The meeting was called to order by President Liddle, at 7: 30 o'clock P.M., the fallowing members being present: Liddle, Fryer, Green, Leemon, Moody, IIRichman.' 'Absent: Amundsen. ' On motion by Richman second by Fryer, the minutes of the meeting of December 14t'h919 36 ,' were approved. The report of the Clerk of the Municipal Court for the week ending November 23919369 showing criminal "fines and costs collected $59.40 9 civil fees received $14.00 9 Conciliation Court fees received $5.50; for the week ending December 14th, showing criminal fines and cost s collect ed $31.80 , civil fees recei ved $13.55, conciliation court fees received $6.00; for the week ending December 21, criminal fines and costs collected $10.00, civil fees, received $19.50, conciliation court fees received 08.25; and for the week ending December 28th,19369 showing criminal fines and costs collected $167.40, civil fees. received $.359 conciliation LL court fees received $2.509 check from Olmsted County $38.10 9 were each read, and r President Liddle referred the same to the City Attorney. An application signed by Brehmer & Kleckner for a license to operate a bowling alley in the building known as 11j Broadway Street North, was read, and upon motion by Green second by Richman, license was granted. President Liddle stated this as being the time and place fixed for receiving bids for the purchase of the Witherstine Property, and asked if tmy one present wished to submit a proposal. any bid. No bids had been filed with the City Clerk, and no one present submitt Alderman Amundsen came in at this time and took his place. Alderman Green introduced a resolution appropriating $233.79 from Code 18 of the General Fund, and ordering payment made to the General Fund, Vode 319 for the 1936-1937 insurance premium distribution for City Hall and contents, City scales and contents, and other special 1 11 policies, which was read. Upon motion by Lemon second by Amundsen, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Green introduced a resolution appropriating $221.05 from the General Fund, Code 20, tb. the General Fund, Code 31, for the 1936-1937 insurance premium distribution OffWl"$,which was read. 147 ' q'r Upon motion by Richman, second by Amundsen that the said resolution be i adopted as read, and all -voting in favor thereof, Presiakat Liddle declared the .said resolution duly passed and adopted: {' Aldarman Green was excused at this time. Alderman Richmanintroduced a resolution granting public dance permit IIto Walter Heins at the Woodman Hall, for December 26th919369 and January 2nd919379 and fixing the fee at MOO,which was read. Upon motion by Moody second by Fryer, that the said resolution be adopted as read,. and all voting in .favor thereof, President Liddle declared the said resolution duly passed and adopted: Alderman Moody introduced a resolution authorizing the Mayor and City Clerk to sign and execute in behalf of the City of Rochester. the contract with Peter P. Bross as architect for the new City Warehouse, which was read. A. Upon motion by Ldhmon second by Richman, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Amundsen introduced the following resolution,which was read: "SEAS, The City of Rochester, Minnesota, has heretofore -entered into contracts for making local public improvements in said City, during the year 1936, which improvements are to be paid for out of the Permanent Improvement Revolving Fund of said City, from the proceeds of the Special Assessments levied by the said E` Common Council of said City during the year 19369 and F WHEREAS, There is not sufficient money in the said Permanent Improvement Revolving Fund to make the payments for the said local improvements as the same become due, and W MEAS, The Common Council of the City of Rochester, Minnesota, dean it necessary for the purpose of maintaining the said Permanent Improvement Revolving Fund and providing money in advance of and in anticipation of the collection of special assessments levied by the Common Council. of said City of Rochester, to issue, negotiate and sell the bonds of said City of Rochester to the aggregate amount of o10,00000 . \ 11 NOW THEREFORE, Be it and it is hereby resolved by the said Common Council: That said Common Council, for the purposes aforesaid, do hereby issue the bonds of the said City of Rochester* Minnesota, in the aggregate amount of $100000:00, which said bonds shall be denominations of $1000.00 each, numbered one t hundred and five (105) to one hundred and fourteen (114) , both numbers inclusive; i all payable to bearer, and the sum of $19000 00 of the principal of the said bonds shall be due and payablo on July let of each of the years 1937;19389-1939, 1940, and 19411, and $1000 *00 of the principal of said bonds shall be due and payable on January 1 148 !) THESE PRESENTS; That the City of Rochester in the County of Olmsted and State of Minnesota, acknowledges and certified that it is indebted tog and for value received, hereby promises to pay to the bearer, on January (July) first. 19??7, the sum of One Thousane ($1,00000) Dollars, together with interest on said sum from the date hereof until paid at the rate of three .(3�) per cent per annum, payable semi-amually on the first day of July and January in each year hereafter , both principal and interest payable in lawful money of the United States of America, at the office of the City Treasurer of the City of Rochester, Minnesota, out of the Permanent Improvement. Revolving Fund, of said City, or if there shall not be sufficient moneys in said Fund to pay the same when due, then out of the General Fund of said City, and for prompt pay- ment of this bond at maturity, with interest as aforesaid, the full faith and credit of the said City of Rochester, is hereby pledged. This bond is issued for the purpose of maintaining the Permanent Improvemient Revolving Fund ' of said City, for the purpose of providing funds in advance of and in anticipation of the collection of moneys to be derived from special assessmeits heretofore levied, but not paid, for the making of local improvements in the year 1936. In witness whereof the City of Rochester by its Common Council -has caused this bond to be signed by the Mayor and attested by the City Clerk and the corporate seal of the City to be affixed hereto and has caused the annexed interest coupons to be signed by the Mayor and City Clerk by their respective facsimile signatures, and said Mayor and City Clerk do, by the execution hereof, adopt as, and for their own prbper signatures, their facsimile -signature, appearing on said coupons, all this January 2nd, 1937. Be it further resolved by the said Common Council: That the Mayor and City Clerk of said City are hereby authorized and directed to make, prepare and execute the said bonds of the City of Rochester, Minnesota, in accordance herewith,' and to make delivery of said bonds, to the City Treasurer of the said City, who will in turn deliver them to the purchaser thereof, upon the. payment of the purchase price and place the funds realized from the sale in the Permanent Improvemeht Revolving Fun of said City, for disbursement for the purposes stated herein: Be. it further resolved by the said Common Council: That the Cijry Clerk of said City be and he is hereby directed to publish a notice, as required by law, of a meeting of the Common Council of said City, which is directed to be held in the Council Chambers, in the City Hall, in said City on the 18th day of January, 19379 at 7:30 o'clock P.M., for the purpose of opening and cpnsidering bids for said bonds, in the Rochester Post -Bulletin a local newspaper printed and published in said City, and the official newspaper thereof; the said advertisement for bids to carry provision that proposals for the purchase of a part of this issue will be considered; it being hereby provided that this Common Council may at its discretion divide the sale of these bonds to those which will be for the best . interests of the said City, and the said :Common Council reserves the right to reject any and all proposals; all proposals to be accompanied by a certified check drawn upon some reputable bank, payable to the City Treasurer of the said City, for at least two (2) per. cent of the principal of the purchase price proposed which said certified check shall be submitted and filed without condition except t)Lat if the bid for the said bonds is accepted the said check shall be applied to the purchase price of the said bonds, otherwise to be returned to the unsuccessful bidder or bidders, and 'that if the successful bidder refuses to pay the balance of the purchase pricetU .said certified check shall be declared forfeited to the City of Rochester, Minnesota, as liquidated damages: Done and passed by the Common Council of the City of Rochester, Minnesota, at a meeting .thereof, held on this 28th day. of December, A.D:1936. Alderman Ricb)nan introduced the following resolution, which was read: . "Be it resolved by the Common Council of the City of Rochester, Minnesota That the Public Utility Board of said City be and the said Boardis hereby authorized to submit optional rates to the Rural Electrification Administration, in accordance with the following quoted resolution request: 150' M r C 2 6 193b "Whereas, the Rural Electrification Administration at. Washington, D.C. has asked the Public'Utility Board of the City of Rochest er,Minnesota for a rate for electrical energy for Rural Co -Operatives in this and adjoining counties, and Whereas, the City Light Plant has at this time and will have during the period of the proposed contract surplus energy for sale t►0 such co-operatives, Therefore be it and it is hereby resolved by the Public Utilil"y Board of the said City that the following .two optional rates be submitted to the Rural Electrification Administration - Rat a No. _ 1 wont hlv First 50,000 KWH @ 1.75 cents per KWH Next 50,000 KWH ® 10'50 cents per KWH Next 50,000 KN6 @ 1.25 cents per KWH Excess @ 1 cent per KWH. Be it and it is hereby further resolved by the said Public Utility Board that the Hon.Common Council of the said City be and is hereby requested to authorize the submission of the above 'rates, subject to reasonable conditions as to details.' " Upon motion by Fryer second by Richman, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Amundsen introduced a resolution appropriat in g $2283.48 from Code 18 of the 4eneral Fund and ordering payment made to Code 20 of the General Fund for settlement of the difference between the 1936 sprinkling, flushing and treating costs $139949.72, and: the sprinkling ' assessments levied, October 12th919369 totaling $11,666.24, which was read. Upon motion by Amundsen second by Fryer, tbat' the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Fryer introduced a resolution appropriating $770.00 from the Street and Alley Fund and ordering payment made to the Quality ors,Inc., for one Oldsmobile 2 door sedan complete as per specifications IMM S 1020.009' .1-ess allowance on 1929 Dodge 0250.00 , balance $770.00 ,which was read. 151 IIUpon motion by Amundsen sad by Richman, that the said resolution be adopted as read, and all voting. in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Fryer introduced a resolution appropriating $213.68 from the Sewer Fund and ordering payment made to the City of Rochester, Light Department, for power furnished at the Sewage Disposal Plant $211.681, and at the Sewer Lift Station $2.009 which was read. Upon motion by Fryer second by Moody, that the said resolution be adopted as read, and all voting in favor thereof; President Liddle declared the said resolution duly passed, and adopted. Alderman Fryer introduced a resolution appropriating $297.26 from the Street and Alley Fund and ordering payment made to the General Fund, Code 311, for the 1936-1937 insurance premium distribution , which was read. Upon motion by Richman second by Amundsen, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said 11 resolution duly passed and adopted. Alderman Moody introduced a resolution appropriating $1040.00 from the Permanent Improvement Revolving Fund and.ordering payment made to the First National Bank of Rochester, Minnesota, for the December 31st,1936,maturity of P.I.jt.bond No.64 $1,000.00, and interest due December 31st,19361, on P.I.R.bonds No.64 and 65 $40 ,00 ,which was read. Upon motion by Moody second by Amundsen, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Moody introduced a resolution appropriating $4544,60 from the Park Improvement Fund and ordering payment made to the Mayo Trust Fund for payrolls for labor during the period of the weeks ending December 18th,1936 and December 24th 19361which was read. Upon motion by Lemmon second by Fryer,that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. 1 152 d :DEC 2 8 1936 Mr. James F. Coon, representing the labor unions, was before the Council and requested that the Council reconsider the matter of. contructing a trunk line sanitary sewer from Broadway Street South to the Sewer Lift in Soldier Field. On motion by Lemmaon second by Amundsen, action on the matter was postponed until 2:00 o'clock P.M. , January 4th,1937. Mr. L.K.Town was before the Council and asked that all relief clients on direct relief be furnished light and water free by the City of Rochester and also requested,that the Council reconsider the matter. of constructing the trunk line sanitary sewer by W.P.A. labor.
