President Liddle called the meeting to order at 7:30 o' clgck P.M., the i following members being present: Liddle, Amundsen, Fryer, Green, Lemmohq Moody, l Richman: Absent: None. i ; I, Upon motion by Moody second by Richman, the minutes of the meetings of June 7th and June loth, were approved. President Liddle stated this as being the time fixed for a hearing on ji the placing of bituminous treatment on First Street Northwest from Eleventh Avenue i Northwest to Twelfth Avenue Northwest, and asked if any one present wished to be heard concerning the said improvement.. No one present wished to be heard concerning i the same: President Liddle announced this as being the time fixed for a hearing on 'i the placing of bituminous treatment on First Street Northwest from Twelfth Avenue i Northwest to Thirteenth Avenue Northwest, and asked if any one present wished to be heard concerning the said improvement: No one present wished to be heard concerning i the same. President Liddle announced this as being the time fixed for a hearing on the placing of bituminous treatment on Ninth Street Southwest from Eighth Avenue Southwest to Ninth Avenue Southwest, and on Ninth Avenue Southwest, from Ninth Street S&uthwest to Tenth Street Southwest, and asked if any one present wished to be heard concerning the said improvement: No one present wished to be heexd concerning the ji same. f President Liddle stated this as being the time set for the adjourned hearing for sprinkling additional streets for the remainder of the 1937 season, and i 330 asked if any one present wished to be heard concerning the skid street sprinkling. A petition signed by Perry A. Beach, et• al, was presented by John L. Willis, requesting that Ninth Avenue Southeast from Sixth Street Southeast. to Tenth Street Southeast be sprinkled. President Liddle stated this as being the time set for receiving and opening bids for the furnishing of bituminous taaterial. ;i bids were opened at this time: " Cutback asphalt Bidder applied. J.W. Dunn Co. .0769 The Barrett Co: The following T-x applied. $ .1194 .1169 President Liddl e referred the above bids to the Street and Alley Committee and the City Engineer for recommendation, -- Mr. Paul Grassle presented a petition signed by on sale liquor dealers requesting the previlege to sell 302% beer. On motion by Green second by .Amundsen the petition was ordered placed on file and the City Attorney instructed to draft an ordinance granting the privilege to on sale liquor dealers to sell 3.2% beer. Mr. A.A.Hirman, Chairman of the Street and traffic Committee of the Rochester Chamber of Commerce, was before the Council and presented a communication from the Street & Traffic Committee of the Chamber of Commerce requesting the Common Council to adopt ordinanced as follows: 1. An ordinance prohibiting the dse of sound trucks; 2. An ordinance prohibiting the distri bation of hand bills in or upon automobiles in the business district; 3.. An ordinance prohibiting the parking of gasoline trucks in the business district; 44. An ordinance limiting the length of trucks permitted to park in diagonal parking lanes, to 22 feet. 331 11 Upon motion by Pryer second by Amundsen, the matter was referred to the I Chief of Police, Chief of the Fire Department and the City Attorney: A petition signed by Daisy L. Plummer, et. a11., was presented by N. W,. i Buenger, requesting permission to grade, install curb and gutter, and place bituminous material on Tenth Street Southwest from Ninth Avenue Southwest to the west city limits' at the expense of the abutting property owners, said improvements to be made under the supervision of the City Engineer. Upon motion by Lemmon second by Richman, said request was granted. George J. Allen was before the Council regarding annexation to the City of Rochester, of a part of Westlawn Addition, and asked that the ordinance be amended allowing said property to be annbxed without donating any portion thereof to i the City of Rochester for public use. Upon motion by L emmon seond by Amundsen, the matter was referred to the Public Grounds Committee and the City Attorney. The Street and Alley Committee and the City Engineer presented a written; report recommending that the proposal of the Barrett Company for furnishing tar, be , accepted, and President Liddle ordered that the said report be placed on file. i' i Alderman Richman introduced the following resolution,which was read: I , "Be it resolved by the Common Council of the City of Rochester, Minnesota: t Thct the bid and pro osa,l of The Barrett Coma for the furnishin of three or more cars of approximately 8000 gallons each of cutback asphalt M.C.3, or Tar No.49 applied, according to Minnesota highway Department specifications, viz: 24,000 gallons, more or less, Tarvia "B" in accordance with state of Minnesota Hi�_,hway Department specifications, delivered and applied to the streets of the City of Rochester at a price of $.1169 per gallon; be and the said bid and proposal is hereby accepted: The amount of the surety bond to be given by the said contractor is hereby fixed at the sum of $2900.00 . " Upon motion by Richman second by Fryer, that the said resolution be be adopted as read, and all voting in favor thereof'', President Liddle declared the said resolution duly passed and adopted. 2 27 —1(—— i I• Upon motion by Amundsen sec (md by Fryer, all other bids were rejected, and the City Clerk authorized to .return the checks which accom- i panied the rejected - bids. The report of the Clerk of the Municipal Court, for the week ending June 7th, showing rEt'mihiDal.fines and costs collected $366.60, ci#il fees received 013.45, conciliation court fees received $1.75; for the is week ending June 14th,1937, showing criminal fines and costs collected is $491 00, civil fees received $7.95, conciliation court fees received $2.25) i and for the week ending June 21st, showing driminal fines and costs collec- ted $317.809 civil fees received $16:40, and conciliation court fees received $5975, were each read, and having been approved by the City Attorney, President Liddle ordered that the same be placed on file. The report of the City Farm, for the month of May, showing cash on hand May 1st $1741.79, receipts in the amount of $1873.86 9 and disbursements for the month $2,081.11, and a balance on hand May 31st $15340549 and pigs i and hogs on hand May 31st , 2779 was read, and President Liddle referred the y I� same to the Finance Committee: I The report of Geo. F. Strifert, Sanitary Inspector, was read, and President Liddle ordered that the same be placed on file. Appointments as special policemen of John C. Hagen for duty at the Armory during t-,,.e week of June 20th, and of Geo. Laack , for duty in all parks, and to hold office until the second Monday in ipri1,1938, and to serve without pay, were read, and President Liddle ordered that the same be Placed on file. An emergency order given by W.A.Moore, Mayor, authorizing the City Clerk to go into the open market and purchase approximately 6000 gallons gasoline for distribution to the various City departments was read, and ordered placed on file. i; 4 0 J 333 Eva McCabe, representing the American Brotherhood for the Blind, was ; before the Council and presented a request for permission to hold a flower sale on the streets of. Rochester, on either June 26th, July 3rd, or July loth. Action on the request was deferred until the next meeting of the Common Rouncil. Dr. D. C. Lochead, Deputy Health Officer, presented a communication from T. B. Magath, Health Officer, regarding clinics and treatments for venereal diseases. i On motion by L emmon second by Amundsen the City Clerk was instructed to prepareda resolution to be presented at the next council meeting, appropriating ! i i $350.00 for the use of the Public Health and Welfare Board to carry on clinics and ' treatments for venereal diseaseso Applications -for non —intoxicating malt liquor licenses , signed by C. F. Thompson at 609 North Broadway, and Catherine Boxrude, at 613 Seventh Street Northwest, were each separately read, and on motion by Amundsen - second by Richman licenses were granted. An application signed by Homer Gillespie, for license to' operate a one chair barber shop, at 2121 south Broadway, was read, and on motion by Amundsen second by R lhhman , l i e en s e was gr anted A petition signed by Martin Paulson for a license to connect with sewers I and drains within the City of Rochester, together with a surety bond in the sum of �1,0000-001 with the Fidelity & Casualty Company of New York as surety thereon, were each separately read, and on motion by Moody sec .:nd by Amundsen, license was granted; . i the bond approved, the surety thereon accepted, and it was ordered that the bond be i placed on file: Applications signed by Stanley Hall, for a permit to use an additional truck to buy and collect junk within the City of Rochester, was read, and on motion by Richman second by Fryer, said request was granted. An application by James HubFbard, for a drivers license was read, and on motion by Richman second by Fryer, license was granted. 334 The application o.�' Don E. Po;3tier, for an electrician's license li together with a surety bond in the sum of $11000.00 with the Fidelity & Casualty Company of New York as surety, were each separately read, and on motion by Moody second by Amundsen, license was granted, subject however to the approval of the City Attorney and Building, Electrical. and Plumbing Inspector, the bond was approved, the surety thereon accepted, and it was ordered that the bond be placed on file. Trainor, were each sepa- rately read, and on motion by Amundsen, second by Richman, licenses were grant a d. Upon motion by Richman second by Fryer, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Amundsen introduced a resolution ordering plans, profiles and specifications ,for the bituminous treatment of First Street Northwest from Eleventh Avenue Northwest to Twelfth Avenue Northwest,.which was read. Upon motion by Green second by Moody that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Moody introduced a resolution ordering Aland, profiles,.and specifications for the bituminous treatment of Ninth Street Southwest from Eighth Ivenue Southwest to Ninth Avenue Southwest, and on Ninth Avenue Southwest from N int h Street Southwest to Tenth Street Southwest, which was read. Upon motion by Green second by Fryer, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Richman introduced the following resolution, which was read: "WIIFRFAS, The following claims, Mrs. WaW:Smith, Community room rental $3.00'; Rochester Morning Journal, republication costs t7.50; Claude A.Johnson, Community room rental $600; Civic League, labor and repairs to the Witherstine property $5.20 ; U. S.Post Office, balance due for use of sewer steamer $:50; and A.F.Salisbury, bdlance due for use of sewer steamer $1.00; are due the City of Rochester, and having been investigated the Common Council is of the opinion that the accounts cannot be collected. - NOW TIDE• EFORE, Be it resolved by the Common Council of the City of Rochester, Minnesota: That the foregoing accounts be and the same are hereby charged off, and i the City Clerk of said City is authorized to make the necessary entries on his I books to properly charge off said accounts." j Upon motion by Lemmon second by Moody, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Richman introduced a resolution designating streets and avenue to be sprinkled during the balance of the 1937 season, which was read. 338 Upon motion by Moody second by L on that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Richman introduced the following resolution,which was read "Be it resolved by the Common Council of the City of Rochester, Minnesota: That' the following is a tabulated list and statement of the votes cast for and against the issuance of City of Rochester, Minnesota, bonds, in the aggregate amount of $451,000.00 for the purpose of furnishing and equipping the new Library Building, at the special election held in said City on June 15Vh, 1937s as determined by the said Common Council on their canvass of the returns of the said, special election made on the 21st day of June, 19379 and that said statement is hereby declared to show the result of the said special election; the said tabulated statement being: - First Ward Second Ward Third Ward District No. District No. District No. 1 2 3 4 5 1 2 3 4 5 1 2 3 4 5 6 Tott6l. Fund Bond No.65 $20-00,which was read. Alderman Fryer introduced a resolution appropriating $565*04 from the Sewer Fund and ordering payment made to the City of Rochester, Light and Water Departments, for power and water furnished the Sewage Disposal Plant $562.94, and power furnished at the sewer lift station $2.10, which I. was read. i, Upon motion by Richman second by Amundsen, that the said resolu- tion be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. W:AdMoore, Mayor requested that the City Clerk• be instructed to thank the Citizens Mediation Board for their recent services rendered: On motion by Moody second by Green, the City Clerk was instructed to prepare the necessary resolution to proceed with the levying of assessments for making sewer and water connections against property abuttmng on Broadway Street from the south line of the Chicago and Northwestern Railway Company tracks to Sixth Street Southwest and Southeast: Upon motion by Lemmon second by Fryer, the Street and Alley Committee were instructed to make the necessary sewer and water connections for all city property fronting on Broadway Street. Upon motion by Lemmon second by Amundsen the Sewer Committee, the City Engineer and the Building, Inspector, were instructed to prepare plans, and specifica— tions fora garage at the Sewage Disposal Plant. Alderman Fryer requested that a proposed ordinance providing for the licensing and regulation of card, board, box, table, stand, cabinate or similar device used in games ofamusement where a charge is made for the use t)aereof, and prescribing penalty for the violation thereof, which was given its first reading on May 3rd,1937, and second reading on June 7th,1937, be brought up for consideration;. Upon motion by Lemmon tocadopt said ordinance as read, second by Amundsen, and upon roll call Aldermen Amundsen, f7reen, Lemmon, and Richman voting "Aye", and Aldermen Fryer and Moody.. voting "No", whereupon H President Liddle declared the said ordinance duly passed and adopted. Alderman Fryer staled that Kris Nielsen, had expressed his desire to purchase a portion of the property belonging to the City of Rochester, near - the Sewage Disposal plant and on motion by Lemmon second by Amundsen, the matter was referred to the Public Grounds Committee, and Aldermen_ Green and Fryer. On' motion by Lemmon second by Amundsen, the Mayor and City Clerk were instructed to express to Senator WM.B.Richardson and - Representative George B. Cutting, the Council's approval of a bill which had been recently introduced in the Minnesota Legislature, authorizing the annexation of territory to the Cites of the second class.
