Rochester, Minnesota, held in the Council Chambers, in the City Hall, in said City on March 29th91937. ` President Liddle called.the meeting.to order at 7:30 o'clock P.M., the 1 following members being present: Liddle, Fryer, Green, Lemmon, Moody, Richman. Absent: Amundsen. Upon motion by Richman second by Gree3b the minutes of the meetings of March loth and 22nd, were each approved. Harold Stewart and Lester Goetting, representing the Jr. Chamber of . II Commerce, were before the Common Council and requested financial assistance in 2. J =- putting on dances at the Aamor on April 2nd and 3rd for the benefit of the Olmsted P S y County 4H Clubs. 4 Upon motion by Moody second by Green, the sum of $70.00 was appro- i?(F R a } priated from Code 3 of the Band Fund and ordered paid to the Junior Chamber of rf Commerce to help defray the expense of dances at the Armory on April 2nd and 3rd, r` for the benefit of the Olmsted County 4H Clubs. The report of the Clerk of the Municipal Court for the week ending `s= March 22nd, whowing criminal fines and costs collected $316.80, civil fees received $19.25, and conciliation court fees received $2.50, and for the week ending March 29th showing criminal fines collected $185.509 civil fees received $17.359 and conciliation court fees received $1.509 were each read, and President Liddle referred the same to the City Attorney. Alderman Amundsen came in at this time and took his Chair. A communication from Peter S. Mackey, Secretary of the Rochester Fire Department Relief Association, requesting the approval of the Common Council f , of a loan t o Elmer Lee on a home t o be construct ed on Lot 16,Block 1, Johnson' s Addition, was read and President Liddle referred the same to the Finance Committee. A communication from H. J: Kruse, representing the Kruse Company, ' regarding water in the basement of their factory building, alledged to have been caused by the Park Department, in changing water levels and soil conditions at Silver Lakq, was read, and President Liddle referred the some to the Park Board and City Engineer: 234 The financiWk st at ern mt of the Rochester Fire Department Relief Association for the year ending December 31st,1936, was read and President Liddle ordered that the same be placed on file. An application signed by Sue Allen representing the Allen Finance Company asking for a license to ' operat e a finance company am the city of Rochester for the year beginning April lst,19379 was read, and upon motion by Amundsen second by Moody,, license was granted. An application signed by R.C.Emerson, representing the Rochester Credit Company, asking for a license to operate a finance company in the city of Rochester for the year beginning !April lst919379 was read, and upon motion by Green second by Richman, license was granted. Applications signed by Claude L.Bogart, Manager for the Yellow Cab Company asking for 13 taxicab licenses were each read, and on motion by Moody second by Amundsen, licenses were granted. Applications. signed by J.C.Adams, representing the Town Taxi Cab Company, for 6 taxicatbolieenses were each read and on motion by Richman second by Fryer, licenses were granted. Upon motion by Fryer second by Moody licenses were granted to t he Rochester Bus Line,Inc., to use and operate 7 motrDr cars for carrying passengers for hire. The following specifications for road oil, and estimate of cost was read, and ordered placed on file: " March 29,1937 41 ,s [. �� Han. Snith City Engineer:" 13b. 235 MAk _� :i 1937 Alderman Fryer introduced the following resolution,whieh was read: ` "WHEREAS, It is deemed expedient and necessary that the city of Rochester, Minnesota, purchase two cars. (109000 gallons. capacity each) of 50-60 road oil to be applied is a dust preventive on various streets and avenues of said City during the 1937 sprinkling season; said oil to meet the required _ Minnesota State Highway Department specifications, and WHEREAS, The City Engineer has submitted an est imat a of cost for the furnishing of said road oils viz: $1320000 or 6.6 cents per gallon applied; SO THEREFORE, Be it resolved by the Common Council of the City. of Rochester, Minnesota: That two cars (10,000 gallons capacity each) of 50-60 road oil be purchased for use on the streets and avenues of the said City; said oil to meet the required Minnesota State Highway Department specifications, and Be it further resolved by the said Common Council; That the City Clerk of said City be and he is hereby authorized and directed to advertise for sealed bids for the furnishing apd application of the - said road oil, said bids to be received and opened at a meeting of this Common Council which is to be held at 7:30 o'clock P.M., on April 12th,1937." Upon motion by Amundsen second by Green that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the sai resolution duly passed and adopted. Mr. L.K.Town, representing the Workers Alliance, was before the I1Council and requested that the Council pay the difference of 20 cents between the city scale and the W.P.A. scale at the City W.P.A. rock quarrying and crushing Project. After some discussion: Alderman Green moved that said request be not I , granted. The motion was seconded by Alderman Richman and all voting in favor thereof. President Liddle announced this as being the time fixed for dissolving the tie vote between Frdd Goetting and Roy Nordby, for Justice of Peace for the First Ward, and between Donald Briese -and John Beatty, for Constable of the Third Ward. �j The following communication was read, and ordered placed on file: " March 15,1937 Mr. Amiel ,Glabe, City Clerk Rochester, Minn. Dear Mr. Blabe: � 236 In reference to yours of March 12th, I wish to j concede the vote that I received in the Nharter Election for the office ,of Justice of Peace of the First Ward of the City i j of Rochester, Minn. in the favor of Mr.Fred Goetting, on the grounds that I am now in the employ of the School Board of said 1I City. I� Yours truly, Roy H. Nordby " In casting lots to dissolve the tie for Justice of the Peace of I j' Third Ward, the selection fell to Fred Goetting, and to dissolve the I tie for Constable of the Third Ward, the selection fell to Don.Briese, and on motion by Green second by Richman, Fred Goetting was declared elected Ii !I Justice of the Peace for the First Ward, and Don Briese, was declared i! j elected Constable for the Third Ward. I I� Alderman Fryer introduced a resolution appropriating $409.94 from I Code 1 of the Bridge Fund and ordering; payment made to Code 2 of the i, Bridge for transfer of funds to take up overdraft and to close out said Code 2, also transferring the uncollected tax beslance in Code 2 of the Bridge Fund to Code 1 of the Bridge Fund, which was read. II - On motion by Green second by Richman, that the said resolution jbe adopted as read, and all voting in favor thereof, President Liddle I declared the said resolution d,.ly passed and adopted. Alderman Fryer introduced a resolution ai.propriating $990.00 from I' ,Iii the General Fund and ordering payment made to the ]lighting Fund, ffor taking up overdrafts in the Lighting Fund, $90.00 thereof to Code 5 of the �I i Lighting. Fund $100.00 to Code 6 and $800.00 to Code 7, which was read. 1 i Upon motion by Fryer second by Moody that the said resolution be �I adopted as read, and all voting in favor thereof, President Liddle declar- ed the said resolution duly passed and adopted. Alderman Green introduced a resolution appropriating 012305.50 from the 11 Band Fund and ordering payment made to the General Fund, for return of temporary i; transfers, which was read. i Upon motion .I by Fryer second by Richman that the said resolution be i' 1; adopted as read, and all voting in favor thereof, President Liddle declared the said ; resolution. duly passed and adopted. Alderman Green introduced a resolution appropriating $376.88 from the General Fund and ordering payment made to the City Farm for transfer of funds received in the November91936, and March,1937, tax settlements for garbage collection assessments received, which was read. Upon motion by Hichman second by Green that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said j resolution duly passed and adopted. Alderman Amundsen introduced a resolution appropriating 257.85 from the General Fund and ordering payment made to the City of Rochester Steam -Heating Departmeht, for steam heat furnished at the City Fall in accordance with the March 25th11937,billing $Which was read. Upon motion by Amundsen second by Green, that the said resolution be adox:ted as read, and all voting in favor thereof, 'resident Liddle declared the said resolution duly passed and adopted. Alderman Richman introduced a resolution appropriating a'4 95.00 from the Fire.Protedtion .Fund, and orderinga ' payment melds t-o the Joy Brothers Motor 'Car Company' for used Packard 7:-1odel 900 .Sedan, for use of the Fire Department, whi-ch was read. Upon motion by Richman second by Amundsen that the said resolution be adopted as read, and, all voting. in favor thereof, President-Liddle declared the said resolution duly passed and adopted. Alderman Moody introduced a resolution appropriating $346 85 from the Park Improvement Fund and ordering payment made to the *Mayo Trust Fund, for payrolls I ' for labor during the period of the week ending March 26th,1937,which was read. h ;i y 238 M;�,,i N `l 1937 Upon motion by Moody second by Lemmon, that. the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. The application signed by Lester Goetting, Chairman of the Entertainment Committee of the Junior Chamber of Commerce, for a permit to conduce public dances in the Armory on April 2na and 3rd, was read. Alderman Lemmon introduced a resolution granting public dance Permit to the Rochester Junior Chamber of Commerce for the Armory on April 2nd and 3*d,1937,Vhd fixing the fee• at 06.001which was read. Upon motion by Lemmon second by Moody,that they said resolution be adopted as read, and all voting in favor ,thereof, President Liddle declared the said resolution duly passed ,and adopted. The following claims were read; and upon motion by Lemmon second by Richman, and all voting in favor thereof, the same were allowed, and the Mayor and City Clerk were authorized and directed to- draw warrants upon the City Treasurer and make payments. accordingly: From the General Fund: Clarence J. Upon motion by Green second by Moody, the City Clerk was instructed to Write to the Commissioner of Highways of the State of Minnesota, for a contract agreement between the State of Minnesota Bind the City of Rochester for the . repaving of Broadway. Upon motion by Lemmon second by Moody, the Street and Alley Committee and the City Engineer were instructed to make a survey of the necessary street widening projects and make a written report of their Findings to tV.e Common Council Alderman Fryer requested that a proposed ordinance regulating the lie sing and sale of non -intoxicating malt liquor,which was introduced and given its first reading on March 22nd,1937, be brought up for consideration at this time. On motion by Fryer second by Amundsen and all voting in favor thereof, the rules were suspended and the said ordinance was given its second r ead ing. On motion by Green second by Fryer and all voting in favor thereof, the rules .were suspended and the said ordinance was given its third and final I I , K r ead inz. Upon motion by Green second by Richman that the said ordinance be adopted as read, and Amundsen, Fryer, Green, Moody, and Richman, voting "Aye", and Lemmon voting "Nay", President Liddle declared the said ordinance duly passed and adopted. Alderman Amundsen introduced the following ordinance,which was given "111, 11 its first reading: "A1T ORDINANCE REPEALING AN ORDINANCE ENTITLED "AN ORDINANCE RECIGATIWG THE LICENSE AND SATE On NON -INTOXICATING MAN LIQUORS, PROHIBITING THE SALE TTTP EOF AT RETAIL EXCEPT IN LICENSED PREMISES AND TO ANY PERSON UNDER THE .AGE OF TWENTY- ONE YEARS OP AGE, AND REPEALING .ALL ORDINANCES OR PARTS OP ORDINANCES INCONSISTENT HEVZE,'dITHI (THE SAME BEING- ORDINANCE N0. 455, AMD THE SRAE HAVING BEEN A.tiENDED BY ORDINANCE NO.459). The Common. Council of the City of Rochester do ordain: 240 IJSI Section 1. That an Ordinance entitled "An Ordinance regulating the license and sale of non -intoxicating malt liquors, prohibiting the sale thereof at retail except in licensed premises and to any person .Iunder the age of twenty-one years of age, and repealing all ordinances „ or parts of ordinances inconsistent herewith", (the same being Ordinance No.455 and the same hewing been amended by Ordinance No.46a9) , and the amendment thereof, be and the same i s hereby repealed in its entirety.
