r Minutes of .an adjourned regular meeting of the. ,Common Council of the
City of Rochester, Minnesota, held in the Council Chambers, in the City Hall, in
a '
-said City on October 18th91937.
President Liddle dalled the meeting to order at 7: 30 oclock P.M. , the
following members being present: Liddle, Amundsen, Fryer, Green, Lemmon, Moody,
Richman. Absent: None.
Upon motion by Fryer second by Richman, the minutes of the meeting of
October 4th919371 were approved: '
President Biddle stated this as being the time set for hearings for th
the levying of special assessments for bituminous paving on Tenth Street Southwest
from Seventh Aveme Southwest to Ninth Avenue Southwest, and on Sixth Avenue South-
west from Ninth Street Southwest to Eleventh Street Southwest, and asked if any
one present wished to be heard concerning the said assessments. There was no one
present who wished to be heard.
President Liddle stated this as being the time set for hearing on the
paving of the alleys in Block 16, Head and McMahon's Addition, and asked if any one
present wished to be heard: There was no one present who wished to be heard concer
ing the said alley paving.

sprinkling assessments for 1937, and asked if any one present wished to be heard

President Liddle referred the above bids to C.E.Ginther Chief of
the Fire Department for recommendation:
Mr. R. D. Manahan, representing Wm. H. Friedell was before the
Council regarding the provisions in the• Zoning Ordinance requiring a certaA ,
area for appartment houses. After considerable discussion it was deemed
advisable that this matter be brought to the att ent ion of the Zoning
Board.
Mr. Earl Boutelle was before the Council regarding the opening of
Fourteenth Avenue Northeast, from Center Street north, and President
Liddle referred the matter t c, the Street, and Alley Committee and the
City Engineer.
The matter of the outlet of the storm sewer. at Sixth Avenue
Southwest and Eleventh Street Southwest was brought up and President
Liddle referred the same to the Sewer Committee and the City Engineer:

The report of the ' C1 erk of the Muhi cipal Court for the week ending
October 4th showing criminal fines and costs collected345.80, civil fees received
$12:65, conciliation court fees 06000; and check frcm Olmsted County $88.20; for th
week ending October llth, showing criminal fines and costs collected $102.70, civil
fees received $110,559 and conciliation court fees received $6.00, and for the week
ending October 18th, showing civil fees received 2155, and conciliation court fee
$3.50, were each read, and having been previously approved by the City Attorney,
' President Liddle ordered that the same be placed on file.
Communications from W: A Moore, Mayor, announcing the appointments of
0: J. Anderson, John Ploof and #ert Niel; as Special Patrolmen in the Police Depart
ment from September 30th to October 13th, were read, and President Liddle ordered
that the same be placed on file.
An emergency order signed by W.A.Moore, Mayor, find-biethe provisions of
II Chapter 284 of the Charter of said City, authorizing the Police Department to pur—
chase one 1937 four door sedan for the sum of $755.00, with an allowance of $455.00
(� for one 1934 four door sedan, leaving a balance due of $300 00, was read, and

The following communication from, the Board of Park Commissioners, was
read, and President Liddle ordered that the same be placed on file:

City of Rochester, Minnesota
Gentlemen:
The Works Progress Administration have set up a project
covering improvements surrounding the Silver Lake Dam and approaches to
the North Broadway bridge., This project will require about $10,00040
in labor which will be furnished by the WPA, .$900 00 in materials to be
furnished by the State Executive Council and $900400 additional for
materials and truck rentals which it will,be necessary for the sponsor
to contribute. ,
It has been requested that the Board of Park Commissioners
sponsor this project and provide the $900400 that is necessary: The
Board of Perk Commissioners wish to place this proposal before your
Honorable Body and if you come to the decision that the City of Rochester
should sponsor a work relief program which will call for -the expenditure
• of approximately $109900:00 of federal and state funds, this Board will be
willing to assume the responsibility of the sponsor if the $900.00 necessary

is made available from some other source rather than the Park
Improvement Fund: This is necessary because the present
budget will provide only for necessary expenditures for the
remainder of the fiscal year:

Upon motion by Lemmon second by Amundsen, the proper officials
were instructed to notify the .WPA offices that the necessary funds will
be made available in order to -carry out .the above project.
A communication from Dr. D. C. Lochead, Deputy Health Officer
requesting an appropriation of $10.00 for smallpox faccine, was read, and
on motion by Lemmon second by Green, the sum of $10.00 was appropriated to
•
the Bi&Taogi cal Fund of the State Department of Health, in payment of 200
tubes of smallpox vaccine.
The City Engineer submitted plans and est imat a of cost for the
construction of a sanitary sewer on Eleventh Street Southwest from Sixth
Avenue Southwest to a point 400 feet southwest, said estimate of cost
being $675.00.
The following communication was read, and President Liddle
ordered that the same be placed on file:

Gentlemen: -
It is the intention of the owners of the property to
be known as Belmont Slope to formally petition annexation to the
City of Rochester in the near future: It is also their intention
• to install this fall sanitary sewer -and water lines in the streets
of Belmont Slope. - These lines are not to be connected to the : City
sewer and water systems until such time as the property may be
annexed to the city. The installation of these lines to be paid
for by the owners of the property.
The Mayo Properties Association (owners of the property)
respectfully requests the cooperation of the city by reviewing the
design and inspecting the installation of .the sewer and water lines,
so that they may be installed to meet the requirements of the city
for city sewer and water lines.

A surety bond in the sum of $1,000.00 of Joe Guiese, with the Hartford
Accident and Indemnity Company as surety, covering junk dealers license was read,
and on motion by Lemmon second by Amundsen, the bond was approved, the surety therein
accepted, and it was ordered that the same be placed on file:

Upon motion by Green second by Fryer the application of Carl
- 11 Peterson for a license to operate a roller skating rink in the second
story of the Cooperative store building was approved, the license granted
and a fee .:.'axed at the sum of $5.00 per month.

recommending that a sanitary sewer be constructed in Fourteenth Avenue
Northeast, from Fourth Street Northeast to°Fifth Street Northeast, was rear

Alderman Amundsen introduced an ordinance repealing ordinance No.483
regulating the opening and ;closing hours of barber shops within the corporate
limits of the City of Rochester, which was given its first reading.
Upon motion by Lemmon second by Fryer and all present voting in favor
thereof, the rules were suspended and the said ordinance was given its second
reading:
Upon motion by Moody second by Richman-. and all present voting in
favor thereof, the rules were suspended and the said ordinance was given its third
and final reading.
Upon motion by Amundsen second by Fryer, to adopt the said ordinance
as read, and all voting ice. favor thereof, President Liddle declared the said
ordinance duly passed and adopted.
Alderman Amundsen introduced anresdlut•ton ordering hearing to be held
at 2:00 o'clock P.M., -on November lst,1937, on the c mstruct ion of a sanitary sewer
in Fourteenth Avenue Northeast from Fourth Street Northeast to Fifth Street North-
east, which was read.
Upon motion. by Amundsen second by Moody that the said resolution be
adopted as read, and all voting in favor thereof, President Liddle declared the sai
resolution duly passed and adopted.
Alderman Amundsen introduced a resolution confirming the sprinkling
assessments as levied October 4th,19379 which was read.

Alderman Fryer introduced a resolution adopting the plans, etc..,
for the construction of a sanitary sewer in Eleventh Street Southwest
from Sixth Avenuc Southwest to a point 400 feet southwest, ordering a
hearing on the same for 2:00 o'clock P.M., on November lst91937, and
ordering advertisement for bids to be received and opened at 2:00 o' clock
P.M. , on November 1st ,1937, which was read.
Upon motion by Lemmon second by Moody, that the said resolution
be adopted as read, and all voting in favor thereof,President Liddle
declared the said resolution duly passed and adopted.
Alderman Fryer introduced a resolution levying special assessments
for scavenger service during 1937,, which was read.
Upon motion by Moody second by Richman,that the said aesolution
be adopted as read, and all voting in favor thereof, President Liddle

for bituminous treatment on Sixth Avenue Southwest from Ninth Street.

Alderman Green introduced a resolution appropaiating $282.13 from the
Street and Alley Fund and ordering payment made to the Permanent Improvement

Alderman Green introduced a resolution appropriating $2990'26 from the
Permanent Improvement Revolving Fund and ordering payment made to Wm.C:Fraser & Son
for labor; and materials for eonstruct:1on of sewer connection on Broadway Street
' trunk line sanitary sewer for property of Miss Burns, described as the north half
of Lot 11, Block 33, Original Plat, which was read.
Upon motion by Amundsen second by Fryer,that the said resolution be

Alderman Amundsen introduced a resolution appropriating $676.64 from
Code 28 of the General Fund and o rdering payment made to the Phillips Petroleum
Company for 8114 gallons gasoline furnished in car GATX 257299 which was read.
Upon motion by, Amundsen second by Fryer, that the said resolution be
adopted as read, and all voting in favor thereof, President Liddle declared the
said resolution duly passed and adopted.
Alderman Richman introduced a resolution appropriating $17770-60 from
the Park Improvement Fund and ordering payment made to the Mayo Trust Fund,fen pay-
�� rolls for labor during the half month ending October 15th,19379which was read.
Upon motion by Fryer second by Breen that the said resolution be
adopted as read, and all voting , in favor thereof, President Liddle declared the
said resolution duly passed and adopted,:
Alderman Richman introduced Ubrefiolution appropriating $454:83 from the
Street and Alley Fund and $1407.25 from the General Fund and ordering payment made t
11 the said funds respectively, for use of equipment during 1937,which was read.
Upon motion by Green second by Richman that the said resolution be
adopted as read, and all voting in favor thereof, President Liddle declared the said
resolution duly passed and adopted.
Alderman Lemmon introduced a resolution appropriating $11,000900 from
Code 18 of the General Fund and ordering payment made to Code 1 of the General Fund
as a permanent transfer, which was read.
Upon motion by Doody second by Richman that the said resolution be
adopted as read, and all voting in favor thereof, President Liddle declared the said
resolution duly passed .and adopted.
Alderman Richman introduced a resolution appropriating $368:44 from the
Fire Protection Fund and ordering payment made to the Gamewell Company for 3 plain
sector boxes and 1 8" slate shelf lower panel and kick plate and brackets complete
for 6 ckt. switchboard, which wss read. ,

Alderman Amundsen introduced a resolution appropriating $125.00
i from the General Fund and order inip payment made to the Park Improvement
Fund, for reimbursement of��C1 rk as Stpecial Patrolman during
Oc7tober,19379which was read:
Upon motion by Fryer second by Moody that the said resolution be
adopted as read, and all voting in favor thereof, President Liddle
declared the said resolution duly passed and adopted.
C. E. Ginther Chief of the Fire Department submitted the follow-
ing recommendation regarding the purchase of fire hose and on motion by
Green second by Richman the said report was accepted and ordered placed
on file:
"October 18 ,1937
To Mayor and Common Council,
Gentlemen:
Believing it to be for the best interest of the City
that new specifications be drain and a readvertisement for bids be made
at a later date.
I recommend that all bids be rejected and checks returned.

Upon motion by Green second by Richman all bids for furnishing fire
hose were rejected and the City Clerk was authorized to return the
certified checks which accompanied said'proposals.
The following claims were ready and upon motion by Moody second
by Richman, and all voting in favor thereof, the same were allowed and the
Mayor and City Clerk were authorized and directed to draw warrants upon
the City Treasurer and make payments accordingly:
