Union .Hall, was read, and President
Liddle ordered that the same be placed on file.
A communication from James T.Spillane in behalf of Henry Grassle,
regarding payment due on contract, entered into by Henry Grassle with the
City of Rochester for the furnishing of gravel, was read, and President
Liddle referred the same to the City Attorney.
A copy of requsition on Saint Mary's Hospital for the isolation
of Florence Dobsen, age 8 years, residing at 618 Eighth Avemu.e Southeast,
and diagnosed to be suffering from scarlet fever, was. read, and President
Liddle ordered that the same be placed on file:
-The reports of the Northern Natural Gas Company of tests taken at
Sioux City, Iowa, showing an average B.T.U. for the week ending October 28t1i,
of 1001; week ending November 4th 1010; week ending November llth, 1024;
Week ending November 18thtl026; week ending November 25th, 1039,; and the
week ending December 2nd, 10449 were read.
The report of the Clerk of the Municipal Court for the week
ending November 30th,1936, showing criminal fines and costs collected
$38.00, civil fees received $9.40, conciliation court fees received $4.00,
and check from Olmsted County $50.451, was read and President Liddle
referred the same to the City Attorney.
The report of the Building, Electrical, and Plumbing Inspector,
for the month of October,19369 showing Building permits issued $138.00, ,
electrical permits $21.509 plumbing .permits $50-025) and for. the identh
of November showing building permits $57.00 9 electrical permits $19.25 9
plumbing permits $37.259 were read, and President Liddle referred the same
to the Finance Committee.
i The report of the City Wei,gbmaster .for the month of November
showing private loads weighed 346, was read, arld President Liddle referred
the same to the Finance Committee.

The application of the Eagles Lodge and Eagles Club Zu,mbro Aerie #2228,
I� asking for a transfer of On °Sal-e non -intoxicating malt liquor license No.1551 and
Off Sale non -intoxicating malt liquor license No..334, from 307- Broadway. Street
South to 18-2 Third Street Southwest, was read, and on motion by Amundsen ,second by
Richman, ;transfer was granted.
Kenneth R.Osman, .representative of the Thorman Rosholt Company of
Minneapolis, was before the Common Council regarding snow regnoval equipment, and
upon motion by Lemmon second by Amundsen the matter. was referred to the Street and
Alley Committee and the City Eagineer for investigation.
.The matter of t}4e application of Clifford Megears for a pop corn stand
was taken up at this -time and upon motion by Amundsen,, second by Moody said applics
t ion was not granted.
Ors motion by Noddy sedond by LemMon the Strdet and Alleys Committee and
the City Engineer were instructed to lower the water connection for the property
known as ,Anna Mohr premises on Vourfeenth Avenue Northeast; 'the same being necessary
on account of the lowering of the grade while grading the street.
Alderman' Fryer came in at this time and took his place.
Upon motion by Richman second by Moody, and all voting in favor thereof,
the following claims were allowed, and the Mayor and City Clerk were authorized and
directed to draw warrants upon the City Treasurer hnd make payments accordingly:

The matter of the repaving of Broadway Street North and South was
aF �� brought up for discussion and upon motion by Green second by Moody, the matter was
referred to the City Engineer and he was instructed to confer with the State Highway
F` Department and make a written recommendation to the Common Council reeardine the
base, kind of .pavement, and an estimate of the cost thereof.
Mr. H.C.Theopold, and H. I. Pearl, representing the local W.P.A.
offices, were before the Council and asked that sufficient funds be made available
in order that the Park Department may continue with the W.P.A. projects already
approved..
Alderman Amundsen introduced a resolution grarting public dance
permit to Walter C. Heins for the Woodman Hall December 5th, and 12th,1936, and
fixing the fee at $6.00 , which was read:
Upon motion by Amundsen second by Fryer, that the foregoing resolution
be adopted as read, and all voting in favor thereof, President Liddle declared the
said resolution duly passed and adopted:

dance permit to Henry Foley for -the A.O.U.W. Halls November 14th and 21st,
19369 and December 5th,1936, and- fixing the. fee at $9.009 which was read..
Upon- Upon motion by Green second by hnundsen, that the foregoing
resolution be adopt ed as, read, • and all voting in favor thereof, (resident
Liddle'deolared the said resolution dull passed and adopted. '
Alderman Amundsen introduced the following resolution which was

"WHEREAS, The Sheet and Alley Committee . o� the Common Council of
the City of Rochester, Minnesota, did call for bids for the erection of
'Holiday -Festoon Lighting according to -specifications on file in the office
of the City Clerk; and
(WHEREAS, The following bids were received and duly considered by
said Committee: Rochester Electric Company $5784,1009 H. & H Electric Company
§600,00 , and .
• WHEREAS, The bid of H. & H. Electric CompaiV was accepted by said
Committee, and a contract entered into accordingly as per specifications on
file;
NOV1 THEREFORE, Be it and it is hereby resolved by the Common
Council of the City of Rochester, Minnesota:
That the action of said Committee in all respects be and the same
is hereby approved and confirmed. "
Upon motion by Lemmon second by Pryer, that the foregoing resolu-
ion be adopted as read, and all voting in favor thereof, President Liddle
eclared the said resolution duly passed and adopted.
Alderman Amundsen introduced 6 resolution ado13ting the plans,
profiles and specifications for the construction of a 'sanitary sewer in
enth Street Southeast between Seventh Avenue Southeast and Eighth Avenue
outheast, and ordering a hearing on this improvement to be held January
4th,19379 at 2;00 o'clock P.M. , and authorizing 'and directing the City

Alderman Green,introdulaed the following resolution, which was read:
"WHEREAS, The City of Rochester has heretofore applied for a ,grant
from the United States Government fog• aid in the construction of a warehouse, the
said project being Minnesota Docket #1260-D9 and
` WHEREAS, The United States Government has heretofore granted said
application, and as part of said requirements has set forth that the work of con-
struction should be commenced"by January llth,1937, and
WHEREAS, All necessary steps have now been taken to obtain the title-
to the real estate upon which the said building will be situated, which necessitat
a delay in drawing the plans and specifications; and
WHEREAS, The final plans and specifications are now being drafted;
NOW THMMRE, Be it and it is hereby resolved by the Common Council
the City of Rochester, Minnesota:
That the United States Government is hereby respectfully requested to
grant further time, not to exceed February llth919379 for the commencement of the
actual work of the construction; and the City Clerk is hereby directed to make such
request and to send a certified copy od this resolution to R.A.Radford, State Direc#or
P.W.A."
Upon motion by Fryer second by Lemmon that the foregoing resolution be
adopted as read, and all voting in favor thereof, President Liddle declared the said
resolution duly passed and adopted.
Alderman Amundsen introduced a resolution appropriating $499.00 from
the Street

Alderman Richman introduced a resolution appropriating $260.50 from th
I) Lighting Fund and ordering payment made to the City of Rochester, Light Department,
for lighting of public buildings in accordance with the November 25th919369billings,
which was read.

tion be adopted as read, and all voting in favor thereof, President Liddle
declared the said resolution duly passed and adopted.
Alderman Richman introduced a resolution appropriating $264.15
from the General Fund -and ordering payment made to the City of Rochester,
Steam Heating Department, for steam heat��rni shed at the City Hall in
accordance with the November 27th,19361,billing, which was read.
Upon motion by Amundsen second by Richman that the foregoing
resolution be adopted as read, and all voting in favor 'thereof, President
Liddle declared the said resolution duly passed'and adopted.
Alderman Richman introduced a resolution appropriating
0297.45 from the Street and Alley Fund and ordering payment made to Seth
Morse for gravel furnished during the period November 4th,1936, to
J November 22nd,19369which was read.
Upon motion by Richman second by Amundsen that the foregoing
resolution be adopted as read, and all voting in favor thereof, President
Liddle declared the said resolution duly passed and adopted.
Alderman Moddy introduced a resolution appropriating $396056
II from P.W.A:Docket#1192-R Fund and ordering payment made to Hugh Vincent
IlFeehan, for balance due on contract for architect fees on Swimming Pool,
ch was read.
Upon motion by Fryer second, by Richman, that thi said resolution
be adopted as read, and all voting in favor thereof, President Liddle
declared the said resolution duly passed and adopted.
Alderman Moody introduced a resolution appropriating $417.00
from the Park Improvement Fund and ordering payment made to Dodge Lumber
& Fuel Company for cement, limat e, et c. , furnished the Park Dept. during
the month of November9l936,wbich was read.
Upon motion by Moody second by Amundsen, that the said resolution
be adopted as read, and all voting in favor thereof, President Liddle
declared the said resolution duly passed aid adopted.

., Alderman .Moody introduced resolution appropriating $463.26 from the

Street and Alley Fund and or paymobt made to the Street and Alley Fund for
use of equipment during November 91936 9 which was read.
Upon motion by Lemon second by Amundsen that the said resolution be
adopted as read, and all voting in favor thereof, 15residerit Liddle declared the
said resolution duly passed and adopted.
Alderman Green introduced a resolution appropriating $856.60 from the
Park Improvement Fund and ordering payment made to the Mayo Trust Pond, for payrolls
for labor during the period of the weeks ending November 27th, and December 4th91936
which was read.
Upon motion by Moody second by Fryer that the said resolution be
adopted as read, and all voting in favor thereof, President Liddle declared the
said resolution duly passed and adopted:
Alderman Green introduced a resolution appropriating $945.50 from
P.W.A.Docket #1192R Fund and ordering payment made to Builders Engineering Company,
for final payment on Contract No.B' change Order No.3-A, additional lockers and

equipment, which was read.
Upon motion by Richman second by Green that the said resolution be
adopted as read, and all voting in favor thereof, President Liddle declared the
said resolution duly passed and adopted.
Alderman Green introduced a resolution appropriating $3385.53 from
P -We' A.Docket #1192-R Fund and ordering payment made to G_Schwart z & CompaxW, for
final estimate on contract for the construction of. swimming pool and bath houses,
which was read.
Upon motion by Moody second by Richman, that the said resolution be
adopted as read, and all voting in favor thereof, President Liddle declared the said
resolution duly passed and adopted.
II: I Alderman Green introduced a resolution appropriating $996250,50 from
the Lighting Fund and ordering payment made to the City oP Rochester , Light Depart-
ment for lighting pf public streets and grounds during August, Sept ember, October
and November,19369 which was read.

Upon motion by Lemon second by Moody that the said resolution be
adopted as read, and all voting in favor thereof, President Liddle
declared the said resolution duly passed .and adopted.
Alderman Richman introduced a resolution appropriating $10 9100.00
from the Street and Alley Fund and ordering payment made to the
First National Bank of'Rochester, Minnesota, for the December 3rd
1 1936 maturity of City of Rochester, Minnesota, certificates of
indebtedness Nos. 25 to 34, inclusive, $10,000.00 and 3 months interest
on same $100.00 , which was read.

resolution be adopted as read, and all voting in favor thereof,
President Liddle declared the said resolution duly passed and adopted.
The City Clerk presented the IDAballed 'snow ordinance unapproved ly
the Mayor; also the following communication,which was read:
"TO THE COMMON COUNCIIj OF THE CITY OF ROCHESTER:
Gent 1 em en:
I return herewith the so-called Snow Ordinance s*Fpweted` for
the following reasond:
1. The general public is not in .favor of this ordinance and for
that reason it will be difficult to enforce it.
2. It is unfair to owners of property in the outlying districts
where there are large tracts of land unoccupied. In those cases the
owner has already been assessed for the sidewalk which he does not use.
It is not fair to him that he should now be compelled to pay for having .
the snow removed.
3. Under the provisions of this ordinance the snow cannot be
removed before the children go to school in the morning in case of a
heavy snow storm: It is therefore useless in that respect, as the
City will still have to use its plows.
4. If the City has to send out its snow plows early in the
morning after snow storms, it is only adding a double expense to the
tax payer.
5. Under our present system the owner of the property virtually r
pays for the eipense of plowing out the sidewalks when he pays his
general taxes. it is possible that this ordinance would work out
satisfactorily if confined ..to only the bupiness district. In my opitnion
}
it works a hardship on owners of residential property, most of whom take
a certain pride in keeping their property neat and clean and are already
doing all that can reasonably be expected of them in the way of clearing
the snow off their walks:

-.60 1. cannot see amy good to be accomplished by the passage of this Ordinance.
The trouble and expense in carrying it out will, in my opinions far exceed the
benefits to be derived.
