HomeMy WebLinkAbout11-01-1937Nov Minutes of a reguletMeeting of the Common Council of the City of Rochesterg Minnesota, held..In the Council Chambersq in the City Hall in said City, on November lst,1937: President Liddle called the meeting to order at 2:00 o'clock P.M.. the following members being present: Liddle, Amundsen, Fryer, Green, Lemmon, Moody, 11 Richman., Absent: None. Upon motion by Amundsen second by Fryer the minutes of the meetings of October 16th, 25th, and 26th, were approved: President Liddle stated this as being the time set' for hearings for the construction of sanitary sewers in Fourteenth Avenue Northeast from Fourth Street Northeast to Fifth Street Northeast, and in Eleventh Street Southwest, from Sixth Avenue Southwest to a point 400 feet Southwest, and+ asked if any one present wished to be heard concerning either of said improvements. No one present wished to be heard concerning the. said improvement s II President Liddle stated this as being the time set for hearings on the levying of special assessments for the construction of curb and gutter on Sixth Avenue Southwest from First Street Southwest to Second Street Southwest, and in Fourth Avenue Southwest from Center Street West to Second Street Southwest; also for the widening of the pavement on First Street Southwest from Broadway to Sixth Avenue Southwest and on First Street NortYmvest from Broadway to Fourth Avenue Northwest, and asked if any one present wished to be heard concerning the levying of the assessments on either of the said. jobs. No one present wished to be heard concerning -the levying of said assessments. 4 }. President Liddle stated this as being the time set *for receiving and opening proposals for the construction of a sanitary sewer in Eleventh Street F Southwest fr cm Sixth Avenue :.Southwest to a point 400 feet Southwest. The following proposals were received and opened at this times Martin Paulson $640.00, V1m. C. i Fraser & Son y 665:50, H. Dornack Plumbing Heating Company $921:00. President Liddle referred the above bids to the Sewer Committee and the City Engineer for recommendation. The Sewer Committee and the City Engineer orally reported that the Petition for a sanitary sewer on Ninth Street Northeast from Eleventh AteaBis North- east to Thirteenth Avenue Northeast, on Twelfth Avenue Northeast from Ninth Street 470 Northeast to Tenth Street Northeast, and on Thirteenth Avenue Northeast from Ninth Street Northeast to Tenth Street Northeast, did not have the signatures of a majority of the property owners, and oh motion by Lemmon petition second by Fryer, the City Clerk was authorized to return the to the petitioners for the purpose of securingadditional signatures. ' An application signed by C. G-: Simonson for the Singer Sewing. Machine Company, for permit to place and maintain a sign at 317 South Broadway, was read, and on motion by Amundsen second by Richman, permit was granted: The report of the Clerk of the Municipal Court for the week ending October 25th, showing criminal fines and costs collected 'p165.40, civil fees received $12.40, conciliation court fees received 03075, was read, and having been heretofore approved by the City Attorney, President Liddle ordered that the same be placed on file. The report of the City Engineer for the month of October, showing disbursements for labor from the General Fund $298 69, from the Street and. Alley Fund2,353:23, from the Sewer Fund595:56, and from the Bride Fund 9426'32, was read, and President Liddle ordered that the same be Placed on file. An application si gn ed by Wesley Sloan for a drivers license was read, and on motion by Lemmon second by Amundsen, license was granted An application signed.by AS.Bourassa and Fred Lund asking for transfer of Off Sale non —intoxicating malt liquor license No267, issued to A.S.Bourassa, at 718 Fifth Street Southwest, to Fred Lund at the same address was read, and on motion by Green second by Richman, transfer was granted: IIA notteeo f claim in the sum of $1900000 signed by George A.Fentm I for injuries alleged to have been caused by defective sidewalk at 107 . Fifth Street Southwest, was read, and President Liddle referred the same to the City Attorney: A communication from James %B Spillane, representing the Senitary Company, Woodhouse Brothers, Rochester Electric Company and G."-Schwartz & Company, demanding settlement for contracts on the new library building, was read, and President Liddle, referred the same to the Library Board. 471 NOV , A request from the City Engineer for an appropriation of $51000.00 from the Street and Alley Fund for, use of the Street and Alley Committee was read, and President Liddle_ ordered that the same be placed on file. Applications signed by C:RDelaney, and Jerome Reichart, asking for transfer of On Sale liquor license No:53 issued to C:R Delaney at 124 South Broadway, to be transferred to Jerome Reichart at the same address, were each read, and on motion by Moody second by Fryer, transfer was granted subject however to the filing of a satisfactory surety bond and certificates showing; no delinquent light and water billsa An ordinance prohibiting, except in case of extreme emergency, the use �f public streets or alleys in the City of Rochester, Minnesota for the purpose of delivering goods wares or merchandise, to others, between the hours of twelve o'clock midnight and five o'clock in the forenoon on any and all days during the months of December, January, ,February and March each year, and between the hours o twelve o'clock midnight and four o'clock .in the forenoon on any and all days durin the months of April, May, June, July, August, September, October and Rovember each year, introduced and given its first reading on October 4th,19379 was given its second reading. s On motion by Green second by Amundsen, and upon roll call all members voting in favor, the rules were suspended and the said ordinance was given its third and final reading. j On motion by Amundsen second by Fryer, to adopt said ordinance as read �I and upon roll call all members voting in favor thereof, President Liddle declared said ordinance daly passed and adopted. An ordinance prohibiting the placing on or in any motor vehicle within the City of Rochester, Minnesota, except with the consent o.f the owner of person in charge of said vehicle, of any card, plackard, hand bill, pamphlet, booklet, manuscript, or any advertising matter of any kind or description, which was introduced and given its first reading on September 7th91937, its second reading on October 4t h,1937, was given its third and final reading. Upon motion by Fryer second by Green to not adopt said ordinance as read, and upon roll call all members present voting in favor thereof, President Liddle declared the said ordinance not adopteda 472 NOV 1 1937 Upon motion by Lemmon second by Fryer, the matter of the disposition of advertising matter upon the streets was referred to the City Attorney for -further consideration*, An ordinance prohibiting t4e.use and operation of loud speakers and amplifiers of any kind, prohibiting the use and operation of motor propelled vehicles with the muffler cutout open, and prohibiting all unnecessary sounding of horns on motor vehicles while using the streets or alleys of the City of Rochester, Minnesota, introduced and given its first reading September 7th,1937, its second reading on October 4th,1937, was given its third and final reading. On motion by Moody second by Amundsen to adopt said ordinance as IIread, and upon roll call, Amundsen, Fryer, Moody and Liddle voting "Aye", I; and Green, Lemmon and Richman voting "No", whereupon President Liddle declared the said ordinance duly passed and adopted. A petition signed by Mrs. Folke Peterson, et . al. , regarding the continuous noise that is being made by dogs owned by. C-eorge Parbes, was . read, and on motion by Lemmon second by Richman, the matter was. referred to the City Attorney and the Chief of Police: Mr. Kris Nielson, submitted a proposal in the sum of $500000 for the purchase of the north half of that part of Outlot 5 Northern Addition, r , which lies west of the river, and President Liddle referred the same to the Public Grounds Committee, the City Attorney, and' the City Engineer. Alderman Moody introduced a resolution ordering hearing on the evying of special " assessments for paving the alley in Block 17, Original lat, which was'read. Upon motion by Green 'second by Moody that the said resolution be pted as read, and all voting in favor thereof, President Liddle declared he said resolution duly passed and adopted. 473 NO V 1 -1931. Alderman Moody introduced a resolution levying special assessments for curb and gutter on Sixth Avenue Southwest from Second Street Southwest to First Street Southwest , which was read: Upon motion by Amundsen second by Richman, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle. declared the said resolution duly passed and adopted: Alderman Fryer introduced a resolution levying special assessments for curb and Butt er on Fourt Avenue Southwest , from Cent er Street West to Second Street Southwest, which was read. Alderman Fryer introduced. a resolution ordering plans, for a sanitary sewer in Fourteenth Avenue. ' Alderman Richman introduced a resolution accepting the proposal of Martin Paulson for the construction of a sanitary sewer in Eleventh Street Southwest, from Sixth Avenue Southwest to a point 400 feet south- west, which was read. Upon motion by Lemmon second by Green,that. the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adoj)ted Upon motion by Amundsen second by Moody all other bids were rejected and the City Clerk was authorized to return the certified checks which accompanied the rejected bids. Alderman Moody introduced a resolution ordering a hearing on the levying of special assessments for the construction of sewer connections 3 to the Broadway Trunk Line Sanitary Sewer, said hearing to be held at KY 7: 30 o'clock P.M., on November 15th919379which was read: Upon motion by Moody second by Amundsen, that the said resolution he adopted as read, and all voting -in favor thereof, President Liddle declared t he said resolution duly passed and adopted. 475 N O V 1937 Alderman Green introduced a resolution appropriating $628.24 from the Sewer Fund and ordering payment made to C.F•Walde for balFnce on contract for construction of a garage at the Sewage Disposal Plant, which was read. Upon motion by Frybr second by Green that the said resolution be adopted as 'read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman. Moody- introduced a resolution appropriating $1226.13 from the Street and Ailey Fund and ordering payment,made to L.M.Feller for final estimate on the construction of curb and gutter in First Street Southwest, which was read. Upon motion by Green second by Moody that the said resolution be adopted as read, and all voting in` favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Moody introduced a resolution appropriating $53400'87 from the Permanent Improvement Revolving Fund and ordering payment made to L.M.Feller for final estimate on the widening of First Street Southwest from Broadway to Sixth IIAvenue Southwest , which was read: Upon motion by Amundsen second by Lemmon that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Richman. introduced a resolution appropriating $201 45 from the Street and Alley Rund and ordering payment made to the Barrett Company for IItarvia furnished to the City Engineer's Department. which was read: Upon motion by Moody second by Richman that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Richman introduced a resolution appropriating $326000 from I; the Permanent Improvement Revolving Fund and ordering payment made to Ell Bornack for installation of sewer connection for Metropolitan Pool Hall, which was read. Upon motion by Richman second by Amundsen, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the IIsaid resolution duly .passed and adopted. NOV 1. 1937 Alderman Amundsen introduced a resolution appropriating $335.08 I from the Permanent Improvement Revolving Fund and ordering payment made to Martin Paulson, for sewer and water connection in Broadway Street South for Devlin' s shoe store property $268000, and for .51withheld on First Avenue Southeast sanitary sewer $67008, which was read: Upon motion by Lemmon second by Moody, that the said resolution be adopted as read, and all voting in favor thereof., President .Liddle declared the said resolution duly passed and adopted. �. Alderman Amundsen introduced a resolution appropriating 417700-32 from the Park Improvement Fund and ordering payment 'made to the Mayo Trust Fund for payrolls for labor during the half month ending October 30th,19379 which was read.
