President Liddle called the meeting to order at 2:00 o'clock P:M. , the following members being present: .Liddle, Amundsen, Fryer, Green, Moody, Richman. Absent: L emmon. ' Upon motion by:Moody second by Amundsen, the minutes of the meeting of September 2'30t h, were approved. ' President Liddle stated this as being the time set for a hearing on the construction of a sanitary •sewer in Eleventh Street Southwest, from Sixth Avenue Southwest to a -point 400 feet southwest, and asked if any one present wished to be heard concerning the said improvement. There was no one present who wished to be heard concerning the said improvement . The report of the Clerk of the Municipal Court , for the wee' ending; I I September ti7th,19371 showing criminal fines and costs collected $460.801 civil fees received $7.35, and conciliation court fees received O'7.00, was read, and having been previously approved by the City Attorney, President Liddle ordered that the same be placed on file: The report of the City Weighma,ster for the month of September, showing ._. 153 private loads weighed 'and receipts in the amount of 415.30 was read, .and ,y ,e President Liddle referred the same to the Finance Committee. •"rim r�R The report of the Building, Electrical and Plumbing Inspector for the 00 permits month of September showing building permits issued a121. , electrical p issued $28:25, and plumbing permits $52.25, was read, and President Liddle referred `'` '` 11 the same to the Finance .Committee. ' Copies of requisitions by the Health Officer upon Saint Mary' s Hospit for the isolation of Doris Doty diagnosed to be suffering from bacillary dysentery of Ralph Miller diagnosed to be suffering from tuberculosis, were each read, and _-`.n 11 President Liddle ordered that the. same be placed on file. An emergency order signed by W:A•_Moore, Mayor, authorizing the City Clerk to go into the open market and purchase approximately 8000 gallons of gasolin for distribution to the various city departments was read, and President Liddle ordered that the same be placed on file. 436 A communication signed by Geo. H. Parker, City Weighmaster, requesting a ten day vacation commencing October llth, was read, and upon I' motion by Green second by Fryer, said request was granted. The report of the City Engineer for the month. of September showing disbursements for labor from the General Fund $883:71, from the Street and Alley Fund $1756.33, sewer fund $540.99, from the Bridge Fund $19.14, and from the Permanent Improvement Revolving Fund $60.96, was read, and President Liddle ordered that the same be placed on file. A c omuni cat ion signed by Robert, C. Ranfranz , tendering his resignation as a member of the Rochester Fire Department Civil Service Commission, effective October 15th,19379 was reed, and on motion by Green second by Richman, said resignation was accepted, and ordered placed on file. Applications signed by Claude Bogart, Manager of the Yellow Cab Company for taxicab licenses, covering a 5 passenger LaSalle sedan bearing state license No.B-631 076, a 5 passenger LaSalle sedan bearing state license No.B-106 300, and a 5 passenger LaSalle sedan bearing state license No.B-4 725, were each separately read, and on motion by L. Amundsen, second by Moody, licenses were granted. An application sign'ed by Allen E. Farnham, for 'a permit to place cna maintain a sign at 101 South Broadway, was read, and on motion by Richman second by Fryer, permit was granted: An application signed by Carl Peterson, for'a license to operate a roller skating rink in the second story of the Co-operative store building located at Broadway Street South and Fourth Street Southeast, was read, and President Liddle referred the same to the License Committee of the Common Council and the Chief of Police. An application signed by Jack F.Schwartz, for a junk dealers license was read, and on motign.by Moody second by Green said application was referred to the License Committee of the Common Council. 437. ! CT Alderman Lemmon, came in at this time and took his seat. An ordinance entitled,"An. ordinance regulating peddlers, solicitors, canfasers, hawkers, itinerant merchants- and transient vendors and merchants" i introduced and given its first reading on August 2nd, 1937, its second reading 1 t931 on September 7th919379 was given its third and final reading. President Liddl.e asked if any one present wished to be' heard concerning said proposed ordinance. Reveral persons were present and spoke in favor of and against the adoption of said proposed ordinance. On motion by Amundsen second by Moody, to adopt said ordinance as read, and upon roll call Aldermen Amundsen, Lemmon, Moody and Liddle voting Aye, end Aldermen Fryer, Green and Richman, voting Nay,whereupon President Liddle declared the said ordinance duly passed and adopted: An ordinance establishing an automobile testing station requiring motor vehicles to be tested, fixing a fee for making tests, and providing a penalty for the violation thereof, introduced and given its first reading on August 2nd, 1937, its second reading on September 7th,1937, was given its third and final reading. Upon motion by Fryer second by Richman to adopt said ordinance as read, and upon roll call all voting in favor thereof',, President Liddle declared the said ordinance duly passed and adopted. An ordinance prohibiting the sale or discharge of fire works or fire crackers, in the City of Rochester, Minnesota, introduced and given its first reading on August 2nd919379 its second reading on September 7th,19379 was given its third and final reading. Upon motion by Lemmon second by Amundsen to adopt said ordinance as read, and upon roll call Amundsen, Lemmon and Moody voting Aye, and Liddle Fryer Green and Richman voting Nay, whereupon President Liddle declared the said proposed ordinance' not adopted. An ordinance entitled, "An ordinance amending an ordinance regulating the sale of intoxicating liquor within the City of Rochester, providing for such I� sales by duly licensed persons, establishing regulations for the operation of place where such intoxicating liquor is sold, providing regulations for the granting of I� OCR- - 193 such licenses, setting license fees, providing penaltie, for the violation thereof, and .repealing all inconsistent ordinances, This is an emergency ordinance rendered necessary for the preservation of the public peace, .heath and safety." introduced and given. its first reading August 2nd, 1937, its second reading September 7th,1937, was Given its third and final reading. Upon motion by Green second by Amundsen, to adopt said ordinance as read, and on roll call all voting in favor thereof, President Liddle declared the said ordinance duly passed and adopted. - An ordinance prohibiting the use and operation of loud speakers and amplifiers of any kind, prohibiting the use and operation_ on motor propelled vehicles with muffler` cutout open, and prohibiting the unnecessary sounding of horns on motor vehicles while using the streets or alleys of the City of Rochester, Minnesota, was given its second reading, An ordinance prohibiting the placing on or in any motor vehicle in the City of Rochester, except with the consent of the owner, or person in charge of said vehicle of any card, plackard, hand bill, pamphlet, - booklet, manuscript, or any, advertising matter of any kind or description, was given its second reading-,-, Alderman Green introduced an ordinance entitled, "An ordinance prohibiting, except in cases of extreme mergency, the use of the public streets or alleys in the City of Rochester for the purpose of delivering goods, warts, or merchandise to customers between the -hours of 12:00 o'clock midnight and 5:00 o'clock in the forenoon an any and: all days during the months of December, January, February and March, of each year, and between the hours of 12:00 o'clock midnight and 4:00 o' clocm in the forenoon on any and all days during the months of April, May,. June, .July, Au gust , Sept emb er October, and November, of each year, was given its first reading. C. E. Ginther Chief of the Fire Department submitted specifica- tions and estimate of cost for 700 feet of fire hose for. use of the Rochester Fire Department vfhich were read,and President Liddle. ordered that the same be placed on file. 4_29 A communication from CO C: Ludwig, Executive Secretary of the League of •�S Minnesota Municipalities, :inviting the City of Rochester to be host city for the Regional meeting of the League of Minnesota Municipalities to he held on December ..'; 15th,1937, and on motion by Lemmon second by Fryer, the Mayor and City Clerk were K R instructed to accept said invitation and assure the League that a suitable githerin place will be provided. Comunicat ions signed by Edward Je Costello, Edward Dillon and Elmer Lee calling attention to`theIr suspension b C.E.Ginther Fire Chief, for a ten g y • day period commencing September 13th,1937, and which resulted in a reduction of $48.30 for each of said salaries for the month of September, and which they feel :- was unwarranted, were read, and on motion by Amundsen second by Fryer the City Clerk was instructed to notify said parties that the Common Council feel they have no juriddiction in the matter. A communication from W.P.A.Offices concerning projects No.4157 and 4240 in the City` of Rochester was .read, and President Liddle referrAd-the -same to: -.the Mayor and the City Clerk:. A request from Arleigh COS mith, City Engineer, for an appropriation of $2,000.00 from the Sewer Fund, for use of the Street and Alley Committee, was . read, and President Liddle ordered that the same be placed on file. A petition signed by Albert Crown, et. al., for the construction of a sanitary sewer in Fourteenth Avenue Northeast, from Fourth Street Northeast to Fifth Street Northeast, was read, and on motion by Lennon second by Amundsen said petition was referred to the Sewer Committee and the City Engineer. A committee report signed by the Street and Alley Committee and the City Engineer recommending .that the east and west alley and the north and south alley in Block 16 Head and McMahon's Addition be paired, was read, and President ,t ') Liddle ordered that the same, be placed on file: Arleigh C.Smith, City Engineer, submitted an estimate of cost in the sum of $2900,00 for connecting the sanitary sewer to the Broadway trunk line sewer on the south. half of Lot 10,Block 22,0riginal Plat,, and an est ��nate of 4�p3 0.00 for connecting the sanitary sewer to the Broadway trunk line sewer and new water tonne fwAy tion on the west 100 feet of the north 23 feet of the south 68 feet of Block 825 OCT - 1 t337 Moe and Olds Addition, was read, and on motion by Lemmon second by Richman said estimate was ordered placed on file, and the City Engineer was instructed to proceed to make the proper connections. The Common Council canvassed the returns of the special election held September 26th,1937. Alderman Richman introduced the following resolution,which was read: "Be it resolved by the Common Council of the City of Rochester, Minnesota: ' That the following is a tabulated statement of the number of votes cast at the Special Election held in the several. election districts in the City of Rochester, on September 23th,1937, in favor of and against the adoption of the propoBed amend ment s to the Charter of the City of R ochest FT as determined by the said Common Council on the canvass of the returns of the said election made on the 4th day of October, 1937, and said statement is hereby declared to show the result of the said election as follows: t o-wit : First Ward . Be it further resolved by the said Common Council: ` That the number of persons present and voting at said Special Election } held September 28th919379 was 1805, of which 647 voted in favor of the adoption _:. of the proposed Amendment No.2, . amending Section 164 of said Charter, and 1094 voted against the adoption of said amendment as shown by the returns of said election as above set . forth; IIBe it further resolved by the said Common Council: That the whole number, of persons present and voting at said special election was 1305 and that it required 1083 votes or 60 percent of all those who _ voted at said special election to, ratify said amendment and that there were not more than 60 percent of the total' number of votes in favor of the adoption and ratification of said proposed amendment No.2, and that said amendment did not receive the necessary 3/5 of the total votes and therefore was not ratified and t adopted by the voters at the said special election and is not made a part of the Charter of : said City of Rochester.. " Upon motion by Fryer second by Moody that the said resolution be adopted as read, and all voting in favor thereof, President Liddl e declared the said resolu- 11 tion duly passed and adopted. II Alderman Richman introduced a resolution adopting the specifications and estimate of cost for the furnishing of 700 feet of fire hose for use of the Fire Department, deeming it expedient/and necessary that said hose be purphased, and instructing the City Clerk to advertise for bids for the furnishing of said fire hose in•accordance with said specifications, said sealed bids to be received and opened at a meeting of the Common Council to be held at 7:30 of clock P.M. , on October 18th,19375 which was read. Upon motion by Amundsen second by Dryer that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed ;and adopted. Alderman Moody introduced a resolution ordering hearing on the levying o special assessments for the placing of bituminous treatment on Tenth Street Southwe from Seventh Avenue Southwest to Ninth Avenue Southwest, said hearing to be held at 7:30 o'clock P.M., on October 18th,19379which was read. r .442 1937 Upon motion by Green second by Fryer, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Amundsen introduced a resolution authorizing the Public Utility Board to enter into a contract with the Olmsted County Rural Electrification project and with the Goodhue County Rural Electrification project for the sale to them of electrical energy in accordance with the terms of the proposed contracts as approved by the City Rtt orney, and in accordance with the resolution request of'the Public Utility Board, which was read. Upon motion by Fryer second by Amundsen, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Amundsen introduced a resolution ordering hearing on the paving of the alley in Block 16 Read & McMahon's Addition, said hearing to be held at 7:30 o'clock P.M., on October 18th919370which vas read: Upon motion by Amundsen second by Richman that the said resolu- tion be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Green introduced a resolution ordering a hearing for 7:30 o' clock P.M., on October 18th,1937, on the levying of special assess - ments for the placing of bituminous treatment on Sixth Avenue Southwest from Ninth Street Southwest to Eleventh Street Southwest, which was read.. Upon motion by Lemmon second by Richman,that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Fryer introduced a resolution levying special assessments for the bituminous treatment of Ninth Avenue Southwest from Ninth Street to Tenth Street and on Ninth Street Southwest from Eighth Avenue to Ninth Avenue Southwest, which was read: Upon motion by Moody second by Lennon that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. 443. :Alf - .; 1037 Alderman Fryer .introduced a resolution ordering plans for a sanitary s in Eleventh Street Southwest from Sixth Avenue Southwest to a point 400 feet south- west, which was read: Upon motion by Richman second by Moody that the said resolution be adopte as read, and all voting in favor thereof; President Liddle declared the said resolu tion duly passed and 'adopted. Alderman Amundsen introduced a resolution appropriating y$2,000.00 from the Sewer Fund for use of the Street and Alley Committee, which was read. Upon motion by Green second by Fryer that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted: Olderman Amundsen introduced a resolution appropriating $390 61 from the Generaal Fund and ordering payment made to the City Farm Fund for transfer of funds on hand from tax settlements for garbage service assessments, which was read. Upon motion by Lemon second by Green that the said resolution be adopt as read, and all voting in favor thereof, President Liddle ,declared the said resolution duly passed and adopted. Alderman Amundsen introduced a resolution appropriating $546.84 from th Permanent Improvement Revolving Fund and ordering payment made to Harry Earle for 558 lin. feet of cur7g and gutter at 0.98 per ft- , constructed under contract and under Job 1898, on Sixth Avenue Southwest from Center Street to Second Street Southwest I ,,,hich was read. Alderman Lemmon introduced a resolution approppiating $315.41 from the Street and Alley Fund and $18. 48 from the Sewer Fund for payment to the Botsford Lumber Company for drain the and sewer pipe, etc., which was read. Upon motionby Fryer second by Amundsen,that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Green introduced a resolution appropriating $260050 from the Sewer Fund and $54 00 from the Street and Alley Fund for payment to the Owatonna Implement Mfg. Co., for complete intakes and special manhole covers, which was read. Upon motion by Green second by Fryer that .the said resolution be adopted ad read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted., Alderman Green introduced a resolution appropriating $430.19 from the Permanent Improvement Revolving Fund and $727.70 from the Street and Alley Fund and ordering payment made to the Barrett Company for &ne tank car of tarvi.a, which was read. Alderman Fryer introduced a resolution appropriating 8351.87 from the General F;,,nd and ordering payment made to the City of Rochester , Water .Department, for water furnished for sprinkling and flushing in accordance with billings of August 25th and September 25th,1937,which was read. Upon motion by Moody second by Lemmon that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared µ�. the said resolution duly passed and adopted. OCT Alderman Fryer introduced a resolution appropriating $541.60 from the Permanent Improvement Revolving Fund and ordering payment made to the Street and Alley Fund for 2410 gal: tarvia used on Job 1902, and 2223 gal. tarvia used on Job 1903, which was read. Upon motion by Richman second by Moody, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Moody .introduced a resolution appropriating$337.19 from the Street and Alley Fund and ordering payment made to the Permanent Improvement Revolving Fund for 2884.4 gal. tarvia, charged to Job 1899 instead of Job M Of which was read. Alderman Moody introduced a resolution appropriating $1754.92 from the IIPark Improvement Fund and ordering payment made to the Mayo Trust Fund for payrolls for labor during the half month ending September 30th919379which was read. Upon motion by Fryer, second by Amundsen,that the said resolution be .adopted as read, and all voting in favor thereof, President Liddle declared the sai resolution duly passed and adopted: Alderman Moody introduced a resolution appropriating $373.50 from the IIF.E.Williams Estate Fund and ordering payment made to J.T. Collin, for premium on insurance policies 60677 and 2083 and 175933, which was read. I� Upon motion by Green second by Fryer, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted: Alderman Richman introduced a resolution appropriating 608.41 from the Sewer Fund andordering payment made to C. F. Walde for estimate No.1 on contract for c&nstruction of a garage at the Sewage Disposal Plant,which was read. Upon motion by Moody second by Lezmon that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Richman introduced a resolution appropriating $6,253.28 from the Permanent Improvement Revolving Fund and ordering payment made to L.M.Feller, for estimate No.1 on contract' for the widening of First Street Southwest from Broadway to Sixth Avenue Southwest, under Job 1895, which was read. Upon motion by Richman second by'Moody that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Richman introduced a resolution appropriating $669.50 jfrom the Sewer Fund and ordering payment made to the City of Rochester Light and Water Departments for electricity and water furnished at the Sewage Disposal Plant and southeast sewage lift station, in accordance with the September 15th91937,billings,which was read. Upon motion by Amundsen second by Richman that the said resolu- tion be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted: Alderman Richman introduced a resolution appropriating $276.31 from the Fire Protection Fund and ordering payment made to the Gamewell i Company for 3 plain sector boxes, and 1 broken model meter, for use of the Fire Department, which was read.
