on March 22nd,1937.
President Liddle called the meeting to order at 7: W o'clock P.11. , the
following members being present= Liddle, Amundsen, Wryer, Green, Lemmon, Moody,
Richman. Absent: Nonel
The call for the special meeting was read and President Liddle ordered
Fr' that the same be placed on file; said meeting having been called for the purpose of
considering license fees for non intoxicating malt liquors.
President Liddle requested the City Attorney Eckholdt to explain the
provisions of the draft of the new proposed ordinance, and Mr. Eckholdt stated that
the only change would be the fee for on sale licenses was being raised to $70.00 on
the premises where dancing was not allowed, and $145.00 on premises wit1b. dancing.
Mr. M.J.Myrow, President of the Malt Beverage Dealers Association, in
speaking for the Association, stated that- he was sure the license fees as above
stated would be agreeable to the Association.
Alderman Amundsen introduced an ordinance entitled, "An ordinance
regulating the license and sale of non -intoxicating malt liquors, prohibitinE; the sale
thereof at retail except in licbnsed Premises and to any person under the age of twent
one years of age, rand repealing, all ordinances or parts of ordinaances
..inconsistent herewith. " which was given its first reading.
Mr. aul Grassle.representing the Liquor Dealers in the City of
Rochester, was before the Council and asked that. the Council consider the change in
the ordinance permitting licuor'dealers to handle 3.2% beer.
An application signed by Philip Sternberg asking for a transfer of

non -intoxicating malt liquor licenses No. 170/from No.301 North Broadway to 16 Third
Street Southwest , was read.
Philip Sternberg was present and stated that he had been unable to
(locate his licensesand asked that duplicate licensesbe granted.
Upon motion by Lemmon second by Fryer transfer was granted, and the
City Clerk was authorized to issue duplicatef Non-into-�cating malt liquor license

A summon complaint and a District Court order in the case of
Geo. B. Tauer against the City of Rochester, Alvin Behike, and Irving L.
Eckholdt, were presented, by the City Attorney Irving L.Eckholdt, and
President Liddl a ordered that the same be placed on file.
Mr. James T. Spillane, representing Geo. B. Mauer, was before
the Council and explained the above mentioned summons and complaint.
The report of the Clerk of the Municipal Court for the week
ending March 15th, showing caiminal fines and costs collected �'81.20 ,

A report of the Rochester Bus Line, Inc., was reed and President Liddle
ordered that the same be placed on fife.
A communication from the Workers Alliance of Rochester, rei=U,uesting the C
" Common Council to inc3nase the wages on the City stone crushing job from 40 cents per
hour to 60 cents pEr hour, and that the City pay the difference between the W.P.A.

` scale of 40 cents per hour and the City scale of 60 cents per hour, was read, and
President Liddle ordered that the same be placed on file.
The following emergency order was read and President Liddle ordered

Dear Mr, Glabe:
It having been made to appear that there is. an immediate
necessity for the purchase by the City of Rochester of approximately 6000
gallons of gasoline to place in the tank at the bulk station owned and
op erat %1 by the City, from which gasoline is issued to the City Departments,
and that the delay occasioned, by the advertisement for bids would cause
great damage to the public interest, I hereby declare the existence of an
emergency in said matter and order, authorize and empower you as City Clerk
in charge of the purchase of gasoline for said purpose, .to go into the open
market and purchase approximately 6000 gallons of gasoline at a cost to the
City of Rochester of approximately $800.00
You are hereby notified that this emergency order is given
to you under and in accordance with the provision's of, Section 284 of the
C ,.art er of the City of Rochester, Minnesota.

Assignment of wages by Chester R. Fellows, to the First National Bank
of Rochester, was read, and on motion by Green, second by Moody, said assignment was
accepted.

The City Engineer's list.of sheets, avenues and alleys to be
sprinkled or treated with other dust preventives during the season of
1937, and estimate of cost was presented, said estimate of cost being
$149045.95, and President Li.ddle ordered that the same be placed on file.
An application signed by Henry Foley for a permit to conduct a
Public dance in the A.O,II,.W.Hall, March 20th, was read.
An application signed by 0. S. Cummens for an electrician's license
was read, and on motion by Moody decond by Fryer, license was granted.
The following claims were read, and on motion by Lemmon second by
Il Moody, and all voting in favor thereof, the same were allowed and the
Mayor and City Clerk were authorized and directed to draw warrants upon the

Alderman Lemmon introduced the following resolution,which was read;
"Be it resolved by the Common Council. of the City of. Rochester,

That the Board of Park Commissioners be and the said Board is hereby
authorized and directed to enter into a contract with the Botsford Lumber Company,
in accordance with the following quoted request:

91,084.60 and in accordance with plans and specifications as prepared by Hugh Vince
Feehsn.

Upon motion by Richman second by Fryer that the said resolution be
adopted as read, and all voting in favor thereof, President Liddle declared the said
resolution duly passed and adopted.
Alderman MO' ody introduced a resolution designating streets, avenues
and alleys to be sprinkled or treated with other dust preventives during the season
of the year 1937, and ordering hearing on the same to be held at 2:00 o'clock P.M. ,
April.5th,19379 which was read.

Upon motion by Moody second by Richman, that the said resolution
be adopted as read, and all voting in favor thereof, President Liddle
declared the said resolution duly passed and adopted.
Alderman Lemmon introduced a resolution' directing the City Clerk
to advertise for bids for official printing and publishing during the year
1937-19389which was read.
Upon motion by Lemmon second by Moody,that the said resolution be
adopted as read, and all voting' in favor thereof , President Liddle declared
the said resolution duly passed and adopted.

Alderman Moody introduced a resolution directing; the City Clerk to
advertise for proposals for being designated as City Depositories, which
was read.
Upon motion by Moody second by Green,that the said resolution be
adopted as read, and all voting in favor thereof, President Liddle ,declared
the said resolution duly passed and :adopted.
Alderman Richman introduced a resolution granting public dance

permit to Henry Foley, for the A.O.U.W.Hall, March 20ttr,1937, and fixing
he fee at $3.00,which was read.
Upon motion by Green second by Pryer,that the said resolution) be
adopted as read, and all voting in favor thereof,Presidett Liddle declared
the said resolution duly passed and adopted:
Alderman Green introduced a resolution appropriating $263.80,
from the Park Improvement Fund and ordering payment made to the Botsford
Lumber Company for lumber furnished for tables, etc., for Park Departmrent,
P253.80 thereof for improvement of parks equipment, and $10.00 for maint-
ce of skating rink, which was read.
Upon motion by Fryer second by Richman,that the said resolution
e adopted as read, and all voting in favor thereof; President Liddle
eclared the said resolution duly passed and adopted.
Alderman Fryer introduced a resolution appropriating $493.15 from
he Park Improvement Fund and ordering payment made to the Mayo Trust Fund
'or payrolls for labor during the period of the weeks ending March 12th and
9th919379which was read.

Upon motion by Fryer second by Amundsen, the rules were suspended and
the said ordinance was given its second reading.
Alderman Fryer introduced an ordinance entitled,"An ordinance establis:
ing and creating a Board of Public 'Weleare for the City of Rochester, setting forth
the number of the board, the method of appointment and its powers and duties." whic
was given its first reading.
A proposed plat of land lying south of Second Street Southwest and

adjacert to the west city limits, for annexation to the City of Rochester, was
presented, and President Liddle referred the same to the Street and Alley Committee,
and the City Attorney.
The following communication was read:

Dear Sir:
We acknowledge receipt of your letter of March 12 requesting information
as to your application for an additional grant. We wrote you on this subject on
March 13, which letter you no doubt have received by now.
Upon receipt of your application for an additional grant and your
request for an extension of time for the commencement of work, we addressed a
letter to the Assistant Administrator on January 29 requesting an extension of
time Although we have received administrative action on the application for
an additional grant, we have not received a reply to our request for approval of
a time textnsion. In the event that the City should decide to proceed with the
construction of the project, either by furnishing all the funds necessary without
any increase in the grant allotment or by revising the plants and readvertising for
bids, it would be necessary to secure PWA administrative approval of an ext en-
sion of time, since, in accordance with the terms of the Government's Offer of Gra
the City was required to commence work not later than January 11,1937, which date
subsequently was extended to February 11,1937.

We suggest that it would be desirable for the City. Counc3.1 to
make a ;prompt decision in this natter and if it is the Council's desire
to construct the project, -we will again, contact our Washington office
requesting approval of the time bxt ensign.

The matter of.. a new site for the construction of a City
Warehouse was brought up and President Liddle referred the matter to
the Mayor, the Street and Alley Committee, the City Attorney and the
City Engineer.
On motion by Fryer second by Richman, the City Clerk was author-
ized and instructed to return the certified check to G.Schwartz 8, Company,
which accompanied their proposal under date of January 25, 1937, for the
construction of a city warehouse.
On motion by Anundsen second by Fryer, •C:E.Ginther, Fire Chief,
s authorized to purchase a used car for use of the "ire Department.
A summons and complaint in the case of Schuster Realty Company,
against the City of Rochester, et. al, was presented by the City Attorney,
and President Liddl a ordered that the same be placed on file.
The off sale liquor licensesgranted by the Common Council under
date of March lst-, have been approved Iv the Liquor Control Commissioner
and returned to the City Clerk, the City Clerk was instructed to deposit
the checks which accompanied the applications and deliver the licenses to
the said applicants.
Upon motion by Moody second by Richman, the Common Council
adjourned.
