FEB 1937
Minutes of an adjourned regular meeting of the Common Council of the
City of Rochester, Minnesota.; `held in the Council Chambers, in the City Rall, in
said City, on February 24th,1937.'
President Liddle .-ca;lled the meeting to order at 7:30 o'clock P.M. ,
the following members being present: Liddle, Amundsen, Fryer, Green, L emmon, Moody,
Richman. Absent: None.
IIUpon motion by Moody second by Green the minutes of the meeting of
11 February 15th, were approved:

To the Honorable Mayor and City Council
GREET IN G:
The American Legion, Benevolent and Protective Order of Elks and the
7 Veterans of Foreign Wars respectfully ask that you grant us permission
to hold our mid -summer Fiesta within the corporate limits of Rochester.
Each of our three organizations . carry an an extensive charitable and
welfare work and funds derived from the Fiesta will be used for these
purposes.
By combining these three great organizations into one large general
Committee we expect to be able to make our Fiesta an artistic and financial
success.

The Fiesta will consist of free attractions, various acts, side shows and
riding davices. In order to obtain the best in such attractions we have
contacted the United Shows, one of the largest and finest travelling organi-
zations on the road'•to-day: ' ' These are the same shows frequently exhibiting
at the Minnesota State Fair and other large annual events. We are well
satisfied with their references,as to cleanliness and merit.
We prefer holding our Fiesta in town where activities can be centralized and
where we, and local merchants, may realize benefit of the crowds we expect to
bring into Rochester. '

Upon motion by Lemon second by Fryer the request referred to in
the foregoing communication was referred to the Mayor, City Attorney, a
Committee of the Common Council to be named by.the President, and a
. ii . representative from each of the different organizations.
President Liddle. accordingly appointed the following committee
from the Common Council: Amundsen, Chairman of the License Committee;
Lemmon, Chairman of the Finance Committee; Green, Chairman of the Street
and Alley Committee; Fryer, Chairman of the Public Grounds Committee, and"
Arleigh C. Smith, City Engineer.
The report of the Clerk of the Municipal Court for the week
ending February 15th, showing criminal fines and costs collected $59.59,
.
Civil Fees received $229"80, and conciliation court fees received $4.00,
was read, and President Liddle referred the same to the City Attorney.
Copy of requisition by the Health Officer upon Saint Mary's
Hospital, for the isolation of. Mrs. Leland Hostetler, residing at 419
Tenth Street Northwest and diagnosed to be suffering f2om scarlet fever,
was read, and President Liddle ordered that the same be placed on file.
An application signed by Walter C. Heins asking for a permit to
conduct public dances at the Woodman Hall on -February 27th and March 6th,
was read.
An application signed by Henry Foley asking for permit to c onduct
public dances at the A:O.U.W.Hall on January 30th, February 6th, and Rebru-
ary 13th, was read.
An application signed by Homer Strangeway for a drivers license was
read, and upon motion by Richman second by Amundsen, license was granted.
An application signed by Roy Lundblad,. Manager of the Piggly
Wiggly Store, asking for permit to place and maintain a sign at 204 Fourth
Street Southwest, was read, and on motion by Moody .second by Richman,
permit was granted.
An application signed by Ernest Maass, Jr. for the Maass & MdAndrev
Co., Inc., for a license to connect with sewers and drains in the City of
Rochester, was read, and upon motion,by Lemmon second by Moody, license
was grant ed:

The surety bond of Maass & McAndrew Company covering their license to
connect with sewers and drains in the City of Rochester, with the National Surety

Corporation as surety in the sum of $19000.00 was read, and on motion by Lemmon
second by Moody, said bond was accepted, the surety thereon approved and it was

ordered that the same be placed on Pile.
An application signed by Claude Bogart, Manager of the Yellow Cab

Company ray asking for a transfer of taxicab license No.3 from a 7 passenger Cadillac,
bearing State license No.B216 904, to a 7 passenger LaSalle bearing State License

No.465179 was read, and on motion by Moody second by Amundsen, transfer was granted.
The following notice of claim against the City of Rochester, was read,

Gentlemen:

Please take notice of the claim arising from the fAct s hereinafter
set forth:
That on the 15th day of February 1937.that portion of the street known
` as Fourth Street Southeast which runs east from South Broadway was in a
particularly unusual icy condition; that ,at nine o'clock in the morning of said

day such a condition continued to exist; that at about that time the undersigned

claimant was - op er at ing his 1936 one and a half ton truck 'in a westerly direc-
tion on to said intersection of Fourth Street Southeast and Broadway; and that

at that time and place a truck operated under the firm name and style of the
Hoover Transfer Compa.rq Nays stopped ,at the stop sign •orr said Intersect -ion;
that your claimant approached said intersection at about eight miles per hour
and when about thirty-five feet eact of said intersection applied his brakes;

that because of the condition of the street his par continued to slide result-
ing in a collision with the Hoover truck; that his truck was damaged in the
sum of about, fifty and N0/100 (50.00)- Dollars.
That the condition of the street was particularly dangerous and that such
situation was allowed to exist by the employees of the City pf Rochester,

in failing to care for -the same -this collisionYresulted and the damage to the

was. properly sanded to 'remedy the situation. This notice is given in accordance
with Section 1831 of. Mason's 1927 Minnesota Statutes.

The following copy of resolution passed and adopted by the
Sinking Fund Commission of the City of Rochester, was read, and upon motion
i by Moody second by Amundsen, the said action was approved:
"be it resolved by the Commissioners of the Sinking Fund of the
City of Rochester, Minnesota:
That the sum of $420.00 ire and the said sum is hereby appro-
priated from the Interest Fund and ordered paid to the First National -
Bank of Rochester, Minnesota, for the March lst,19Vq maturity of interest
on Repaving Bonds No.B to 359inclusive."

That W.A.Moore and Julius J.Reiter are hereby declared to be candidate
fnr Mayor of the City of Rochester, at the Charter Election to be held March 9t h,193 ;
That B. Amundsen and W.E..Knutson are declared to be candidates for
Alderman of the First Ward of the City of Rochester at the Charter Election to be
held March 9t h,1937;

candidates for Aldermad of the ' Second Ward' of 'the. City of Rochester at the

for Alderman of the Third Ward of the City of Rochester at the Charter
Election to be held March 9th,1937.
The City Clerk of said City is hereby instructed to cause the
names of the said persons to be printed as candidates for the said
3zespective offices upon the official ballots at the coming Charter

Upon motion by Moody. second by Fryer that the said resolution be
adopted as read, and all voting in favor thereof, President Liddle declared
the said resolution duly passed and adopted.
Alderman Richman introduced a resolution granting public dance
permit to W.C.Heins for the Woodman Hall on February 27th91937, and
March 6th91037, and -fixing the fee at $6.00, which was read.
Upon motion by Amundsen second by Richman, that the said resolu-
tion be adopted as read, and all voting in favor thereof, President Liddle
declared the said resolution duly passed and adopted.
Alderman. Moody introduced a resolution granting public dance permit
to Henry Foley for the I.O.U.W.Rall, for January 30th, February 6th, and
February 13th, and fixing; the
fee at
$9.00, which
was read.
Upon motion by Fryer

the said resolution be.
adopted as read, and all voting in favor thereof, President Liddle declared
the said resolution duly passed and adopted.
Alderman Richman introduced the following resolution, which was

That the Honorable E.J.Pearlove, State Comptroller of the State
of Iinnesota, be and he is hereby requested to make an examination of the
books and records of the City of Rochester, Minnesota, for and Burin ~ the
period April lst,1936 to March 31,1937, and
Be it further resolved by the said Common Council:
That the City Clerk of said.CIty i s hereby dig ected t o furnish
the said Comptroller with a certified copy of this resolution and make
respectful request that this examination be made.

Alderman Amundsen introfteed a resolution appropriating 240,99 from
the F.E.William' s Estate Fund and ordering payment made to Simon St ensrud, for

share in the rentals from the Williams Estate business building, less supervision,

Alderman Fryer introduced a resolution appropriating $450.91 from the
General Fund and ordering payment made to the City Farm Fund for transfer of money
received from insurance companies for fire loss at the City Farm, which was read.
Upon motion by Moody second by Richman that the said resolution be

adopted as read, and all voting in favor thereof, President Liddle declared the said

Upon motion by Green second by Richman the City Clerk was instructed to

notify all department heads to furnish inventories of supplies and eauipment within

sale liquor licensee
issued by your local

expire on April 5, 1937.
In order that each licensee can continue in business for the
ensuing year, the requirements as outlined in part I. paragraph
A9BjC of the new instruction sheet must be properly executed
and the off sale papers sent to this department thirty days
before the renewal date.
The instruction sheet referred to in the preceding paragraph
gives you detailed information as to t:l:e requirements for a new
application, renewal, transfer of an off sale license or change
in location, and the procedure for an applicant not renewing
license at the expiration date, and the procedure where an off
sale license is cancelled before the expiration date.
The necessary off sale papers are being sent under separate cover.
Your cooperation in furnishing the off sale papers, properly
executed, will be greatly appreciated:

Upon motion by Lemmon second -by Richman, Manfred Fi..Waldron, City
Milk Inspector was authorized to attend a Committee hearing before the
Minnesota Legislature regarding pending legislation affecting the pasteurize
tion of milk.
11 Upon motion by Fryer second by Amundsen the sum of $5.00 was
appropriated from the General Fund, Code 18, and ordered paid to J.WFeller
Postmaster, for postage for use of the City Attorney.
The Mayor and Rity Clerk were authorized and directed to draw a
Warrant upon the General fund for $50*00 for postage for the City Attorney.
Alderman Amundsen requested that an ordinance amending an ordin-
ance establishing fire limits, introduced by him and given its first reading
January 25th91937, and its second reading February lst91937, be withdrawn,
in order that C. E. Ginther, 'Chief of the Fire Department may have more
time to check the lines as set forth in said ordinance*
and all voting in favor thereof,
Upon motion by Lemtmon second by Greens/said request was granted, al
and no further action to be taken on said ordinance.
Upon motion by Moody second by Richman, the Common Council
adj ourn ed.
